ZONING ADMINISTRATOR: Michael Strange STAFF MEMBERS: Herb Fauland, Don Dooley MINUTES: Minutes of the January 10, 1990, Zoning Administrator Meeting were continued to the January 24, 1990 Zoning Administrator Meeting. REGULAR AGENDA ITEMS: ITEM 1: USE PERMIT NO. 89-73 Applicant: Carl G. Lans 21821 Fairlane Circle Huntington Beach, CA 92646 Request: To construct a blockwall with wrought iron a maximum 5'-6" in height within the front yard setback pursuant to Section 9771(1) of the Huntington Beach Ordinance Code. Location: 19812 Gloucester Lane Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1, California Environmental Quality Act, 1986 Herb Fauland presented the staff report. He stated that this item was continued from the January 10, 1990 Zoning Administrator meeting to allow the Zoning Administrator to visit the subject property and to discuss safety concerns regarding vehicular and pedestrian traffic with the Public Works Department. Staff gave an overview of the request and maintained a recommendation of denial based upon vehicular and pedestrian safety concerns, incompatibility with surrounding neighborhood and that the request would set a precedent in the area. Staff recommended denial based upon findings. THE PUBLIC HEARING WAS OPENED Mr. Carl Lans, the applicant, was present and urged the Zoning Administrator to approve the request. He said the request was not for a 5'6" block wall but is a request to construct a 2' high block wall with wrought iron and light standard structures above. There were no other persons to speak for or against the request and the public hearing was closed. The Zoning Administrator said he had visited the site and felt the wall to be excellent craftmanship and would be an asset to the property and neighborhood. Based upon his determination that no safety concerns exist and that it would not be detrimental to the surrounding neighborhood, the Zoning Administrator stated he would approve the request. USE PERMIT NO. 89-73 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS. FINDINGS FOR APPROVAL: 1. The construction of a blockwall with wrought iron a maximum 5'-6" in height at a zero (0) front yard setback will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The construction of a blockwall with wrought iron a maximum 5'-6" at a zero (0) front yard setback in height is consistent with the goals and objectives of the City's General Plan and Land Use Map. 3. The location site layout and design of the proposed blockwall with wrought iron a maximum of 5'-6" in height at a zero (0) front yard setback properly adapted the proposed structure to streets, driveways and other adjacent structures and uses in a harmonious manner. As designed, the structure will not cause any vehicular and pedestrian conflicts because adequate vision is provided with the wrought iron openings in the blockwall structure. In addition, the proposed structure will be compatible with the existing single family neighborhood and surrounding area. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan and elevations received and dated December 22, 1989, shall be the conceptually approved layout. 2. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material shall be disposed of at an off -site facility equipped to handle them. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. ZA MINUTES -2- (4584d) 3. The Zoning Administrator reserves the right to revoke Use Permit No. 89-73 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 2: SITE PLAN AMENDMENT NO. 89-8 Applicant: Investment Concepts, Inc. Eric M. Brown 777 S. Main Street, Suite 161 Orange, California 92613 Request: To construct a maximum six (6) foot high blockwall, enclose twenty-nine (29) carports with garage doors and provide security gates between the existing apartment buildings. Location: 17861-17932 Bell Circle (Huntington Sands Apartments) Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1, California Environmental Quality Act, 1986 Herb Fauland presented the staff report with a recommendation for approval with findings and conditions of approval. He said the request to enclose the garages substantially complies with the Security Ordinance Code. Staff also stated that the blockwall request complies with code requirements and that the proposed security gates between the existing apartment buildings shall not obstruct any driveways or alleys. In addition, the security gates shall comply with the Fire Department requirment specification no. 403 for emergency access. Staff requested the applicant to submit a detailed site plan which indicates the location of the security gates for review, approval and inclusion in the subject file. Eric Brown, representing the applicant, was present to answer any questions of staff. He concurred with staffs recommendation and indicated that all Fire Department requirements shall be met. SITE PLAN AMENDMENT NO. 89-8 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed revision does not constitute a substantial change. 2. The proposed revision does not change the use of the property. 3. The revision results in an improved development. 