ZONING ADMINISTRATOR: Michael Strange STAFF MEMBER: MINUTES• REGULAR AGENDA ITEMS: Herb Fauland The Minutes of the March 14, 1990 Zoning Administrator Meeting were approved as submitted. ITEM 1: COASTAL DEVELOPMENT PERMIT NO 90-5/ENVIRONMENTAL ASSESSMENT NO. 90-8 Applicant: City of Huntington Beach Public Works Department 2000 Main Street Huntington Beach, California 92648 Request: Construction of storm drains, catch basins, sewer pipes and the relocation of man holes. Location: 6th Street - Pacific Coast Highway to Walnut Avenue; Walnut Avenue - 6th Street to 3rd Street. Herb Fauland reported that this is a request for public works improvements in the coastal zone and therefore requires discretionary approval. Staff stated that a negative declaration has been prepared and the mitigation measures are included in the conditions of approval. Staff recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Randall Wampler, property owner, asked to review the proposed plans. There were no other persons present to speak for or against the request and the public hearing was closed. Steve Kriger, representing Public Works Department, was available to answer questions. DRAFT NEGATIVE DECLARATION NO. 90-8 AND COASTAL DEVELOPMENT PERMIT NO. 90-5 WERE APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS AND WITHIN ANOTHER TEN (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL: 1: The proposed construction of storm drains, catch basins, sewer pipes and the relocation of manholes conform with the plans, policies, requirements and standards of the C-LUP. 2. The proposed construction of storm drains, catch basins, sewer pipes and the relocation of manholes are consistent with the CZ suffix and the base zoning district as well as qther provisions of the Huntington Beach Ordinance Code applicable to the property. 3. The proposed construction of storm drains, catch basins, sewer pipes and the relocation of manholes will provide - infrastructure in a manner that is consistent with C-LUP. 4. The proposed construction of storm drains, catch basins, sewer pipes and the relocation of manholes will conform with the public access and public recreation policies of Chapter 3 of the California Coastal Act. Adequate access to the beach from Pacific Coast Highway is provided. 5. Any negative impact from the displacement of parking spaces by the construction of storm drains, catch basins, sewer pipes and the relocation of manholes is being mitigated by replacing the parking spaces at a one to one ratio as the need warrants. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated January 25, 1990 shall be the conceptually approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. During cleaning, grading, earth moving or excavation, the applicant shall: a. Control fugitive dust by regular watering, paving construction roads, or other dust preventive measures. b. Maintain equipment engines in proper tune. 4. During construction, the applicant shall: a. Use water trucks or sprinkler systems to keep all areas where vehicles move damp enough to prevent dust raised when leaving the site. b. Wet down area in the late morning and after work is completed for the day. ZA Minutes - 3/21/90 -2- (5244d) C. Use low sulfur fuel (.04k% by weight) for construction equipment. d. Phase and schedule construction activities to avoid high ozone days (first stage smog alerts). e. Discontinue construction during second stage smog alerts. 5. Construction shall be limited to Monday - Saturday 7:00 a.m. to 8:00 p.m. Construction shall be prohibited Sundays and Federal holidays. 6. Prior to initiation of construction, police and fire departments shall be notified and the departments shall be kept informed about duration and extent of construction throughout the process. 7. Public Works Department shall provide alternate routes for traffic during the construction phase, if necessary. Adequate signage shall be provided to warn motor vehicles, bicyclists and pedestrians of construction. 8. Should parking spaces be displaced by the improvement plan, parking shall be replaced at a one to one ratio as the improvements are implemented and the replacement of parking spaces is warranted. FORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. ITEM 2: COASTAL DEVELOPMENT PERMIT NO, 90-9: Applicant: Frank Jao 3322 Devon Circle Huntington Beach, California 92649 Request: To permit the remodel and addition to an existing 2,228 square foot single story single family residence. The remodel consist of 696 square feet to the first floor and the addition consists of a new 2,512 square foot second story. Location: 3322 Devon Circle (Admiralty Island, Huntington Harbour). Herb Fauland reported that the request is for an addition and remodel to an existing single family home. Staff stated that the request is within the height limit and meets the zoning code requirements for the R1 and CZ development standards. Staff recommended approval with findings and conditions of approval. ZA Minutes - 3/21/90 -3- (5244d) The Zoning Administrator reviewed the plans. THE PUBLIC HEARING WAS OPENED. John Cowles, representing the applicant, agreed to the conditions of approval. There were no other persons to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 90-9 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS AND WITHIN ANOTHER TEN (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO, 90-3: 1. The remodel and addition to an existing 2,228 square foot two story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 90-9 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the remodel and addition to an existing 2,228 square foot two story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed remodel and addition to an existing 2,228 square foot two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated February 20, 1990 shall be the conceptually approved layout. 2. All proposed docks and ramp improvements shall require separate permits for the improvements located within the public waterways. 3. All proposed cantilevered deck improvements require separate permits for the improvements. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. ZA Minutes - 3/21/90 -4- (5244d) 5. Proposed structures shall be architecturally compatible with existing structures. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. The Public Works Department requirements are: a. Water service shall be upgraded pursuant to Public Works standards. b. The applicant shall pay all applicable Public Works fees. 9. The Fire Department requirements are as follows: a. Automative sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Codes Standards. Minimum 2 inch domestic fire service required. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 90-3 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: LOT LINE ADJUSTMENT NO. 90-1A Applicant: Walden and Associates Paul E. Reichardt 18012 Cowan, Suite 210 Irvine, California 92714 Request: To adjust the property lines between (Assessor Parcel No. 023-181-33 & 34) Lot 22, 23 and A of Tract 13821. Location: 6471, 6481 Morningside Drive Herb Fauland reported that Lot A located between lots 22 and 23 is for the purpose of access to an oil island for maintenances purposes and future access to a golf course. Staff noted that lot A is no longer needed for the access to the oil island and the plans for the golf course access are no longer required. The request was reviewed ■ by the City Engineer. Staff recommended approval with findings and conditions of approval. Paul Reichardt, the applicant, was present to answer questions. ZA Minutes - 3/21/90 -5- (5244d) LOT LINE ADJUSTMENT NO. 90-1A WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS. FINDINGS FOR APPROVAL: 1. The lot line adjustment will not create a nonconforming parcel. 2. The lot line adjustment will not create a nonconforming yard requirement. 3. The lot line adjustment will not sever existing structures on the two lots. CONDITIONS OF APPROVAL A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Lot Line Adjustment received by the Department of Community Development on March 5, 1990 shall be the approved layout. 2. Monuments for the newly -established property lines shall be readjusted in compliance with the Subdivision Map Act. A record of survey shall be completed to verify the location of the newly placed monuments. 3. Said plat map shall be recorded with the County recorder prior to the issuance of a certificate of compliance for the structure and/or structures upon subject properties. A copy of the recorded document shall be submitted to the Department of Community Development for the file. 4. All previous conditions of approval for Tract Map No. 13821, Zone Change No. 88-9 and Conditional Use Permit No. 88-18 shall remain in effect. 5. The applicant shall remove drive approach and replace with curb, gutter and sidewalk.
