PLANNING COMMISSION SUBCOMMITTEE REPORTS
Commissioner Kirkland report actions taken by the Design
Review Board during their August meeting.
Commissioner Ortega reported that the proposed Holly-Seacliff
Master Plan is available for comments. There will be two
study sessions for Planning Commission review prior to the
scheduled public hearing on October 3, 1989. She also
reported that the Subdivision Committee recommended denial of
Tract 14017 on August 9, 1989 due to the request for medium
density in an area zoned low density. This tract will be
heard by the Commission on September 19, 1989.

89-20 (CONTINUED FROM JULY 19, 1989 PLANNING COMMISSION

APPLICANT: Steichen Associates
LOCATION: 17751 Beach Boulevard
Use Permit No. 89-28/Conditional Exception (Variance) No. 89-20 is a
request for a 380 square foot addition to an existing 1,040 square
foot dental office building, including an exterior building
remodel. The conditional exception is required because after
required street dedication on the exterior side of the lot, the
building's setback will be 4 feet-8 inches in lieu of the 10 feet
required (Section 9220.7). In addition, the development does not
meet perimeter landscaping requirements; the lot has landscape
planter strips between 3 feet-8 inches and 4 feet-8 inches in width
in lieu of 6 feet required (Section 9608(f)). Finally, the existing
building has a nonconforming front setback of 32 feet-8 inches
without the additional landscaping required where a building
encroaches into the 50 foot setback.
STAFF RECOMMENDATION:
Approve Use Permit No. 89-28 and Conditional Exception (Variance)
No. 89-20 with findings and conditions of approval.
ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Section
15301, Class 1 of the California Environmental Quality Act.
THE PUBLIC HEARING WAS OPENED.
Chuck Steichen, applicant, spoke in support of the request. He
asked the Commission to consider eliminating condition 2-f for
reciprocal agreement and modify condition 3 for signage as Dr. Dains
does not have complete control of the sign. He went on to say that
Dr. Dains agreed to remove his name from the sign.
William Carlson, attorney representing Dr. Dains, spoke in support
of the request. He requested that the reciprocal easement agreement
not be made a condition of approval but left up to the occupants of
the center.
Art Folger, Deputy City Attorney, asked the applicant to provide a
letter stating he would not do anything to prevent the removal of
the sign at this time or in the future.
Fred Chemberlen, attorney representing Dr. Krough the property owner
to the south, was present. He advised the Commission of a pending
lawsuit to not allow a wall between the two properties. He said Dr.
Krough wishes to maintain the sign for his medical practice and that
removing the word "dental" would cause the sign to look unsightly.

Delores Dains spoke in support of the request and urged the
Commission to approve with the elimination of condition 2-f.

FINDINGS FOR APPROVAL - USE PERMIT NO, 89-28:
1. The location, site layout and design of the proposed dental
office expansion and remodel properly adapts the proposed
structures to streets, driveways and other adjacent structures
and uses in a harmonious manner.
2. The access to and parking for the proposed dental office
expansion and remodel does not create an undue traffic problem.
3. The establishment, maintenance and operation of the proposed
dental office expansion and remodel will not be detrimental to
the general welfare of persons residing or working in the
vicinity; and property and improvements in the vicinity of such
use or building.
4. The granting of the dental office expansion and remodel will
not adversely affect the General Plan of the City of Huntington
Beach.
FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 89-20:
1. Due to the small size of the lot (94.5 feet by 68 feet) and the
additional required dedication for Newman Avenue there are
exceptional or extraordinary circumstances or conditions
applicable to the land, buildings or premises involved that do
not apply generally to other property or uses in the district.
2. The granting of conditional exceptions for exterior side yard
setback, front setback landscaping, and perimeter landscaping
are necessary in order to preserve the enjoyment of one or more
substantial property rights.
3. The granting of Conditional Exception (Variance) No. 89-20 for
exceptions to exterior side yard setback, front setback
landscaping, and perimeter landscaping will not be materially
detrimental to the public health, safety and welfare, or
injurious to the conforming property in the neighborhood.
4. The conditional exceptions for exterior side yard setback,
front setback landscaping, and perimeter landscaping are
consistent with the goals and objectives of the City's General
Plan.

