Minutes of the June 28, 1989 and July 5, 1989 Meetings to be approved by the Acting Zoning Administrator were continued to August 2, 1989. REGULAR AGENDA ITEMS: LOT LINE ADJUSTMENT NO. 89-2 Continued from July 19, 1989 Applicant: Walden & Associates 18012 Cowan, Suite 210 Huntington Beach, CA 92648 Request: Relocation of side yard property lines between five (5) parcels (Lots 7, 8, 9 & 10, Block 404, Huntington Beach Tract, Main Street Section and Lot F of Tract 12900). Location: 417 Main Street Environmental This request is covered by Categorical Exemption, Status: Section 15305, Class 5, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that staff is recommending approval with a revised map submitted by the applicant. Uri Gati, applicant, was present and submitted the revised map to staff. LOT LINE ADJUSTMENT NO. 89-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. As no lots are being created, the lot line adjustment does not create a nonconforming parcel. ZA Minutes 7/26/89 -1- 5029h 1 2. The lot line adjustment does not create a nonconforming yard requirement. 3. The lot line adjustment does not further sever any existing structures. The common property line between lots 8 and 9, as it exists, severs an existing structure and will temporarily continue to do so after the adjustment. No new entitlements shall be issued on the subject property until the lots are properly consolidated through the Parcel Map process. 4. The lot line adjustment does not allow a greater number of dwelling units than allowed by this code prior to the adjustment. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Plat Map received by the Department of Community Development on July 14, 1989 shall be the approved layout. 2. Monuments for the newly established lot configuration shall be readjusted in compliance with the State Subdivision Map Act. 3. A copy of the recorded parcel map shall be filed with the Department of Community Development. 4. Lots 8 and 9, Block 404, Huntington Beach Tract, Main Street Section shall be consolidated through the Parcel Map process prior to any alteration which would increase the square footage of the building or construction of any new structures on the subject property. 5. Neither Parcel one (1) or four (4) as shown on the approved Lot Line Adjustment shall be sold separately as long as the building remains on the two lots. USE PERMIT NO. 89-33 Applicant: George Pearson 15402 Electronic Lane Huntington Beach, CA 92649 Request: To add 457 square feet to an existing arcade within an existing retail center. Location: 16922 Beach Blvd. Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that concerns were expressed by the Police Department which have been addressed in the conditions of approval. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 89-33 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The expansion, maintenance and operation of the arcade will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 89-33 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 9, 1989 shall be the approved layout. 2. Prior to occupancy, street improvements on "A" street shall be completed to Public Works Standards. 3. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off —site facility equipped to handle them. 5. A minimum of one (1) security guard shall be provided on —site every day from 5:00 p.m. to closing. An additional security guard shall be provided on —site on Friday and Saturday nights from 7:00 p.m. to closing. Said Security Guards shall be uniformed and be a minimum of 21 years of age. 6. The rear exit shall be for emergency exit only. The door for the rear exit shall remain closed during business hours. 7. The front door(s) shall remain closed during business hours except to permit customers and employees to enter and exit the premises. 8. The applicant shall work with the Police Department to assure compliance with applicable City Ordinances and the conditions of approval of Use Permit No. 89-33. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. The Zoning Administrator reserves the right to revoke Use Permit No. 89-33 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. USE PERMIT NO. 89-38 Applicant: Charles G. Messig 5372 Old Pirate Lane Huntington Beach, CA 92649 Request: An addition to a single family dwelling including conversion of an existing garage into a family room. The existing structure has a non -conforming side yard setback (two (2) feet in lieu of the code required five (5) feet). Location: 5372 Old Pirate Lane Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1 and Section 15305, Class 5, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that the Fire Department is requiring the entire structure to have a non-combustible roof. He stated that staff is recommending approval. There was no one present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 89-38 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The addition to the single family dwelling will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 89-38will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. The proposed addition is in conformance with applicable zoning regulations. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 28, 1989 shall be the approved layout. ZA Minutes 7/26/89 -4- 5029h 2. Non-combustible roofing shall be provided for the entire structure per Fire Department requirements. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 5. Low -volume heads shall be used on all spigots and water faucets. 6. All applicable Public Works fees shall be paid prior to issuance of building permits. 7. The proposed garage shall be completed prior to occupancy of the garage conversion. INFORMATION ON SPECIFIC CODE REOUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. A one -hour wall and parapet is required at the two (2) foot setback. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. USE PERMIT NO. 89-39 Applicant: Douglas F. Martin 8232 Guilders Drive Huntington Beach, CA 92647 Request: To add onto a single family dwelling maintaining a non -conforming side yard setback (4 feet in lieu of 5 feet). Location: 735 13th Street Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1 and Section 15305, Class 5, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, advised the applicant that a tentative parcel map is required to divide the property but a waiver could be requested. He stated that staff is recommending approval. The public hearing was opened and Douglas Martin, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 89-39 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: ZA Minutes 7/26/89 -5 5029h FINDINGS FOR APPROVAL: 1. The single family addition will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 89-39 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 29, 1989 shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall file a tentative parcel map to consolidate Lots 35 and 37, Block 713 of the Huntington Beach Tract. The parcel map or plat map shall be recorded with the Orange County Recorder and a copy of the recorded map or plat filed with the Department of Community Development prior to final inspection or occupancy. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. USE PERMIT NO. 89-42 Applicant: Michael Milano 401 Main Street Huntington Beach, CA 92648 Request: Temporary Outdoor Event - Ten (10) day parking lot sale for Bicycle Outpost. (August 2-12, 1989) Location: 401 Main Street Environmental This request is covered by Categorical Exemption, Status: Section 15311, Class 11, California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that staff is recommending approval. The public hearing was opened and Michael Milano, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 89-42 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: ZA Minutes 7/26/89 -6- 5029h FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use for ten (10) days will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 89-42 will not adversely affect the General Plan of the City of Huntington Beach. 3. Adequate parking is available off -site in the City parking lot across the street. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated July 7, 1989 shall be the approved layout. 2. The tent shall meet Huntington Beach Fire Department standards for fire retardancy. 3. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 4. If merchandise is left out overnight, a security guard shall be provided on -site during the hours the business is closed. 5. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 89-42 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. COASTAL DEVELOPMENT PERMIT NO. 89-15 Applicant: Stephen Day 3920 E. Coronado Street Suite E Anaheim, CA 92806 ZA Minutes 7/26/89 -7- 5029h Request: Remodel and addition to an existing single family dwelling (723 square feet total addition). Location: 16956 Coral Cay Lane Coastal Status: APPEALABLE Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1(a), (e), California Environmental Quality Act, 1986 Staff member, Thomas Rogers, reported that staff is recommending approval. The public hearing was opened and Stephen Day, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. FINDINGS FOR APPROVAL: 1. The proposed single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the RI Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. CONDITIONS OF APPROVAL: SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 22, 1989 shall be the approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off —site facility equipped to handle them. 3. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. Low —volume heads shall be used on all spigots and water faucets. 5. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Covenant" assuring that the single family residence will be maintained as one (1) dwelling unit.
