The following sub -committee reports were presented:
Commissioner Kirkland - reported action taken by the Design
Review Board at the October 12, 1989 meeting.
Commissioner Williams - Oil Committee met to discuss potential
secondary recovery drill sites.
Chairman Bourguignon - attended Oil Spill Seminar held in Santa
Barbara and presented details of the conference.

C. PUBLIC HEARING ITEMS
C-1 CODE AMENDMENT NO 88-12 AND NEGATIVE DECLARATION NO. 89-8
(CONTINUED FROM OCTOBER 3. 1989 PLANNING COMMISSION MEETING)
APPLICANT: CITY OF HUNTINGTON BEACH
At the September 6, 1989 Planning Commission meeting, considerable
discussion ensued regarding the creation of uses with nonconforming
parking based on the proposed changes to the parking standards. The
public hearing was continued to allow staff an opportunity to review
and revise, if necessary, the existing and proposed standards for
uses which do not comply with Article 960.
Staff prepared recommended changes which attempted to alleviate many
of the concerns raised. These recommended changes were not
discussed at the October 3 meeting; the item was continued to
October 17. Since that time staff has determined that the proposed
ordinance and suggested changes could be revised into a new format
to make the regulations more "user-friendly". A continuance would
allow staff time to make the modifications in format and bring the
item back to the Commission for discussion.
STAFF RECOMMENDATION:
Continue Code Amendment No. 88-12 and Negative Declaration No. 89-8
to the December 7, 1989 Planning Commission meeting.
Commission requested staff to prepare a matrix showing the Current
Code, Proposed Code and staff's recommendation on each proposed
change.

C-2 CONDITIONAL USE PERMIT NO. 89-43 (CONTINUED FROM OCTOBER 3,

Conditional Use Permit No. 89-43 was continued by the Planning
Commission on October 3, 1989, to allow time for the applicant to

submit a detailed proposed schedule of usage of`the church facility
and a letter of approval from the Oceanview School District for such
use. In addition, the Commission requested that staff analyze the
day care use currently in operation and make a recommendation for
hours of operation that will not result in a shortage of available
parking spaces.
Conditional Use Permit No. 89-43 is a request to establish the
Goldenwest Church of Christ in Rooms 16, 17, 19 and 20 of the closed
Parkview Elementary School. On September 6, 1989, the Planning
Commission approved Conditional Use Permit No. 89-32 for a child
care center in another portion of the same building. Section 9630
of the Huntington Beach Ordinance Code lists church uses as
unclassified, permitted in any district subject to conditional use
permit by the Planning Commission.
ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Class l(e),
Section 15301 of the California Environmental Quality Act.
STAFF RECOMMENDATION:
Approve Conditional Use Permit No. 89-43 with findings and
conditions of approval.
THE PUBLIC HEARING WAS OPENED
James King, 9532 Netherway Drive, representing the applicant, spoke
in support of the request and made himself available to answer any
questions:
There were no other persons present to speak for or against the
request and the public hearing was closed.
A condition requiring all parking at the facility to be on -site only
with street parking and parking at Murdy Park being prohibited was
requested by the Commission. The Commission also suggested a
condition regarding the expiration of the church's lease with the
school district. Since the lease is set to expire June 30, 1990,
they felt if the church chose to extend the lease and all conditions
of approval were met that Conditional Use Permit No. 89-43 should be
able to be extended administratively through the Community
Development Department.

FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the Goldenwest
Church of Christ will not be detrimental to the general welfare of
persons residing or working in the vicinity or to property and
improvements in the vicinity.
2. The granting of the conditional use permit for the church use will
not adversely affect the General Plan of the City of Huntington
Beach.
3. The proposed church is consistent with the goals and objectives of
the City's General Plan and Land Use Map.
4. The access to and parking for the proposed church use does not
create an undue traffic problem because adequate parking and
circulation are provided on site, and no excessive traffic will be
generated. Potential conflicts between different uses are avoided
due to no overlap in hours of operation.
CONDITIONS OF APPROVAL:
1. The site plan and floor plans received and dated August 28, 1989
shall be the approved layout.
2. The church shall be limited to rooms 16, 17, 19, 20, and adjacent
workroom of the school facility. Any expansion in the area shall
require approval by the Planning Commission.
3. The church shall be limited in its use of the facility in the
following manner:
a. Weekdays prior to 6:30 PM - a maximum of 26 vehicles at any
one time.
b. Weekdays after 6:30 PM - the church shall have full use of
the facility.
C. Weekends (Saturday and Sunmday) - the church shall have full
use of the facility.
4. Applicant shall obtain a business license from the City of
Huntington Beach prior to operation.
5. The Goldenwest Church of Christ shall comply with all applicable
provisions of the Ordinance Code, Building Division, and Fire
Department.
6. The applicant shall meet all applicable local, State and Federal
Fire Codes, Ordinances and standards.

7. All parking at the facility shall be on -site only. Street parking
and parking at Murdy Park shall be prohibited.
8. The Planning Commission reserves the right to revoke this
conditional use permit if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
9. Conditional Use Permit No. 89-43 shall expire at the end of the
church's lease with the school district, currently set at June 30,
1990. If the lease is extended and all conditions of approval are
met Conditional Use Permit No. 89-43 can be extended
administratively through the Community Development Department.
C-3 PRECISE PLAN OF STREET ALIGNMENT NO 89-3/ENVIRONMENTAL
ASSESSMENT NO 89-36 (CONTINUED FROM OCTOBER 3 1989 PLANNING
COMMISSION MEETING)
APPLICANT: City of Huntington Beach
LOCATION: Walnut Avenue between Main and Sixth Streets
This item was continued to the October 17, 1989 Planning Commission
meeting in order to allow staff to further analyze potential project
impacts.
The City Council adopted Circulation Element Amendment No. 84-1 on
June 4, 1984, establishing the general alignment of Walnut Avenue
between Lake and Sixth Streets. Precise Plan of Street Alignment
No. 86-1, establishing the precise alignment of Walnut Avenue, was
adopted October 27, 1986. This precise alignment reflects 80 foot
ultimate right-of-way requiring a 10 foot dedication on each side of
Walnut Avenue, to be required at the time adjacent properties are
redeveloped. Precise Plan of Street Alignment No. 89-3 proposes to
create a modified right-of-way width of 60 feet on Walnut Avenue from
Main to Sixth Street.
ENVIRONMENTAL STATUS:
Pursuant to the environmental regulations in effect at this time, the
Department posted draft Negative Declaration No. 89-36 for ten days,
and no comments either verbal or written were received. The staff, in
its initial study of the project, has recommended that a negative
declaration be issued.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve Negative
Declaration No. 89-36 and Precise Plan of Street Alignment No. 89-3
and recommend adoption by the City Council.

THE PUBLIC HEARING WAS OPENED
Sheryl Caverly, 201, 203 Main Street, spoke in support of the proposed
precise plan of street alignment.
Dianne Easterling, 203 Eighth Street, spoke in opposition to the
proposed plan. She feels it is inconsistent and will create problems
with a modified right-of-way width of 60 feet on Walnut Avenue from
Main to Sixth Street.
Bill Gallegos, 210 Fifth Street, spoke in support of keeping the 80
foot width. He feels the proposed parking structures will cause
bottlenecks if the streets are narrowed.
Susan Worthy, 128 Sixth Street, spoke in favor of keeping the streets
at 60 foot widths. She said major restoration will be done on her
property and a 60-foot street width is more desirable.
There were no other persons present to speak for or against the
proposed street alignment and the public hearing was closed.
The Commission discussed their previous action on the Precise Plan of
Street Alignment and agreed to take "no action". It was felt that
they should either table the item or make a motion to not rescind
their previous motion which clearly stated they recommended an 80 foot
width on Walnut Avenue.

