PUBLIC HEARING ITEMS B-1 CONDITIONAL USE PERMIT NO. 90-37/COASTAL DEVELOPMENT PERMIT NO. 90-21 (Continued from July 17, 1990 APPLICANT: City of Huntington Beach/California Resorts LOCATION: 300 Pacific Coast Highway The request is to modify Conditional Use Permit No. 88-7 and Coastal Development Permit No. 88-3 by changing the square footage mix of uses at Pierside Pavilion (reduced retail square footage and increased restaurant square footage). 1 The request was originally approved by the Planning Commission on April 5, 1988, as Conditional Use Permit No. 88-7 and Coastal Development Permit No, 88-3. The proposal for Pierside Pavilion was for a 90,000 square foot entertainment complex, including retail, office, and a 6-plex movie theater. On March 6, 1990, the Planning Commission approved Conditional Use Permit No. 89-61, a request by Pepper's restaurant to modify the conditions of approval of Conditional Use Permit No. 88-7. The request was to provide for enlarging the proposed nightclub from 3,000 square feet, as originally approved, to an approximately 3,500 square foot nightclub integrated within a 13,000 square feet total Peppers restaurant/Golden Bear nightclub complex. Conditional Use Permit No. 89-61 also modified Conditional Use Permit No. 88-7 by allowing the nightclub to be located along the pedestrian plaza, rather than along Main Street. Coastal Development Permit No. 90-21 was filed to modify Coastal Development Permit No. 88-3 and address the increased intensity of use. The Zoning Administrator approved Coastal Development Permit No. 90-21 on June 13, 1990, based on a proposed valet plan, to be submitted and approved as a condition of approval. Commissioner Leipzig subsequently appealed the decision. STAFF RECOMMENDATION: 1. Approve Coastal Development Permit No. 90-21 with findings, to modify the square footage mix of uses approved by Coastal Development Permit No. 88-3. 2. Approve Conditional Use Permit No. 90-37 with findings and conditions of approval, to modify the square footage mix of uses approved by Conditional Use Permit No. 88-7. THE PUBLIC HEARING WAS OPENED. Doug Langevin, 8196 Pawtucket, stated that he owns property within 300 feet of the project and was not notified of the public hearing. He was opposed to the request due to concerns of inadequate parking and felt that the certificate of occupancy should not be granted until the parking structure was completed. Dick Harlow, representing the applicant, urged the Commission to move ahead with the request as time was at a critical point. He said that California Resorts would not be opposed to come back to the Commission with a parking plan. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Howard Zelefsky, the Planning Director, reported that it did not appear that Mr. Langevin's property falls within the 300 foot notification radius. PC Minutes - 7/24/90 -2- (6792d) 7 Commissioner Kirkland stated support of the request and the changes because there was little to go on when the plans were first made. He said; however, was opposed to valet parking in that it is not compatible with the aims and goals of Redevelopment. He said attendant parking would be more acceptable. Commissioner Williams also supported the request; however felt strongly that a parking management plan be reviewed and approved by the Commission. Chairwoman Ortega stated opposition to the request because projects of this type should have the parking management plan submitted with the request. A MOTION WAS MADE BY KIRKLAND, SECOND BY SHOMAKER TO APPROVE CONDITIONAL USE PERMIT NO. 90-37/COASTAL DEVELOPMENT PERMIT NO. 90-21 WITH FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Shomaker Mountford, Williams, Kirkland Leipzig NOES: Ortega ABSENT: Bourguignon ABSTAIN None MOTION PASSED FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 90-21: 1. The proposed mixed commercial development conforms with the plans, policies, requirements and standards of the Huntington Beach Coastal Element of the General Plan, including provision of adequate parking for new development in the Coastal Zone, because the valet plan for the Pavilion structure combined with the City structure will accommodate the demand generated. 