ZONING ADMINISTRATOR: Michael Strange STAFF MEMBERS: Herb Fauland MINUTES: Minutes of the March 28, 1990 Zoning Administrator Meeting were approved. REGULAR AGENDA ITEMS: COASTAL DEVELOPMENT PERMIT NO. 90-12 Applicant: Mr. Mike Whelan 13470 Dalewood Street Baldwin Park, CA 91706 Request: To demolish an existing 1,657 square foot single story single family residence and rebuild a new 5,266 square foot two-story single family residence. Location: 3492 Gilbert Drive (Gilbert Island, Huntington Harbour). Environmental- This request is covered by Categorical Exemption, Status: Section 15303, Class 3, California Environmental Quality Act, 1986 This item was continued from the March 28, 1990 Zoning Administrator meeting to allow the applicant time to revise the site plan (indicating changes to the rear setback for the balcony and site coverage) to bring the request into conformance with code requirements. Herb Fauland reported that the request is to demolish an existing home and rebuild a new residence. Staff further stated that the requested changes had been made and the project met all code requirements. Staff requested that two sets of the revised plans be submitted to the Department of Community Development prior to issuance of a building permit. Based upon the revisions, staff recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Mike Whelan, project applicant, was present and spoke in support of the request. Bob Helfer, adjacent property owner, was present and expressed concern that the proposal did not meet Huntington Harbour Homeowner's Association CC&R's. Herb Fauland stated that the City would not be enforcing the CC&R's. It will be the responsibility of the applicant and Homeowner's Association to reach an agreement. Mike Whelan, applicant, stated that he would work with the Association and abide by the established CC&R's. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 90-12 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMIVIISSION WITHIN TEN (10) DAYS; WITHIN ANOTHER TEN (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 90-12: 1. The request to demolish an existing single family residence and rebuild a new 5,266 square foot two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 90-12 is consistent with the CZ suffix zoning requirements, the RI Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed 5,266 square foot two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed 5,266 square feet two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 2, 1990 shall be the conceptually approved layout with the following modifications: a. The site plan and floor plans shall indicate a maximum site coverage of 55%. 2. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 3. All proposed cantilevered deck improvements require separate permits for the improvements. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. ZA Minutes of 4/4/90 -2- (5398d) 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. The Public Works Department requirements are: a. Repair and replace curb and gutter, driveway and sidewalk as needed. b. Water service shall be upgraded pursuant to Public Works standards. C. The applicant shall pay all applicable Public Works fees. d. Submit grading plan and soils report for review and approval. e. Contact Parks, Tree and Landscaping about trees located in parkway. 10. The Fire Department requirements are: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code standards. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 90-12 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. USE PERMIT NO. 90-13 Applicant: Stephen L. Mac Gregor 606 Huntington Street Huntington Beach, California 92648 Request: To permit a 200 square foot addition to an existing two car garage with a non -conforming interior sideyard setback of 2'-0" in lieu of the code required 3'-01'. The proposal also includes a 575 square foot roof deck above the garage. Location: 606 Huntington Street Environmental This request is covered by Categorical Exemption, Status: Section 15301, Class 1, California Environmental Quality Act, 1986 Herb Fauland reported that the request is to construct a 200 square foot addition to provide a laundry and storeroom within an existing garage. The request requires the use ZA Minutes of 4/4/90 -3- (5398d) permit process because the existing garage is provided with a non —conforming sideyard setback. Staff displayed photos of the proposal and stated that the request meets all code requirements. Staff further stated that a two and one—half (2 1/2') foot alley dedication will be required as well as other requirements established by the Department of Public Works. Staff recommended approval of the project with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Stephen Mac Gregor, project applicant, was present and spoke in support of the request. The applicant expressed concern with several of the conditions required by Public Works (i.e., repair of curb and gutter, abandonment of existing water service and construction of new water service). Mr. Mac Gregor stated that he considered some of the conditions to be inaccurate and had spoken with the Public Works Department. The applicant requested a two week continuance to allow him time to speak with Public Works regarding his concerns and to clarify the required conditions of approval. The Zoning Administrator stated that he would agree to a continuance of the item. USE PERMIT NO. 90-13 WAS CONTINUED BY THE ZONING ADMINISTRATOR FOR TWO WEEKS. THE PUBLIC HEARING WAS LEFT OPEN.