5. The granting of the conditional exception from the minimum
landscape planter widths of Section 9608(f) of the Huntington
Beach Ordinance Code will not defeat the general purposes or
intent of the code which is to provide landscape areas to
enhance the appearance of a project to passers-by because the
actual percentage of landscaping provided (8.9 percent) exceeds
the minimum code requirement of 6 percent.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans and elevations received and dated
July 11, 1989, shall be the conceptually approved layout with
the following modifications:
a. The trash enclosure shall be relocated to the south side of
the building.
b. A minimum 24 foot aisleway around the building shall be
provided, requiring the modification/relocation of two
trellis canopy columns.
c. The existing perimeter wall at streetside shall be removed
to allow visibility of new landscaped areas.
2. Prior to issuance of building permits, the following shall be
completed:
a. A rooftop mechanical equipment plan must be submitted
showing screening and must be approved. Any rooftop
mechanical equipment shall be screened from any view. Said
screening shall be architecturally compatible with the
building in terms of materials and colors.
b. A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and
fill properties, foundations, retaining walls, streets, and
utilities.
c. A grading plan shall be submitted to the Department of
Public Works for review and it must be approved (by
issuance of a grading permit). A plan for silt control for
all water runoff from the property during construction and
initial operation of the project may be required if deemed
necessary by the Director of Public Works.
d. The applicant shall dedicate an additional five feet of
right-of-way for Newman Avenue as well as a 25 foot radius
at the corner of Beach and Newman. Public works
improvements shall be constructed as deemed necessary by
the Department of Public Works.

e. A Landscape Construction Set must be submitted to the
Departments of Community Development and Public Works and
must be approved. The Landscape Construction Set shall
include a landscape plan prepared and signed by a State
Licensed Landscape Architect and which includes all
proposed/existing plant materials (location, type, size,
quantity), an irrigation plan, a grading plan, an approved
site plan, and a copy of the entitlement conditions of
approval. The landscape plans shall be in conformance with
Section 9608 and of the Huntington Beach Ordinance Code.
The set must be approved by both departments prior to
issuance of building permits. Any existing mature trees
that must be removed shall be replaced at a 2 to 1 ratio
with minimum 36-inch box trees, which shall be incorporated
into the project's landscape plan.
f. The subject property shall enter into an irrevocable
reciprocal access agreement or irrevocable offer to
dedicate a future easement between the subject site and the
adjacent property to the south at such time as the property
redevelops. A copy of the legal instrument shall be
approved by the Community Development Department and the
City Attorney as to form and content and, when approved,
shall be recorded in the Office of the County Recorder. A
copy shall be filed with the Department of Community
Development.
g. A sign plan must be submitted depicting all proposed signs
based upon the remodeled building and site improvements.
Prior to final building permit approval, the existing
freestanding sign shall be removed or altered to comply with
Article 961 (Sign Code), or property owner shall submit a
"Letter of Agreement", signed and notarized, assuring that such
sign shall be made to comply when joint owner agrees.
The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
REVOCATION HEARING - CONDITIONAL USE PERMIT NO. 87-5 (CONTINUED
FROM JULY 18, 1989 PLANNING COMMISSION MEETING)
APPLICANT: FHP, Inc.
LOCATION: 19066 Magnolia Street (southeast corner of Magnolia
Street and Garfield Avenue)

The revocation of FHP's Conditional Use Permit No. 87-5 to operate a
Senior Medical Center at Garfield Plaza Shopping Center was
considered due to parking problems that have arisen at the center.
On June 6, 1989, the Planning Commission formed a subcommittee
consisting of FHP representatives, center tenants, landowners, and
Commissioners Bourguignon and Ortega. The purpose of the
subcommittee was to formulate a parking management plan addressing
various measures to alleviate the parking problems.
STAFF RECOMMENDATION:
Reaffirm Conditional Use Permit No. 87-5 and adopt measures
recommended by subcommittee with status report in six months.
THE PUBLIC HEARING WAS OPENED.
Margie Schiller, owner of Margie's Kitchen, spoke in opposition to
the request. She was concerned that eight businesses have closed in
the center since FHP opened.
Helen Campbell, FHP patient, spoke in support of the request. She
said she never had a problem with parking at the center.
Kermit Simons, FHP patient, spoke in support of the request. He
said he had been a patient at the FHP facility for over three years
and never experienced a parking problem.
Betty Goldberg, FHP patient, spoke in support of the request. She
said before FHP opened the center had many vacant suites. She feels
that the senior center is a lifeline for seniors which enables them
to be productive human beings.
Robert Cole Sr., FHP patient, spoke in support of the request. He
gave an example of a time when he parked in front of another tenant
suite and a security guard was at his car door before he could get
out advising him to park behind the building and a golf cart would
bring him to the entrance. He urged the Commission to reaffirm the
conditional use permit.
William Kanold, FHP patient, spoke in support of the request. He
said over the past two years visiting to the center he never had a
problem with parking.
Al Goldberg, FHP patient, spoke in support of the request. He said
the parking spaces assigned to other tenants are usually empty.
Robert Davis, owner of the Health Food Chalet, spoke in
to the request. He said he was required to meet parking
requirements when his establishment opened and feels FHP
the parking standards also.

