PUBLIC HEARING ITEMS B-1 REVISED CONDITIONAL USE PERMIT NOS 89-58 AND 89-59/COASTAL DEVELOPMENT PERMIT NOS, 89-33 AND 89-34 APPLICANT: HUNTINGTON BEACH BY THE SEA LOCATION: 1300 and 1390 Pacific Coast Highway Revised Conditional Use Permit Nos. 89-58 and 89-59 and Coastal Development Permit Nos. 89-33 and 89-34 are requests for two four -unit condominium projects with three special permits for 1) minimum dimension of common open space, 2) site coverage and 3) upper story setback. These projects were approved by the Planning Commission on February 2, 1990, and denied by the City Council on appeal on April 2, 1990. The City Council's action for denial included directions for the applicant to submit a revised project to the Design Review Board and Planning Commission for approval. Staff has determined that a special permit for elimination of ground floor private open space is not required, so that request was dropped from the application. STAFF RECOMMENDATION: Approve Revised Conditional Use Coastal Development Permit Nos. modified conditions of approval. THE PUBLIC HEARING WAS OPENED Permit Nos. 89-58 and 89-59 and 89-33 and 89-34 with findings and Ron Saffron, applicant, was present and available to answer any questions from the Commission. Commissioner Williams expressed concern with the number of guest parking spaces provided in the project. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The location, site layout and design of the proposed project with special permits properly adapts the proposed structure to streets, driveways, and other adjacent structures and uses in a harmonious and beneficial manner. 2. The combination and relationship of one unit to the other on the site is property integrated. 3. The access to and parking for the proposed dwelling units does not create an undue traffic problem. Access for all of the units is off the alley at the rear of the property. 4. The proposed four unit condominium is not detrimental to the General Plan of the City of Huntington Beach. 5. The Design Review Board reviewed this development and determined that the project substantially conforms with the Downtown Specific Plan and Downtown Design Guidelines. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 89-33/34: 1. The proposed four unit condominium project conforms with the plans, policies, requirements and standards of the Huntington Beach Coastal Element of the General Plan, the Downtown Specific Plan -District Two, as well as the C-LUP which permit the density proposed by this project. 2. Coastal Development Permit No. 89-33/34 is consistent with the CZ (Coastal Zone) suffix, the Downtown Specific Plan as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development conforms to all applicable development standards. 3. At the time of occupancy, the proposed four unit condominium project can be provided with infrastructure in a manner that is consistent with the Huntington Beach Coastal Element and Coastal Land Use Plan of the General Plan. Full public services are available at the subject location. 4. The proposed four unit condominium project conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The project is on the inland side of Pacific Coast Highway; therefore, public access to the beach is not affected. CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and dated May 4, 1990, shall be the conceptually approved layout. PC Minutes - 5/15/90 -3- (5846d) 2. The applicant shall obtain approval of a trash pickup plan from Rainbow Disposal. 3. An offer of reciprocal vehicular access shall be made to the adjacent property owner in order to allow a shared driveway from the alley to the entrance gate on the project. 4. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Depict all utility apparatus, such as but not limited to backflow devices and Edison transformers, on the site plan. They shall be prohibited in the front and exterior yard setbacks unless properly screened by landscaping or other method as approved by the Community Development Director. b. Floor plans shall depict natural gas and 220V electrical shall be stubbed in at the location of clothes dryers; natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units; and low -volume heads shall be used on all spigots and water faucets. C. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. d. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). e. Elevations shall depict colors and building materials proposed as approved by the Design Review Board. f. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 5. Prior to issuance of building permits, the applicant/owner shall complete the following: a. A Landscape Construction Set must be submitted to the Design Review Board and the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan PC Minutes - 5/15/90 -4- (5846d) 1 prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plant materials (location, type, size, quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Section 9608 and the Downtown Specific Plan of the Huntington Beach Ordinance Code. The set must be approved by both departments prior to issuance of building permits. Landscaping within the front yard setback shall be compatible with the blufftop park across Pacific Coast Highway. The landscape plans shall include Mediterranean Fan Palm settings in the front yard setback, and in exterior side yard areas visible from Pacific Coast Highway. The main trunk of each setting must be at least 10 feet tall, with pups of 2 to 6 feet in height. b. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. 6. The Public Works Department requirements are as follows: a. All applicable Public Works fees shall be paid. b. The alley shall be dedicated and improved to City standards. c. Public improvements on Pacific Coast Highway shall be constructed per City and CalTrans requirements. d. A 27 foot right-of-way radius shall be required at the corner of Pacific Coast Highway and Thirteenth Street/Fourteenth Street. e. Vehicular access rights shall be dedicated to Pacific Coast Highway and Thirteenth Street/Fourteenth Street. f. An 8-inch water main shall be constructed in the alley. g. Construct backflow preventers on water services. The location of the backflow preventers to be reviewed and approved by the Department of Community Development. h. Any oil wells on the site shall be reabandoned to current standards. 7. Fire Department requirements are as follows: a. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations and Uniform Building Code Standards. PC Minutes - 5/15/90 -5- (5846d) b. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: manual pulls; water flow, valve tamper and trouble detection; 24-hour supervision; annunciation; and audible alarms. c. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. d. Security gates will be designed to comply with Huntington Beach Fire Department Standard No. 403. e. Address numbers will be installed to comply with Huntington Beach Fire Code Standards. The size of the numbers will be the following: 1) the number for the building will be sized a minimum of ten (10) inches with a brush stroke of one and one-half (1-1/2) inches; 2) Individual units will be sized a minimum of four (4) inches with a brush stroke of one-half (1/2) inch. f. Submit to the Fire Department for approval a Fire Protection Plan containing requirements of Fire Department Specification No. 426. 8. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 10. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 11. All grill work or handrails shall be constructed of anti -corrosive materials. 12. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 13. Prior to issuance of a Certificate of Occupancy, the following shall be completed: a. All improvements (including landscaping) to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. b. Compliance with all conditions of approval specified herein shall be accomplished. PC Minutes - 5/15/90 -6- (5846d) 1 14. Should a Traffic Impact Fee be adopted by the City Council, the applicant/owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval. 15. Should park and recreation fees be raised prior to issuance of building permits, applicant shall be responsible for higher fees. 16. Conditional Use Permit No. 89-58 and Coastal Development Permit No. 89-33 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. B-2 CONDITIONAL USE PERMIT NO. 90-4/CONDITIONAL EXCEPTION VARIANCE) NO. 90-14 (CONTINUED FROM APRIL 3, 1990 PLANNING COMMISSION MEETING) APPLICANT: STEPHEN DAY - COMMUNITY METHODIST CHURCH LOCATION: 6662 Heil Avenue Conditional Use Permit No. 90-4 is a request for an overall expansion of approximately 7,330 square feet to an existing church. Conditional Exception (Variance) No. 90-14 is required as the proposed project increases the floor area of a nonconforming structure by more than 10 percent. The structure is nonconforming as to the number of parking spaces provided, the parking lot configuration and the amount of landscaping provided within the parking area. On April 3, 1990, the Planning Commission opened the public hearing for Conditional Use Permit No. 90-4 and Conditional Exception (Variance) No. 90-14. In response to concerns raised regarding the existing parking problems, the Planning Commission continued consideration of the project to allow the applicant to identify and evaluate possible strategies for alleviating the safety hazards and the nuisance created by the church members parking on Heil Avenue and the adjacent residential streets. Staff does not perceive that the applicant has been able to adequately address the parking concerns which have been identified. The only parking management measure which has been implemented has been a carpool program. However, no measure of participation in the program has been provided. PC Minutes - 5/15/90 -7- (5846d) STAFF RECOMMENDATION: Approve Conditional Use Permit No. 90-4 for expansion of a maximum 1,985 square feet with findings and conditions of approval and deny Conditional Exception (Variance) No. 90-14 with findings. THE PUBLIC HEARING WAS OPENED Steve Day, 14415 Suffolk Street, applicant, spoke in support of the request. He said an earnest attempt to mitigate most concerns (red -curbing and cone placement on Heil) and to be a good neighbor had been made and urged the Commission to approve the request. He said the