A tape recording of this meeting is on file in the.City Clerk's Office. The Mayor called the Special. Meeting of the City Council of the 'City 'of Huntington Beach to order pursuant to Huntington Beach City Charter Section 303(b) - an emergency affecting the public peace, health or safety. Mayor Mays stated that the city has. had a major oil spill on February 7, 1990 of upwards of 400,000'gallons of oil off the shores of Huntington Beach ema- nating from an oil tanker's mooring attempts to off load oil. He stated that oil had been spread over the waters and it threatens to destroy and damage the fish, the wildlife, the beaches, and waters of Huntington Beach. PRESENT: Winchell, Green, Mays, Silva ABSENT:. MacAllister, Bannister, Erskine The Mayor requested the City Clerk to read focal Resolution No. 1990-1 (6113) Requesting Director, Office of Emergency Services, Concurrence in Local Emergencies, into the record in full as`follows: LOCAL RESOLUTION REQUESTING DIRECTOR, OFFICE OF' EMERGENCY SERVICES, CONCURRENCE IN LOCAL EMERGENCIES - 1990-1 WHEREAS, ON February 7, at 7:25 p.m., 1990, the City Council of the City of Huntington Beach found that. due to an oil spill from an off=loading oil tanker attempting to drop anchor, a condition of extreme peril to life and property did exist in the. City of Huntington Beach.: during the period February 7, at 7:25 p.m., 1990; and WHEREAS, in accordance with state law the City Council now declares an emergency did exist throughout said city; NOW, THEREFORE, it is hereby declared and ordered that a copy, of this declaration be forwarded to the State Director.of the Office of Emergency Ser- vices with a request that that he find it acceptable in accordance with provi- sions of the Natural Disaster Assistance Act; and IT IS FURTHER RESOLVED that Raymond Picard, Director of Civil Defense, City of Huntington Beach is hereby designated as the authorized representative of the City of Huntington Beach for the purpose of receipt, processing, and coordination of all inquiries and requirements necessary to obtain available state assistance, 20rl Page 2 - Special Council Minutes - 2/7190 The Mayor reported on the oil. spill and announced the measures being taken. He then requested the Fire.Chief to give Council additional background. The Fire Chief presented an extensive report on.ihe oil spill.. Bill Reed, Public Informations Officer, presented a''report to Council and Supervisor Harriett Mieder spoke regarding the.County's functions. A motion was. made by Mays, seconded Silva, to adopt Local Resolution No. 1990-1 (5113). The motion passed by the.following roll call vote AYES: Winchell, Green, Mays, Silva NOES: None ABSENT: MacAllister, Bannister, Erskine The Mayor requested the City Clerk to read Resolution No. 1990-2 (6114) into the record in full as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REQUESTING THE CONCURRENCE OF THE STATE DIRECTOR OF THE OFFICE OF EMERGENCY SERVICES IN DECLARING A LOCAL EMERGENCY-.1990-2 WHEREAS, on February 7, at 7:25 p.m., 1990, the City Council of the City of Huntington Beach found that due to an oil spill from an oil tanker off the coast of Huntington Beach, a condition of extreme peril to:life and property did exist in the City of Huntington Beach during the period of February 7 - 28, 1990; and In accordance with state law, the City Council now declares an emergency did exist throughout said city. NOW. -THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that a copy of this declaration be forwarded to the state Director of Office of Emergency Services with a request that he find it acceptable in accordance with provisions of the Natural Disaster Assistance Act; and BE IT FURTHER RESOLVED that Raymond Picard, Director of Civil Defense, is hereby designated as the authorized 'representative of the City of Huntington Beach for the purpose of receivingg, processing and coordinating all inquiries and requirements necessary to obtain available.state assistance.. A motion was made by Mays. second Green, to adopt Resolution No. 19904 (6114). The motion carried by the following vote: AYES: Winchell, Green. Mays, Silva NOES: None ABSENT: MacAllister, Bannister, Erskine The Mayor requested the City Clerk to read Resolution No. 1990-3 (6115) into the record in full as follows: RESOLUTION REQUESTING GOVERNOR TO PROCLAIM A STATE OF EMERGENCY - 1990-3 WHEREAS, on February 7. at 7:25 p.m., 1990, the City Council of the City of Huntington Beach found that due to an oil spi11 from an oil tanker off the coast of Huntington Beach, &'condition of extreme peril to life and property did exist in the City of Huntington Beach; and .202 e Page 3 - Special Council Minutes - 2/7/90 r] 1 WHEREAS, .in accordance with state law the City Council declared an emergency did exist throughout said city; and WHEREAS, it has now been found that local resources are unable to cope with the effects of said emergency; NOW, THEREFORE, it is hereby. declared and ordered that a copy of this declaration be forwarded to the Governor of California with the request that he proclaim the City of Huntington Beach to be a State of Emergency; and IT IS FURTHER ORDERED that a copy of this declaration be forwarded to the State Director of the Office of Emergency Services; and IT IS FURTHER RESOLVED that Raymond Picard,.Civil Defense Director of the City of Huntington Beach is hereby designated as the authorized representative for. public assistance and Richard Barnard, acting City Administrator, are herebydesignated as the authorized representatives for individual assistance of the City of Huntington Beach for the purpose of.areceipt processing and coordination of all inquiries and requirements necessary to obtain available state and federal. assistance. A motion was made by Mays, 'second Green, to adopt Resoluti.on No. 1990-3 (6115). The motion carried by the following vote; AYES: Winchell, Green, Mays, Silva NOES: None ABSENT: MacAllister, Bannister, Erskine Mayor.
