ORAL COMMUNICATIONS Doug Langevin, 8196 Pawtucket Drive, Huntington Beach, spoke in opposition to Item C-2, Precise Plan of Street Alignment/Environmental Assessment No. 89-36. He was concerned that the Environmental Assessment does not address the economic impacts of the historic properties. The economic impact is of significant importance to the owners in their decision whether to demolish or restore their building. Davis Burris, 220 5th Street, Huntington Beach, spoke in opposition to Item C-2, Precise Plan of Street Alignment. He was concerned that the historic structures would have to be moved if the street were widened to 80 feet. Bill Holman, Huntington Beach Company, asked the Commission if it was the Commission's intent to continue Item C-4, Code Amendment No. 88-12, pursuant to staff's recommendation. PUBLIC HEARING ITEMS C-1 APPEAL OF ZONING ADMINISTRATOR'S DENIAL OF CONDITIONAL EXCEPTION (VARIANCE) N0. 89-35 (CONTINUED FROM 9/19/89 PLANNING COMMISSION MEETING) APPLICANT: Walden Williams LOCATION: 529 Eighth Street Conditional Exception (Variance) No. 89-35 is a request to permit the reconstruction and addition to a single family dwelling maintaining a three foot rear yard setback and a zero foot side yard setback for the garage. The applicant also wishes to construct an addition to the dwelling at a 7 foot in lieu of a 7.5 foot rear yard setback. On August 16, 1989, the Zoning Administrator acted on the applicant's request by approving Use Permit No. 89-34 to permit the use of reduced side yard setbacks (3 feet in lieu of 5 feet) with findings and conditions of approval and denying Conditional Exception (Variance) No. 89-35 for the reduced rear yard setback and zero foot side yard setback. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Section 15303, Class 3, of the California Environmental Quality Act. STAFF RECOMMENDATION: Deny the appeal and uphold the Zoning Administrator's denial of Conditional Exception (Variance) No. 89-35 with findings. THE PUBLIC HEARING WAS OPENED: Walden Williams, the applicant, spoke in support of the request. He advised that the reason for the addition was to allow private living space for the owner's elderly parents. He urged the Commission's support of the request. Frank Goetz, the architect, spoke in support of the request. He disagreed with staff's opinion that the request was a major remodel as he feels it is "facadism". Wilfred Meyer, 516 9th Street, spoke in opposition to the request stating concern over the rear yard setback. There were no other persons present to speak for or against the request and the public hearing was closed. PC Minutes - 10/3/89 -3- (3935d) Commissioner Leipzig said he supported the Zoning Administrator's denial of the request due to problems with the alley and side yard setback. Commissioner Mountford also supported the Zoning Administrator's denial because the findings to grant a variance request did not exist. There does not appear to be exceptional or extraordinary circumstances or conditions applicable to the land, buildings or premises involved that does not apply generally to property or class of uses in the same district. The property is regular in shape and has twice the area and frontage required within the Townlot Specific Plan. 2. The subject property can be fully developed within regular established setbacks; therefore, a conditional exception (variance) is not necessary for the preservation and enjoyment of substantial property rights. 3. Granting of Conditional Exception (Variance) No. 89-35 would constitute a special privilege inconsistent with limitations upon properties in the vicinity. Numerous residential structures have been constructed within the Townlot Area adhering to the minimum rear and side yard setbacks. 4. Exceptional circumstances do not apply that deprive the subject property of privileges enjoyed by other properties in the same zone classifications. The extent of the reconstruction, reconfiguration and addition to the existing dwelling constitutes new construction. PC Minutes - 10/3/89 -4- (3935d) f' L C-2 PRECISE PLAN OF STREET ALIGNMENT NO, 89-3/ENVIRONMENTAL ASSESSMENT NO. 89-36 APPLICANT: City of Huntington Beach LOCATION: Walnut Avenue between Main and Sixth Streets Precise Plan of Street Alignment No. 86-1, establishing the precise alignment of Walnut Avenue, was adopted October 27, 1986. This precise alignment reflects 80 foot ultimate right-of-way requiring a 10 foot dedication on each side of Walnut Avenue, to be required at the time adjacent properties are redeveloped. Precise Plan of Street Alignment No. 89-3 proposes to create a modified right-of-way width of 60 feet on Walnut Avenue from Main to Sixth Street. STAFF RECOMMENDATION: Approve Negative Declaration No. 89-36 and Precise Plan of Street Alignment No. 89-3 and recommend adoption by the City Council. ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time, the Department posted draft Negative Declaration No. 89-36 for ten days, and no comments either verbal or written were received. The staff, in its initial study of the project, has recommended that a negative declaration be issued. Prior to any action on Precise Plan of Street Alignment No. 89-3, it is necessary for the Planning Commission to review and act on Negative Declaration No. 89-36. THE PUBLIC HEARING WAS OPENED. Thomas Caverly, 553 Temple Hills Drive, owner of 201 and 203 Main Street, spoke in support of staff's recommendation for right-of-way width of 60 feet on Walnut Avenue. Bill Gallegos, 210 5th Street, spoke in opposition to staff's recommendation. Guy Guzzardo, 515 Walnut Avenue, spoke in support of staff's recommendation. He said that if the street were widened to 80 feet historical buildings would be destroyed. Gary Mulligan, 117 and 225 Main Street, spoke in support of staff's recommendation. He said the businesses downtown would not benefit from four lanes of traffic. Keith Bohr, Redevelopment Agency staff, spoke in support of the request. He said, Redevelopment Agency would support a 60 foot right-of-way since the proposed development on Main Street between Main and Sixth Streets is for rehabilitation purposes only. If the block were being completely reconstructed an 80 foot right of way would be supported. PC Minutes - 10/3/89 -5- (3935d) Les Evans, City Engineer, spoke in support of staff's recommendation. He reported that traffic studies performed in May, 1988, recommended a 60 foot right-of-way. Dick Harlow, 111 loth Street, spoke in support of staff's recommendation. He said a wider right-of-way may result in a traffic flow of 25 to 30 miles per hour which would not benefit the business owners and could be the cause of accidents. There were no other persons to speak for or against the request and the public hearing was closed. The Commission felt that the main issues were not addressed sufficiently in the staff report and requested additional information be prepared. The Special Permits are to allow: 1) 0 foot setback on Walnut Avenue in lieu of 5 feet; 2) 0 foot build -to -line on Main Street in lieu of 5 feet; and 3) structures up to 30 feet in height within 25 feet of the Main Street right-of-way in lieu of a maximum of 25 feet in height. Adopt and certify as adequate Environmental Impact Report No. 89-4 by adopting Planning Commission Resolution No. 1419 (with Statement of Overriding Considerations); B. Approve Coastal Development Permit No. 89-1 with the following findings; and C. Approve Conditional Use Permit No. 89-1 with Special Permits with the following findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Bill Gallegos, 208 and 210 5th Street, spoke in opposition to the request. He said a 0 foot setback on Walnut allows an unfair advantage to some property owners. Dick Harlow, 111 loth Street, spoke in support of the request. He said the 0 foot setback allows the rebuilding of structures to be built where the existing stuctures are located. He supported the 0 foot build -to -line as other requirements would create a 9 foot setback from existing buildings. There were no other persons to speak for or against the request and the public hearing was closed. The granting of Conditional Use Permit No. 89-1 for up to 70,726 square feet of mixed use development will implement the General Plan of the City of Huntington Beach, the Downtown Specific Plan, and the Downtown Design Guidelines. 2. The location, site layout, and design of the structures on the rehabilitation block will properly adapt them to streets, driveways, and other adjacent structures and uses in a harmonious manner, because final design of each rennovated or reconstructed building will be subject to Design Review Board approval. 3. The access to and parking for the proposed rehabilitation/new construction does not create an undue parking problem, because mitigation measures will be implemented requiring payment of in -lieu fees and construction of off -site spaces. FINDINGS FOR APPROVAL - SPECIAL PERMITS: 1. The following special permits promote a better living environment by adapting the Downtown Specific Plan requirements to better suit individual development of commercial and office buildings on the block, which are compatible with the surrounding area: a. Zero foot setback on Walnut Avenue in lieu of 5 feet; b. Zero foot build -to -line on Main Street in lieu of 5 feet; and C. Structures up to 30 feet in height within 25 feet of the Main Street right-of-way in lieu of a maximum of 25 feet in height. 2. The requested special permits provide for maximum use of aesthetically pleasing types of architecture, design and building layout. 3. The requested special permits will not be detrimental to the general health, welfare, safety and convenience, nor detrimental or injurious to the value of property or improvements of the neighborhood or of the City in general. 