ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Mike Connor, Herb Fauland MINUTES: The Minutes of the August 8, 1990 were approved as submitted and the Minutes of August 15, 1990 were continued to the Zoning Administrator meeting of August 29, 1990. REGULAR AGENDA ITEMS: ITEM 1• COASTAL DEVELOPMENT PERMIT NO 90-33/TENTATIVE PARCEL MAP 90-198 (R): Applicant: Walden and Associates 18012 Cowan, Suite 210 Irvine, CA 92714 Property Owner: Huntington Beach Company Request: To subdivide one (1) 206 acre parcel of land into two (2) parcels of land. Location: Area bordered by Garfield Ave, Goldenwest St., Seacliff Country Club and the westerly city boundary. Herb Fauland, Staff Planner, reported that the request was continued from the August 15, 1990 Zoning Administrator meeting to allow staff time to clarify issues regarding the appeal of Precise Plan of Street Alginment No. 89-4 to the California Coastal Commission. As proposed, Seapointe Avenue is part of the subdivision of the two parcels of land and therefore is critical to the tentative approval of the parcel map. Staff recommended amended conditions of approval regarding street dedications, net parcel acreage and final map approval contingent upon final approval of Precise Plan of Street Alignment No. 89-4 for Seapointe Avenue by the California Coastal Commission. Staff advised that the request is to subdivide two parcels for conveyance of the property and for financing purposes only. No development is proposed as part of the requested subdivision. Staff recommended approval with findings and amended conditions of approval. THE PUBLIC HEARING WAS OPENED. Russ Lines, representing the property owner, urged the Zoning Administrator's approval. He advised that the appeal before the Coastal Commission for Precise Plan of Street Alignment No. 89-4 for Seapointe Avenue had nothing to do with their request. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 90-33/TENTATIVE PARCEL MAP NO. 90-198(R) WERE APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO 90-33: 1. The request to subdivide one (1) 206 acre parcel of land into two (2) parcels conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 90-33 is consistent with the CZ suffix zoning requirements, the Zoning Districts, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed request to subdivide one (1) 206 acre parcel of land into two (2) parcels will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed request to subdivide one (1) 206 acre parcel of land into two (2) parcels conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. FINDINGS FOR APPROVAL: TENTATIVE PARCEL MAP NO. 90-198(R) 1. The proposed subdivision of one (1) 206 acre parcel of land into two (2) parcels for the conveyance and financing of real property only is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this land use at the time the land use designation for Planned Community allowing residential uses was placed on the subject property. The size, depth, frontage, street width and other design features of the proposed 206 acre subdivision into two (2) parcels as proposed are in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: TO BE COMPLETED PRIOR TO'USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on July 17, 1990, shall be the conceptually approved layout (with the amendments as noted thereon). 2. The following street and right of way dedications to City and Public Works standards shall be required: a. Goldenwest Street north of Clay Avenue: 60 feet to center line of Goldenwest Street b. Garfield Avenue west of Goldenwest Street to Edwards Street: 60 feet to centerline of Garfield Avenue. c. Garfield Avenue west of Edwards Street to Seapoint Avenue: 100 feet ultimate right of way. d. Garfield Avenue west of Seapoint Avenue to the westerly City boundary: 90 feet ultimate right of way. e. Seapoint Avenue south of Garfield Avenue: 100 feet ultimate right of way. 3. Final parcel map approval shall indicate the approved right of way cross sections for Garfield Avenue west of Edwards Street to Seapoint Ave. 4. Final parcel map approval shall indicate net acreage for each parcel of land. 5. Compliance with all applicable City Ordinances. 6. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 7. A copy of the recorded parcel map shall be filed with the Department of Community Development. ZA Minutes - 8/22/90 -3- (6982d) 8. Tentative Parcel Map No'. 90-198(R) shall not be deemed approved until the Precise Plan of Street Alignment No. 89-4 for the proposed Seapoint Avenue as depicted on Tentative Parcel Map No. 90-198 has been approved -by the California Coastal Commission. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 90-33/Tentative Parcel Map No. 90-198(R) if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: CONDITIONAL EXCEPTION NO, 90-32 Applicant: Michael Mehalick 320 22nd Street Huntington Beach, CA 92648 Request: To add to an existing structure which would exceed the 55% maximum site coverage. The applicant is requesting to add approximately 547 square feet to an existing 2020 square foot single family dwelling which exceeds the maximum 55% site coverage required by Section 9130.5 by approximately 2% (58.75 square feet). Location: 325 13th Street Mike Connor, Staff Planner, reported that the addition consists of expanding the game room onto the existing deck, constructing a crossover to a new master bedroom addition over the garage with a stairway leading to a deck above the new bedroom. Due to the alley dedication required the existing structure exceeds the 50% site coverage. The code allows a 55% site coverage provided the additional site coverage is offset by an equal amount of open space and the house remains two stories. The only additional site coverage is a result of the second story crossover which does not extend to the ground. He said the existing house does not meet open space requirements and the request includes a stairway to a third story deck which would provide the open space required by Code. Staff recommend approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Michael Mehalick, the applicant, said that the addition is compatible with the neighborhood. ZA Minutes - 8/22/90 -4- (6982d) Ll 1 CONDITIONAL EXCEPTION NO. 90-32 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Conditional Exception No. 90-32 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 5. The granting of Conditional Exception No.90-32 is necessary in order to preserve the enjoyment of one or more substantial property rights. 