ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: Herb Fauland MINUTES: The Minutes of the February 28, 1990 Zoning Administrator Meeting were continued to the March 14, 1990 Zoning Administrator Meeting. REGULAR AGENDA ITEMS: ITEM 1: USE PERMIT NO.90-5: Applicant: Gracie La Nguyen Huntington Beach Lawnmower 21036 Brookhurst Street Huntington Beach, California 92646 Request: To permit outdoor storage of lawnmowers and lawnmower parts. Location: 21036 Brookhurst Street Herb Fauland presented the staff report. He said the request was continued from the February 28, 1990 Zoning Administrator meeting to allow the applicant additional time to come up with a design plan to screen the storage of lawnmowers and lawnmower parts. The applicant had not submitted new plans; therefore, staff recommended denial due to outside storage not being compatible in a commercial zone. THE PUBLIC HEARING WAS OPENED. Mr. Nguyen was present and spoke in support of the request. He said the lawnmowers are stored outside while waiting for parts on order. Also, he had signed a five year lease and the owner of the property had told him he could store lawnmowers outside. There were no other persons present to speak for or against the request and the public hearing was closed. The Zoning Administrator approved the request with conditions of approval to construct a 8 foot wall compatible with the existing store to screen the storage area. USE PERMIT NO. 90-5 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS. FINDINGS FOR APPROVAL - USE PERMIT NO. 90-5: 1. The establishment, maintenance and operation of the proposed outside storage of lawnmowers and lawnmower parts will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 90-5 to permit the outside storage of lawnmowers and lawnmower parts will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposed request to permit the outside storage of lawnmowers and lawnmower parts is consistent with the goals and objectives of the City's General Plan and Land Use Plan. CONDITIONS OF APPROVAL - USE PERMIT NO. 90-5: 1. The site plan and floor plan received and dated February 7, 1990, shall be the conceptually approved layout with the following modifications: a. The applicant shall submit a blockwall plan for screening purposes a maximum 8'-0" high along the areas used for outside storage. b. Proposed blockwalls shall be architecturally compatible with existing structures. 2. The applicant shall restripe the three (3) parking stalls located on the north side of the proposed storage area. 3. The applicant shall not display any lawnmower parts, lawnmowers or any merchandise for sale or customer pick-up along the sidewalk or adjacent to the commercial building. 4. All signs shall be brought into compliance with the Huntington Beach Ordinance Code prior to final building permit inspection. ZA Minutes - 3/7/90 -2- (5115d) 5. The major identification sign shall be removed or altered to comply with Article 961 within ninety (90) days of the approval date. 6. All repair work shall be conducted wholly within the building. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. A review of the use shall be conducted within (6) months of the date of this approval to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If at that time, there is a violation of these conditions or code sections, Use Permit No. 90-5 may become null and void. 9. A trash enclosure shall be constructed pursuant to Section 9730.60 of the Huntington Beach Ordinance Code. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire.Codes Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 90-5 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2• COASTAL DEVELOPMENT PERMIT NO, 90-4: Applicant: Richard Anderson 128 S. Glassell Avenue Orange, California 92666 Request: To permit a 1,441 square foot addition to the existing first and second story with a 175 square foot addition to the existing second floor deck. Location: 16602 Somerset Lane (Huntington Harbour). Herb Fauland presented the staff report. He said the item was continued from the February 28, 1990 Zoning Administrator meeting in an effort to allow the applicant and abutting property owner time to devise a design plan which'would address concerns regarding obstruction of view and privacy. A revised plan was submitted with a redesign of the deck and staff recommended approval with conditions. ZA Minutes - 3/7/90 -3- (5115d) THE PUBLIC HEARING WAS OPENED. Mr. Anderson reviewed the revised plans and urged approval of the request. Mr. Kakimoto, 3762 Seascape Drive, spoke in opposition to the request. Mr. Kakimoto's main concern with the request is the proposed deck provides a clear view of his back yard pool and that the proposed setback for the addition would be in violation of the CC&R's. The Zoning Administrator advised Mr. Kakimoto that the City does not enforce CC&R's and the revised request complies with the zoning code. There were no other persons to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 90-4 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS AND WITHIN ANOTHER TEN (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 90-4: 1. The request to permit a 1,441 square foot addition to an existing two story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 90-4 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the addition of 1,441 square feet to an existing two story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed addition of 1,441 square feet to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March 7, 1990 shall be the conceptually approved layout. 