Maximize the outdoor and environmental potential of the City by providing comprehensive, coordinated recreation, parks and open space programs that fulfill the needs of all segments of the community (Open Space and Conservation Element). B-1 2. Find alternative methods of providing parks if park fees are inadequate or non-existent (Recreation Element). 3. Acquire land for parks, open space and recreation prior to land development (Recreation Element). 4. Provide additional community facilities within Huntington Central Park to help satisfy the deficiency in community park space (Recreation Element). 5. ORAL COMMUNICATIONS Margie Schiller, Margie's Kitchen, 1906 Magnolia, reported parking conditions and problems still occurring at the FHP site. She said the parking attendants are questioning everyone arriving at the site and she has received many complaints regarding the new procedure. She requested staff to follow-up on the problems. PUBLIC HEARING ITEMS C-1 CODE AMENDMENT NO. 88-12/NEGATIVE DECLARATION NO. 89-8 (CONTINUED FROM SEPTEMBER 6, 1989 PLANNING COMMISSION MEETING) APPLICANT: CITY OF HUNTINGTON BEACH Code Amendment No. 88-12 is a request to amend parking and landscape provisions of the Huntington Beach Ordinance Code and Downtown Specific Plan. The parking regulations and landscape provisions are currently being revised to clarify various sections and terminology regarding the creation of nonconforming uses based on the proposed changes to the parking standards. STAFF RECOMMENDATION: Continue Code Amendment No. 88-12 and Negative Declaration No. 89-8 to the October 3, 1989 Planning Commission meeting. The total proposed square footage is 3,659 square feet. A new kindergarten playground is also proposed. This item was continued from the September 6, 1989 Planning Commission meeting to allow staff to further analyze the traffic flow around the site, and to clarify issues with regard to use of the church buildings. PC Minutes - 9/19/89 -3- (3871d) ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Section 15301, Class 1, of the California Environmental Quality Act. STAFF RECOMMENDATION: Approve Conditional Use Permit No. 89-33 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED There was no one present to speak for or against the request and the public hearing was closed. Conditions of approval relative to changes in parking management plan and on -site circulation plan and fire sprinklers were added. The location, site layout, and design of the proposed kindergarten classes and religious education building properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 2. The combination and relationship of one proposed use to another on the site are properly integrated. 3. The access to and parking for the proposed kindergarten classes and religious education building does not create an undue traffic problem. CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and dated August 10, 1989, shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: PC Minutes - 9/19/89 -4- (3871d) L a. Floor plans shall depict natural gas stubbed in at the locations of cooking facilities, water heaters, and central heating units; and low -volume heads shall be used on all spigots and water faucets. b. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. c. Elevations shall depict colors and building materials proposed. d. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations. e. The site plan (or reference page) shall include all conditions of approval imposed on the project printed verbatim. 3. Any modification to the approved parking management plan and on -site circulation plan shall be submitted to the Planning Commission for review and approval. 4. Fire Department requirements are as follows: An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 5. Prior to issuance of building permits all applicable Public Works fees shall be paid. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. C-3 DRAFT 1989 HOUSING ELEMENT UPDATE FOR THE CITY OF HUNTINGTON BEACH (CONTINUED FROM SEPTEMBER 6. 1989 PLANNING COMMISSION MEETING) APPLICANT: CITY OF HUNTINGTON BEACH California State Law requires that local governments prepare and adopt a Housing Element of the General Plan, and that the element be updated at five-year intervals. The City retained the firm of Cotton/Beland to prepare the Housing Element Update. The document PC Minutes - 9/19/89 -5- (3871d) has been completed and comments from the public and the State have been received. Copies of the State's comments were distributed to the Planning Commission on September 6, 1989. At present, staff is continuing to work with the Consultant and the State to address these comments. STAFF RECOMMENDATION: Continue this item to the study session and public hearing scheduled for October 3, 1989. A MOTION WAS MADE BY ORTEGA, SECOND BY WILLIAMS, TO CONTINUE DRAFT 1989 HOUSING ELEMENT TO A STUDY SESSION AT 5:30 PM, OCTOBER 3, 1989, AND THEN TO THE REGULARLY SCHEDULED MEETING, BY THE FOLLOWING VOTE: AYES: Shomaker, Williams, Bourguignon, Ortega, Leipzig NOES: Kirkland ABSENT: Mountford (Out of Room) ABSTAIN: None MOTION PASSED C-4 CONDITIONAL USE PERMIT N0, 89-38 APPLICANT: BISSELL ARCHITECTS Conditional Use Permit No. 89-38 is a request to construct a two-story rectory office and priest living quarters to replace an existing inadequate facility at St. Mary's by the Sea. The new construction will be attached to an existing family room/social hall building. Church uses are listed as unclassified, permitted in all zones subject to conditional use permit approval by the Planning Commission pursuant to Section 9630 of the Huntington Beach Ordinance Code. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Section 15301, Class l(e) of the California Environmental Quality Act. HISTORIC REVIEW: As the property is listed in the City's Historic Resources Survey Report, a request for comments was sent to the Historic Resources Board. The Board felt that the new rectory structure was highly compatible with the church building, although they did recommend that the chimney be redesigned since it presented a modern appearance. PC Minutes - 9/19/89 -6- (3871d) STAFF RECOMMENDATION: Approve Conditional Use Permit No. 89-38 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Glen Gellatly, applicant, spoke in support of the request. He said the church would like to retain the existing small drive on Tenth Street since it fulfills a very important need of the church; Public Works Department has agreed to allow retention. He expressed his concerns with the requirement to widen the east side of the alley. He asked approval to have the dedication condition deleted. Richard Harlow spoke in support of the request. He asked for a waiver of the condition requiring alley dedication and removal of the existing wall and landscaping. Mike McMahon, 413 Tenth Street, urged the Planning Commission to approve the request. He also urged more flexibility on the conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. The Commission commended Father Johnson for a great example of historical beautification on his project. The establishment, maintenance and operation of the rectory building addition will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental -to the value of the property and improvements in the neighborhood. 2. The location, site layout, and design of the proposed rectory building addition properly adapts the proposed structure to streets, driveways, and other adjacent structures and uses in a harmonious manner. The access to and parking for the proposed rectory building addition does not create an undue traffic problem as six spaces over and above the minimum required by Conditional Exception No. 79-3 are provided. CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and dated August 31, 1989, shall be the conceptually approved layout with the following modifications: a. A two and one-half foot dedication shall be shown for the west side of the alley. b. The chimney shall be redesigned to incorporate a compatible historic appearance to be reviewed by the Design Review Board. c. The Existing 10 foot driveway on loth Street may remain. 2. Prior to submittal for building permit, a detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 3. The site plan (or reference page) shall include all conditions of approval imposed on the project printed verbatim. 4. Prior to issuance of building permit: a. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. b. A parcel map consolidating the lots shall be submitted. Said map shall be recorded prior to final inspection and a copy submitted to the Department of Community Development. 5. The Public Works Department requirements are as follows: a. Prior to Certificate of Occupancy, applicant shall construct all required public improvements on Tenth Street, Orange Avenue and existing alley. Improvements to the alley shall be delayed until such time as the remaining alley dedication in this block are received. PC Minutes - 9/19/89 -8- (3871d) 6. Fire Department requirements are as follows: An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations in the new rectory addition and the existing family room, with a local alarm to notify occupants. 7. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 9. The Planning Commission reserves the right to revoke this conditional use permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs. C-5 APPEAL OF ZONING ADMINISTRATOR'S DENIAL OF CONDITIONAL EXCEPTION (VARIANCE) NO, 89-35 APPLICANT: WALDEN WILLIAMS Conditional Exception (Variance) No. 89-35 is a request to permit the reconstruction and addition to a single family dwelling maintaining a three foot rear yard setback and a zero foot side yard setback for the garage. Additionally, the applicant wishes to construct an addition to the dwelling at a 7 foot in lieu of a 7.5 foot rear yard setback. On August 16, 1989, the Zoning Administrator acted on the applicant's request by approving Use Permit No. 89-34 to permit the use of reduced side yard setbacks (3 feet in lieu of 5 feet) with findings and conditions of approval and denying Conditional Exception (Variance) No. 89-35 for the reduced rear yard setbacks and zero foot side yard setback. Submitted for your consideration is an appeal by the applicant to the action taken by the Zoning Administrator. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Section 15303, Class 3, of the California Environmental Quality Act. SPECIFIC PLAN• The project is located within the Townlot Specific Plan, District 1, Section "A" (Article 913, Huntington Beach Ordinance Code). STAFF RECOMMENDATION: Deny the appeal and uphold the Zoning Administrator's denial of Conditional Exception (Variance) No. 89-35 with findings. A representative of the applicant requested a continuance on Conditional Exception (Variance) No. 89-35. He said Mr. Williams was out of town and would return in time for the next meeting. PC Minutes - 9/19/89 -9- (3871d) A MOTION WAS MADE BY ORTEGA, SECOND BY LEIPZIG, TO CONTINUE APPEAL OF ZONING ADMINISTRATOR'S DENIAL OF CONDITIONAL EXCEPTION (VARIANCE) NO. 89-35 TO THE OCTOBER 3, 1989 PLANNING COMMISSION MEETING, BY THE FOLLOWING VOTE: AYES: Shomaker, Kirkland, Bourguignon, Ortega, Mountford, Leipzig NOES: None ABSENT: Williams (Out of Room) ABSTAIN: None MOTION PASSED C-6A DRAFT ENVIRONMENTAL IMPACT REPORT NO, 89-5, LAND USE ELEMENT AMENDMENT NO 89-1 AND ZONE CHANGE N0._ 89-2 APPLICANT: HALL AND ASSOCIATES The request is to make necessary land use and zoning changes with related Environmental Impact Studies to allow for an increase in density from low density residential to medium density residential for a planned development on approximately 2.56 gross acres of land at the southeast corner of the intersection of Bushard Street and Garfield Avenue. These changes would permit an increase of approximately eight residential units. Current land use and zoning allow for 10 standard 60 foot x 100 foot single family homes on a cul-de-sac street. The applicant's proposal is for eighteen single family homes on 35 foot x 110 foot and 45 foot x 78 foot lots along a private street. A zoning designation of R2 (Medium Density) would allow approximately 38 apartments to be constructed on this site. An R1-PD (Low Density Residential -Planned Development) zoning designation would allow for 13 single family homes. Draft Environmental Impact Report No. 89-5 analyzes the potential impacts of all of these options as well as a 20,000 square foot commercial/retail center. STAFF RECOMMENDATION: (A) Adopt and certify as adequate Draft Environmental Impact Report No. 89-5 and forward it to the City Council for their adoption and certification with findings; and (B) Deny Land Use Element Amendment No. 89-1 from Low Density Residential to Medium Density Residential; and (C) Deny Zone Change No. 89-2 from R1-FP2 (Low Density Residential- Floodplain District 2) to R2-FP2 (Medium Density Residential-Floodplain District 2) with findings. Draft Environmental Impact Report No. 89-5 has been completed in compliance with the California Environmental Quality Act as amended June 1986 and all State and local guidelines therefore. 2. Draft Environmental Impact Report No. 89-5 adequately addresses the potential environmental impacts that may be associated with Land Use Element Amendment No. 89-1 and Code Amendment No. 89-2 and is found to be certifiable. 3. Draft Environmental Impact Report No. 89-5 was presented to the Planning Commission for review and consideration the information contained in the final environmental impact report prior to approving the project. 4. Findings and Facts in Support of Findings have been made for all significant effects identified in Draft Environmental Impact Report No. 89-5. The proposed zone change from R1-FP2 (Low Density Residential- Floodplain District 2) to R2-FP2 (Medium Density Residential-Floodplain District 2) would be incompatible with adjacent and nearby land uses since access to the subject parcel would be taken solely from streets serving the adjoining properties. 2. The proposed zone change from R1-FP2 (Low Density Residential- Floodplain District 2) to R2-FP2 (Medium Density Residential-Floodplain District 2) would significantly increase the amount of traffic originally anticipated for the existing residential streets. 3. The proposed zone change from R1-FP2 (Low Density Residential- Floodplain District 2) to R2-FP2 (Medium Density Residential-Floodplain District 2) would severely impact the amount of on -street parking available to existing residences. 4. The proposed zone change from R1-FP2 (Low Density Residential- Floodplain District 2) to R2-FP2 (Medium Density Residential-Floodplain District 2) would subject six units to noise levels of Ldn 45 or greater due to insufficient setbacks and other mitigation measures. 