Environmental This request is covered by Categorical Exemption,
Status: Section 15305, Class 5, California Environmental Quality Act, 1986
Staff member, Thomas Rogers, reported that this was originally approved in 1985 for the
final map but it expired. The request involves a 15 foot strip of land requiring alley
improvements and is going to be split up between two homes. Mr. Rogers stated that the
same conditions apply from the previous application except for Conditional No. 8, which
was removed. He stated that staff is recommending approval.
Anita Huffman -Brace, applicant, was present and spoke in support of the request.
TENTATIVE PARCEL MAP NO. 85-330 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The proposed consolidation of four (4) parcels into three (3) parcels for purposes of
residential use is in compliance with the size and shape of property necessary for
that type of development.
2. The General Plan has set forth provisions for this type of land use as well as setting
forth objectives for implementation of this type of use.

land use designation for medium and low density allowing residential buildings was
placed on the subject property.
4. The size, depth, frontage, street width and other design and improvement features

with the State Map Act and supplemental City Subdivision Ordinance.
CONDITIONS OF APPROVAL:

1. The Tentative Parcel Map received by the Department of Community Development
on April 7, 1989 shall be the approved layout.

Staff member, Thomas Rogers, reported that the Planning Commission approved a
Conditional Use Permit for a hotel to be built on this property, and one of the conditions
of approval for said CUP was for the applicant to legalize the lot as the final step in the
process.

TENTATIVE PARCEL MAP NO. 89-155 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
I. The proposed legalization of one parcel for the purpose of commercial use is in
compliance with the size and shape of property necessary for that type of
development.
2. The General Plan has set forth provisions for this type of land use as well as setting
forth objectives for implementation of this type of use.

Environmental This request is covered by Categorical Exemption,
Status: Section 15311, Class 11, California Environmental Quality Act,

Staff member, Thomas Rogers, reported that this sale takes place each year and staff is
recommending approval with the same conditions as the previous year.
Maura McEveety, representing the applicant, was present and spoke in support of the
request.
USE PERMIT NO. 89-23 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE
FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2. The granting of Use Permit No. 89-23 will not adversely affect the General Plan of
the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated April 28, 1989 shall be the approved layout.
2. The applicant shall provide for clean up of the area after closing of the event.

3. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
4. The applicant shall obtain clearance from the Public Liability Claims Coordinator,
Administrative Services Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed at least five (5) days prior to the
event.
5. The tent shall meet Fire Department standards for fire retardancy.
6. The applicant shall obtain the necessary permits from the Fire Department.
7. Sidewalks shall be maintained at a clear width of four feet (4').
8. Two (2) parking spaces adjacent to the north side of the tent and two (2) parking
spaces adjacent to the south side of the tent shall remain clear for turn around
purposes.
9. If merchandise is to be left out overnight, a security guard shall be provided and the
Huntington Beach Police Department notified.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant may erect the tent and have the sale provided that all conditions of
approval have been met.
3. Zoning Administrator reserves the right to revoke Use Permit No. 89-23 if any
violation of these conditions of the Huntington Beach Ordinance Code occurs.

Staff member, Thomas Rogers, reported that the project will be compatible with the
neighborhood and stated that staff is recommending approval He also stated that there
have not been any written complaints against the request.
The public hearing was opened. The applicant was not present and there was no one else
present to speak for or against the request so the public hearing was closed.

2. The granting of Use Permit No. 89-18 will not adversely affect the General Plan of
the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
4. The proposed wall does not appear to create any safety hazards since it does not
block any views required by the code.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated April 20, 1989 shall be
the approved layout.
2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.

Applicant: Frank K. Daugherty

Request: To add a six hundred (600) square foot addition over the existing
garage. Structure is non -conforming as a result of having a three
(3) foot setback in lieu of the code required five (5) foot setback.
Location: 1832 Lake Street
Environmental: This request is covered by Categorical Exemption,
Status: Section 15303, Class 3, California Environmental Quality Act, 1986.
Staff member, Thomas Rogers, reported that this request is in the Oldtown Specific Plan
and anything in this zone over 30 feet requires a five foot setback instead of the usual
three feet. The applicant's three foot setback acts as a zero side yard setback and the
adjacent property has an easement to use that area of the property and upon this staff
recommended approval.
Mr. Strange asked Mr. Rogers if any of the neighbors responded negatively. Mr. Rogers
stated that there were no complaints received.
The public hearing was opened and Frank Daugherty, applicant, was present and spoke in
support of the request.
There was no one else present to speak for or against the request so the public hearing
was closed.

FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The establishment and occupation of the proposed addition will not be detrimental
to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2. The granting of Use Permit No. 89-19 will not adversely affect the General Plan of
the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
4. Although the setbacks are non —conforming, the easements which allow the exclusive
use of the adjacent side yards in effect provide the required open space and meet
the intent of the side yard setbacks.

the approved layout.
2. No windows shall be permitted on the north elevation except for windows that are
frosted, glassblock, or windows placed high enough as to discourage the view onto

Staff member, Thomas Rogers, stated that this request required a public hearing because
it was over three days. He stated that the applicant had the same sale last year with no
problems or complaints. He stated that one of the requirements different than last year
was that if the applicant left any merchandise out during the night the applicant must
have a security guard and contact the HB Policy Department and let them know about the
event.
The public hearing was opened and Lien T. Vu, applicant, was present and spoke in support
of the request.
There was no one else present to speak for or against the request so the public hearing
was closed.

FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:

certification shall be submitted to the Fire Department for review and approval.
7. Necessary permits shall be obtained from the Fire Department. Site shall be field
inspected prior to occupancy.

in support of the request.

CONDITIONAL EXCEPTION NO. 89-18 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
I. The granting of Conditional Exception will not constitute a grant of special privilege
inconsistent upon other properties in the vicinity and under an identical zone
classification. Post approvals of similar variances within the immediate
neighborhood (CE 87-82 and CE 84-23) have set precedence.
2. Because of special circumstances applicable to the subject property, the dwelling
structure is set back 33.5 feet, the strict application of the Zoning ordinance is
found to deprive the subject property of privileges enjoyed by other properties in the
vicinity and under identical zone classification.

3. The granting of a conditional exception will not adversely affect the general plan of
the City of Huntington Beach.
4. The granting of a conditional exception is necessary to preserve the enjoyment of
one or more substantial property rights.
5. The granting of conditional exception will not be materially detrimental to the
public welfare or injurious to property in the same zone classification. No
comments from the adjacent property owners have been received. Further, the
single story is proposed to be setback over fifteen (15) feet from the rear property
line, this having minimal impact on the adjacent property to the rear.
6. The granting of reduction in open space minimum dimension will not reduce the
required total open space area of 900 square feet.

the approved layout with the following modifications:

Staff member, Thomas Rogers, reported that there has been a precedent already set in
the neighborhood. He stated that one condition requires that a second water heater not
be allowed unless the existing one is removed. He stated that staff is recommending
approval.

The public hearing was opened and James Griffith, applicant, was present and spoke in
support of the request although he requested that a small water heater be allowed in the
kitchen area due to the fact that it takes a long time for the hot water to reach the
kitchen. Mr. Strange stated that he would allow a 20 gallon water heater in the kitchen
area.
There was no one else present to speak for or against the request so the public hearing
was closed.
CONDITIONAL EXCEPTION NO. 89-19 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