Freda Davis, co-owner of the Health Food Chalet, spoke in opposition
to the request. She provided records she compiled on August 15 as
to the number of people entering and leaving the facility which far
exceeded the number of appointments approved per day by the
Commission.
Dr. Gary Goldstein, Sr. Vice President for FHP, spoke in support of
the request. In response to complaints regarding parking problems
he stated that there is a shuttle service to the FHP parking
facility three miles away. He went on to say that they have hired
security guards to monitor the parking area and designated spaces
for tenant parking only. He said they would look into a pharmacy
delivery service and consider an entrance through the rear of the
building.
Ron Gray, FHP General Manager, spoke in support of the request. He
advised that FHP had initiated a mail out prescription program and
interest among patients was growing. He urged the Commission to
reaffirm the conditional use permit.
There were no other persons to speak for or against the request and
the public hearing was closed.

3. (AMENDED) The maximum number of scheduled and non-scheduled
patient appointments (includes specialities, etc.) shall not
exceed 260 per day Monday through Friday and not exceed 150
per day Saturday and Sunday. Any changes to this condition
shall be subject to review by the Planning Commission and
their determination of whether or not a conditional use permit
would be required.
4. (AMENDED) Hours of operation shall be limited to 8 AM to 7 PM
Monday through Sunday. Any additional hours of operation
shall be subject to review by the Planning Commission and
their determination of whether or not a conditional use permit
would be required.
12. FHP will reduce the number of appointments by about 15 percent
between 10 AM - noon since that is one of the peak parking
demand periods of the day.

13. FHP will maintain their existing parking program (ie. parking
lot security guard, etc.).
14. FHP will submit an alternative parking lot layout which
increases the overall number of parking spaces for the
center. This alternative layout shall include tenant
designated parking spaces. This layout shall be submitted in
conjunction with "A" for Planning Commission consideration.
15. A Parking Management Plan shall be submitted by FHP to include
the items discussed herein. In addition, FHP will work with
the property owner and other tenants in the center (Century
21, Thrift & Loan, etc.) to have their employees park behind
the FHP building.
16. FHP will attempt to work with the property owner to update the
planned sign program for the center. It is to include
upgrading individual tenant wall signs.
17. FHP will further analyze a car pooling system for patients.
18. Alternative customer entrances (rear of the building) to the
other businesses within the center shall be considered where
feasible.
19. A review by staff and report to the Planning Commission of
these measures and their impact upon the parking area shall be
conducted in six months. The Planning Commission may add,
amend or delete conditions as deemed necessary.

APPLICANT: Dean Fronk for McDonnell Douglas Space System
Company
LOCATION: 5301 Bolsa Avenue
The applicant's request is to construct three (3) industrial
buildings (approximately 26,000 square feet total), to add on to
three (3) existing industrial structures (approximately 9,300 square
feet total), and to designate an area for screened outside storage
(approximately 53,000 square feet). The request also includes the
use of metal panels in lieu of masonry materials for some of the
proposed construction.
ENVIRONMENTAL STATUS:
Pursuant to the environmental regulations in effect at this time,
the Department of Community Development posted draft Negative
Declaration No. 89-18 for ten days, and no comments, either verbal
or written were received.

(VARIANCE) NO 89-32/NEGATIVE DECLARATION NO, 89-10
APPLICANT: Smoky's Stables USA Inc.
Fred & Alexis Burkett
LOCATION: 1,000 ft. southeast of the southerly terminus of
Bolsa Chica Rd.
Conditional Use Permit No. 89-2 in conjunction with Conditional
Exception (Variance) No. 89-32 and Negative Declaration No. 89-10 is
a request to permit the expansion of horse facilities on the 5 acre
portion (within the City) of a 12 acre temporary commercial horse
facility. The expansion includes two 18-stall barns, a riding
arena, a tack room, and a watchman's trailer and will accommodate
the relocation of some horses from the closing Ocean View Horse
Stables. Conditional Exception (Variance) No. 89-32 is a request to
encroach approximately 145 feet into the minimum 300 foot distance
requirement to a residential zone or use, and waive the perimeter
fencing and landscaping requirements of Article 967, Commercial
Equine Standards, of the Huntington Beach Ordinance Code.

