MINUTES: The Minutes of the July 11 were continued to
the Zoning Administrator Meeting of July 25,
1990.
REGULAR AGENDA ITEMS:
ITEM 1: CONDITIONAL EXCEPTION NO 89-26/ONE YEAR EXTENSION OF TIME
Applicant: Albert L. & Patricia A. Castellano
Request: A reduced exterior sideyard setback
(8 foot 4 inches in lieu of 10 feet)
Location: 7541 Danton Circle
Mike Connor, Staff Planner, reported that the project was approved
by the Zoning Administrator on June 21, 1989. Staff advised that
the applicant was not able to act on the permit due to a serious
illness and death in the family. Staff recommended approval of a
one year extension of time.
CONDITIONAL EXCEPTION NO. 89-26/ONE YEAR EXTENSION OF TIME WAS
APPROVED BY THE ZONING ADMINISTRATOR. HE STATED THAT ALL ACTIONS
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN CALENDAR (10) DAYS.
ITEM 2: USE PERMIT NO. 90-32
Applicant: Lien T. Vu
Request: Annual Twenty One (21) Day Tent Sale from July 21,
1990 through August 10, 1990, pursuant to Section
9730.64 of the Huntington Beach Ordinance Code.
Location: 7738 Edinger
Mike Connor, Staff Planner, reported that the request is for an
annual tent sale. He advised that the request had been reviewed by
Public Works, Fire Department & Building Division and standard
conditions of approval were added. Staff recommended approval with
findings and conditions.
THE PUBLIC HEARING WAS OPENED.
The applicant, Mr. Vu, concurred with the conditions of approval and
urged approval of the request.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 90-32 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT
ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity.
b. Property and improvements in the vicinity of such use or
building.
2. The granting of Use Permit No. 90-32 will not adversely affect
the General Plan of the City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated June 18, 1990 shall be the
conceptually approved layout.
2. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
3. Fire access lanes shall be a minimum with of (20) twenty feet.
4. A detailed site plan shall be submitted to the Huntington Beach
Fire Department for approval (show table locations, tents,
barriers, etc.).
5. The applicant shall obtain all necessary Fire Department
permits and comply with all provisions of Article 32 of the
Uniform Fire Code.
6. The applicant's request shall include necessary permits for
balloons and temporary signs.

17. The applicant shall obtain clearance from the Public Liability
Claims Coordinator, Administrative Services Department, and/or
shall provide a Certificate of Insurance and Hold Harmless
Agreement to be executed at least five (5) days prior to the
event.
8. All parking shall be a minimum of forty (40) feet from the
proposed tent.
9. The proposed tent shall be of fire retardant material. Proof
of Certification shall be submitted to the Fire Department for
approval prior to the tent's installation on the site.
10. The proposed tent shall be secured against collapsing to the
satisfaction of the Fire Department.
11. "No Smoking" signs shall be posted in conspicuous locations.
12. Fire extinguishers shall be provided in number and locations
specified by the Fire Department.
13. A minimum of two (2) exits shall be provided and maintained.
14. Stand by personnel shall be on site to safeguard premises.
15. An overnight security guard shall be provided to protect
merchandise left overnight.
INFORMATION OF SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the
Ordinance Codes, Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and
Federal Fire Codes, Ordinances and standards.
3. The Zoning Administrator reserves the right to revoke Use
Permit No. 90-32 if any violations of these conditions or the
Huntington Beach Ordinance Code occurs.
ITEM 3: CONDITIONAL EXCEPTION (VARIANCE) NO 90-23 IN CONJUNCTION
WITH USE PERMIT 0-30
Applicant: Philip Talbert/Scott Sackin
Request: To permit reduced front and rear setbacks and reduced
open space dimensions and a six (6) foot block wall two
(2) feet from the front property line.

