ZONING ADMINISTRATOR: STAFF MEMBER: MINUTES• REGULAR AGENDA ITEMS: Mike Strange Mike Connor The Minutes of the August 1, 1990 was approved by the Zoning Administrator as submitted. ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 89-4: Applicant: Phil Trinh 16732 Coral Cay Lane Huntington Beach, CA 92646 Request: To permit a one year story to an existing Section 989.5.3 (b) Ordinance Code Location: 16732 Coral Cay Lane Coastal Status: APPEALABLE extension of time to add a second single family dwelling pursuant to (3) of the Huntington Beach Mike Connor, Staff Planner, reported that Coastal Development Permit No. 89-4 was approved on March 1, 1989. The applicant submitted plans to the property owners association and received their approval on July 11, 1990. Staff recommended approval of the one year extension of time. COASTAL DEVELOPMENT PERMIT NO. 89-4 (ONE YEAR EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 89-4: 1. The request to permit the remodel and addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 89-4 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed remodel and addition to an existing two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed remodel and addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. All Conditions of Approval from the Notice of Action letter dated March 1, 1990. 2. The Fire Department requirements are: a. Automatic sprinkler systems shall be installed throughout to.comply with Huntington Beach Fire Department and Uniform Building Code standards if the gross floor area exceeds 5,000 square feet. 3. This permit shall expire March 1, 1991. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 90-10 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: TENTATIVE PARCEL MAP NO. 90-264 Applicant: Jamil Gammoh 327 llth Street Huntington Beach, CA 92648 Request: To consolidate two lots into one pursuant to Section 9921 of the Huntington Beach Ordinance Code. Location: 327 llth Street (South West Corner of llth Street and Orange Avenue). ZA Minutes - 8/8/90 -2- (6854d) 1 1-1 Mike Connor, Staff Planner, reported that the request is the result of a fire that occurred on the property to a single family residence on the back of the lot. He stated that the Department of Public Works is requesting that the applicant improve and dedicate a 2 1/2 foot alley dedication to city standards. A tentative parcel map is required to eliminate the lot line and permit reconstruction. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. James Gammoh, the applicant, concurred with the conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. TENTATIVE PARCEL MAP NO. 90-264 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed lot consolidation for purposes of commercial and residential use in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing commercial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. 5. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. ZA Minutes - 8/8/90 -3- (6854d) SPECIAL CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on July 12, 1990 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. A two and one half (2.5) foot alley dedication shall be dedicated to City standards. 4. Water supply shall be through the City of. Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s)). 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed. 6. All utilities shall be installed underground at the time said parcel(s) is/are developed. 7. The applicant shall comply with all applicable City Ordinances. 8. Street improvements shall be constructed to Public Works standards. 9. Upon completion of the above conditions, the applicant may submit a request for the waiver of the final parcel map in conjunction with an eight and one-half (8 1/2) inches by an eleven (11) inch plat map. Upon the granting of the final map waiver by the Zoning Administrator, the applicant shall record a "Covenant To Hold Properties As One Parcel" and the approved plat map with the Orange County Recorder's Office. A copy of the recorded covenant shall be filed with the Department of Community Development prior to final inspection issuance of building permits. ITEM 3• USE PERMIT NO. 90-43 Applicant: Denise DeVines 1 ZA Minutes - 8/8/90 -4- (6854d) Request: To permit a One Day Temporary Outdoor Event August 18, 1990, pursuant to Section 9730.64 of the Huntington Beach Ordinance Code Location: 16400 Pacific Coast Highway Mike Connor, Staff Planner, reported that the temporary outdoor event is to be held on August 18, 1990 between the hours of 11:00 AM and 5:00 PM and will take place in the southern portion of the parking lot. The event is a fund raiser for the Huntington Beach Pier and is sponsored by the Red Onion Restaurant. Staff noted that the Police Department was notified of the event and no comments had been received. Staff recommended approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. Chip Harvey, representing the applicant, was present and concurred with the conditions of approval. There were no other persons to speak for or against the request and the public hearing was closed. USE PERMIT NO. 90-43 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements -in the vicinity of such use or building. 2. The granting of Use Permit No. 90-43 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated July 20, 1990 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum with of (20) twenty feet. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). ZA Minutes - 8/8/90 -5- - (6854d) 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant's request shall include necessary permits for balloons and temporary signs. 7. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 8. All proposed tents shall be of fire retardant material. Proof of Certification shall be submitted to the Fire Department for approval prior to the tent's installation on the site. 9. The proposed tent shall be secured against collapsing to the satisfaction of the Fire Department. 10. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 11. A minimum of two (2) exits shall be provided and maintained. ITEM 4• USE PERMIT NO. 90-44 Applicant: Peter's Landing Marina Request: Temporary Outdoor Event, August 19, 1990 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code Location: 16400 Pacific Coast Highway Mike Connor, Staff Planner, reported that the temporary outdoor event is a meeting for the managers and tenants in the marina and is not open to the public. The meeting will take place on August 19, 1990 between the hours of 12:00 noon and 3:00 PM. Staff recommended approval with findings and conditions. ZA Minutes - 8/8/90 -6- (6854d) 1 THE PUBLIC HEARING WAS OPENED. Linda Rouan, representing the applicant, concurred with the conditions of approval. There were no other persons to speak for or against the request and the public hearing was closed. USE PERMIT NO. 90-44 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. ITEM 5• COASTAL DEVELOPMENT PERMIT NO. 90-26: Applicant: Maurice White 16174 Bimini Lane Huntington Beach, CA 92649 Request: To permit the remodel and addition of 224 square feet to an existing 1942 square foot townhouse, pursuant to Section 989.5.3.(b)(1) of the Huntington Beach Ordinance Code. The additions consist of a 132 square foot room addition to the second floor and a 92 square foot -addition to the first floor which was recently permitted. Location: 16174 Bimini Lane Coastal Status: APPEALABLE Mike Connor, Staff Planner, reported that the request is for an 224 square foot addition to the first and second story of an existing single family townhouse. The homeowners association reviewed the proposed plans and recommended approval. Staff recommended approval with findings and conditions. Dennis Groat, Fire Department, advised that if the overall townhouse structure exceeds 5,000 square feet, a new ordinance requires the enmtire structure to be sprinklered. 1 ZA Minutes - 8/8/90 -8- (6854d) 1 THE PUBLIC HEARING WAS OPENED. Maurice White concurred with the conditions of approval except for the condition requiring the entire building to be sprinklered. The sprinklering would be a hardship because there are eight units and the other seven owners would not want to participate. Mike Strange advised that the Zoning Administrator does not have authority to amend conditions required by the Fire Department. Dennis Groat suggested that the applicant meet with the Fire Marshall to request an exception of this condition. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 90-26 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO, 90-26: 1. The request to permit the remodel and addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 90-26 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Proposed structures shall be architecturally compatible with existing structures. 4. The Fire Department requirements are: a. Automatic sprinkler systems will be installed throughout the structure to comply with Huntington Beach Fire Department and Uniform Building Code standards. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2.