2. Coastal Development Permit No. 90-21 is consistent with the CZ (Coastal Zone) suffix, the Downtown Specific Plan and other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed mixed commercial development can be provided with infrastructure in a manner that is consistent with the Huntington Beach Coastal Element and Coastal Land Use Plan of the General Plan. 4. The proposed mixed commercial development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. PC Minutes - 7/24/90 -3- (6792d) FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 90-37: 1. The location and design of the proposed valet parking properly adapts the structures to the proposed mix of uses in a harmonious manner. Through the use of valet parking the additional parking spaces required by the modified mix of uses can be provided. 2. The access to and parking for the mixed use development as proposed does not create an undue traffic problem. 3. The proposed mix of uses is consistent with the General Plan Land Use Designation of Visitor Serving Commercial, and implements the provisions of the Downtown Specific Plan District 3 (Visitor Serving Commercial). CONDITIONS OF APPROVAL: 1. A full size (18 inch X 24 inch) parking management plan shall be submitted for review and approve by the Planning Commission. The plan shall detail those areas reserved for attendant parking and self parking during each hour that the structure is open. A written narrative shall accompany the plan, which details the method of transitioning spaces from self parking to attendant parking as the need increases. The narrative shall describe the percentage of attendant versus self parking during each hour, and its location. The narrative shall also outline a plan for validated parking in the structure for patrons of Pierside Pavillion. A minimum of 2 hours validated parking shall be provided to the customers of Pierside Pavilion. 2. Any change in type of use and/or square footage which would increase the number of required parking spaces shall be subject to review and approval by the Planning Commission. 3. All applicable conditions of Conditional Use Permit No. 88-7 and Coastal Development Permit 88-3 shall remain in effect. B-1 CODE AMENDMENT 90-3/NEGATIVE DECLARATION 90-17 APPLICANT: Jim Caviola LOCATION: City Wide Code Amendment No. 90-3 is a request to amend Articles 911 (Low Density Residential), 912 (Medium, Medium High, and High Density Residential Districts), and 942 (Water Recreation Districts) to allow projecting decks up to five (5) feet beyond the bulkhead. Currently, the code only allows such projections in the single family residential zones (R1). PC Minutes - 7/24/90 -4- (6792d) ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time, the Department of Community Development advertised draft Negative Declaration No. 90-17 for twenty-one (21) days, and no comments, either verbal or written were received. The staff, in its initial study of the project, has recommended that a negative declaration be issued. Prior to any action on Code Amendment No. 90-3, it is necessary for the Planning Commission to review and act on Negative Declaration No. 90-17. STAFF RECOMMENDATION: Continue Code Amendment No. 90-3/Negative Declaration No. 90-17 to September 5, 1990 to allow sufficient time to receive comments from a scheduled meeting of the Huntington Harbour Code Committee. THE PUBLIC HEARING WAS OPENED. Chairwoman Ortega advised that anyone who speaks at the meeting may not be able to speak again when the item is heard in September. Jim Caviola, the applicant, said he would prefer to address the Commission in September. THERE WERE NO PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CONTINUED OPEN. Commissioner Leipzig supported the continuance and suggested that areas that apply be superimposed on the map. He also requested an amendment into the Code requiring the Planning Division to periodically review with the Department of Fish & Game the Ell Grass Bed mapping. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class 1, Section 15301 of the California Environmental Quality Act. STAFF RECOMMENDATION: Approve Conditional Use Permit No. 90-21 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. The location, site layout, and design of the existing restaurant with on -site sale of beer and wine properly adapts the existing and proposed use to streets, driveways, and other adjacent structures and uses in a harmonious manner. The site is provided with adequate on -site parking and is buffered from the residential uses to the west. 2. The combination and relationship of the existing restaurant with the proposed on -site sale of beer and wine are properly integrated. The existing restaurant is provided with adequate seating and floor area to accommodate the addition of on -site sale of beer and wine. 3. The access to and parking for the existing restaurant does not create an undue traffic problem. Access to the site is provided on Beach Boulevard and Knoxville Avenue and the existing twenty-two (22) on -site parking spaces is adequate for the existing commercial uses. PC Minutes - 7/24/90 (6792d) CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 17, 1990 shall be the conceptually approved layout. 