4. The revision does comply with all applicable provisions of the Huntington Beach Ordinance Code. ZA MINUTES -3- (4584d) SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations dated December 12, 1989 shall be the conceptually approved layout with the following modification: A. An amended site plan shall be submitted which indicates the location of the proposed security fences for review and approval and inclusion in the subject file. 2. The Fire Department requirements are as follows: a. The security gates shall comply with City specification No. 403. b. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. All building spoils, such as unusable limber, wire pipe and other surplus or unusable material shall be disposed of at an off -site facility equipped to handle them. 4. The Public Works requirement is that all driveways and alleys be kept free and clear for access. 5. The applicant shall obtain all necessary permits for the proposed blockwall, garage improvements and security gates. 6. The development shall comply with all applicable provisions of the Huntington Beach Ordinance Code, Building Division and Fire Department. ITEM 3: USE PERMIT NO. 89-74 Applicant: John & Mary Miller 705 Delaware Street Huntington Beach, CA 92648 Request: To permit a 192 square foot addition to an existing single family residence with nonconforming setbacks and convert an existing enclosed patio into a two (2) car garage with nonconforming setbacks. Location: Environmental Status: 705 Delaware Street This request is covered by Categorical Exemption, Section 15301, Class 1, California Environmental Quality Act, 1986 ZA MINUTES -4- (4584d) Don Dooley presented the staff report. Staff reported that the request was to add 192 square feet to an existing single family residence with nonconforming setbacks and covered parking. Staff reported that the existing single family residence is constructed over an existing property line and would normally require a parcel map. It was determined by staff that because the proposed addition is not greater than one third the value of the existing single family residence, a parcel map is not required. Staff did recommend that a covenant to hold the two parcels as one be recorded with the County of Orange. In addition, staff stated that the existing enclosed patio will be converted into a two car garage which will meet code required on -site parking. Based upon the applicants ability to provide on -site parking, record a covenant and meet all other code requirements, staff recommended approval of the request. THE PUBLIC HEARING WAS OPENED The applicants, Mr. & Mrs. Miller, were present and urged the Zoning Administer to approve the project. There were no other persons to speak for or against the request and the public hearing was closed. USE PERMIT NO. 89-74 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and construction of a 192 square foot addition to an existing single family residence with non -conforming setbacks and the conversion of an enclosed patio into a two (2) car garage will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity since the addition and alteration is minor in nature. 2. The granting of Use Permit No. 89-74 to construct a 192 sq.ft. room addition to an existing single family residence with non -conforming setbacks and convert an enclosed patio into a two (2) car garage will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposed addition and construction of a 192 sq. ft. addition to an existing single family residence with non -conforming setbacks and conversion of an enclosed patio into a two (2) car garage is consistent with the goals and objectives of the City's General Plan and Land Use Map. ZA MINUTES -5- (4584d) 4. Approval of Use Permit No. 89-74 will permit an existing single family residence without on -site parking to convert an existing enclosed patio into a two (2) car garage and meet current parking requirements per Article 9606(B)(3) of the Huntington Beach Ordinance Code. 5. The location, site layout, and design of the proposed addition and proposed two -car garage properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 6. The access to and parking for the existing single family dwelling and proposed.two-car garage will not create an undue traffic problem. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 28, 1989, shall be the conceptually approved layout. 2. The garage wall, 2'-4" from the property line, shall have a one (1) hour construction fire wall with no openings, and be provided with a parapet wall pursuant to Building Department standards and specifications. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. Proposed addition shall be architecturally compatible with the existing structures. 5. Prior to the issuance of a building permit, the property owner shall sign, notarize and record with the County Recorder a Covenant to hold lots 3 & 4 of Block 704 of the Vista Del Mar tract under common ownership and submit a copy of the recorded document for inclusion in the subject file. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 89-74 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
