ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Herb Fauland, Mike Connor MINUTES: The Minutes of the June 13, 1990 Zoning Administrator Meeting were approved by the Zoning Administrator Meeting as submitted. REGULAR AGENDA ITEMS: ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 90-15: Applicant: McDonald A. Overby 3131 North 56th Street Phoenix, Arizona 85018 Request: To permit the remodel and addition to an existing 3,193 square foot single story residence. The remodel consists of a 2,879 square foot second floor addition. Location: 3262 Gilbert Drive (Huntington Harbour) Herb Fauland, Staff Planner, reported that the proposal is a request to permit an addition to an existing single family residence. The second floor addition which exceeds the 10% or more increase of the internal floor area of the existing structure allowed by Code requires a Coastal Development Permit. Staff noted that the addition has been reviewed and approved by the Huntington Harbour Architectural Review Committee. Staff made a recommendation that an exterior access door be eliminated to prevent the potential use of the bedroom as a second unit. Staff recommended approval with findings and amended conditions of approval. THE PUBLIC HEARING WAS OPENED The applicant, Mr. Overby, spoke in support of the request. He said he was not opposed to staffs request to eliminate the exterior access door. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 90-15 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 90-15: 1. The request to permit the remodel and addition of a 2,879 square feet second story to an existing single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 90-15 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the remodel and addition of a 2,879 square foot second story to an existing single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed 6,072 square feet two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 4, 1990 shall be the conceptually approved layout with the following modifications: a. The proposed door for bedroom No. 4 which provides exterior access shall be removed. 2. The applicant shall submit a revised complete set of plans pursuant to condition no. 1 for review and approval and inclusion in the entitlement file. 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 4. All proposed cantilevered deck improvements require separate permits for the improvements. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. 7. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. Low -volume heads shall be used on all spigots and water faucets. 9. The Public Works Department requirements are: ZA Minutes - 6/20/90 -2- (6227d) a. Repair and replace curb and gutter, driveway and sidewalk as needed. b. Water service shall be upgraded pursuant to Public Works standards. C. The applicant shall pay all applicable Public Works fees. 10. The Fire Department requirements are as follows: a. Automatic sprinkler system will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. 11. Construction shall be limited to Monday - Saturday 7:00 a.m. to 8:00 p.m.. Construction shall be prohibited on Sunday and Federal holidays. 12. The conditions of approval shall be printed verbatim on the site plans for building permit plan check. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 90-15 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO. 90-18/CONDITIONAL EXCEPTION (VARIANCE) NO. 90-19 Applicant: Brent A. Sears Design A.I.A. 3517 E. Broadway Long Beach, CA 90803 Request: To permit the exterior facade improvement to an existing office/commercial building. The conditional exception (variance) is to permit a reduced landscaped planter adjacent to a public right-of-way and a reduction to the minimum turning radius requirement. Location: 16182 Pacific Coast Highway ZA Minutes - 6/20/90 -3- (6227d) Herb Fauland, Staff Planner, reported that the request is the result of a stop work order issued by the Building Division because of building improvements performed without obtaining a permit. Staff noted that the applicant has continued to perform improvements on the site which included mechanical equipment on top of the building and installation of awnings and landscaping. The project was reviewed and approved by the Design Review Board in March with recommendations incorporated as conditions of approval. The variance request is for the reduction of the 10 feet landscape planters along the public right-of-way and minimum turning radius for on site parking. Staff recommended approval with findings and conditions of approval with modifications to the minimun turning radius, landsacping and location of the trash enclosure. THE PUBLIC HEARING WAS OPENED John King, the property owners representative, presented an overlay with the changes requested by staff. He urged the Zoning Administrator's approval of the request. Mr. Hadjain, the property owner, requested that the second driveway be permitted for access to the trash area. Staff advised that the removal of the second driveway was a Planning Division and Public Works requirement. Staff also noted that the revised location of the trash enclosure eliminates the need for the second driveway and therefore provides improved landscaping on site, and reduces ingress and egress points along Pacific Coast Highway. There were no other persons present to speak for or against the request and the public hearing was closed. The Zoning Administrator reminded the property owner of the importance of obtaining all necessary permits before any more improvements on site. USE PERMIT NO. 90-18/CONDITIONAL EXCEPTION (VARIANCE) NO. 90-19 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: USE PERMIT NO, 90-18: 1. The establishment, maintenance and operation of the exterior facade improvements to an existing commercial/office building will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 90-18 to permit the exterior facade improvements to an existing commercial/office building will not adversely affect the General Plan of the City of Huntington Beach. The proposed exterior facade improvements to an existing commercial/office building is consistent with the goals and objectives of the City's General Plan and Land Use Map. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 90-19: 1. There are exceptional or extraordinary circumstances or conditions applicable to the land, building or premises involved that do not apply generally to other property or uses in the same district. The existing lot configuration, existing location of the on -site structures, existing access point and parking area precludes the proposal from complying with the code requirements for landscaping and parking turning radius. 2. The granting of Conditional Exception (Variance) No. 90-19 for a reduced landscape planter along a public right-of-way and a reduction to the minimum turning radius is necessary in order to preserve the enjoyment of one or more substantial property rights. 3. The granting of Conditional Exception (Variance) No. 90-19 for a reduced landscape planter along a public right-of-way and a reduction to the minimum turning radius will not be materially detrimental to the public health, safety and welfare, or injurious to the land, property or improvements in the neighborhood. 4. The granting of Conditional Exception (Variance) No. 90-19 for a reduced landscape planter along a public right-of-way and a reduction to the minimum turning radius will not defeat the general purposes or intent of the code which is to provide code required landscaping and minimum turning radius. 5. The granting of Conditional Exception (Variance) No. 90-91 for a reduced landscape planter along a public right-of-way and a reduction to the minimum turning radius is consistent with the goals and objectives of the City's General Plan and Land Use Map designation of Visitor Serving Commercial. 6. The granting of Conditional Exception (Variance) No. 90-19 for a reduced landscape planter along a public right-of-way and a reduction to the minimum turning radius will not adversely affect the General Plan of the City of Huntington Beach. 7. The applicant is willing and able to carry out the purposes for which Conditional Exception (Variance) No. 90-19 is sought and will proceed to do so without unnecessary delay. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and dated April 9, 1990, shall be the conceptually approved layout with the following modifications: ZA Minutes - 6/20/90 -5- (6227d) 11 a. Parking stalls 5-7 shall be modified to provide a minimum 27' turning radius. b. The trash enclosure shall be relocated to the rear of the site behind the stairwell. C. The 12 foot-6 inch wide landscaped planter along the front of the building shall have one (1) access point 6 feet-0 inch wide to the front door of the building. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Depict all utility apparatus, such as but not limited to backflow devices and Edison transformers, on the site plan. They shall be prohibited in the front and exterior yard setbacks unless properly screened by landscaping or other method as approved by the Community Development Director. b. Floor plans shall depict natural gas and 220v electrical shall be stubbed in at the location of clothes dryers; facilities, water heaters, and central heating units; and low -volume heads shall be used on all spigots and water faucets. C. Elevations shall depict colors, awnings and building materials as approved by the Design Review Board on April 19, 1990. d. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturaly compatible with the building in terms of materials and colors as approved by the Design Review Board on April 19, 1990. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. e. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations. f. The Community Development Department shall review and approve the following: (1) Special architectural treatment shall be provided on all building walls as approved by the Design Review Board on April 19, 1990. (2) Revised site plan and elevations as modified pursuant to Condition No. 1. (3) All pipes, conduits, etc. attached to the building shall be painted to match the building. ZA Minutes - 6/20/90 -6- (6227d) (4) All railings, windows, trims, etc. shall be painted white. (5) A gutter system shall be installed around the building. g. The site plan shall include all conditions of approval imposed on the project printed verbatim. 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file. b. A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape architect and which includes all proposed/existing plant materials (location, type, size, quantity), and irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Section 9608 of the Huntington Beach Ordinance Code. C. A grading plan shall be submitted to the Department of Public Works for review if the parking area is to be repaved and it must be approved (by issuance of a grading permit). d. All applicable Public Works fees shall be paid. e. All proposed signs shall be in conformance with Article 961 (Signs). 