4. The requested special permits are consistent with the objectives of the Downtown Specific Plan standards in achieving a development adapted to the surrounding built environment and compatible with proposed development in the area. r- i PC Minutes - 10/3/89 -8- (3935d) 1 11 FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO, 89-1: 1. The proposed 70,726 square foot mixed -use development conforms with the plans, policies, requirements and standards of the Huntington Beach Coastal Element of the General Plan. 2. Coastal Development Permit No. 89-1 is consistent with the CZ (Coastal Zone) suffix, the Downtown Specific Plan, and provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed 70,726 square foot mixed -use development can be provided with infrastructure in a manner that is consistent with the Huntington Beach Coastal Element and Coastal Land Use Plan of the General Plan. 4. The proposed 70,726 square foot mixed -use development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO, 89-1 WITH SPECIAL PERMITS. COASTAL DEVELOPMENT PERMIT NO. 89-1, AND ENVIRONMENTAL IMPACT REPORT NO, 89-4: 1. The site plan, floor plans, and elevations for each proposed addition, alteration, or new building shall be subject to the standards of the Downtown Specific Plan, the conditions of this Conditional Use Permit and the Special Permits herein, and shall be subject to approval by the Design Review Board. 2. Prior to the issuance of any demolition permits an adequate monitoring and/or bonding program shall be established between the City Redevelopment Agency and property owners to ensure that demolition and construction vibration impacts do not adversely affect offsite structures. 3. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Floor plans shall depict natural gas and 220V electrical stubbed in at the location of clothes dryers; natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units; and low -volume heads shall be used on all spigots and water faucets. b. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. PC Minutes - 10/3/89 Qz (3935d) 4. C. Elevations shall depict colors and building materials proposed. d. All rooftop mechanical equipment shall be screened from view of public rights -of -way. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. e. Prior to the issuance of Building Permits, a detailed lighting plan shall be approved by the Department of Community Development. The plan shall be consistent with the Downtown lighting plan and lighting standards in the Downtown Design Guidelines. f. Where determined necessary by the Departments of Building and Public Works, a detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. Depending on the results of soils studies conducted for new construction mitigating measures will be required to be incorporated into the project. These measures may include but not limited to: buffer, special grading, special foundations, subdrains, dewatering devices, and retaining walls. g. The Design Review Board shall review the site plans, floor plans and elevations, including proposed colors and materials. The Design shall incorporate elements of the Downtown Design Guidelines, and elements of historic Huntington Beach structures. h. The site plan (or reference page) shall include all conditions of approval imposed on the project printed verbatim. Prior to issuance of building permits, the applicant/owner shall complete the following: a. Comprehensive documentation of the project site, as it currently exists, shall be prepared prior to the issuance of any building, grading, and/or demolition permits. The documentation shall be in accordance with standards established by the Historical American Buildings Survey/Historical American Engineering Records (HABS/HAER). The report shall be archivally maintained with provisions for public access. The costs associated with preparation and maintenance of the documentation shall be the responsibility of the Huntington Beach Redevelopment Agency. PC Minutes - 10/3/89 -10- (3935d) b. Prior to the approval or issuance of any demolition, grading, and/or building permits, all facets of the project related to historic preservation shall be reviewed and approved by the City of Huntington Beach. C. Where determined necessary by the Department of Public Works, a grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. d. The City of Huntington Beach Redevelopment Agency shall be responsible for parking spaces required for existing square footage. The number of spaces for which the Agency will be responsible shall be based on existing legally constructed square footage, to be verified prior to issuance of building permits. e. All applicable Public Works fees shall be paid. f. Where required by the Huntington Beach Ordinance Code or the State Subdivision Map Act, a parcel map consolidating parcels or portions of parcels shall be submitted. Said map shall be recorded prior to final inspection and a copy submitted to the Department of Community Development. g. An interim parking and/or