MINUTES: Minutes of the November 8, 1989 Zoning Administrator Meeting were
approved.

Request: To add a six hundred and eighty (680) square foot second story
room addition to an existing two thousand four hundred and ten
(2,410) square foot two story single family dwelling.

Environmental This request is covered by Categorical Exemption,
Status: Section 15301, Class 1, California Environmental Quality Act, 1986
Staff reported that this is a request to add a second story to an existing single story single
family residence. Staff stated that the request meets all the development standards of
the RI and CZ zone classification. Staff recommended approval of the request.
The public hearing was opened and Bill Lee, applicant, was present and spoke in support of
the request. There was no one else present to speak for or against the request so the
public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 89-35 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The proposed six hundred and eighty (680) sq. ft. second story room addition to a
two-story single family residence conforms with the plans, policies, requirements
and standards of the Coastal Element of the General Plan.

2. Coastal Development Permit No. 89-28 is consistent with the CZ suffix zoning
requirements, the RI Zoning District, as well as other provisions of the Huntington
Beach Ordinance Code applicable to the property.
3. At the time of occupancy, the proposed six hundred and eighty (680) sq. ft. second
story room addition to a two-story single family residence will be provided with
infrastructure in a manner that is consistent with the Coastal Element of the
General Plan.
4. The proposed six hundred and eighty (680) sq. ft. second story room addition to a
two-story single family residence conforms with the public access and public
recreation policies of Chapter 3 of the California Coastal Act.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated October 19, 1989 shall
be the conceptually approved layout.
2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
3. Proposed structures shall be architecturally compatible with existing structures.
4. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
S. Low -volume heads shall be used on all spigots and water faucets.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke Coastal Development Permit
No. 89-35 if any violation of these conditions or the Huntington Beach Ordinance
Code occurs.

Environmental This request is covered by Categorical Exemption,
Status: Section 15301, Class 1, California Environmental Quality Act, 1986
Staff reported that this is a major remodel of an existing single family residence. Staff
went on to state that the request meets the required R1 and CZ zoning classification's
development standards except the bay windows may not project into the side yard as
designed. Staff stated that the projections must be modified to eliminate floor area from
projecting into the side yard and that the applicant concurred with staffs
recommendation. Staff also stated that the site is below site coverage. Staff
recommended approval.
The public hearing was opened and Richard Anderson, applicant, was present and spoke in
support of the request. He stated that the dining room projecting bay window would be
removed and the bedroom bay window would be modified to meet the code. There was no
on else present to speak for or against the request so the public hearing was closed.

(1,294) sq. ft. to an existing two story single family residence conforms with the
plans, policies, requirements and standards of the Coastal Element of the General
Plan.

b. The architectural features (bay windows) shall be modified to eliminate any
floor area. A cross section of the proposed bay windows shall be provided.
2. Prior to issuance of building permits, the following plans shall be submitted to the
Community Development Department:
a. Two (2) sets of revised plans as modified in Condition No. 1.

3. The Fire Department requirements are as follows:
a. Provide an automatic fire sprinkler system throughout the sturcture per Fire
Department standards.
b. Upgrade domestic water services to a two (2) inch fire service connection.

WAIVER OF FINAL MAP
TENTATIVE PARCEL MAP NO. 88-409

Request: Waiver of Final Map and Condition No. 8 for Tentative Parcel Map
No. 88-409 to consolidte two and one-half (2 1/2) lots into two (2)
lots for residential development.

Environmental This request is covered by Categorical Exemption,
Status: Section 15305, Class 5, California Environmental Quality Act, 1986
Staff reported that this is a request to waive the condition for a final map of Tentative
Parcel Map No. 88-409 and a request to waive the final map. Staff stated that after
review of the tentative parcel map requirements for a waiver, it was determined that the
request does comply with Subdivision Section 992 to waive the final map. Staff noted that
Condition No. 8 requiring the final map was also a part of the request.
The applicant was not present but did inform staff prior to the meeting that he concurred
with staff recommendation.