C-4 CONDITIONAL USE PERMIT NO. 89-41
APPLICANT: MANOUCHEHR ZARDINEJAD
LOCATION: 19092 Beach Boulevard, Suite T
Conditional Use Permit No. 89-41 is a request to allow beer and wine
sales at an existing 825 square foot restaurant. The restaurant has
had an ABC license in the past under a different owner. Section
9636.1 of the Huntington Beach Ordinance Code requires conditional use
permit approval by the Planning Commission for alcohol sales at a
restaurant which is within 300 feet of a residence.

ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Section 1(e),
Class 15301, of the California Environmental Quality Act.
STAFF RECOMMENDATION:
Approve Conditional Use Permit No. 89-41 with findings and conditions
of approval.
THE PUBLIC HEARING WAS OPENED
Manouchehr Zardinejad, 8161 E. Marseillie Drive, applicant, spoke in
support of the request and agreed with all conditions of approval
imposed by staff.
There were no other persons present to speak for or against the
request and the public hearing was closed.

the existing restaurant will not create an undue traffic
problem. All parking requirements are met.
2. The proposed sale of beer and wine for on -site consumption at
the existing restaurant is compatible with the existing uses in
the area.
3. The proposed sale of beer and wine for on -site consumption at
the existing restaurant will not have a detrimental effect upon
the general health, welfare, safety and convenience of persons
working or residing in the neighborhood and will not be
detrimental to the value of property and improvements in the
vicinity.
4. The proposed sale of beer and wine for on -site consumption at
the existing restaurant will not be detrimental to the goals
and policies of the Huntington Beach General Plan.

CONDITIONS OF APPROVAL:
1. The site plan and floor plans received and dated September 18,
1989, shall be the conceptually approved layout.
2. The operating hours shall be Monday through Friday from 9:30 AM
to 7:00 PM, Saturday from 10:00 AM to 5:00 PM, and closed
Sunday. Any increase or change in hours shall require prior
approval by the Planning Commission.
3. The applicant shall obtain a license to sell alcoholic
beverages from Alcoholic Beverage Control prior to the sale of
alcoholic beverages. License shall be restricted to on -site
consumption only.
4. There shall be no tables placed outside of the store.
5. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
6. The Planning Commission reserves the right to revoke
Conditional Use Permit No. 89-41 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
C-5 CONDITIONAL USE PERMIT NO. 89-50
APPLICANT: ROCCO SARRACINO
LOCATION: 522 Main Street
Conditional Use Permit No. 89-50 is a request to permit the sale of
alcoholic beverages for on -site consumption in conjunction with a
proposed restaurant. Pursuant to Section 9636 of the Huntington
Beach Ordinance Code, the sale of alcoholic beverages requires a
conditional use permit.
ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Section
15301, Class 2, of the California Environmental Quality Act.
REDEVELOPMENT STATUS:
The proposed restaurant is within the Downtown Redevelopment area.
Redevelopment staff has indicated that the proposed restaurant/bar
use would be compatible with the existing and planned uses within
the Downtown Redevelopment Project area.
STAFF RECOMMENDATION:
Approve Conditional Use Permit No. 89-50 with findings and
conditions of approval.

THE PUBLIC HEARING WAS OPENED
Rocco Sarracino, applicant, spoke in support of the request. He
said he once attended a function at "The Greek Corner" that was held
upstairs and found it quite delightful and asked if this could ever
be allowed.
Bill Gallegos, 210 Fifth Street, welcomed Mr. Sarracino to the area
and spoke in support of the request.
There were no other persons present to speak for or against the
request and the public hearing was closed.
Staff suggested an added condition requiring approval by the Design
Review Board on any modifications to the exterior elevation.

sales for on -site consumption will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the
City's General Plan and Land Use Map. The restaurant/bar is a
permitted use within the Mixed Use designation of the Land Use
Element of the General Plan.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
September 25, 1989, shall be the conceptually approved layout.
Any modification to the exterior elevation must be approved by
the Design Review Board prior to issuance of any building
permits.

2. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
3. All alcohol beverage control requirements shall be met prior to
alcohol sales.
4. Live entertainment shall be prohibited unless a conditional use
permit for such entertainment is granted by the Planning
Commission.
5. All proposed signage shall be reviewed and approved by the
Design Review Board.
6. The Planning Commission reserves the right to revoke
Conditional Use Permit No. 89-50 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
C-6 SPECIAL SIGN PERMIT NO. 89-3
APPLICANT: MARK FRANK, SPESCO
LOCATION: 6952 Warner Avenue
Special Sign Permit No. 89-3 is a request for the installation of
two channel letter signs with almost twice the amount of square
footage as that which is permitted by code. Section 9610.5(b) of
the Huntington Beach Ordinance Code specifies the type, size and
number of attached signs allowed for the subject property. Where
the applicant wishes to exceed these standards, Section 9610.7 sets
forth the provisions for special sign permit review by the Planning
Commission.
ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Section
15311, Class 11, of the California Environmental Quality Act.
STAFF RECOMMENDATION:
Deny Special Sign Permit No. 89-3 with findings.
THE PUBLIC HEARING WAS OPENED
Gil Schauer, owner of the Trading Post at 6952 Warner, spoke in
support of the request. He discussed his interpretation of the
code. He was unclear to the definition of building frontage. He
said his store faces 2 streets, 2 parking areas with 2 entrances and
2 addresses and that he is taking down 5 signs to replace with 2
nice proportionate signs. He feels that according to his reading of
the code he is in compliance. He also expressed concern that as the
owner of the store he felt that he should have been notified.

Mark Frank, applicant, 701 Lakme Avenue, Wilmington, showed slides
of some nonconforming signs in the area and spoke in support of the
request. He presented new plans which would amend his application
now requesting two signs with a total of 126 square feet in lieu of
82.5 square feet by code.
Mark Miller, 4302 Pickwick, spoke in support of the request and read
into the records a letter from the landlord questioning staff's
recommendation for denial of the request.
There were no other persons present to speak for or against the
request and the public hearing was closed.
Discussion of the code requirements ensued and code violations
occurring at the site were pointed out and addressed. Commission
suggested a continuance and directed staff to review the code
requirements and sign examples discussed by applicant, and also
review the possible sign violations.

C-7 ZONE CHANGE NO. 89-4/NEGATIVE DECLARATION NO. 89-37
APPLICANT: CITY OF HUNTINGTON BEACH
LOCATION: 817 Oceanhill Drive
Zone Change No. 89-4 and Negative Declaration No. 89-37 constitute a
request to rezone one residential lot in the Oldtown area from
(Q)OTSP-2-0 (Qualified-Oldtown Specific Plan District 2-Combined
with Oil) to (Q)OTSP-2 (Qualified-Oldtown Specific Plan District
2). On September 6, 1989, the Planning Commission approved a
similar request to remove the -0 (combined with oil) suffix on
eleven (11) residential lots in the Oldtown area. The subject
parcel at 817 Oceanhill should also have the -0 suffix removed from
the zoning since it has been developed with a single family home,
and oil production no longer exists on the lot.

ENVIRONMENTAL STATUS:
Pursuant to the environmental regulations in effect at this time, the
Department of Community Development posted draft Negative Declaration
No. 89-.37 for ten days, and no comments, either verbal or written
were received. The staff, in its initial study of the project, has
recommended that a negative declaration be issued.
SPECIFIC PLAN:
The subject site is within the Oldtown Specific Plan area.
STAFF RECOMMENDATION:
Approve Negative Declaration No. 89-37 and Zone Change No. 89-3 with
findings and forward to City Council for adoption.

1. Staff was requested to investigate the feasibility of
drafting a letter to property owners in the
Ellis-Goldenwest area (Trotter Drive) advising them that
removal of any tree with greater than an 8-inch diameter
requires a permit.
2. Chairman Bourguignon was directed to send a memo to the
City Council requesting that Victor Leipzig be added to
the Huntington Beach Wetland Coalition, representing the
Planning Commission.