2. The restaurant shall comply with all applicable provisions of the Ordinance Code, Uniform Building Code, and Uniform Fire Code. 3. All Alcoholic Beverage Control (ABC) requirements shall be met prior to alcohol sales. 4. Live entertainment shall be prohibited unless a conditional use permit for such entertainment is granted by the Planning Commission. 5. Hours of operation shall be from 11:00 a.m. to 9:00 p.m. daily. 6. The Planning Commission reserves the right to revoke Conditional Use Permit No. 90-21 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. B-4 CONDITIONAL USE PERMIT NO. 90-14 APPLICANT: Eldon W. Bagstad LOCATION: 470 Pacific Coast Hwy. Conditional Use Permit No. 90-14 is a request for an expansion of an existing market/liquor store into the adjacent retail space located at 414 Pacific Coast Highway (currently occupied by a surfboard shop). The expansion would increase the square footage of the market/liquor store from 1,422 square feet to 2,844 square feet. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class 1, Section 15301 of the California Environmental Quality Act. STAFF RECOMMENDATION: Approve Conditional Use Permit No. 90-14 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Eldon Bagstad, the applicant, concurred with the recommended conditions of approval including the added condition for an adjoining door located in the back to connect the two buildings. He said he had obtained a liquor license for the adjacent unit. PC Minutes - 7/24/90 -7- (6792d) In response to the Commission, Howard Zelefsky, the Planning Director, advised that the City would prefer to have the units combined to one address; however, Alcoholic Beverage Control requires two licenses and two separate addresses. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. COMMISSIONER WILLIAMS ADVISED HE WOULD BE VOTING AGAINST THE MOTION BECAUSE THE APPLICANT WOULD HAVE TWO LIQUOR LICENSES FOR TWO LOCATIONS AND WAS CONCERNED THAT ONE LOCATION COULD BE SOLD RESULTING IN TWO LIQUOR STORES ON THE SAME BLOCK. The granting of Conditional Use Permit No. 90-14 for alcohol sales for off -site consumption will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The market/liquor store is a permitted use within the Mixed Use designation of the Land Use Element of the General Plan. CONDITIONS OF APPROVAL: 1. A revised floor plan shall be submitted to the Department of Community Development depicting one integrated liquor store to prevent suites from being subdivided. 2. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. PC Minutes - 7/24/90 -8- (6792d) 1 3. All alcohol beverage control requirements shall be met prior to alcohol sales. 4. All proposed signage and exterior modifications shall be reviewed and approved by the Design Review Board. 5. The Planning Commission reserves the right to revoke Conditional Use Permit No. 90-14 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. B-5 SPECIAL SIGN PERMIT NO, 90-7 APPLICANT: Bentall Properties LOCATION: 7755 Center Avenue The request is to retain two 550 square foot leasing banners for approximately nine months which were installed in May, 1990. The applicant had obtained a temporary sign permit which expires on August 10, 1990. The signs are located on the top of a 12 story office tower, and oriented toward northbound and southbound motorists on the 405 freeway. The copy on the banners consists of the telephone number of the leasing agent and a logo. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class 11, Section 15311 of the California Environmental Quality Act. STAFF RECOMMENDATION: Approve Special Sign Permit No. 90-7 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Ashley Powell, representing the applicant, requested that the suggested condition of approval requiring a $5,000 cash bond be eliminated. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission concurred with staff that a cash bond was necessary; however, lowered the bond to $500. A MOTION WAS MADE BY MOUNTFORD, SECOND BY KIRKLAND TO APPROVE SPECIAL SIGN PERMIT NO. 90-7 WITH FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: PC Minutes - 7/24/90 ME (6792d) 1 Commissioner Leipzig advised that he would be voting against the motion due to problems the City had encountered with banners and because the length of time of the request was excessive. He felt a three month administrative action by staff would be more appropriate. Strict compliance with Article 961 will result in a substantial hardship to the applicant, because a 30 square foot sign would not be visible due to the height of the building and the distance to the primary targets (motorists on the 405 Freeway). 