B. ORAL COMMUNICATIONS
Kay Richards, 67281 Briarcliff Drive, voiced her complaints
and concerns with code violations occurring at the Hebrew
Academy on Willow Lane and requested monitoring and
enforcement by the Planning Commission. Her concerns
included: inoperable vehicles left on the grounds; caretaker
and family living in trailer on the site; large dirt pile on
south side of property; school van and school bus parked on
grass; and overall lack of maintenance on the site.
B-1 PLANNING COMMISSION SUB -COMMITTEE REPORTS
Commissioner Kirkland reported actions taken by the Design
Review Board during their July meetings.
Commissioner Williams discussed meetings held with the Oil
Committee. He said focus is being concentrated on the
diminishing oil production in the City and concerns regarding
the safety and aesthetics of oil facilities.
Chairman Bourguignon attended the first meeting of the
Committee on Solar Rooms/Windscreens in the harbor and said it
was very successful. He thanked staff for their participation.
Commissioner Ortega discussed the recently scheduled FHP
Subcommittee meeting. She said progress is being made at the
FHP site.
Commissioner Leipzig discussed the Coastal Zone '89 Conference
held in South Carolina in which he attended and said the
"Bolsa Chica" wetland area drew nationwide interest. Another
topic that drew nationwide interest was "ocean disposal of
sewage waste."

C. PUBLIC HEARING ITEMS
C-1 REVOCATION HEARING - CONDITIONAL USE PERMIT NO. 87-5
(CONTINUED FROM JUNE 6, 1989 PLANNING COMMISSION MEETING)
APPLICANT: FHP, INC.
LOCATION: 19066 Magnolia Street (southeast corner of Magnolia
Street and Garfield Avenue)
On May 2, 1989, the Planning Commission reviewed a parking study
dated March 27, 1989, submitted by FHP for the Senior Medical
Center. The Planning Commission expressed concern that the number
of appointments per hour and enrollment at the Center, combined with
the configuration of the parking lot, may result in limited parking
opportunities for customers visiting other businesses at the
shopping plaza. The Commission directed staff to schedule a public
hearing for June 6, 1989, so that representatives of FHP could
attend and present reasons why the conditional use permit for the
senior center should not be revoked.
On June 6, 1989, the Planning Commission formed a subcommittee
consisting of FHP representatives, center tenants, landowners, and
Commissioners Bourguignon and Ortega. The purpose of the
subcommittee was to formulate a parking management plan to address
tenant designated parking, alternative methods of transporting
patients to and from the center, and other measures to alleviate
parking problems. The revocation hearing was continued to July 18,
1989.
Since June 6, the subcommittee has met twice to discuss the various
problems at the center and to suggest possible solutions. The City
selected a parking consultant, Parsons Brinckerhoff, to design
alternative layouts for the parking area, with the goal to provide
more stalls with better accessibility to the tenants.
As of July 12, 1989, Garfield Plaza is under new ownership. A
representative attended the July 12 subcommittee meeting and
expressed a desire to work with the tenants to ease parking demand.
Given the new ownership of the center, and the subcommittee's wish
to review further studies currently underway by the parking
consultant, the subcommittee agreed to recommend a 30-day
continuance of the revocation hearing, to August 15, 1989.
STAFF RECOMMENDATION:
Continue revocation hearing of Conditional Use Permit No. 87-5 for
30 days to the August 15, 1989 Planning Commission meeting.

continuance.

LOCATION: 7921-31 Glencoe (west of Beach Boulevard)
The applicant's request is for the subdivision of a 115 foot by 135
foot parcel into two parcels, one with 60 feet of frontage and one
with 55 feet of frontage. The latter parcel requires a variance to
the minimum lot width of 60 feet required pursuant to Section 9120.2
of the Huntington Beach Ordinance Code. The intent of the applicant
is to construct a four-plex on the larger lot and a tri-plex on the
smaller lot for a total of seven units.
STAFF RECOMMENDATION:
Approve Negative Declaration No. 89-12, Tentative Parcel Map
No. 89-225 and Conditional Exception (Variance) No. 89-23, with
findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED
There was no one present to speak for or against the request and the
public hearing was closed.
Concerns were expressed by the Commission regarding the increase of
one unit (density) on the subject property as a result of the lot
split. The existing R2 zoned parcel allows 6 units; the lot split
would allow 3 units on one parcel and 4 units on the other for a
total of 7. It was felt, however, that the lot split with one
reciprocal driveway would be more attractive than two lots with two
driveways. After further discussion, it was felt that the lot split
and resulting density was consistent with the surrounding area.

FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO. 89-225:
1. The proposed subdivision of this .36 acre lot into two (2)
parcels for purposes of residential use is in compliance with
the size and shape of property necessary for that type of
development.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of use.
3. The property was previously studied for this intensity of land
use at the time the land use designation for medium density
residential was placed on the subject property.
4. The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standards, plans and
specifications on file with the City as well as in compliance
with the State Map Act and supplemental City Subdivision
Ordinance.
FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 89-23:
1. Granting of the conditional exception (variance) for a 55 foot
wide lot will not be detrimental to the health, safety, or
welfare of residents of neighboring properties or injurious to
improvement of property in the vicinity due to the proposed
reciprocal driveway easement.