Mike Connor, Staff Planner, reported that the request was to
construct a 3,230 square foot single family residence, with
conditional exceptions (variances) to front and rear setbacks and
open space dimensions. The use permit is a request to construct a
six (6) foot high wall set back two (2) feet from the front property
line. Staff concurred with the variance request with the exception
of the lattice over the planter in the front yard. Staff
recommended that it should be pushed back to a ten (10) foot setback
or eliminated. Staff recommended denial of the Use Permit for the
wall as it was not compatible with the neighborhood. As an
alternive, staff recommended a five (5) foot setback for the use
permit request.
THE PUBLIC HEARING WAS OPENED.
Mr. Talbert, the applicant, advised that the lot on Crest Avenue was
on a curve and was a restrictive building site. He felt that the
lot should be considered the same as a corner lot which would allow
the six foot wall.
There were no other persons present to speak for or against the
request and the public hearing was closed.
CONDITIONAL EXCEPTION (VARIANCE) NO. 90-23/USE PERMIT NO. 90-30
WERE APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND REVISED
CONDITIONS OF APPROVAL TO ALLOW A SIX FOOT (6) HIGH WALL AT THREE
FEET (3) FROM THE FRONT PROPERTY LINE AND TO ALLOW THE LATTICE COVER
AS PROPOSED. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of Conditional Exception (variance) No. 90-23 in
conjunction with Use Permit No. 90-30 will not adversely affect
the General Plan of the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the
City's General Plan and Land Use Map.
4. Granting of reduction in open space minimum dimension and
minimum open space area will not reduce the required total open
space area (900 Square Feet).

5. Because of special circumstances applicable to the subject
property, including size, shape, topography, location or
surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone
classifications.
6. The granting of Conditional Exception No. 90-23 is necessary
in order to preserve the enjoyment of one or more substantial
property rights.
7. The granting of Conditional Exception No. 90-23 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications.
8. The granting of Conditional Exception No. 90-23 will not
adversely affect the General Plan of the City of Huntington
Beach.
9. The applicant is willing and able to carry out the purposes for
which Conditional Exception No. 90-23 is sought and he will
proceed to do so without unnecessary delay.
10. The location, site layout, and design of the proposed use
properly adapts the proposed structures to streets, driveways,
and other adjacent structures and uses in a harmonious manner.
0 SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
June 22, 1990 shall be the conceptually approved layout.
2. Revised site plan floor plans and building elevations shall be
submitted to the Planning Division depicting the modifications
described herein:
a. Building elevations shall be revised to match the approved
floor plans.
b. The six (6') foot privacy wall shall be set back a minimum
of three (3) feet from the front property line.
3. Prior to issuance of building permits, applicant shall file a
parcel map consolidating lots 2 and 4 of Block 810 of the
Wesley Park Tract. Said map shall be recorded with the County
of Orange Recorder prior to final inspection and a copy of the
recorded map submitted to the Department of Community
Development for inclusion in the entitlement file.
4. "Any oil wells (active, idle, abandoned, etc) on property to be
dedicated to the City shall be abandoned pursuant to Fire
Department standards by the property owner, at the cost of the
property owner, prior to City Acceptance of such property."

5. "Should a Traffic Impact Fee be adopted by the City Council,
the applicant/owner shall be responsible for paying such fee
prior to issuance of a Certificate of Occupancy and/or final
building permit approval."
6. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
7. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
8. Low -volume heads shall be used on all spigots and water faucets.
9. Per Huntington Beach Ordinance Code, Section 9960.2(f)(6), a
30-inch box tree shall be planted in the front yard of the lot
and in the exterior side yard of the corner lot as provided in
the Street Tree Standards adopted by the City of Huntington
Beach. A 36-inch box tree may be substituted, if a 30-inch box
tree is unobtainable.
10. All curbs, gutters, sidewalks and one-half of the alley shall
be constructed to Public Works standards.
11. A two (2') foot six (6") inch alley dedication shall be
required along the rear property line.
12. All alley approaches shall be constructed to Public Works
standards.
13. All standing pipes in the public right-of-way shall be removed
to the satisfaction of the Department of Public Works.
14. A grading plan and soils report shall be submitted to the
Department of Public Works.
15. Conditions of approval shall be printed verbatim on all working
drawings submitted for plan check.
16. A landscape plan shall be submitted to and approved by the
Department of Public Works for the area between the front
sidewalk and the privacy wall.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.

