MINUTES: Minutes of the February 14, 1990 Zoning
Administrator Meeting were approved by the
Zoning :Aministrator as submitted.
REGULAR AGENDA ITEMS:
ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 90-2:
Applicant: James Tyler Architects

Request: To construct a 720 square foot second story
addition to an existing single story single family
residence,
Location:- 4002 Ondine Circle (Hun t-ington Harbour).
Coastal Status: APPEALABLE
Herb Fauland presented the staff report. The request is to
construct a 720 square foot second story addition to an existing
single family residence. He said Lhs request meets City Code and
Coastal Zone requirements. An existing awning located within the
interior side yard setback will ae removed due to the lack of an
approved building permit for the awning. Mr. Fauland reported that
an adjacent neighbor had reviewed the plans and had no objection to
the request. He recommended approval with findings and conditions.
THE PUBLIC HEARING WAS OPENED
Murray Ross, the applicant was present, and concurred with staff's
recommendation.
There were no other persons to speak for or against the request and
the Public Hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 90-2 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
(10) DAYS AND WITHIN ANOTHER TEN ('10) DAYS TO THE COASTAL
COMMISSION.
FINDINGS FOR APPROVAL/COASTAL'DEVELOPMENT PERMIT NO. 90-2:
1. The construction of a 720 square foot second story addition to
an existing single story single family residence conforms with
the plans, policies, requirements and standards of The Coastal
Element of the General Plan.
2. Coastal Development Permit No. 90-2 is consistent with the CZ
suffix zoning requirements•, the Rl Zoning District, as well as
other provisions of the' Huritingcon Beach OrdYnance Code
applicable z)b ;.he proper-ty.,
3. At the time ui occa:ja :cv. , ::ire piopGsed construction of a 720
square foot second story addition zo an existing single story
single family residence will be provided with infrastructure
in a manner that is consistent with the Coastal Element of the
General Plan.
4. The construction of a 720 square foot second story addition to
an existing single.story single-family residence conforms with
the public access and'public recreation policies of Chapter 3
of.the California Coastal act:
SPECIAL CONDITIONS 07 APPROVAL:
1. The site plan dated February C,.199u and the floor plans, and
elevations=-_ceivbd, and: dated January 5, 1990 shall be the
conceptually , appro ,red, layout
2. All proposed docks and ramp improvements shall require''
separate permits for'the improvements located within the
public waterways.'
3. All proposed cantilevered deck improvements require separate -
permits for the improvements.
4. All building spoils., such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.

5. Proposed structures shall be architecturally compatible with
existing structures,'
6. Natural gas shall be stubbed in.at the locations of cooking
facilities, water heaters, -and central heating units.
7. Low -volume hea&s shail be used on all spigots and water
faucets.
8. The applicant shall pay all applicable Public Works fees.
9. The existing enclosed awning located along the southerly
interior property line shall be removed and or modified to
meet the interior side yard setbacks prior to issuance of
building permits.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code. Building Division, and Fire Department.
2. The applicant shall meet all applicable local,.State, and
Federal Fire Codes, Ordinancas, and standards.
3. The Zoning Administrator reserves the right to revoke Coastal
Development Permit No: 90-2 if any violation of these
conditions or the Huntington Beach Ordinance.Code occurs.
ITEM 2: CONDITIONAL EXCEPTION (.VARIA-MCL) NO. ^50-3

FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 90-3:
1. There are exceptional or extraordinary circumstances or
conditions applicable to the land, the irregular shape of the
.lot and the premises involved that do not apply generally to
other property or uses in the'same district. The subject
property is zoned Oldtown Specific Plan and has approximately
twenty-one (21).feet of lot width along the rear lot line which
prohibits the construction of a standard 19 foot wide two (2)
car garage -to the rear of the property for alley access.
2. The granting of Cond-L'tional Exception (Variance) No. 90-3 for
the construction of tko (2) t:rree ;3). story- single family
residence with variance to inferior `Jideyacd setback for a two
car garage is necessary in order to preserve the enjoyment of
one or more substantial property rights.
3. The granting of Conditional Exception (Variance) No. 90-3 for
the construction of two (2) Three (3) story single family
residence with variance to interior sideyard setback for a two
car garage will not be materially detrimental to the public
health, safety and welfare; or injurious to the land, property
or improvements in the neighborhood.

6. The granting of Conditional Axception (Variance) No. 90-3 for
the construction of two :(2) "three 1,3) ,ptory single family

car garage will not adversely afteCt the General Plan of the
City of Huntington Beach.
7. The applicant is willing and able to carry out the purposes for
which Conditional Exception jVariance') No. 9073 is sought and
will proceed to do so without unnecessary delay.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
February 24, 1990 shall -be the conceptually approved plans for
607 Frankfort Avenue.,
2. The site plan dated S•anuary 17, 1990, the floor plans and
elevations received dated.February 3, 1990 shall be the
conceptually approved plans for•605 Frankfort Avenue.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
4. Proposed structures ,hall be architecturally compatible with
existing structures.'

ITEM 3: CONDITIONAL EXCEPTION NO. 90-9
Applicant: WLA Arcon, Inc.

Request: To permit a 4'-0" wide landscape planter in lieu of a
6'-0" wide -landscape planter as required by Section
9510.13 of the Huntington Beach Ordinance Code.
Location: Northwest corner of Talbert Avenue and Brookshire Lane
Herb Fauland reported that a conditional use permit for the Elk's
Lodge was approved by. the Planning Commission; however as a
condition of approval a conditional exception (variance) for the
landscape planter was required. Staff recommended that the
applicant redesign the -drive aisle width to 25 feet which would
provide the additional 2 'Leet"for the landscape planter.
THE PUBLIC HEARING WAS O?EWED
Warren Lortie, the applicant, withdrew the conditional exception
request advising he would redesign the drive aisle.
There were no other persons to speak for or against the request and
the Public Hearing was closed.
