Meeting were approved as submitted.

Request: To permit a 200 square foot addition to an existing two car garage
with a non -conforming interior side yard setback of 2'-0" in, lieu of
the code required 3'-0". The proposal also includes a 575 square
foot roof deck above the garage.

Status: Section 15301, Class 1, California Environmental Quality Act, 1986.
This item was continued from the Zoning Administrator meeting of April 4, 1990 to allow
the applicant time to work with the Public Works Department to resolve discrepancies in
their conditions of approval.
Herb Fauland, staff planner, reported that the request is to allow a 200 square foot
addition to an existing two car garage. Staff stated that the applicant would not be in
attendance at today's public hearing but that the Department of Public Works had revised
their conditions. Staff stated that the project met all code requirements and
recommended approval of the request with findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED
The applicant was not present.
There were no persons present to speak for or against the request and the public hearing
was closed.
USE PERMIT NO. 90-13 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
FINDINGS AND CONDITIONS OF APPROVAL. ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
(10) CALENDAR DAYS.
FINDINGS FOR APPROVAL/USE PERMIT NO. 90-13:
1. The establishment, maintenance and operation of the addition of two hundred (200)
sq. ft. to an existing two (2) car garage with a non —conforming interior side yard
setback will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2. The granting of Use Permit No. 90-13 to add two hundred (200) sq. ft. to an existing
two (2) car garage with a non —conforming interior side yard setback will not
adversely affect the General Plan of the City of Huntington Beach.
3. The proposed addition of two hundred (200) sq. ft. to an existing two (2) car garage
with a non —conforming interior side yard setback is consistent with the goals and
objectives of the City's General Plan and Land Use Map.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated March 13, 1990 shall be
the conceptually approved layout.
2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off —site facility equipped to handle them.
3. Proposed structures shall be architecturally compatible with existing structures.
4. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
5. Low —volume heads shall be used on all spigots and water faucets.
6. The Public Works requirements are as follows:
a. Dedicate a 2 1/2 foot alley dedication and construct all Public Works
improvements.
7. All proposed building walls setback at 2'-0" from property line shall be constructed
with one (1) hour construction and no openings pursuant to Building Department
requirements.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the
Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire
Codes, Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke Use Permit No.
90-13 if any violation of these conditions or the Huntington Beach
Ordinance Code occurs.
SITE PLAN AMENDMENT NO. 90-1

Request: To permit the placement of a rolling wrought iron security gate.
Location: 18561-18571 Edgebrook (Huntington Creek Condominiums)
Environmental This request is covered by Categorical Exemption,
Status: Section 15301, Class 1, California Environmental Quality Act, 1986.
Herb Fauland, staff planner, reported that the request is to permit a rolling wrought iron
security gate to be placed at the subject site. Staff stated that the Department of Public
Works had reviewed that request and were recommending approval. Staff stated that the
request meets all code requirements and recommended approval with findings and
conditions of approval.
THE PUBLIC HEARING WAS OPENED
The applicant, Cheryl Lawrence, was present and spoke in support of the request.
There were no other persons present to speak for or against the request and the public
hearing was closed.
SITE PLAN AMENDMENT NO. 90-1 WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH FINDINGS AND CONDITIONS OF APPROVAL. ALL ACTIONS TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.
FINDINGS FOR APPROVAL:
1. The proposed revision does not constitute a substantial change.
2. The proposed revision does not change the use of the property.

3. The revision results in an improved development.
4. The revision does comply with all applicable provisions of the Huntington Beach
Ordinance Code.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, and elevation dated March 22, 1990 shall be the conceptually approved
layout.
2. The proposed security gate shall not be used for ingress or egress of the
residents/occupants of the condominium complex.
3. The Fire Department requirements are as follows:
a. The security gates shall comply with City specification No. 403.
b. The applicant shall meet all applicable local, State and Federal Fire Codes,
Ordinances and standards.
4. All building spoils, such as unusable limber, wire pipe and other surplus or unusable
material shall be disposed of at an off -site facility equipped to handle them.
S. The Public Works requirements are as follows:
a. The applicant shall restripe Ellis Avenue to provide a separate turn pocket for
entrance into the condominium complex pursuant to Public Works standards and
specifications.
6. The applicant shall obtain all necessary permits for the security gates.
7. The development shall comply with all applicable provisions of the Huntington Beach
Ordinance Code, Building Division and Fire Department.