CONDITION NO. 8 WAS WAIVED TO ALLOW A WAIVER OF FINAL MAP FOR
TENTATIVE PARCEL MAP NO. 88-409 BY THE ZONING ADMINISTRATAOR WITH THE
FOLLOWING FINDING:
FINDING OF APPROVAL FOR WAIVER:
1. The proposed waiver to consolidate Lots 8, 10 and the Southern one-half of Lot 12
of block 611 of Huntington Beach Tract, 17th Street Section into two (2) parcels of
land complies with the requirements as to area, improvement and design, flood and
water drainage control, appropriate and approved public roads, sewer and water
facilities, environmental protection, and other requirements of Article 992 of the
Subdivision Section of the Ordinance Code.
CONDITIONAL EXCEPTION NO. 89-52

Request: To construct a solar room attached to the house that projects
thirty (30) inches onto the projecting deck pursuant to the
windscreen provisions [Section 9110.11(d)]. The variance is to fully
enclose the solar room in lieu of the requirement [Section
9110.11(d)(1)] that one side of any structure on the projecting deck
be open eighty (80%) percent.

Environmental This request is covered by Categorical Exemption,
Status: Section 15301, Class 1, California Environmental Quality Act, 1986
Staff stated that the proposed project is a request to construct a solar room pursuant to
the windscreen provision of the code. Staff reported that as required by code, the
proposed solar room may project beyond the bulkhead if one side of the room is open 80
percent. The applicant is requesting to enclose the sides of the room but maintain sliding
glass doors on each side of the room. Staff stated that if approved at the Zoning
Administrator's level, it will be "in concept only" because that portion of the proposed
solar room that projects across the bulkhead is in the ultimate jurisdiction of the
California Coastal Commission.. Staff recommended approval
The public hearing was opened and Kenneth Bourguignon, applicant, was present and spoke
in support of the request. There was no one else present to speak for or against the
request so the public hearing was closed.
Staff stated that this request would be sent to the California Coastal Commission as an
"in concept only" proposal. If approved at the Coastal Commission, a code amendment
will be drafted by the City of Huntington Beach to permit this type of development.
CONDITIONAL EXCEPTION NO. 89-52 WAS APPROVED IN CONCEPT ONLY BY THE
ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. Because of special circumstances applicable to the subject property, including size,
shape, location and surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by other properties in the
vicinity and under identical zone classifications. The property is located at the end
of a cul-de-sac street adjacent to a public waterway and has an irregular shape.

2. The granting of Conditional Exception No. 89-52 to fully enclose the solar room in
lieu of the requirement that one side of any structure on a projecting deck be open
80% is necessary in order to preserve the enjoyment of one or more substantial
property rights.
3. The granting of Conditional Exception No. 89-52 to fully enclose the solar room in
lieu of the requirement that one side of any structure on a projecting deck be open
80% will not be materially detrimental to. the public welfare, or injurious to
property in the same zone classifications.
4. The granting of Conditional Exception No. 89-52 to fully enclose the solar room in
lieu of the requirement that one side of any structure on a projecting deck be open
80% will not adversely affect the General Plan of the City of Huntington Beach.
5. The applicant is willing and able to carry out the purposes for which Conditional
Exception No. 89-52 is sought and he will proceed to do so without unnecessary
delay.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated October 20, 1989 shall
be the conceptually approved layout.
2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
3. Proposed structures shall be architecturally compatible with existing structures.
4. The proposed solar room addition shall maintain all three sliding doors, including the
existing sliding glass door located between the house and the solar room.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke Conditional Exception No.
89-52 if any violation of these conditions or the Huntington Beach Ordinance Code
occurs.
NOTE Approval is " In -Concept" only. The project is within the original
jurisdiction of the California Coastal Commission; therefore, the Coastal
Commission's approval is required prior to issuance of building permits.
