ACTING ZONING ADMINISTRATOR: Scott Hess STAFF MEMBERS: Thomas Rogers MINUTES: Minutes of the June 21, 1989 Zoning Administrator Meeting were approved. Minutes of the June 28, 1989 and July 5, 1989 Meetings to be approved by the Acting Zoning Administrator were continued to July 19, 1989. REGULAR AGENDA ITEMS: USE PERMIT NO. 89-35 Applicant: T.W. Layman Associates 6515 Van Nuys Blvd. Van Nuys, CA 91401 Request: Conversion of an existing restaurant (Bob's Big Boy) to a retail use, (a music plus music/video store is proposed). Location: 9842 Adams Avenue Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that the parking lot configuration is staying the same. He stated that if the project is approved, the signage must concur with the ordinance code. Staff recommended approval. The public hearing was opened and Reney Chartior, representing the applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 89-35 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the retail use will not be detrimental to: ZA Minutes 7/12/89 -1- 4924h a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 89-35 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. The location, site layout, and design of the proposed use properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. S. The access to and parking for the proposed use does not create an undue traffic problem. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 13, 1989 shall be the approved layout. 2. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of any proposal rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. b. A Landscape Construction Set submitted to the Departments of Community Development and Public Works. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9608 of the Huntington Beach Ordinance Code. The set must be complete and approved by both departments prior to issuance of building permits. 3. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 4. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 5. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 6. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 7. Driveway approaches shall be a minimum of thirty (30) feet in width and shall be of radius type construction. ZA Minutes 7/12/89 —2— 4924h 8. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 9. Deteriorated public improvements shall be reconstructed to Public Works standards. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off —site facility equipped to handle them. 11. Natural gas shall be stubbed in at the locations of water heaters and central heating units. 12. Low —volume heads shall be used on all spigots and water faucets. 13. If lighting is included in the parking lot, high—pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 14.. Prior to issuance of building permits, the subject property shall provide proof of or enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. 15. All applicable Public Works fees shall be paid prior to issuance of building permits. 16. All utility apparatuses such as but not limited to backflow devices and Edison Transformers, shall be prohibited in the front yard and exterior side yards unless properly screened by approved landscaping or any other method approved by the Director. All such apparatuses shall be depicted on the site plan prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The developments shall comply with Article 940 of the Huntington Beach Ordinance Code regarding flood plain development standards. 4. All signs shall comply with Article 961 of the Huntington Beach Ordinance Code. 5. Prior to issuance of building permits the applicant shall restripe the parking lot so that it conforms to Article 960 of the Huntington Beach Ordinance Code. 6. The Zoning Administrator reserves the right to revoke this use permit if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ZA Minutes 7/12/89 —3— 4924h CONDITIONAL EXCEPTION NO. 89-30 Applicant: Tom Jacobs P.O. Box P Huntington Beach, CA 92648 Request: Remodel/ addition to a single family dwelling which would exceed the allowed maximum site coverage (55% in lieu of 50%) and floor area ratio (1.06 to 1 in lieu of 1 to 1). Location: 505 13th Street Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1(e)(2)(A), California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that staff is recommending denial based on three concerns being there is no land related hardship, approving this application would be setting a precedent in the neighborhood and the floor area ratio is to high adding that staff cannot justify the request. The public hearing was opened and Tom Jacobs, representing the applicant, was present and stated that the basic problem with the plan is that the was the house is situated on the lot. Steve Olson, owner of the home, spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. Mr. Strange stated that staff cannot justify any reason for this variance and stated that the the request could be continued for a week to allow time for the applicant to work with staff to bring the request into conformance or a comparable plan to satisfy staff and the applicant. CONDITIONAL EXCEPTION NO. 89-30 WAS CONTINUED TO JULY 19, 1989 BY THE ZONING ADMINISTRATOR. COASTAL DEVELOPMENT PERMIT NO. 89-13 Applicant: Joseph Rosen 16915 Edgewater Lane Huntington Beach, CA 92649 Request: Remodel and second story addition to an existing single family dwelling. (The single family dwelling is proposed to have an area of 4,100 square feet total including the garage) Location: 16915 Edgewater Lane Coastal Status: APPEALABLE Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1(a)(2)(B), California Environmental Quality Act, 1986 ZA Minutes 7/12/89 —4- 4924h Staff member, Thomas Rogers, reported that the request meets code and is very close to the site coverage required. He stated that that abutting properties and the Home Owners Association were notified with no response for or against the request. He stated that staff is recommending approval. The public hearing was opened and Joseph Rosen, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 89-13 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The proposed single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the RI Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 6, 1989 shall be the approved layout. 2. Messer Post Office Box 435 Seal Beach, CA 90740 Request: Remodel/ addition to an existing single family dwelling. The single family dwelling is proposed to have an area of 4,723 square feet including living areas, garage and deck area. Location: 16981 Bolero Lane Coastal Status: APPEALABLE Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1(e)(2)(B), California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that staff is recommending approval. The public hearing was opened and William Messer, architect for the project, was present and spoke in support of the request. COASTAL DEVELOPMENT PERMIT NO. 89-14 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The proposed single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the RI Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. Site coverage shall be limited to fifty—five percent (55%) of the net lot area. Compliance with the site coverage requirements will be determined upon the submittal of working drawings for plan check. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off —site facility equipped to handle them.