building materials storage plan shall be submitted to the Department of Community Development to assure adequate parking is available for employees, customers, contractors, etc., during any structure's construction phase. h. Property owners shall provide on -site parking or pay in -lieu fees for additional square footage in accordance with the approved facade grant program. Provision for payment of fees must be made prior to issuance of building permits, in accordance with the program. i. The Precise Plan of Street Alignment between Main and Sixth Streets shall adopted by the City Council prior to permits for new construction on the Avenue (201 Main Street, 412 Walnut Street). for Walnut Avenue be resolved and issuance of building lots adjoining Walnut Avenue, 202 Fifth PC Minutes - 10/3/89 -11- (3935d) 5. A sign and landscape plan shall be submitted to the Design Review Board -and/or City Planning Department by each property owner prior to approval of sign permits. The location and type of all signs shall conform to the provisions of the Huntington Beach Ordinance Code and be consistent with the standards listed on page 33 of the Downtown Design Guidelines. All lighting and landscaping materials shall also be consistent with the guidelines. 6. The City shall encourage and/or sponsor a planned sign program on both sides of Main Street. This program shall include possible sign amortization, City funded removal of existing signs, and City funded purchase and mounting of new signs. 7. The City shall implement consistency of similar landscape and landscape on both sides of Main Street. 8. As projects within the parking district, comprised of Downtown Specific Plan Districts 3 and 5a, request development approval, they shall contribute their "fair -share" towards reducing the cumulative parking demand deficiency. Fees shall be paid prior to issuance of building permits or certificate of occupancy, whichever comes first. The offsite parking spaces shall be in place prior to the issuance of a certificate of occupancy for the new development. 9. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards. 10. The development shall comply with all applicable provisions of Division, and Fire Department. the Ordinance Code, Building 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 12. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 13. Construction on the project site shall not exceed two stories or 30 feet in height. 14. This conditional use permit shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. PC Minutes - 10/3/89 -12- (3935d) C-4 MOVED TO ORAL COMMUNICATION (ITEM B) C-5 DRAFT 1989 HOUSING ELEMENT UPDATE (CONTINUED FROM SEPTEMBER 19 1989 PLANNING COMMISSION MEETING) California State Law requires that local governments prepare and adopt a Housing Element of the General Plan, and that the element be updated at five-year intervals. The City retained the firm Cotton/Beland to prepare the Housing Element Update. The document has been completed and submitted to HCD for their review. Copies of the State's comments were distributed to the Planning Commission on September 6, 1989. The Consultant has responded to the majority of the State's comments and appropriate revisions have been made to the document. Discussions continue to resolve the remaining issues. STAFF RECOMMENDATION Continue for 30 days to allow further discussions with the State. The item will be readvertised prior to public hearing. Begin II, 16221 Watson Circle, representing Goldenwest Church of Christ, spoke in support of the request. He said there was a misunderstanding with staff regarding the proposed hours of operation. He requested the condition limiting the hours of operation to Sunday days and Monday thru Thursday after 6:30 PM be modified. David Smith, representing Goldenwest Church of Christ, spoke in support of the request. There were no other persons present to speak for or against the request and the public hearing were closed. The Commission was concerned that parking would not be adequate if the hours of operation were expanded to meet the applicant's request. PLANNING COMMISSION ITEMS Commissioner Leipzig reported a visit to FHP during the week of September 29. The security guard advised that a new security firm would be starting the following week. Commissioner Ortega indicated that the Commission had denied Resolution No. 1389, Downtown Standards for Cul-de-sacs, and wanted to be sure that the Council was aware of their decision. Commissioner Ortega reminded staff that the Commission voted to place conservation items on the agenda. Commissioner Williams asked staff to report status of burned building at Florida and Main. Commissioner Leipzig asked when the White Hole Area would be on the Planning Commission agenda. H. COMMUNITY DEVELOPMENT ITEMS Staff discussed action taken at the October 2, 1989 City Council meeting. The Commission was apprised that electronic reader boards were approved by a 4/3 vote. I.