2. The applicant shall submit two (2) sets of modified plans to be included in the subject file. ZA Minutes - 3/7/90 -4- (5115d) 1 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 4. All proposed cantilevered deck improvements require separate permits for the improvements. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. 7. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. Low -volume heads shall be used on all spigots and water faucets. 9. The Public Works Department requirements are: a. Repair and replace curb and gutter, driveway and sidewalk. b. Water service shall be upgraded pursuant to Public Works standards. C. The applicant shall pay all applicable Public Works fees. 10. The Fire Department requirements are: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code standards. b. Smoke detectors shall be installed pursuant to Huntington Beach Fire Department standards. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Gialketsis 16151 Santa Barbara Lane Huntington Beach, California 92649 Request: Remodel and addition of 438 sq.ft. to an existing two story single family residence. Location: 16271 Mandalay (Huntington Harbour). Herb Fauland reported that the proposed request meets all R-1 and coastal zone development standards and recommended approval with the standard findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Mr. Gialketsis reported that the remodel is consistent with the surrounding neighborhood as several homes in the area had constructed the same addition. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 90-8 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS AND WITHIN ANOTHER TEN (10) DAYS TO THE COASTAL COMMISSION. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 90-8 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ZA Minutes - 3/7/90 -7- (5115d) ITEM 4: USE PERMIT NO. 90-7 Applicant: Pat's Ski & Sport Shop Michael J. Anderson 8909 Adams Avenue Huntington Beach, California 92646 Request: Temporary Outdoor Event to permit Pat's Ski & Sport Shop ski sale on March 9, 10, 11, 1990. Location: 8909 Adams Avenue Herb Fauland reported that the proposed outdoor event would take place in two tents located in the parking lot. The tents would not block any drive aisles or fire lanes. Staff recommended approval with the standard findings and conditions of approval. The applicant agreed to all the conditions of approval. USE PERMIT NO. 90-7 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 90-7 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated January 23, 1990 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. The event shall not block any existing driveways. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). ZA Minutes - 3/7/90 -8- (5115d) 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant's request shall include necessary permits for balloons and temporary signs. 7. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 8. The Police Department requirements are: a. Outside overnight storage of merchandise requires a security guard. b. Sales shall be conducted within the existing store. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. ITEM 5: USE PERMIT NO. 89-7 Applicant: American Restaurants Corporation Mr. Ron Brett 5528 Everglades Street Ventura, California 93003 Request: One-year extension of time Location: 5942 E. Edinger Numbers 101 and 114 Herb Fauland reported that Use Permit No. 89-7 was approved for the establishment of a restaurant. Due to a change or ownership, the new owners are requesting an extension of time. In response to a question by the Zoning Administrator, the applicant agreed to a six month extension of time. A SIX MONTH EXTENSION OF TIME WAS APPROVED FOR USE PERMIT NO. 89-7 BY,THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS. ZA Minutes - 3/7/90 -9- (5115d) SPECIAL CONDITIONS OF APPROVAL: 1. The extension of time for Use Permit No. 89-7 shall expire on September 19, 1990. 2. All previous conditions of approval for Use Permit No. 89-7 shall remain in effect. ITEM 6: USE PERMIT NO, 90-8 Applicant: Sears, Roebuck and Co., Outlet Bruce Winslow 9045 Adams Avenue Huntington Beach, California 92646 Request: Temporary outdoor event to permit Sears Outlet sale on March 15, 16, 17, 1990. Location: 9045 Adams Avenue Herb Fauland reported that the request includes a canopy to be used for the display of sale items located in the parking lot. He said all the fire lanes and drive aisles will be maintained. Staff recommended approval with the standard findings and conditions of approval. The applicant's representative, Ms. Miller, agreed to all the conditions of approval. USE PERMIT NO. 90-8 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL.