ENVIRONMENTAL STATUS:
Pursuant to Section 15073 of the California Environmental Quality
Act, Draft Mitigated Negative Declaration No. 89-10 was prepared for
Conditional Use Permit No. 89-2 and Conditional Exception (Variance)
No. 89-32 (see Attachment No. 3). Because the California Coastal
Commission is acting as a responsible agency in this case, the draft
mitigated negative declaration was circulated through the State
Clearinghouse and posted for a thirty (30) day public review period
from July 12, 1989, to August 10, 1989.
RECOMMENDATION:
Approve Negative Declaration No. 89-10 and Conditional Use Permit
No. 89-2 as modified by staff and Conditional Exception (Variance)
No. 89-32 for waiver of landscaping and fencing and reduced setback
for watchman's trailer only with findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Stephen Pace, Attorney representing the applicant, spoke in support
of the request. He said condition 8-a requiring the road to be
paved would be financially impractical. He urged the Commission to
delete this requirement.
Alexis Burkett, owner of Smoky's Stables, spoke in support of the
request.
D. J. Martin, 21021 A Lochlea Lane, spoke in support of the
request. He indicated that the rules and regulations at the stables
are enforced.
Jim Tullio, 5331 Glenstone Drive, spoke in opposition to the
request. He said people walk horses on public streets and horse
manure is a severe problem. Also, there is over -crowding in the
stables and the flies are a serious problem. He urged the
Commission to deny the expansion.
Patricia Keppler, 5442 Kenilworth, spoke in opposition to the
request. She expressed concern over the fill dirt which has been
brought onto the site and also the increased traffic on Graham
Street for the stables.
Shelly Burkett, daughter of the proprietor, spoke in support of the
request. She said, at one time there were 33 stable facilities in
the City of Huntington Beach and only 3 are left. The stable
provides a service to the community with riding lessons, hay rides,
pony rides, barbeque pits, horse shoes along with the stables. She
urged the Commission to approve the expansion.
Terry Dunavan, 5176-111 Tortaga Drive, spoke in opposition to the
request and provided a petition with 75 signature opposing the
expansion.

Cynthia Larson, 9676 Pettswood Drive, spoke in support of the
request. She said that horse -back riding was one of the few
sporting activities available for young girls and women.
Kristen Bender, 21142 Shepherd Lane, spoke in support of the
request. She said she has boarded at other stables and has found
that Smokey's has fewer problems than other stables.
Charles Beauregard, 17221 Greenleaf Lane, spoke in opposition to the
request. He said the fly problem has become unbearable.
There were no other persons to speak for or against the request and
the public hearing was closed.

CONDITIONAL EXCEPTION (VARIANCE) NO. 89-32 AND NEGATIVE DECLARATION
89-10, BY THE FOLLOWING VOTE:
Commissioner Leipzig said he would be voting against the motion as
the request for expansion required improvements to the site that
would not be accomplished without the expansion.
Commissioner Mountford responded that the stable is not compatible
with the surrounding neighborhood and did not want to make a bad
situation worse.
Commissioner Shomaker said she would support the motion but would
like to see all the conditions met.
Commissioner Kirkland was concerned due to the amount of time being
spent by the Commission reviewing projects that should never be
approved and this is a prime example.
Commissioner Ortega was concerned because the City is going in a
direction that does not include equestrian.
Commissioner Williams said he would be voting against the motion
because horses are compatible with residential as determined in the
Ellis/Goldenwest area.

materially detrimental to the public health, safety and welfare
or injurious to the surrounding uses in the neighborhood since
exceptional circumstances apply to the land which preclude
detrimental effects.
2. The requested exception for landscaping, fencing, and the
placement of the watchman's trailer within the minimum 300 feet
setback requirement will allow the continuation of a previously
established stable which is compatible with surrounding
properties and does not detract from the general environment of
the area, and therefore, the exception insures the preservation
and use of substantial property rights.
3. Because of the location of the site upon which the use is
proposed exceptional circumstances exist that do not generally
apply to other properties or classes of uses in the same
district due to the remoteness of the site.

CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT N0, 89-2:
1. The site plan, as modified pursuant to staff's alternative
(attachment #6), shall be the conceptually approved layout.
a. No structure other than those shown on the approved site

2. This approval shall be in effect until October 20, 1991, in
conjunction with the applicant's current lease agreement with
Metropolitan Water District and approved permits with the

a. The proposed stables shall be allowed for a temporary
period or until October 20, 1991 when all current

3. A copy of all current lease agreements for the temporary horse
facility and the applicable properties shall be submitted to
the Community Development Department for inclusion in the
subject file.
4. A copy of the current liability insurance policy shall be
submitted to the Community Development Department for the file
and shall be available for review by the public.
5. The applicant shall provide a grading plan, soils report and
compaction report to the Public Works Department for review and
approval prior to the issuance of any permits. The applicant
shall be required to eliminate runoff into the adjacent
wetlands area. The grading plan must be approved by the
Regional Water Quality Control Board prior to the issuance of
building permits or grading permits.
a. Prior to the issuance of grading permits, the Orange
County Vector Control District shall be notified to
inspect the premises to reduce the potential for rodent
dispersal.
b. The applicant will be required to file a Report of Waste
Discharge with this Regional Board for issuance of an
animal confinement facility permit.

C. If dewatering is found to be necessary during
construction activities, either a national Pollutant
Discharge Elimination System (NPDES) permit for discharge
to surface waters of a Waste Discharge Requirements (WDR)

d. The caretaker's unit shall be provided with an adequate
sewer system approved by Public Works and Building
Departments.
6. Prior to issuance of building permits, the applicant/owner
shall complete the following:
a. Submit copy of the revised site plan and elevations
pursuant to Condition No. 1 for review and approval and
inclusion in the entitlement file.
b. The applicant shall remove fill on the proposed site down
to a level which is comparable to the adjacent site and
which allows for adequate drainage (from approximately 9
feet down to 1 to 2 feet). The proposed structures
should reach an elevation similar to or less than the
existing structures on the adjacent site.
C. Submit a hydrology/hydraulic study and drainage system
study to the Department of Public Works for review and
approval.
d. The elevations of the structures will be reviewed by the
Community Development Department. Measures such as
landscaping, outside treatments, fencing etc. shall be
provided as buffers from adjacent viewpoints. Where
possible, roofs shall be sloped away from corrals or
stables to prevent flooding and disease such as hoof rot
and thrush.
e. Submit landscape plan for review and approval. Perimeter
trees and shrubs shall be shown on the site plan for dust
control. Plants that are attractive to rodents, such as
Algerian ivy, oleander, palm, trees, yuccas, etc. shall
be avoided.
f. The applicant shall submit a log containing the name of
every horse, the owners name and address and location of
every horse on site to the Community Development
Department for inclusion in the file and thereafter on an
annual basis.
g. The facility shall be in accordance with the requirements
of condition number 10.

d. The applicant shall submit to the Building Division the

(1) Two complete sets of signed plans which include:

entrance into the facility with adequate turnaround to the
satisfaction of the Fire Department.
b. Provide emergency water supply pursuant to Fire Department
approval.
c. Corrals, racks, and stalls shall be constructed of
non-combustible materials or shall be constructed pursuant
to Huntington Beach Fire Department Specification No. 404.
d. All plans shall be approved by the Fire Department prior to
construction.
e. The applicant shall meet all applicable local, State and
Federal Fire Codes, ordinances and standards.
Special attention shall be given to water systems because
accumulations of manure, bedding, and/or feed within water are
ideal for fly production.
a. A non -leak valve for all troughs, bowls, cups, and other
water sources shall be provided in each corral.