2. Granting of the conditional exception (variance) for a 55 foot
wide lot will not adversely affect the General Plan of the City
of Huntington Beach.
3. Granting of the conditional exception (variance) for a 55 foot
wide lot does not constitute a grant of special privilege from
other properties in the vicinity.
4. Because of special circumstances applicable to the subject
property, location, or surroundings, the strict application of
the zoning ordinance is found to deprive the subject property
of privileges enjoyed by other properties in the vicinity under
identical zone classifications.
CONDITIONS OF APPROVAL - TENTATIVE PARCEL MAP NO, 89-225:
1. The Tentative Parcel Map received by the Department of
Community Development on July 7, 1989, shall be the approved
layout.
2. A parcel map shall be filed with and approved by the Department
of Public Works prior to issuance of any building permits, and
recorded with the Orange County Recorder.
3. Water supply shall be through the City of Huntington Beach's
water system at the time said parcel is developed.
4. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time said parcel is developed.
5. All utilities shall be installed underground at the time said
parcel is developed.
6. The tentative parcel map shall comply with all applicable City
Ordinances.
7. A copy of the recorded parcel map shall be filed with the
Department of Community Development.
8. All Public Works improvements shall be constructed to City
standards.
9. Drainage flow/direction shall be approved by the Department of
Public Works.
10. A grading plan shall be submitted to the Department of Public
Works for review and it must be approved (by issuance of a
grading permit). A plan for silt control for all water runoff
from the property during construction and initial operation of
the project may be required if deemed necessary by the Director
of Public Works.

11. A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and
utilities.
CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 89-23:
1. Prior to construction of any residential units on the subject
property, a use permit application for the seven unit project
shall be reviewed and approved by the Zoning Administrator.
2. Additional open space over and above the minimum required by
code shall be provided on each lot in an amount equal to the
area gained by not having to provide two full 25 foot wide
driveways.
3. One central driveway (reciprocal easement for egress and
ingress) to serve both parcels shall be provided.
C-3 CONDITIONAL USE PERMIT NO. 89-28
APPLICANT: CHRIST PRESBYTERIAN CHURCH
LOCATION: 20122 Magnolia Street (approximately 450 feet south
of Adams Avenue)
Conditional Use Permit No. 89-28 is a request to add a 1,200 square
foot, modular office building to the existing Christ Presbyterian
Church pursuant to Section 9630 of the Huntington Beach Ordinance
Code.
STAFF RECOMMENDATION:
Approve Conditional Use Permit No. 89-28 with findings and
conditions of approval.
THE PUBLIC HEARING WAS OPENED
Ken R. Smith, 8705 Hummingbird Avenue, applicant, spoke in support
of the request and urged the Commission to approve. He said becasue
of a very marginal budget he would like to eliminate restroom
facilities in the modular building since there is a facility within
20 feet. He requested the condition be revised to allow flexibility
in submitting a sewer and water plan should the restroom facilities
not be required by the Building Department.
There were no other persons present to speak for or against the
request and the public hearing was closed.

FINDINGS FOR APPROVAL:
1. The location, site layout, and design of the proposed 1,200
square foot, modular office building properly adapts the
proposed structures to streets, driveways, and other adjacent
structures and uses in a harmonious manner.
2. The combination and relationship of one proposed use to another
on a site are properly integrated.
3. The access to and parking for the proposed 1,200 square foot,
modular office building does not create an undue traffic
problem.
4. The granting of Conditional Use Permit No. 89-28 will not be
detrimental to the City's General Plan.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans and elevations received and dated
June 9, 1989, shall be the conceptually approved layout.
2. Prior to issuance of building permits, the applicant/owner
shall complete the following:
a. Submit a sewer and water plan to the Public Works
Department for approval if determined necessary by the City
Engineer.
3. All applicable Public Works fees shall be paid.
4. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
6. Construction shall be limited to Monday - Saturday 7:00 AM to
8:00 PM. Construction shall be prohibited Sundays and Federal
holidays.

