ORAL COMMUNICATIONS John Fisher, 6692 Shetland Circle, expressed his concerns with the request to accept conveyance of property formerly used as the Orange County Transfer Station from the County to the City for park purposes (Item A-2). He feels the transaction will create a "financial Jonas" that the future homeowners will have to swallow. He feels the land swap is being initiated to speed up downtown development and urged the Commission to take a closer look at the acquisition. He recommended that the City urge the County to maintain the park and suggested an estimate be prepared on the maintenance and the cost that will be spent on the linear park over the years. Paul Weatherly, 7622 Talbert Avenue, urged the Commission to approve his extension of time request (Item D-1). PUBLIC HEARING ITEMS C-1 CODE AMENDMENT NO 88-12/NEGATIVE DECLARATION N0. 89-8 (CONTINUED FROM NOVEMBER 7. 1989 PLANNING COMMISSION MEETING) APPLICANT: CITY OF HUNTINGTON BEACH LOCATION: City-wide This item was continued from the November 7, 1989 Planning Commission public hearing. The final draft has been revised to include the language pertaining to uses with nonconforming parking as presented October 3, 1989. The Code Amendment has been revised in accordance with Planning Commission comments from the many study sessions. The final draft also has been reviewed by Fire and Public Works Departments. Code Amendment No. 88-12 is a request by Planning staff to revise/amend the Huntington Beach Ordinance Code and Downtown Specific Plan to update and revise parking regulations and landscape provisions. STAFF RECOMMENDATION: As a result of the study session held at 5:30 PM staff recommended that the Planning Commission continue Negative Declaration No. 89-8 and Code Amendment No. 88-12 to a 5:30 PM study session, Tuesday, December 5, 1989, and then to the regular meeting at 7:00 PM. A MOTION WAS MADE BY WILLIAMS, SECOND BY LEIPZIG, TO CONTINUE CODE AMENDMENT NO. 88-12 AND NEGATIVE DECLARATION NO. 89-8 TO A 5:30 PM STUDY SESSION, TUESDAY, DECEMBER 5, 1989, AND THEN TO THE REGULAR MEETING AT 7:00 PM, BY THE FOLLOWING VOTE: AYES: Shomaker, Kirkland, Williams, Bourguignon, Ortega, Mountford, Leipzig NOES: None ABSENT: None ABSTAIN: None MOTION PASSED C-2 CODE AMENDMENT NO 89-10 (CONTINUED FROM NOVEMBER 7, 1989 PLANNING COMMISSION MEETING) APPLICANT: CITY OF HUNTINGTON BEACH Code Amendment No. 89-10 is a request by Community Development Department to amend, update, and renumber Article 972, Environmental Regulations. PC Minutes - 11/21/89 -3- (4294d) Code Amendment No. 89-10 is intended to revise and update the environmental regulations to implement policies of the City Council and the California Environmental Quality Act. The code amendment also proposes to renumber the article to facilitate the future completion of the Division 9 rewrite. STAFF RECOMMENDATION: Approve Code Amendment No. 89-10 with findings and forward to the City Council for adoption. THE PUBLIC HEARING WAS OPENED There was no one present to speak for or against the code amendment and the public hearing was closed. After discussion on the proposed changes to the code the Commission suggested a continuance to incorporate the following: change committee name to Environmental Assessment Committee; indicate composition of Committee (department director or his designee); change language in Section 9704,allowing the discretionary body to amend an environmental impact report; and require phased monitoring for projects developed in more than one period of time; specify time period (10 days suggested) for appeals. FINDINGS FOR APPROVAL: 1. Code Amendment No. 89-10 creates regulations consistent with the California Environmental Quality Act and the policies of the City Council. 2. Code Amendment No. 89-10 establishes procedures to ensure developments will comply with the goals and policies of the General Plan and State law. Staff was also directed to investigate the phrasing of process for phased projects and to bring the code amendment as modified back as a "D Item" before forwarding it to the City Council. C-3 CONDITIONAL USE PERMIT NO, 89-54 APPLICANT: YADMAR, INC. LOCATION: 16400 Pacific Coast Highway - Suite 103 (Peter's Landing) Conditional Use Permit No. 89-54 is a request to operate live entertainment at an existing restaurant pursuant to Section 9241(b) of the Huntington Beach Ordinance Code. Cafe Bristol, located in the Peter's Landing complex, is oriented with its main entrance facing the water and a rear door facing the parking lot and Pacific Coast Highway. While the business has had entertainment in the past, the applicant is a new owner and the code specifies that the required conditional use permit is non -transferable. