REGULAR AGENDA ITEMS: WAIVER OF FINAL MAP TENTATIVE PARCEL MAP NO. 89-369 Applicant: Gene Springer Carl Brooks Incorporated 1366 Coronado Avenue Long Beach, CA 90804 Request: Waiver of Final Map for Tentative Parcel Map No. 89-369 to consolidate two (2) lots into one (1) parcel of land. Location: 15881 Chemical Lane Environmental This request is covered by Categorical Exemption, Status: Section 15305, Class 5, California Environmental Quality Act, 1986 Staff reported that the tentative map was approved one week ago and the applicant has met all Public Work's improvements and all required conditions of approval have been met. The request meets all requirements for a waiver. Staff recommended approval of the waiver of the final map. Gene Springer, applicant, was present and spoke in support of the request. WAIVER OF FINAL MAP FOR TENTATIVE PARCEL MAP NO. 89-369 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDING: FINDING OF APPROVAL FOR WAIVER: 1. The proposed waiver to consolidate lots 2 and 3 of Tract 8746 into one (1) parcel of land complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. ZA Minutes 10/25/89 -1- 5462h TENTATIVE PARCEL MAP NO. 89-338 Applicant: Harry G. Bovie 1216 Delaware Street Huntington Beach, CA 92648 Request: Consolidate two (2) lots into one (1) parcel Location: 609 California Street Environmental This request is covered by Categorical Exemption, Status: Section 15305, Class 5, California Environmental Quality Act, 1986 Staff reported that this is a request to consolidate two lots into one parcel. Staff stated that an existing single family dwelling and a detached garage will be removed as noted on the map and a new singly family residence will be built after the map has been approved. Staff stated that the applicant will be eligible for a waiver of the final map requirement. Staff recommended approval. Louie Hernandez, representing applicant, was present and spoke in support of the request. TENTATIVE PARCEL MAP NO. 89-338 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The proposed consolidation of two (2) lots into one (1) parcel for the purpose of residential use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for the Oldtown Specific Plan allowing residential development was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed consolidation are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on September 28, 1989 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. The alley shall be dedicated to City standards. All vehicular access rights along California Street and the alley shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator. 5. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 6. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. 7. All utilities shall be installed underground at the time said parcel is developed. 8. Compliance with all applicable City Ordinances. 9. Upon completion of the above conditions, the applicant may submit a request for the waiver of the final parcel map in conjunction with an eight and one-half (8 1/2) inch by an eleven (11) inch plat map. Upon the granting of the final map waiver by the Zoning Administrator, the applicant shall record a "Covenant To Hold Properties As One Parcel" and the approved plat map with the Orange County Recorder's Office. A copy of the recorded covenant shall be filed with the Department of Community Development prior to final inspection/issuance of building permits. USE PERMIT NO. 89-56 Applicant: Edriss Miskinyar 11672 Poes Street Anaheim, CA 92804 Request: To permit a mobile food cart at the entrance to the Home Depot for a maximum of 21 days as a temporary outdoor event. Location: 6912 Edinger Avenue Environmental This request is covered by Categorical Exemption, Status: Section 15311, Class 11, California Environmental Quality Act, 1986 Staff reported that this mobile food cart would be placed at the entrance of the Home Depot for 21 days which will consist of 10 consecutive weekends starting November 10, 1989 and ending January 3, 1990. Staff expressed concern along with the Fire Department and Public Works Department with regards to the cart being placed at the entrance of Home Depot. The Fire Department's concern was that when people line up for food at the cart, fire lanes may be blocked. Staff amended the applicant's request to move the cart to the east side of the entrance adjacent to the garden area which will move the crowd away from the entrance of Home Depot. The Fire Department had concerns with the revised location based upon the location of the loading area for the store. The Fire Department noted that this would cause a conflict with the fire lanes and the loading area. Staff also stated that a condition was added that the cart be removed from the premises every day. Staff recommended approval of the request as modified. The public hearing was opened. Edriss Miskinyar, applicant, spoke in support of the request. ZA Minutes 10/25/89 -3- 5462h 1 John Chow, Don Yu and Marta Bustamante, tenants in the center, spoke in opposition of the request stating that the food cart would take business away from their shops. The Zoning Administrator asked staff if one person owned the center. Staff replied that the center was under several owners but had one landlord. Staff added that Home Depot's representative submitted a letter authorizing the food cart be placed on -site. Staff stated that the applicant substantially complies with code for a temporary outdoor event, but the Home Depot was not having a special event to coincide with the food cart as is usually the case with temporary outdoor events. There was no one else present to speak for or against the request so the public hearing was closed. The Zoning Administrator continued the item to allow the applicant to work out any conflicts with the other tenants on -site and allow staff time to further check the code on the intent of temporary outdoor events. The Zoning Administrator also requested staff to get the City Attorney's opinion as to the intent and definition of a temporary outdoor event and if this request complies with the definition and intent of the code. USE PERMIT NO. 89-56 WAS CONTINUED TO NOVEMBER 1, 1989 BY THE ZONING ADMINISTRATOR. THE MEETING WAS ADJOURNED TO THE OCTOBER 30, 1989 STUDY SESSION BY THE ZONING ADMINISTRATOR.