2. The proposed banner signs will not adversely affect other signs in the area because they will not block or interfere with such signs. 3. The proposed banner signs will not be detrimental to property located in the vicinity and will be compatible with the surrounding area, because they are oriented toward traffic on the 405 Freeway. 4. The proposed sign will not obstruct pedestrian or vehicular traffic vision. CONDITIONS OF APPROVAL: 1. The elevations received and dated July 11, 1990 shall be the conceptually approved layout. 2. The banners shall be maintained in a neat and attractive manner at all times. The signs shall be replaced if, upon inspection by the City of Huntington Beach Land Use Enforcement staff, they are found to be damaged, faded, or otherwise unreadable as intended. 3. A $500 cash bond shall be posted to ensure removal of the banners upon expiration of the permit period (May 10, 1991). 4. The Planning Commission reserves the right to revoke this Special Sign Permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs. PC Minutes - 7/24/90 -10- (6792d) B-6 SPECIAL SIGN PERMIT NO. 90-5 APPLICANT: AT3 Associates, Inc. PROPERTY OWNER: Campbell Automobile Group LOCATION: 18801 Beach Blvd. Special Sign Permit No. 90-5 is a request for a 20 foot tall, 64 square foot freestanding sign in lieu of the permitted height of 7 feet for this lot. The entire signage program for this project was reviewed by the Design Review Board at their meeting of April 26, 1990 with a recommendation that the freestanding sign should be made to conform to the sign code and be reduced to a maximum height of seven (7) feet. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class 15311, Section 11 of the California Environmental Quality Act. STAFF RECOMMENDATION: Deny Special Sign Permit No. 90-5 with findings. THE PUBLIC HEARING WAS OPENED. John Campbell urged the Commission's approval which would allow the dealership to be compatible with other signs along Beach Blvd. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. A MOTION WAS MADE BY WILLIAMS TO APPROVE SECIAL SIGN PERMIT NO. 90-5 WITH FINDINGS AND CONDITIONS OF APPROVAL. THE MOTION FAILED FOR LACK OF A SECOND. Strict compliance with 9610.5 will not result in a substantial economic hardship to the applicant because the location on Beach Boulevard adjacent to other auto dealerships serves better to attract customers than does an oversized sign. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class 1, Section 15301 of the California Environmental Quality Act. STAFF RECOMMENDATION: Approve Conditional Use Permit No. 90-22 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. LOCATION: 16672 Beach Blvd. (Marshall's Mall) Staff reported that the Design Review Board conditioned the applicant to submit a planned sign program for the center and to initiate remodel of the entire center. STAFF RECOMMENDATION: Approve Planned Sign Program 90-8 with amended findings and conditions of approval. Planned Sign Program No. 90-8 will provide for signage that reflects the size and layout of the shopping mall development, incorporating similar design elements in terms of materials, colors, illumination, and sign type. 2. Planned Sign Program No. 90-8 provides for signs that will be compatible with the architectural style and colors of the building. 3. The signs will be compatible with other signs in the surrounding area and with the intent of Article 961. 19 CONDITIONS FOR APPROVAL - PLANNED IGN PROGRAM_NO. 90-2-2s 1. The attached sign program dated June 8, 1990 shall be the approved program, with the following modifications: a. The Good Guys signage on the Beach Boulevard frontage shall be limited to a maximum of 200 square feet in area. b. The commercial unit with frontage on Terry Drive (Strouds) shall be limited to the approximately 85 square feet of sign area depicted on the Planned Sign Program, until such time as other allowable sign area is available for transfer. c. The Good Guys signage located on the back of the building shall be non -illuminated and limited to 12 inches in height. 2. The location of the proposed signs shall be generally as shown on the elevations dated June 8, 1990. 3.
