ZONING ADMINISTRATOR: Michael Strange STAFF MEMBERS: Herb Fauland MINUTES: Minutes of the January 3, 1990 Zoning Administrator Meeting were approved. REGULAR AGENDA ITEMS: COASTAL DEVELOPMENT PERMIT NO. 89-44 Applicant: Brion S. Jeannette 470 N. Newport Boulevard Newport Beach, CA 92663 Request: Demolish existing single family residence and build a new 4,355 sq.ft. two story single family residence. Location: 4061 Morningstar Drive (Huntington Harbour). Environmental This request is covered by Categorical Exemption, Status: Section 15303, Class 3, California Environmental Quality Act, 1986 Staff reported that the existing/proposed residence is adjacent to a water way and that the proposal meets all development standards of the RI and CZ requirements. Staff stated that the request also meets site coverage requirements of fifty—five (55%) percent. Staff recommended approval of the project subject to conditions and findings for approval. The public hearing was opened and Brion S. Jeannette, applicant, was present and spoke in support of the request. Mr. Jeannette submitted a copy of a letter from the Huntington Harbour Home Owners Association which gave their approval of the proposed project. Staff notified the applicant that the request to demolish the existing residence would require a demolition permit from the Department of Community Development. There was no one else present to speak for or against the request so the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 89-44 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The demolition of an existing single family residence and construction of a new 4,355 sq.ft. two story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. F 2. Coastal Development Permit No. 89-44 is consistent with the CZ suffix zoning requirements, the RI Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed demolition of an existing single family residence and construction of a new 4,355 sq.ft. two story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed demolition of an existing single family residence and construction of a new 4,355 sq.ft. two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 21, 1989 shall be the conceptually approved layout. 2. All proposed docks and ramp improvements shall require separate permits for the improvements located within the public waterways. 3. All proposed cantilevered deck improvements require separate permits for the improvements. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off —site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low —volume heads shall be used on all spigots and water faucets. 8. The applicant shall submit a grading plan and soils report for review and approval to the Public Works Department prior to issuance of building permits. 9. The applicant shall pay all applicable Public Works fees. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 89-44 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ZA Minutes of 1/10/90 —2— (4544d) USE PERMIT NO. 89-71 Applicant: Alan T. Holmes Carl Karcher Enterprises 222 S. Harbor Boulevard Anaheim, California 92805 Request: To permit the construction of a 124 square foot drive-thru window. Location: 21532 Brookhurst Street (Carl's Jr.) Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1, California Environmental Quality Act, 1986 Staff reported that the applicant's request to remodel/reconfigure the drive-thru lane at the subject restaurant is in conformance with commercial standards and requirements. Staff stated that the existing site provides adequate on -site parking and landscaping. Staff informed the applicant that all signs and banners will require a separate permit prior to installation. Staff further stated that the departments of Public Works and Fire expressed no comments or concerns regarding the request. The Zoning Administrator reviewed photographs of the site as well as elevations of the proposal. The public hearing was opened and Alan T. Holmes, applicant, was present and spoke in support of the request. The applicant also informed the Zoning Administrator that the proposed drive-thru window would be used strictly as a "cash window" in addition to the existing "food service window." The applicant stated that the additional window would speed up the waiting time for the customer as well as provide for more sanitary conditions. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 89-71 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The construction a 124 square foot drive-thru window will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 89-71 to construct a 124 square foot drive-thru window addition will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposed addition of a 124 square foot drive-thru window addition is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. All proposed signage requires separate permit and shall be in compliance with Article 961 (Signs) of the Huntington Beach Ordinance Code. S. USE PERMIT NO. 89-73 Applicant: Carl G. Lans 21821 Fairlane Circle Huntington Beach, CA 92646 Request: To construct a blockwall with wrought iron a maximum 5'-6" in height within the front yard setback pursuant to Section 97710) of the Huntington Beach Ordinance Code. Location: 19812 Gloucester Lane Environmental This request is covered by Categorical Exemption, Section Status: 15301, Class 1, California Environmental Quality Act, 1986 Staff reported that a building permit was issued to the applicant's client on November 27, 1989 allowing construction of a blockwall at the subject address. Staff also stated that a stop work order was issued because the proposed fence did not comply with the approved site plan. Staff further stated that the approved plans showed a fifteen (15') foot setback but the wall was built at a zero (0) foot front yard setback. Staff reported that safety concerns exist with the two (2) abutting driveways, compatibility with the surrounding neighborhood and the size, height, and width of the pilasters. Staff notified the Zoning Administrator that an on —site inspection revealed that no other walls in the neighborhood were built at a zero (0) foot front yard setback. The Zoning Administrator inquired from staff as to whether any comments had been received from other City departments. Staff replied that no comments were received. Staff reported that due to safety issues, height and location of the wall and the lack of compatibility with the surrounding area, staff is recommending denial of the proposed request as submitted. Staff requested that the structure be modified to meet the zoning requirements for fences in the front yard setback. ZA Minutes of 1/10/90 —4— (4544d) C The public hearing was opened. Carl G. Lans, applicant, was present and spoke in support of the request. The Zoning Administrator reviewed photographs of the wall. Discussion between the applicant and Zoning Administrator ensued regarding safety issues, height and location of the wall. There was no one else present to speak for or against the request so the public hearing was closed. The Zoning Administrator stated that his decision to continue this item was based on a desire to conduct an on —site inspection of his own and to speak with the City Traffic Engineer to determine whether the Public Works Department had concerns with possible traffic/safety impacts. USE PERMIT NO. 89-73 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE NEXT MEETING OF WEDNESDAY, JANUARY 17, 1990.