5. The proposed zone change from R1-FP2 (Low Density Residential- Floodplain District 2) to R2-FP2 (Medium Density Residential-Floodplain District 2) would facilitate designs aesthetically incompatible with the surrounding residential areas in regards to density, height, setbacks, landscaping and flood mitigation. C-6B CONDITIONAL USE PERMIT NO. 89-17 WITH SPECIAL PERMITS AND TENTATIVE TRACT MAP NO, 14017 APPLICANT: HALL AND ASSOCIATES Conditional Use Permit No. 89-17 with Special Permits and Tentative Tract Map No. 14017 is a request to construct an 18 unit detached single family dwelling planned residential development with special permits to deviate from required sideyard setbacks, offsets, building separation and required common open space pursuant to Section 9150 of the Huntington Beach Ordinance Code. ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time, the Department of Community Development prepared and circulated Draft Environmental Impact Report No. 89-5. PC Minutes - 9/19/89 -12- (3871d) STAFF RECOMMENDATION: Deny Conditional Use Permit No. 89-17 and Tentative Tract Map No. 14017 with findings. THE PUBLIC HEARING WAS OPENED There was no one present to speak for or against the request and the public hearing was closed. REQUEST BECAME MOOT DUE TO THE DENIAL OF LAND USE ELEMENT AMENDMENT NO. 89-1 AND ZONE CHANGE NO. 89-2. C-7 CONDITIONAL USE PERMIT NO. 89-1 WITH SPECIAL PERMITS. COASTAL DEVELOPMENT PERMIT NO. 89-1, ENVIRONMENTAL IMPACT REPORT NO. 89-4 APPLICANT: CITY OF HUNTINGTON BEACH REDEVELOPMENT AGENCY Conditional Use Permit No. 89-1 with Special Permits and Coastal Development Permit No. 89-1 constitute a request to allow up to 70,726 square feet of mixed use development on one City block bounded by Main Street, Walnut Avenue, Fifth Street and Olive Avenue. New square footage may occur on an owner -by -owner basis under one of two options: 1) facade improvement of existing buildings in conjunction with new additions up to the maximum square footage permitted under the Downtown Specific Plan; or 2) demolition of existing structures and construction of new buildings up to the maximum square footage permitted under the Downtown Specific Plan. This conditional use permit and coastal development permit are intended to serve as the master entitlements for all new square footage on the block. Each property owner may elect a building option pursuant to this action, or alternatively, choose either no action or facade rehabilitation only (no entitlement required). Any exterior alteration, whether facade work or new construction, will require final approval by the Design Review Board. ENVIRONMENTAL STATUS: In accordance with the California Environmental Quality Act, Environmental Impact Report No. 89-4 (EIR No. 89-4) was prepared to analyze the potential impacts of the project. STAFF RECOMMENDATION: A. Adopt and certify as adequate Environmental Impact Report No. 89-4 by adopting Planning Commission Resolution No. 1419 (with Statement of Overriding Considerations); B. Approve Coastal Development Permit No. 89-1 with findings; and C. Approve Conditional Use Permit No. 89-1 with Special Permits with findings and conditions of approval. PC Minutes - 9/19/89 -13- (3871d) A lengthy discussion ensued between the Commission and staff. The Commission questioned staff regarding the following: 1. How is square feet being calculated for parking spaces that will be grandfathered. Will bootleg square footage be counted? 2. Since the Commission suggested approval of an 80 foot street on Walnut will this cause a hardship on the proposed project? Will this previous action trigger minute action for a new precise plan? Will action on this request void their prior action? 3. What is the economic feasibility of this project. Would like to see it addressed in the EIR. 4. Will the "fees in lieu of parking spaces" cover the cost of building the proposed parking structures? Since there were several issues causing major concerns to the Commission it was suggested that this item be continued after the public hearing. THE PUBLIC HEARING WAS OPENED Tom Van Wei, 818 Walnut, said he owns a street -sweeping business and he has noticed that setbacks make a neighborhood. If buildings are too close to the street it creates a poor image of the neighborhood. Richard Harlow, 111 Tenth Street, representing Gary Mulligan, urged the Commission to approve the request. He said the EIR failed to address the number of on -street parking spaces that currently exist and hopes they will be credited to the overall downtown. He feels the shortfall can be bolstered by the availability of on -street parking and the proposed third block structure. He discussed the terms of paying for parking agreed upon with the Redevelopment Agency. At the time of permit an agreement to pay will be made and that sum will be postponed or financed over a 5-year period and amortized. He also discussed the wording for special permits, setbacks, building heights and revenues. There were no other persons present to speak for or against the request and the public hearing was closed. Discussion ensued regarding on -going negotiations between Signal Landmark and the Water Company regarding the Smoky Stable site and whether an extension of the conditional use permit was in order. Also, the matter of the stockpiled dirt was discussed. Staff agreed to assist in checking permits to determine responsibility for removal of the dirt.