b. Automatic valves, or sanitary drains of the water flow is
continuous, shall be installed in all large troughs or cups.
c. Back -siphoning devices shall be installed to protect the
public water supply. An approved pressure vacuum breaker
is recommended on the water line serving the paddocks. The
vacuum breaker shall be at least twelve (12") inches above
the highest point of the water usage, or an approved
double-check valve may be acceptable. Back -siphoning
devices shall not be required for automatic water cups.
10. The facility shall be maintained as follows:
a. Manure shall be removed from the premises every day, unless
it is kept in a covered bin or bog made of sound metal,
brick, stone, concrete, or wood lined with fly -tight
materials or buried in the ground and covered with earth or
other materials sufficient to prevent the attraction or
breeding of flies or other insects.
b. Manure shall not be permitted to remain in any bin or bog
for a period longer than seven (7) days. All manure
removal standards shall be maintained to the satisfaction
of the Orange County Vector Control District.
c. Rodent control shall be diligently practiced, and the
entire premises shall be kept in an orderly and sanitary
condition to prevent possible rodent infestation.
d. All dry grains shall be stored in rodent -proof metal
containers, and hay shall be stored in a covered structure
on a cement slab or on a raised wood platform which
maintains a minimum clearance of six (6) inches above the
ground.
e. In paddocks and corrals , the earth surface shall be
properly graded to suit the master drainage plan so that
rain water and overflows from water trough do not form
ponds.
f. In all enclosures where horses are maintained, the land
surface of such enclosures shall be graded above the
remaining land surface for drainage purposed.
g. Continuous dust control of the entire premises shall be
practiced providing a method for light water sprinkling of
arenas and exercise pens. This method of dust control
shall be indicated on the Site Plan. Dust control on the
premises shall be subject to regulation contained in
Chapter 8.24 of the Huntington Beach Municipal Code.
h. All water management shall be maintained to the
satisfaction of the Orange County Vector Control District.

i. Lighting shall be required to be shut off after 10:00 p.m.,
with the exception of security lighting. All outside
lighting shall be provided using energy efficient lamps
(e.g. high pressure sodium vapor, metal halide) and shall
be directed to prevent "spillage" onto adjacent properties.
j. Horses shall be subject to Orange County Flood Control
District regulations regarding use of the adjacent flood
control channel bank. If there are limitations, the
applicant shall work with the Flood Control District to
provide a sign to inform people using the stable facility.
k. Hours of operation shall be limited to 7:00 a.m. to 10:00
p.m.
1. The number of parking spaces provided on -site shall be per
city code.
m. Horses, hay rides and related activities shall be limited
to the subject property, unless written authorization is
obtained from the property owner. A copy of the
authorization shall be submitted to the Community
Development Department for the file. Signs shall be posted
throughout the premises indicating "Riders Not to Stray
Onto Private Property".
During construction, the applicant shall:
a. Use water trucks or sprinkler systems in all areas where
vehicles travel to keep damp enough to prevent dust raised
when leaving the site;
b. Wet -down areas in the late morning and after work is
completed for the day;
c. Use low sulfur fuel (.05% by weight) for construction
equipment;
d. Attempt to phase and schedule construction activities to
avoid high ozone days (first stage smog alerts);
e. Discontinue construction during second stage smog alerts.
12. Construction shall be limited to Monday - Saturday 7:00 AM to
8:00 PM. Construction shall be prohibited Sundays and Federal
holidays.
13. The 5 acre facility within the City boundaries shall not exceed
25 horses per acre or a maximum of 125 as permitted by Section
9670.3.
14. All land use violations within the City limits shall be abated
within 90 days of final action. In addition, the applicant
shall work with the County to abate any county violations.

1. The site plan, floor plans, and elevations received and dated
July 17, 1989, shall be the conceptually approved layout.
2. Prior to submittal for building permits, the applicant/owner
shall complete the following:
a. Elevations shall depict colors and building materials
proposed.
b. The site plan shall include all conditions of approval
imposed on the project printed verbatim.
3. The Public Works Department requirements are as follows:
a. The water service to the home shall have a Water Division
approved back -flow prevention system.
4. Fire Department Requirements are as follows:
a. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
b. The applicant shall meet all applicable local, State and
Federal Fire Codes, Ordinances, and standards.
5. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.

6. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
7. Construction shall be limited to Monday - Saturday 7:00 AM to
8:00 PM. Construction shall be prohibited Sundays and Federal
holidays.
8. Prior to final building permit approval or issuance of a
Certificate of Occupancy, the following shall be completed:
a. All improvements (including landscaping) to the property
shall be completed in accordance with the approved plans
and conditions of approval specified herein.
b. Compliance with all conditions of approval specified herein
shall be accomplished.
9. This Conditional Use Permit No. 89-26 shall become null and
void unless exercised within one (1) year of the date of final
approval, or such extension of time as may be granted by the
Planning Commission pursuant to a written request submitted to
the Planning Department a minimum 30 days prior to the
expiration date.
