ZONING ADMINISTRATOR: Michael Strange STAFF MEMBERS: Herb Fauland MINUTES: Minutes of the October 4, 1989 Zoning Administrator Meeting were approved. REGULAR AGENDA ITEMS: USE PERMIT NO. 89-59 Applicant: Evans Kitsigianis Plains True Value Home Center 5961 Warner Avenue Huntington Beach, CA 92649 Request: To permit a three (3) day parking lot sale from October 13 through 15, 1989. Location: 5961 Warner Avenue (Plains True Value Home Center) Environmental This request is covered by Categorical Exemption, Status: Section 15311, Class 11, California Environmental Quality Act, 1986 Staff reported that this is a request for a temporary outdoor event at the True Value Home Center. Staff stated that there are no Planning, Fire Department or Police Department concerns and staff recommended approval. Karen Tompkins, representing the applicant, was present and spoke in support of the request. USE PERMIT NO. 89-39 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. ZA Minutes 10/11/89 -1- 5460h 2. The granting of Use Permit No. 89-59 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated October 3, 1989 shall be the approved layout as amended by the Huntington Beach Fire Department. 2. Fire access lanes in the parking lot shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, barriers, etc.). 4. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 89-59 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. USE PERMIT NO. 89-55 Applicant: Mr. and Mrs. John Potter 10351 Kamuela Drive Huntington Beach, CA 92649 Request: Addition of a 289 square foot family room to a single family dwelling with a non -conforming front yard setback Location: 10351 Kamulea Drive Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1, California Environmental Quality Act, 1986 Staff reported that the use permit was required due to a non -conforming front yard setback. Research on this site indicated that other homes in the tract were built with 22 foot front yard setbacks for front entry garages, but this particular home was built with a 16 foot front yard setback. Staff reported that the site meets the open space requirement and all other code requirements for the room addition. Staff recommended approval of the request. The public hearing was opened and Mrs. Potter, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. ZA Minutes 10/11/89 -2- 5460h USE PERMIT NO. 89-55 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the addition of a two hundred and eighty nine (289) square foot family room to a single family dwelling with a non -conforming front yard setback will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 89-55 to permit the addition of a two hundred and eighty nine (289) square foot family room to a single family dwelling with a sixteen (16) foot non -conforming front yard setback in lieu of a twenty-two (22) foot setback for a front entry garage will not adversely affect the General Plan of the City of Huntington Beach. 3. The location, site layout, and design of the proposed use properly adapts the proposed structures to streets, driveways and other adjacent structures and uses in a harmonious manner. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated September 18, 1989 shall be the conceptually approved layout. 2. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material shall be disposed of at an off -site facility equipped to handle them. 3. Natural gas shall be stubbed in at locations of cooking facilities, water heaters and central heating units. 4. Low volume heads shall be used on all spigots and water faucets. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 89-55 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. CONDITIONAL EXCEPTION NO. 89-48 Applicant: Robert K. Copeland 9812 Rainier Circle Huntington Beach, CA 92646 ZA Minutes 10/11/89 -3- 5460h Request: A variance request to reduce the minimum dimension for open space to sixteen (16) feet in lieu of twenty-five (25) feet. Location: 9812 Rainier Circle Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1, California Environmental Quality Act, 1986 Staff reported that the applicant is adding to his existing single family residence which will reduce the minimum dimension for open space from 25 feet to 16 feet. This will cause the applicant to meet the open space requirement in two areas. Staff reported the applicant must have a minimum of 900 square feet of open space. Due to the lot's configuration staff stated that the applicant can provide areas of open space in the rear of the property meeting the overall code requirement for open space. Staff recommended approval. The public hearing was opened and Bob Copeland, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. CONDITIONAL EXCEPTION NO. 89-48 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The granting of a conditional exception to reduce the minimum dimension for open space to sixteen (16) feet in lieu of twenty-five (25) feet will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under identical zone classification. Although the minimum dimension is sixteen (16) feet in lieu of twenty-five (25) feet, over Seventeen Hundred (1,700) square feet of usable open space is being provided [Five -Hundred (500) square feet over the code mandated Twelve Hundred (1,200) square feet]. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location of surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The property is located on a cul-de-sac and the lot is pie shaped which provides a larger dimension across the rear of the property. With a reduced minimum dimension, adequate open space is provided behind the front yard setback and to the rear of the property. 3. The granting of a conditional exception for a reduction in the minimum dimension for open space is necessary to preserve the enjoyment of one or more substantial property rights. 4. The granting of a conditional exception for a reduction in the minimum dimension for open space will not be materially detrimental to the public welfare or injurious to property in the same zone classification. 5. The granting of a conditional exception for a reduction in the minimum dimension for open space will not adversely affect the general plan of the City of Huntington Beach.