4. The Public Works Department requirements are as follows: a. Driveway approaches shall be a minimum of thirty feet (301) in width and shall be of radius -type construction. b. Applicant shall pursue CalTrans approval of radius type driveways on Pacific Coast Highway. C. Dedicate Pacific Coast Highway to CalTrans and the Department of Public Works standards. d. All public improvements (curb, gutter, sidewalks, etc.) shall be constructed to CalTrans and Department of Public Works standards and specifications. 5. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. ZA Minutes - 6/20/90 -7- (6227d) 1 I- 6. Construction shall be limited to Monday - Saturday 7:00 a.m. to 8:00 p.m. Construction shall be prohibited Sundays and federal holidays. 7. Prior to issuance of a Certificate of Occupancy, the following shall be completed: a. All improvements (including landscaping) to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. b. Compliance with all conditions of approval specified herein shall be accomplished. C. The applicant shall obtain all necessary building permits and mechanical permits for work accomplished without the necessary permits prior to Use Permit No. 90-18 and Conditional Exception (Variance) No. 90-19 approval. 8. The building shall be limited to office type uses only. The available on -site parking is calculated at a office use ratio of one (1) space per 300 gross square feet of building area. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 90-18/Conditional Exception (Variance) No. 90-19 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: USE PERMIT NO. 90-31 Applicant: Jan Hankow 7225 Edinger Huntington Beach, California 92649 Request: Temporary Outdoor Event -Tent Sale, June 29 - July 1, 1990. Location: 7225 Edinger Mike Connor, Staff Planner, reported that the proposed tent sale is located in the parking lot of Home Express Store which is currently closed for business. The tent will occupy approximately 12 parking spaces in front of the store. Staff recommended approval with findings and conditions of approval. ZA Minutes - 6/20/90 W:11 (6227d) USE PERMIT NO. 90-31 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT APPROVAL OF A TEMPORARY EVENT CAN BE APPEALED TO THE ZONING ADMINISTRATOR WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 90-31 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated June 5, 1990 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. The event shall not block any existing driveways. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. Three (3) fire extinguishers shall be installed at locations approved by the Fire department. 7. A certificate showing proof that the tent is fireproof shall be presented to the Fire Department prior to installation of the tent. 8. The applicant's request shall include necessary permits for balloons and temporary signs. 9. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 10. The applicant shall coordinate traffic and parking control for the event with the Huntington Beach Police Department. ZA Minutes - 6/20/90 -9- (6227d) INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 90-31 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 4: TENTATIVE PARCEL MAP NO. 90-198 Applicant: Walden and Associates 18012 Cowan, Suite 210 Irvine, CA 92714 Request: To subdivide one (1) 206 acre parcel of land into two (2) parcels of land. Location: Area bordered by Garfield Ave, Goldenwest St., Seacliff Country Club and the westerly city boundary. Herb Fauland, Staff Planner, reported that the request is to subdivide a major parcel of land for the purpose of financing and conveyance of property. Staff indicated that a letter had been received from Amigos de Bolsa Chica requesting that the item be continued until the Precise Plan of Street Alignment for Seapoint, Avenue is resolved. Staff indicated that the request had been further reviewed by Planning Staff and recommended that the lot line be eliminated from the map and therefore the map would indicate a one lot subdivision. Staff recommended approval with findings and conditions of approval with modifications to amend the map to indicate a one (1) lot subdivision. Dave Walden, the applicant, advised that the purpose of the map was for financing and conveyance and not development of the parcels of land. Bill Holman, Huntington Beach Company, concurred with staffs recommendation to amend the map to indicate a one (1) lot subdivision. TENTATIVE PARCEL MAP NO. 90-198 WAS APPROVED BY THE ZONING ADMINISTRATOR TO AMEND THE MAP TO INDICATE A ONE (1) LOT SUBDIVISION WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE CITY COUNCIL WITHIN TEN CALENDAR (10) DAYS. FINDING OF APPROVAL: 1. The proposed one (1) lot subdivision of land for purposes of financing and conveyance of real property is in compliance with the size and shape of property necessary for that type of subdivision. ZA Minutes - 6/20/90 -10- (6227d) 2. The General Plan has set forth provisions for this type of use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this land use at the time the land use designation for Planned Community allowing .� residential uses was placed on the subject property. 4. The size, depth, frontage, and other design features of the proposed one (1) lot subdivision as proposed are in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on June 20, 1990, shall be the conceptually approved layout with the following modifications: a. The parcel line between Parcel 1 and Parcel 2 shall be removed and the tentative parcel map shall reflect a one (1) lot subdivision. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Goldenwest Street shall be dedicated to City standards. 4. Compliance with all applicable City Ordinances. 5. A copy of the recorded parcel map shall be filed with the Department of Community Development.