7. No outside storage shall be permitted, except for storage in
conjunction with construction activity.
8. Exterior building materials and colors shall be compatible with
other structures on site.
9. All previous conditions of approval of Conditional Use Permit
No. 80-14 and Conditional Use Permit No. 85-61 shall remain in
effect.
C-4 USE PERMIT NO 89-28/CONDITIONAL EXCEPTION (VARIANCE) NO. 89-20
APPLICANT: STEICHEN ASSOCIATES ARCHITECTURE
LOCATION: 17751 Beach Boulevard (southwest corner at Newman
Avenue)
Use Permit No. 89-28/Conditional Exception (Variance) No. 89-20 is a
request for a 380 square foot addition to an existing 1,040 square
foot dental office building, including an exterior building
remodel. The conditional exception is required because after
required street dedication on the exterior side of the lot, the
building's setback will be 4 feet-8 inches in lieu of the 10 feet
required (Section 9220.7). In addition, the development does not
meet perimeter landscaping requirements; the lot has landscape
planter strips between 3 feet-8 inches and 4 feet-8 inches in width
in lieu of 6 feet required (Section 9608(f)). Finally, the existing
building has a nonconforming front setback of 32 feet-8 inches
without the additional landscaping required where a building
encroaches into the 50 foot setback (Sectional District Map). Use
Permits along Beach Boulevard are referred to the Planning
Commission by policy.
STAFF RECOMMENDATION:
Approve Use Permit No. 89-28 and Conditional Exception (Variance)
No. 89-20 with findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED
Dr. Robert Krough, 17781 Beach Boulevard, spoke in opposition to the
request. He said there is a pending lawsuit against Dr. Danes
regarding the parking situation on the property. He objects to the
increased intensity of the use because he feels it will add to the
parking problems. He requested that one parking space be designated
as a common easement area for ingress and egress to alleviate
problems.

Chuck Steichen, representing the applicant, spoke in support of the
request. He said he is not aware of any pending litigation on the
property and feels they are meeting all parking requirements. He
urged the Commission to approve the project. He asked for deletion
of Condition 2.f. because he feels it will severely limit future
development of the property and does not feel it is justified. He
also said that the sign in front of the property does not belong to
Dr. Danes and therefore does not feel they have the right to remove
it, however said their name would be removed from the sign pole.
Dr. Danes, property owner, spoke in support of the project. He said
he plans to retire and give his business to his daughter. He said
he did not have any knowledge of a pending lawsuit.
There were no other persons present to speak for or against the
request and the public hearing was closed.
The Commission discussed several alternatives to alleviate parking
problems on the property. They were concerned about the alleged
litigation. A continuance was suggested in order to allow staff and
the architect time to redesign the driveway so that reciprocal
access would not be necessary and to allow the City Attorney to
verify the alleged lawsuit.

D-1 REOUEST FOR 60-DAY EXTENSION OF TIME FOR ADMINISTRATIVE REVIEW

APPLICANT: Michael A. Duran/The Hale Corporation
LOCATION: 8201 Newman (northeast corner of Newman and Van
Buren)
The City Council, on July 18, 1988, overruled the Planning
Commission and approved Administrative Review No. 87-29 and upheld
the Planning Commission's denial of Conditional Exception
No. 87-68. The project is a request to construct a three-story,
10,567 square foot medical office building with joint use of
parking. The variance request, which was denied, was to reduce a
landscape planter width and reduce an exterior sideyard setback.

The applicant is requesting a 60-day extension of time for
Administrative Review No. 87-29, based upon delays in obtaining
recordation of the approved CC&Rs from the County of Orange, as
required prior to issuance of building permits. In addition, staff
has investigated the status of the applicant's plan check process.
The applicant is finalizing plan check corrections with Planning and
Building and expects to obtain construction permits within the
60-day extension period and commence construction.
Section 9811.6.1 of the Huntington Beach Ordinance Code specifies
that upon written application a one-year extension of time may be
granted, if practical difficulties arise which make implementation
of an approved administrative review impossible within the scope of
time provided.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission grant a 60-day
extension of time for Administrative Review No. 87-29 to September
15, 1989, with all conditions of approval to remain in effect.

D-2 REQUEST FOR SECOND ONE-YEAR EXTENSION OF TIME FOR CONDITIONAL
USE PERMIT NO. 87-28
APPLICANT: Leader Partnership
LOCATION: 8102 Ellis Avenue (south side of Ellis Avenue
approximately 500 feet east of Beach Boulevard)
James Lu, General Partner of Leader Partnership, is requesting a
second one-year extension of time for Conditional Use Permit No.
87-28. Conditional Use Permit No. 87-28 is a request for a 140-room
senior rest/retirement home and was approved by the Planning
Commission on August 4, 1987. The project was appealed and the City
Council approved Conditional Use Permit No. 87-28 on September 8,
1987.

On July 19, 1988, the Planning Commission approved a one-year
extension of time for Conditional Use Permit No. 87-28. The
applicant is requesting a second one-year extension of time in order
to negotiate an easement with the property owner to the west and
obtain construction financing. The building permits have been
approved by the Public Works, Planning and Building Departments.
The Fire Department has not approved the building permits, thus the
applicant is requesting additional time. Section 9843.4 of the
Huntington Beach Ordinance Code specifies that upon written request
by the applicant, the Planning Commission may grant extensions of
time not to exceed one year.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission grant a one-year
extension of time for Conditional Use Permit No. 87-28 to September
8, 1990, with all previous conditions of approval to remain in
effect.
The Commission expressed concerns with the project being completed.
They felt if the developer could not meet all conditions imposed
that the project should be abandoned.
James Lu, applicant, addressed the Commission and said that all
conditions could be met except he was having trouble getting an
agreement with his neighbor on reciprocal access and with financing
problems because of the nature of the project.
The Commission agreed that since so much time and money had been
spent on the project that a 6 month extension would be appropriate.