Herb Fauland, staff planner, stated that the request is to permit the addition of a
single -story family room with a 7'-6" rear yard setback in lieu of the code required
10'-011. Staff displayed the site plan and photographs of'the existing residence. Staff
recommended approval of the request based upon the lot's unique shape and the fact that
land related hardship findings can be supported.
THE PUBLIC HEARING WAS OPENED
Raymond Li, applicant, was present and spoke in support of the request.
Mr. & Mrs. Marty Schaefer were present to speak in opposition of the request. Mr. & Mrs.
Schaefer expressed concern over the proposed addition's close proximity and that it would
block the view from their backyard area. Mr. Robert Dow was present to speak in
opposition of the request.
Discussion ensued between the applicant, appellants, staff and the Zoning Administrator
and various alternatives were presented. As no immediate solution was presented, the
Zoning Administrator trailed the item to the end of the agenda and requested that the
applicant and appellants attempt to arrive at a solution.
THE PUBLIC HEARING WAS LEFT OPENED
Following review of the remaining agenda items, Conditional Exception No. 90-16 was
brought back to the Zoning Administrator for review.
The Zoning Administrator inquired from the applicant if he would be willing to have his
architect redesign the addition with modifications to the roof height and design;
specifically, the roof height should be reduced from 12' to 10' in height and the roof style
be of a flat design. The applicant stated that he would be willing to revise the request and
resubmit the proposal to the Zoning Administrator within a weeks time.
Mr. & Mrs. Schaefer stated that they would be in support of the request if the suggested
height and design modifications were made.
Mr. Dow stated for the record that he was in opposition to the request to encroach into
the rear setback even with the re -designed roof.
There were no other persons present to speak for or against the request and the public
hearing was closed.
CONDITIONAL EXCEPTION NO. 90-16 WAS CONTINUED TO THE MEETING OF
APRIL 25, 1990 BY THE ZONING ADMINISTRATOR TO ALLOW SUFFICIENT TIME FOR
THE APPLICANT TO SUBMIT HIS REVISED REQUEST WITH MODIFICATIONS.

Status: Section 15305(a), Class 5, California Environmental Quality Act,
1986.
Herb Fauland, staff planner, stated that the applicant is requesting a one year extension of
time of Use Permit 89-16 to allow a three (3) foot interior side yard setback in lieu of the
five (5) foot side yard setback requirement for single family dwellings in the Townlot
Area. Staff stated that the applicant is having some difficulty in obtaining the necessary
permits from the City and therefore will need an extension of time. Staff recommended
approval of the request subject to the conditions of approval for Use Permit No. 89-16.
REQUEST FOR A ONE—YEAR EXTENSION OF TIME FOR USE PERMIT NO. 89-16 WAS
APPROVED BY THE ZONING ADMINISTRATOR WITH ALL PREVIOUS FINDINGS AND
CONDITIONS OF APPROVAL TO REMAIN IN EFFECT. ALL ACTIONS TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN (10) CALENDAR DAYS.

Environmental This request is covered by Categorical Exemption,
Status: Section 15304, Class 4, California Environmental Quality Act, 1986.
Herb Fauland, staff planner, stated that the applicant is requesting permission to operate
a one day temporary outdoor event on April 28, 1990 at the First Christian Church site.
Staff stated that the request was in conformance with City codes and regulations and
recommended approval subject to findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED
Ms. Francesca Becker and Ms. Jeanne Fowler, applicants, were present and spoke in
support of the request.
There were no other persons present to speak for or against the request and the public
hearing was closed.

USE PERMIT NO. 90-19 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
FINDINGS AND CONDITIONS OF APPROVAL. ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
(10) CALENDAR DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity.
b. Property and improvements in the vicinity of such use or building.
2. The granting of Use Permit No. 90-19 will not adversely affect the General Plan of
the City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated March 10, 1990 shall be the conceptually approved
layout.
2. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
3. The event shall not block any existing driveways.
4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for
approval (show table locations, tents, barriers, etc.).
S. The applicant shall obtain all necessary Fire Department permits and comply with all
provisions of Article 32 of the Uniform Fire Code.
6. The applicant's request shall include necessary permits for balloons and temporary
signs.
7. The applicant shall obtain clearance from the Public Liability Claims Coordinator,
Administrative Services Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed at least five (5) days prior to the event.

1. The event shall comply with all applicable provisions of the Ordinance Codes,
Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and Federal Fire Codes,