5. A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and
utilities.
6. The Zoning Administrator reserves the right to revoke
Conditional Exception No. 90-23 in conjunction with Use Permit
No. 90-30 if any violation of these conditions of the
Huntington Beach Ordinance Code occurs.
ITEM 4: USE PERMIT NO, 90-38
Applicant: Harry T. MacDonald & Associates
Request: To permit the placement of two temporary classrooms
approximately twenty feet on school district property
and twenty feet on city property.
Location: 9300 Indianapolis
Mike Connor, Staff Planner, reported that the request is to permit
the placement of two temporary classrooms. He stated that school
district projects typically are not reviewed by the City but since
the structures would be partially on City property it requires a use
permit. All building permits will be issued by the Office of the
State Architect.
THE PUBLIC HEARING WAS OPENED.
David Ydeen, representing the applicant, reported that the structure
is approved by the State of California and the State assumes all
responsibility.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 90-38 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT
ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.

2. The granting of Use Permit No. 90-38 will not adversely affect
the General Plan of the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the
City's General Plan and Land Use Map.
4. The location, site layout, and design of the proposed use
properly adapts the proposed structures to streets, driveways,
and other adjacent structures and uses in a harmonious manner.
5. The combination and relationship of one proposed use to another
on site are properly integrated.
6. The access to and parking for the proposed use does not create
an undue traffic problem.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July 2, 1990, shall be the conceptually approved layout.
2. Prior to issuance of building permits, the following plans and
items shall be submitted and/or completed by the applicant:
a. Four (4) sets of landscape and irrigation plans to the
Department of Community Development and Public Works for
review and approval.
b. A Landscape Construction Set shall be submitted to the
Departments of Community Development and Public Works. The
landscape construction set shall include a landscape plan
prepared and signed by a State Licensed Landscape Architect
which includes all proposed/existing plant materials
(location, type, size, quantity), irrigation plan, grading
plan and approved site plan, and copy of conditions of
approval. The landscape plan shall be in conformance with
Section 9608 and of the Huntington Beach Ordinance Code .
The set must be complete and approved by both departments
prior to issuance of building permits.
3. Installation of required landscaping and irrigation systems
shall be completed prior to final inspection/within twelve (12)
months.
4. The following Design Review Board recommendations shall be
incorporated into the project:
a. Submittal and approval of a landscape plan showing
landscape treatment along the northside of the structure.
b. Break up of horizontal facade with two (2) inch battens.
c. Color shall reflect existing structures.

d. Applicant shall coordinate any construction on city
property with the Department of Public Works to ensure
corrective grading work is accomplished to prevent any
drainage problems that may arise.
5. Fire extinguishers shall be installed and locations specified
by the Fire Department.
6. Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
7. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
8. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
9. Proposed structures shall be architecturally compatible with
existing structures.
10. All applicable Public Works fees shall be paid prior to
issuance of building permits.
11. Conditions of approval shall be printed verbatim on all working
drawings submitted for plan check.
12. This Use Permit shall expire five (5) years from the date of
its approval unless it is extended by the Zoning Administrator.

ITEM NO 5' CONDITIONAL EXCEPTION NO. 90-29
Applicant: Ms. Kathleen Weiss
Request: To permit the construction of a single family dwelling
which exceeds maximum site coverage and floor area
ratio.
Location: 220 Tenth
Mike Connor, Staff Planner, reported the request was originally
approved under the standard plan check process however a discrepancy
was discovered between the site plan and grading plan after
construction of the basement had been completed. This has resulted
in the variance request to exceed the maximum site coverage by 1.5
percent and floor area ratio by 52 square feet. The additional
floor area would be added in the 7 foot wide crossover from the
residence to the garage. Staff recommended approval with findings
and conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Lou Hernandez, the architect, was present and urged approval of the
request.
There were not other persons to speak for or against the request and
the public hearing was closed.

ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
