Minutes of the June 28, 1989 and July 5, 1989 Meetings to be approved

Environmental This request is covered by Categorical Exemption,
Status: Section 15305, Class 5, California Environmental Quality Act, 1986
Staff member, Thomas Rogers, reported that Tentative Parcel Map No. 89-231 was
approved last month by the Zoning Administrator and complied with all conditions. Public
Works recommended that the waiver be granted. He stated that staff is recommending
approval.
Teri Wilson, applicant, was present and spoke in support of the request.

other requirements of Article 992 of the Subdivision Section of the Ordinance Code.

FINDINGS FOR APPROVAL:
1. The lot line adjustment does not create a nonconforming parcel.

2. The lot line adjustment does not create a nonconforming yard requirement.
3. The lot line adjustment does not sever any existing structure on either of the two
lots.
4. The lot line adjustment does not allow a greater number of dwelling units than
allowed by this code prior to the adjustment.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
1. Monuments for the newly -established corners shall be readjusted in compliance
with the Subdivision Map Act.
2. Authentic data on the bearings on the adjusted line shall be shown on a plat map
which shall be certified by the City Engineer prior to recordation.
3. Said plat map shall be recorded with the County recorder prior to the issuance of a
certificate of compliance for the structure and/or structures upon subject

Staff member, Thomas Rogers, reported that this event is a fund raiser for the Blind
Children' Study Center. He stated that the applicant has obtained insurance and he also
stated that letter have been received from surrounding business in support of the request.
Jim Hanan, representing applicant, was present and spoke in support of the request.

FINDINGS FOR APPROVAL:
1. The establishment and operation of the outdoor event of the use will not be
detrimental to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2. The granting of Use Permit No. 89-36 will not adversely affect the General Plan of
the City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated June 14, 1989 shall be
the approved layout.
2. The hours of the outdoor event shall be limited to July 29, 1989 from 11:00 a.m. to
6:00 p.m.
3. Sidewalks shall not be blocked.
4. The applicant shall provide for clean-up of the site.
5. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
6. The applicant shall obtain clearance from the Public Liability Claims Coordinator,
Administrative Services Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed at least five (5) days prior to the
event.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.

Request: Security Gates and enclosures for trash bin areas for the Regency
Palms Apartment Complex.

Environmental This request is covered by Categorical Exemption,
Status: Class 5, California Environmental Quality Act, 1986
Staff member, Thomas Rogers, reported that staff is requiring the applicant to provide a
turn around telephone at the gate for visitors. He also stated that the applicant provide a
sign at the gate showing that this entrance is for residents. He stated that the applicant
is proposing nine trash enclosures with six already existing. He stated that staff is
recommending approval.
The public hearing was opened and Eric Brown, representing the applicant, was present
and agreed with staff requests.
There was no one else present to speak for or against the request so the public hearing
was closed.
SITE PLAN AMENDMENT NO. 89-2 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The proposed revisions do not constitute a substantial change in the original
development.
2. The use of property does not change as a result of the proposed revisions.
3. The density of the project does not increase as a result of the proposed revisions.
4. The revisions result in an improved development.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated June 19, 1989 shall be
the approved layout with the following modifications:

2. A revised site plan shall be submitted depicting the modifications described herein:
a. Signage shall be provided specifying that the Golden West Street entrance is for
residents only and that visitors must enter via the Warner Avenue entrance.
b. Knox switches for both entrances shall be accessible from within a vehicle.
3. No trash enclosures shall be constructed in required parking spaces.
4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off —site facility equipped to handle them.
5. The proposed gates and enclosures shall be architecturally compatible with existing
structures.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. The blockwalis, security gates, and trash enclosures shall comply with all applicable
provisions of the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,

REVOCATION OF HOME OCCUPATION NO. 89-1

VIOLATION: Use of garage in conjunction with Home Occupation Permit
(Huntington Beach Ordinance Code Section 9730.42).

Land Use Technician, Margaret Kleckner, reported that she received several citizen
complaints regarding the storage of decal space goods in Brent Hawker's garage which is a
violation of the Huntington Beach Ordinance Code Section 9730.42. She stated that she
has spoken with and sent notices to Mr. Hawker, but he has not responded one way or the
other.
The public hearing was opened. Brent Hawker, Home Occupation Permit holder, was not
present. JoAnn Bolter, landlady, was present and confirmed the allegations.
There was no one else present to speak so the public hearing was closed.
Mr. Strange asked Ms. Kleckner when she last inspected the said resident. She responded
that here last investigation was on June 13, 1989 and the situation was the same.
In conclusion with all evidence submitted, Mr. Strange stated that he would revoke Mr.
Hawker's Home Occupation Permit.