6. The granting of Conditional Exception No. 90-32 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 7. The granting of Conditional Exception No. 90-32 will not adversely affect the General Plan of the City of Huntington Beach. 8. The applicant is willing and able to carry out the purposes for which Conditional Exception No. 90-32 is sought and he will proceed to do so without unnecessary delay. 9. The location, site layout, and design of the proposed use properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. ZA Minutes - 8/22/90 -5- (6982d) SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, -floor plans, and elevations received and dated August 3, 1990 shall be the conceptually approved layout. 2. Any oil wells (active, idle, abandoned, etc) on property to be dedicated to the City shall be abandoned pursuant to Fire Department standards by the property owner, at the cost of the property owner, prior to City Acceptance of such property. 3. A two foot six inch alley dedication shall be dedicated to the City and improved to the Department of Public Works standards. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. All conditions of approval shall be printed verbatim on all working drawings submitted to the Building Division. 9. All applicable Public Works fees shall be paid prior to issuance of building permits. 10. No further additions to the home will be permitted. 11. Bay windows shall not extend to the floor. 12. A convenant shall be recorded to maintain the structure as a single family dwelling. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke this Conditional Exception if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ZA Minutes - 8/22/90 -6- (6982d) ITEM 3• USE PERMIT NO, 90-51 Applicant: Nola Skyler 5801 Middlecoff Dr. Huntington Beach, CA 92649 Request: To permit a rummage sale (Temporary Outdoor Event) August 25th and 26th pursuant to Section 9730.64 of the Huntington Beach Ordinance Code Location: 2205 Main Street (Seacliff Shopping Center, North Parking Lot) Mike Connor, staff planner, reported that the request for the rummage sale will be held in the rear parking lot of the Seacliff Shopping Center. Staff recommended approval with findings and conditions of approval. USE PERMIT NO. 90-51 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 90-51 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated August 7, 1990 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum with of (20) twenty feet. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. ZA Minutes - 8/22/90 -7- (6982d) 6. The applicant's request shall include necessary permits for balloons and temporary signs. 7. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 8. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 9. Stand by personnel shall be on site to safeguard premises. 10. An overnight security guard shall be provided to protect merchandise left overnight. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 90-51 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 4: USE PERMIT NO, 90-49 Applicant: Tom Graham 18337 Colville Street Fountain Valley, Ca 92708 Request: To permit the construction of a six (6) foot high fence ten (10) feet from the front property line pursuant to Section 9771(L) of the Huntington Beach Ordinance Code. Location: 16861 Saybrook Lane ZA Minutes - 8/22/90 -8- (6982d) Mike Connor, Staff Planner, reported that the he performed a field study and determined that the proposed fence would be compatible with other properties in the neighborhood. He said there are many walls in the front portions of the properties, the Huntington Harbour Mall is directly across the street which has an eight foot high wall and because Saybrook is a busy street. He recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Tom Graham, the applicant, concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. The Zoning Administrator asked the applicant if pilasters had been considered to be constructed at the front corners to maintain the current appearance. He stated that the pilasters would improve the appearance of the proposed fence and therefore would be included as a condition of approval. USE PERMIT NO. 90-49 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. Proposed structures shall be architecturally compatible with existing structures. INFORMATION ON SPECIFIC CODE REOUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. ITEM 5: COASTAL DEVELOPMENT PERMIT NO, 90-31 Applicant: Ross Boydell - R.E.B. Design 1018 N. Lemon St. Orange, CA. 92667 Request: To demolish an existing single family dwelling and construct 5,515 square foot single family dwelling pursuant to 989.5.3 (b) (1) of the Huntington Beach Ordinance Code. Location: 3311 Devon Circle, Huntington Beach, CA. 92649 Coastal Status: APPEALABLE Mike Connor, Staff Planner, reported that the request meets code requirements. The proposed lighthouse is considered to be ornamental if the stairs and floor are eliminated. Staff recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Ross Boydell, the applicant, agreed to the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. ZA Minutes - 8/22/90 -10- (6982d) L COASTAL DEVELOPMENT PERMIT NO. 90-31 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 90-31: 1. The request to permit the remodel and addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 90-31 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed construction two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed remodel and addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated July 17, 1990 shall be the conceptually approved layout with the following modification: a. The lighthouse shall be revised to eliminate the circular staircase and no third floor. It shall be considered an ornamental tower. b. The peak of the roof covering the ornamental tower shall not exceed 30 feet in height. 2. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 3. All proposed cantilevered deck improvements require separate permits for the improvements. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. The Public Works -Department requirements are: a. Repair and replace curb and gutter, driveway and sidewalk as needed. b. Water service shall be upgraded pursuant to Public Works standards. C. The applicant shall pay all applicable Public Works fees. 9. The Fire Department requirements are: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code standards. If the structure is determined to exceed 5000 gross square feet by the Building Division. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 90-31 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
