REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 89-261 Applicant: Richard Astle 4641 Stellrecht Circle Huntington Beach, CA Request: Consolidation of three lots into one lot for Professional/Office use. Location: 7742 Warner Avenue (Southeast corner of Oak Street and Warner Avenue). Environmental This request is covered by Categorical Exemption, Status: Section 15305, Class 5, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that staff is recommending approval. Vicki Foster, representing the applicant, was present and spoke in support of the request. TENTATIVE PARCEL MAP NO. 89-261 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The proposed consolidation of three (3) parcels into one (1) parcel for purposes of office use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. ZA Minutes 6/21/89 —1— 5023h 1 3. The property was previously studied for this intensity of land use at the time the land use designation for office/professional district allowing office buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on May 24, 1989 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Warner Avenue and the corner radius at Warner Avenue and Oak Street shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. 6. All utilities shall be installed underground at the time said parcel is developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Community Development. 9. All vehicular access rights along Warner Avenue and Oak Street shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator. 10. All conditions of previously approved Conditional Exception No. 88-84 shall remain in effect. 11. Full street improvements shall be constructed to the Department of Public Works standards. 12. A grading plan and soils report shall be required prior to issuance of building permits.It is recommended that you immediately pursue completion of these Conditions of Approval in order to expedite the processing of your total application. ZA Minutes 6/21189 —2- 5023h USE PERMIT NO. 89-32 Applicant: Pat's Ski & Sport Shop 8909 Adams Ave Huntington Beach, CA 92646 Request: Temporary Outdoor Event Annual three-day Tent Sale on June 23, 24, and 25, 1989. Location: 8909 Adams Avenue Environmental This request is covered by Categorical Exemption, Status: Section 15311, Class 11, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that this event has taken place every year for the last four years. He stated that all conditions are standard with clarification that there be two 20 x 20 square feet tents requiring the use of 10 parking spaces. He reported that the Police Department requested that the applicant put the merchandise away at night. Staff recommended approval. Mike Mason, representing the applicant, was present and spoke in support of the request. USE PERMIT NO. 89-32 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 89-32 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations dated June 7, 1989 shall be the approved layout. 2. The applicant shall provide for clean up of the area after closing of the event. 3. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 4. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. Two (2) parking spaces adjacent to the south side of the tent shall remain clear for turn around and safety purposes. A visible barricade shall be provided. 7. Tents shall comply with Article 32 of the Huntington Beach Fire Code. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 2. The applicant may erect the tent and have the sale provided that all conditions of approval have been met. 3. Zoning Administrator reserves the right to revoke the Use Permit No. 89-32 if any violation of these conditions or of the Huntington Beach Ordinance Code occurs. CONDITIONAL EXCEPTION NO. 89-25 Applicant: Robert A. Kuehn 6801 Crista Palma Drive Huntington Beach, CA 92647 Request: Reduced dimension for the calculation of private open space (15 feet in lieu of 20 feet) Location: 6801 Crista Palma Drive Environmental This request is covered by Categorical Exemption, Status: Section 15305, Class 5, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that due to the rare shape of the lot and because the lot is at the end of a cul-de-sac, staff is recommending approval. The public hearing was opened and Robert A. Kuehn, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. CONDITIONAL EXCEPTION NO. 89-25 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The granting of a conditional exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. Although the minimum dimension is fifteen (15) feet in lieu of twenty (20) feet, over sixteen hundred (1,600) square feet of usable open space is being provided [seven hundred (700) square feet over the code mandated nine hundred (900) square feet]. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. The property is pie shaped giving a larger dimension across the rear of the property. Even with a smaller dimension, adequate open space can be provided. Additionally, the property backs up to Slater Avenue. The excessive traffic noise precludes the normal enjoyment of the required open space. 3. The granting of a conditional exception is necessary to preserve the enjoyment of one or more substantial property rights. 4. The granting of conditional exception will not be materially detrimental to the public welfare or injurious to property in the same zone classifications. 5. The granting of a conditional exception will not adversely affect the general plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 19, 1989 shall be the approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Low -volume heads shall be used on all spigots and water faucets. INFORMATION ON SPECIFIC CODE REOUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. CONDITIONAL EXCEPTION NO. 89-26 Applicant: Albert L. & Patricia A. Castellano 7541 Danton Circle Huntington Beach, CA 92648 Request: A reduced exterior side yard setback (8 foot 4 inches in lieu of 10 feet). Location: 7541 Danton Circle Environmental This request is covered by Categorical Exemption, Status: Section 15305, Class 5, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that the property has an unusual configuration and is located in a cul-de-sac and staff is recommending approval. There was no one else present to speak for or against the request so the public hearing was closed. CONDITIONAL EXCEPTION NO. 89-26 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The granting of a conditional exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. The property is unusually shaped creating an exterior side yard which is not parallel to the existing dwelling. Additionally, the proposed addition is behind an existing eight (8) foot high blockwall and will have minimal impact to the public right-of-way and will be adequately protected from the street. 3. The granting of a conditional exception is necessary to preserve the enjoyment of one or more substantial property rights. 4. The granting of a conditional exception will not be materially detrimental to the public welfare or injurious to property in the same zone classifications. The proposed addition is one story and is buffered from the street by an existing eight (8) foot high blockwall. 5. The granting of a conditional exception will not adversely affect the general plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 22, 1989 shall be the approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Low -volume heads shall be used on all spigots and water faucets. INFORMATION ON SPECIFIC CODE REOUIREMENTS: 1. Madrid 17842 Irvine Blvd, Suite 112 Tustin, CA 92680 Request: Remodel and addition to an existing single family dwelling (4,660 square feet total living area and 500 square feet total garage area). Location: 4151 Morning Star Drive Coastal Status: APPEALABLE Environmental This request is covered by Categorical Exemption, Status: Section 15305, Class 5, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that this is an extensive remodel to a single family dwelling of the existing footprint except for a few feet. He stated that the request complies with code and does not block any type of access to the water. He stated that staff is recommending approval. The public hearing was opened and Samuel P. Madrid, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 89-10 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The proposed single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the RI Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 15, 1989 shall be the approved layout. 2. Site coverage shall not exceed fifty five (55%) percent of the lot area. 3. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Covenant" assuring that the single family residence will be maintained as a single family dwelling unit. 7. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2.