suggestion to add a third Sunday service was not warranted because of the size of his congregation. He said the only time there was a parking impact was between 8:30 and 9:30 and 10:00 and 11:00 on Sunday mornings. Frances Cordry, 16522 Fountain Lane, said she has lived next door to the church for 16 years and has no concerns. She is also the director of the nursery school at the church. She said the playground is open to all neighborhood children daily which she feels is a "good neighbor" attempt. David Rogne, 6662 Heil Avenue, pastor of the church, said the church has not had any improvements for 25 years and feels the proposed addition will make the church more useable and will help to correct noise problems. He said the addition is not being proposed to increase the sanctuary, just to improve the facility. He urged the Commission to approve so that the improvements could be completed during the summer while the nursery school is closed. He said other churches in the area, like their church, only require off -site parking for approximately 3 hours on Sunday morning. Sally Rans, 6282 Santa Ynez Drive, spoke in support of the request. She said the church adds to the social consciousness and fulfills the needs of the community. Marilyn Kuga, 6741 Bridgewater Drive, spoke in opposition to the request. She addressed her concerns with parking on Heil and in the surrounding neighborhood. She said the required parking is 148 spaces and the church is only providing 92. She presented traffic and accident statistics for Heil Avenue and said there have been 130 accidents in 3 years. Commissioner Kirkland said he checked the Heil traffic statistics and found that in 3 years 10 of the accidents fell on Sunday, 1 at 6:55 AM and 1 at 11:40 AM. The rest of the accidents occurred after 3:00 PM. Ms. Kuga said whether the church is allowed to build or not, the lack of adequate and safe parking exists and should be resolved. She feels the need for adequate parking is more critical than building modifications. She presented a lengthy letter with several attachments, including photographs, to the Commission. PC Minutes - 5/15/90 -8- (5846d) 1 Betty Williams, 6672 Julien Circle, presented a petition containing 40 names of residents concerned with the parking problems in the neighborhood. She emphasized that she was not against the church, just the traffic and parking impacts. She said the red -curbing is just a quick -fix of the situation and feels the there should be a long-term fix imposed. She also objects to the blocking of the bike lane on Heil Avenue. Vinh Gia Pham, 6581 Redgrove Circle, expressed his concerns with the parking problems in the neighborhood and access to Heil Avenue. He said the red -curbing has helped, however. Lou Ann Coerper, 16591 Dale Vista, said she feels the church is trying to alleviate the parking problems in the neighborhood. She said the red -curbing has helped exiting onto Heil Avenue. She does not object to the church off -site parking for 3 hours on Sunday. She said she was told that the church parking would be expanded to 115 spaces and that their plans do not include expansion to the size of their sanctuary for added members. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Commissioner Williams said he did not support approving a non -conforming building with a shortfall of parking and does not feel that is the intent of the code or process. Commissioner Leipzig stated he was not in favor of approving a variance granted on problems created by the applicant. He questioned staff on the land -related hardship. Staff said that the hardship had been determined based upon the size and the location of the buildings on the site. The access to and parking for the proposed church facility does not create an additional traffic problem. FINDINGS FOR APPROVAL CONDITIONAL EXCEPTION (VARIANCE) NO. 90-14: 1. The granting of a conditional exception will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. The existing parking configuration is legal nonconforming. The expansion does not intensify the use or create additional parking problems. 2. Because of special circumstances applicable to the subject property, including size, location, and surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The parking area is limited in size and is surrounded by already improved properties. 3. The granting of a conditional exception is necessary to preserve the enjoyment of one or more substantial property rights. 4. The granting of conditional exception will not be materially injurious to in detrimental to the public welfare or property the same zone classifications. The proposed addition does not intensify the use or create an additional parking problem. 5. The granting of a conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 90-4: 1. The site plan, floor plans and elevations received and dated March 27, 1990, shall be the conceptually approved layout. 2. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3. A Landscape Construction Set shall be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plant materials (location, type, size, quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. An additional conditional use permit shall be rquired for any of the following: a. An increase in the number of children enrolled in the preschool; b. The establishment of a weekday school for school age children; c. An increase of any building area on the site. 14. Should a Traffic Impact Fee be adopted by the City Council, the applicant/property owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval. 15. The Planning Commission reserves the right to revoke Conditional Use Permit No. 90-4 and Conditional Exception (Variance) No. 90-14 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 16. Conditional Use Permit No. 90-4 and Conditional Exception (Variance) No. 90-14 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. NON-PUBLIC HEARING ITEMS D-1 STATEMENT OF OVERRIDING CONSIDERATIONS (ENVIRONMENTAL IMPACT REPORT NO. 89-8, RESOLUTION NO. 1431) APPLICANT: CITY OF HUNTINGTON BEACH/STATE LANDS COMMISSION At the May 1, 1990 Planning Commission meeting, Environmental Impact Report No. 89-8, Conditional Use Permit No. 89-52, Coastal Development Permit No. 89-29 and Floodplain Variance No. 90-1 for demolition and reconstruction of the Huntington Beach Pier were approved. The Planning Commission determined that impacts to historic resources could not be mitigated to a level of insignificance and directed staff to prepare a Statement of Overriding Considerations. STAFF RECOMMENDATION: Adopt Resolution No. 1431 as amended, adopting and certifying as adequate Environmental Impact Report No. 89-8 with mitigation measures, findings and statement of overriding considerations. There was a question as to whether the proposed artificial reef off of the pier would trigger the need for another EIR or Supplement. It was explained that the proposed reef would be a separate project and whether a Supplement or new EIR would be needed would be explored at that time. A MOTION WAS MADE BY KIRKLAND, SECOND BY MOUNTFORD, TO APPROVE AND ADOPT RESOLUTION NO. 1431 AS AMENDED, CERTIFYING AS ADEQUATE ENVIRONMENTAL IMPACT REPORT NO. 89-8 WITH MITIGATION MEASURES, FINDINGS AND STATEMENT OF OVERRIDING CONSIDERATIONS, BY THE FOLLOWING VOTE: AYES: Shomaker, Leipzig NOES: Ortega ABSENT: None ABSTAIN: None MOTION PASSED Mountford, Williams, Kirkland, Bourguignon, PC Minutes - 5/15/90 -13- (5846d) RESOLUTION NO. 1431 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH ADOPTING ENVIRONMENTAL IMPACT REPORT NO. 89-8: DEMOLITION AND RECONSTRUCTION OF THE HUNTINGTON BEACH PIER WHEREAS, Environmental Impact Report No. 89-8 and related entitlements have been prepared; and The City of Huntington Beach was the lead agency in the preparation of the Environmental Impact Report; and All persons and agencies wishing to respond to notice duly given have been heard by the Planning Commission either through written notice or during a public hearing on May 1, 1990, and such comments as were made were duly noted and responded to. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Huntington Beach as follows: SECTION 1: The Planning Commission does hereby find that Environmental Impact Report No. 89-8 has been completed in compliance with the California Environmental Quality Act and all State and local guidelines. SECTION 2: The Planning Commission has considered all significant effects detailed in Environmental Impact Report No. 89-8, together with proposed mitigation measures to mitigate such effects (see Exhibit A). SECTION 3: The Planning Commission finds that through the implementation of the aforementioned mitigation measures the majority of the potentially adverse impacts associated with the project can be eliminated or reduced to a level of insignificance and have made findings in accordance thereto (See Exhibit B). SECTION 4: The Planning Commission further finds that the benefits accruing to the City from the project override the unmitigable impacts to historic resources as detailed in the attached Statement of Overriding Considerations (see Exhibit C) and have made the appropriate findings (see Exhibit B). SECTION 4: The Planning Commission of the City of Huntington Beach does hereby adopt and certify as adequate Environmental Impact Report No. 89-8. SECTION 5: The Planning Director is hereby authorized and directed to file with the Office of the County Clerk and the State Office of Planning and Research a notice of determination for Environmental Impact Report No. 89-8, as required by Section 15094 of the California Environmental Quality Act Guidelines. LIGHT AT 17TH AND MAIN (NEAR HIGH SCHOOL) - Possibility of installing a left -turn directional arrow 2. OVERVIEW OF LAND USE PLAN AND UPDATE ON BOLSA CHICA 3. CONSTRUCTION TRAILER/OFFICE AND ILLEGAL SIGNS AT PIERCE AND ROOSEVELT - Requested full report on permits granted at site and follow-up on notification to owners of signs. 4. PROCEDURE FOR PROCESSING ON -SITE GRADING PERMITS H. COMMUNITY DEVELOPMENT ITEMS Mike Adams reiterated action taken by the City Council at their May 7, 1990 meeting. He also informed the Commission that at future study sessions (first meetings of the month) monthly reports will be presented from Advance Planning, Land Use, Zoning Administration, Current Planning.