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Section 15301, Class 1, of the California Environmental Quality Act. COASTAL STATUS• Appealable zone, but project is categorically excluded pursuant to Section 989.5.3.13(f) of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Approve Conditional Use Permit No. 89-54 with findings and conditions of approval. PC Minutes - 11/21/89 W-M (4294d) THE PUBLIC HEARING WAS OPENED Chip Harvey, representing Peter's Landing and the restaurant manager, spoke in support of the request. He requested that approval be given for three musicians that would play until 1:00 PM. He said recent sound studies had been completed (using one of the adjacent neighbor's living room to set up the equipment) and the the decibels received were in an acceptable range. He said complaints received by Peter's Landing were usually regarding the Red Onion and not Cafe Bristol and that dancing was not permitted at this particular establishment and it would not be encouraged. Mike Alford, Broadmoor Homes, said he has been conducting his own sound studies for two years from his home which is across the water from this establishment. He said Cafe Bristol's speakers are too loud and feels the speaker system and number of entertainers should be limited. There were no other persons present to speak for or against the request and the public hearing was closed. It was suggested that a condition be added to include a review after three months of operation and if any noise complaints should be received regarding the live entertainment the applicant shall pay for the cost of a sound study to be conducted by the Orange County Department of Environmental Health. A MOTION WAS MADE BY ORTEGA, SECOND BY WILLIAMS, TO APPROVE CONDITIONAL USE PERMIT NO. 89-54 WITH FINDINGS AND ADDED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Shomaker, Mountford, NOES: None ABSENT: None ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL: Kirkland, Williams, Bourguignon, Ortega, Leipzig 1. The establishment, maintenance and operation of live entertainment (live music for listening without dancing) will not be detrimental to the general welfare of persons residing or working in the vicinity. 2. The use will not be detrimental to property and improvements in the vicinity. PC Minutes - 11/21/89 -6- (4294d) 1 3. The combination and relationship of one use (live entertainment without dancing) to another use (restaurant) on site are properly integrated. 4. The proposal is consistent with the City's General Plan of Land Use which designates this site as Visitor Serving Commercial. CONDITIONS OF APPROVAL: 1. The site plan and floor plans received and dated November 3, 1989, shall be the conceptually approved layout. 2. Live music shall be limited to a maximum of one musician and performances shall be limited to 9:00 PM to 12:00 Midnight each day. 3. No dancing shall be permitted. 4. Exterior doors shall remain closed during all performances. 5. The proposed use shall comply with all applicable Fire and Building codes, including Chapter 33 of the Uniform Building Code. 6. Fire Department requirements are as follows: a. Maintain 44-inch aisle width and handicapped facility. b. Obtain proper permits if additional electrical is required in entertainment area. c. Maintain exiting, fire protection equipment and housekeeping, as stated in previous citation documents to former business owner. 7. The proposed live entertainment shall comply with Chapter 8.40 "Noises" of the Huntington Beach Municipal Code. Should complaints be received regarding noises generated by the live entertainment, the Planning Commission reserves the right to require the applicant to mitigate the noise level. 8. This conditional use permit shall be non -transferable. 9. The primary use of the building shall be dining and the sale of food; live entertainment shall be a secondary use. 10. No outside tables shall be permitted. 11. An entertainment permit shall be submitted and approved prior to the establishment of the live entertainment within the restaurant. A copy of said permit shall be submitted to the Department of Community Development to be included in the Conditional Use Permit file. PC Minutes - 11/21/89 -7- (4294d) 12. The use shall be subject to review by the Planning Commission after three operational months for possible modification to conditions of approval regarding hours and number of musicians, based on business operation. Said review shall be a public hearing with notice to all property owners within 300 feet of parcel. 13. Should noise complaints be received regarding the live entertainment, the applicant shall pay for the cost of a sound study to be conducted by the Department of Environmental Health, County of Orange. 14. The Planning Commission reserves the right to revoke Conditional Use Permit No. 89-54 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 15. Conditional Use Permit No. 89-54 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Community Development Department a minimum of 30 days prior to the expiration date. C-4 CONDITIONAL USE PERMIT NO, 89-37/NEGATIVE DECLARATION NO. 89-29 APPLICANT: HOAG MEMORIAL HOSPITAL LOCATION: 19582 Beach Boulevard Conditional Use Permit No. 89-37 is a request to construct a 53,110 square foot medical office building pursuant to Section 9220.1 of the Huntington Beach Ordinance Code. ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time, the Department of Community Development posted draft Negative Declaration No. 89-29 for ten days, and no comments, either verbal or written were received. The staff, in its initial study of the project, has recommended that a negative declaration be issued. STAFF RECOMMENDATION: Approve Negative Declaration No. 89-29 and Conditional Use Permit No. 89-37 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED A representative from Hoag Memorial Hospital spoke in support of the request. He said that all conditions of approval are acceptable. With the suggested condition regarding the "green acres" provision I he requested that staff provide him with estimated user fees. A MOTION WAS MADE BY WILLIAMS, SECOND BY LEIPZIG, TO APPROVE CONDITIONAL USE PERMIT NO. 89-37 AND NEGATIVE DECLARATION NO. 89-29 WITH FINDINGS AND AMENDED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Shomaker, Kirkland, Williams, Bourguignon, Ortega, Mountford, Leipzig NOES: None ABSENT: None ABSTAIN: None MOTION PASSED 1. The location, site layout, and design of the proposed 53,110 square foot medical office building properly adapts the proposed structures to streets, driveways and other adjacent structures and uses in a harmonious manner. 2. Access to and on -site parking for the proposed 53,110 square foot medical office building does not create an undue traffic problem. 3. The granting of Conditional Use Permit No. 89-37 for a 53,110 square foot medical office building is consistent with the designated zoning and will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations dated received November 8, 1989, shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Submit three copies of the site plan to the Planning Division for addressing purposes. If street names are necessary, submit proposal to Fire Department for review and approval. b. Depict all utility apparatus, such as but not limited to backflow devices and Edison transformers, on the site plan. They shall be prohibited in the front and exterior yard setbacks unless properly screened by landscaping or other method as approved by the Community Development Director. Floor plans shall depict natural gas and 220V electrical shall be stubbed in at the location of clothes dryers; natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units; and low -volume heads shall be used on all spigots and water faucets. d. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. e. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). f. Elevations shall depict colors and building materials proposed. g. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. h. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations. i. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. j. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 1 PC Minutes - 11/21/89 -10- (4294d) 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plant materials (location, type, size, quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Section 9608 of the Huntington Beach Ordinance Code. The set must be approved by both departments prior to issuance of building permits. Any existing mature trees that must be removed shall be replaced at a 2 to 1 ratio with minimum 36-inch box trees, which shall be incorporated into the project's landscape plan. b. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. c. Hydrology and hydraulic studies shall be submitted for Public Works approval. d. All applicable Public Works fees shall be paid. e. Perimeter fencing plans for review and approval which depict decorative materials. f. The applicant shall provide an irrevocable offer to dedicate reciprocal access between the subject site and adjacent properties and to participate in a common driveway with Newland Center. A copy of the legal instrument shall be approved by the Community Development Department and the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development. 4. The Public Works Department requirements are as follows: a. Construct all required City and CalTrans public improvements. b. On -site water system shall be dedicated to the City of Huntington Beach and facilities shall be located in vehicular travelways. PC Minutes - 11/21/89 -11- (4294d) 5. c. on -site sewer is private. d. An on -site sewer and water utility plan shall be provided on City mylar. e. Drainage flow direction shall be approved by the City and Caltrans. f. The developer will be responsible for the payment of any additional fees adopted in the "upcoming" Water Division Financial Master Plan. g. Landscape irrigation system shall be designed and constructed to include a separate water line for the use of reclaimed water. Fire Department Requirements are as follows: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. b. A Class III wet standpipe system (combination) will be installed to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. c. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: (1) Manual Pulls (2) Water flow, valve tamper and trouble detection (3) 24 hour supervision (4) Smoke Detectors (5) Annunciation (6) Audible Alarms d. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. e. Three fire hydrants will be installed prior to combustible construction. Shop drawings will be submitted to the Public Works Department and approved by the Fire Department prior to installation. PC Minutes - 11/21/89 -12- (4294d) f. Elevators will be sized to accommodate an ambulance gurney. Minimum 6' 8" wide by 4'3" deep with minimum of 42" opening. g. Fire lanes will be designated and posted to comply with Huntington Beach Fire Department Standard No. 415. h. Address numbers will be installed to comply with Huntington Beach Fire Code Standards. The size of the numbers will be the following: (1) The number for the building will be sized a minimum of ten (10) inches with a brush stroke of one and one-half (1-1/2) inches. (2) Individual units will be sized a minimum of four (4) inches with a brush stroke of one-half (1/2) inch. i. Dimensions for Fire Access. Includes 24' or 27' fire lanes, turnarounds and 17' by 45' radius turns. j. Submit to the Fire Department for approval a Fire Protection Plan containing requirements of Fire Department Specification #426. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 9. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 10. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site; b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05% by weight) for construction equipment; PC Minutes - 11/21/89 -13- (4294d) d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 11. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 12. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be completed: a. A Parcel Map shall be accepted by the City Council. It shall be recorded with the County Recorders Office and a copy submitted to Planning Division prior to approval of a Certificate of Occupancy. b. Compliance with all conditions of approval specified herein shall be accomplished. 13. Should a Traffic Impact Fee be adopted by the City Council, the applicant/property owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval. C-5 VESTING TENTATIVE TRACT MAP NO, 14122/NEGATIVE DECLARATION NO. 89-55 APPLICANT: WALDEN AND ASSOCIATES LOCATION: Southwest corner of Main Street and Sixth Street. Vesting Tentative Tract Map No. 14122 is a request to subdivide Lot 1 of Tract 12900 vertically and horizontally into two lots to separate the commercial and residential portions of the Townsquare project, pursuant to Section 9990.3 of the Huntington Beach Ordinance Code. All requirements for submittal of a vesting map have been met, as previous entitlements for the Townsquare project have been approved by the City. ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect the Department of Community Development posted draft Declaration No. 89-55 for ten days, and no comments, or written were received. The staff, in its initial project, has recommended that a negative declaration at this time, Negative either verbal study of the be issued. It will not increase the density or intensity of use of the land, and is therefore exempt from Coastal Development Permit processing requirements pursuant to Section 989.5.1 of the Huntington Beach Ordinance Code. REDEVELOPMENT STATUS: The project is located within the Main -Pier Redevelopment Project Area. STAFF RECOMMENDATION: Approve Negative Declaration No. 89-55 and Vesting Tentative Tract Map No. 14122 with findings and conditions of approval. The size, depth, frontage, street width, and other design features of the proposed vertical and horizontal subdivision for two lots are in compliance with the standard plans and specifications on file with the City as well as in compliance with the State Subdivision Map Act and the supplemental City Subdivision Ordinance. 2. The property was previously studied for this intensity of land use at the time that the General Plan designation of Mixed Use- Commercial/Office/Residential and Downtown Specific Plan - District 6 zoning were implemented; and at the time Tract 12900 was approved for Mixed Use development. The General Plan has set forth provisions for Mixed Use development at this site as well as setting forth objectives for the implementation of this type of use. 4. The site is physically suitable for the proposed mixed use development. 5. Vesting Tentative Tract No. 14122 complies with the provisions of Article 999 (Vesting Tentative Maps) of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL: 1. The tentative tract map received and dated September 14, 1989, shall be the approved layout, with the following modification: a. Show typical cross sections of Main Street, Sixth Street, and private street. 2. Public Works requirements are as follows: a. Conditional Use Permit No. 87-51 was a request to construct a 42,000 square foot, two-story auto repair shop. Conditional Exception (Variance) No. 87-84 was a request to allow off -site circulation in lieu of on -site circulation as required by Section 9605(b) of the Huntington Beach Ordinance Code. The applicant was previously granted a one-year extension of time by the Planning Commission on November 15, 1988, due to the lengthy structural plan check process and delays in concluding financial arrangements for the project. However, because the applicant is involved in litigation activity in Orange County Superior Court, it has continued to prevent him from funding the project.
