MINUTES: The Minutes of the August 29, 1990 were
approved as submitted.
REGULAR AGENDA ITEMS:
ITEM 1 ADMINISTRATIVE REVIEW NO 89-11/CONDITIONAL EXCEPTION NO.
89-43•
Applicant: Independent Development Compancy
Request: To permit a one year extension of time for:
Administrative Review No. 89-11 to permit the
construction of a 3,740 square foot retail
building, Conditional Exception No. 89-43 to
permit a 26.5 foot wide drive aisles in lieu of
27 foot wide aisles required by section 9603 of
the Huntington Beach Ordinance Code.
Location: 10001 Adams Ave. (Northeast corner of Brookhurst
St. and Adams Ave.)
Environmental This request is covered by Categorical Exemption,
Status: Section 15303, Class 3, California Environmental
Quality Act, 1986
Mike Connor, Staff Planner, stated that this request was originally
approved in 1989. Since the date of approval, the applicant has
been unable to proceed with construction due to a soil contamination
problem on -site. For this reason, a one-year extension of time has
been requested. Staff reported that building permits have been
obtained for the project.
Staff stated that the applicant wishes to revise the front facade of
the structure to include a canopy along Brookhurst Street.
Staff recommended approval of the request with the condition that
the project be reviewed and approved by the Design Review Board.
THE PUBLIC HEARING WAS OPENED.
Joan Leguay, applicant, was present and spoke in support of the
request.
The Zoning Administrator stated that he would recommend approval of
the extension with the following additional conditions:
1. SIX MONTH REVIEW OF THE REQUEST BY THE ZONING
ADMINISTRATOR.
2. BUILDING PERMITS SHALL REMAIN ACTIVE.
3. PROJECT ELEVATIONS SHALL BE REVIEWED AND APPROVED BY THE
DESIGN REVIEW BOARD.
There were no other persons present to speak for or against the
request and the public hearing was closed.
REQUEST FOR A ONE-YEAR EXTENSION OF TIME FOR ADMINISTRATIVE REVIEW
NO. 89-11/CONDITIONAL EXCEPTION NO. 89-43 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. ALL ACTIONS
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN CALENDAR (10) DAYS
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of extension of time will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the
City's General Plan and Land Use Map.
SPECIAL CONDITIONS OF APPROVAL:
1. All conditions from the previous Condition Letter dated August
23, 1989 shall apply.
2. The revised elevations shall be subject to review and approval
of the Design Review Board.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.

ITEM 2: ADMINISTRATIVE REVIEW NO. 90-15:

Request: To permit the procesing of expired
pharmacudicals with expanded office area
pursuant to Section 9510.01(C) of the Huntington
Beach Ordinance Code.
Location: 5722 Research Drive
Environmental This request is covered by Categorical Exemption,
Status: Section 15301, Class 1, California Environmental
Quality Act, 1986
Mike Connor, Staff Planner, reported that the request is to permit
the processing of expired pharmacudicals with an expanded office
area. This process is considered reverse -distribution by the State
of California. Staff reported that the expired pharmacudicals are
forwarded to the facility for documentation and sorting. The
expired pharmacudicals are then packaged in cannisters, stored
on -site, and transferred by truck to an incinerator facility for
destruction.
Eugene Fullerton, representing the applicant, was present.
The Zoning Administrator inquired as to whether or not a state
license was required for handling the expired pharmacudicals. Mr.
Fullerton stated that he was not sure if a state or federal license
was required but would consult with the applicant. The Zoning
Administrator stated that proof of a state/federal license would be
required prior to issuance of a certificate of occupancy.
ADMINISTRATIVE REVIEW NO. 90-15 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. ALL ACTIONS
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July 30, 1990 shall be the conceptually approved layout.
2. Should a Traffic

3. An automatic fire sprinkler system shall be approved and

4. Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
5. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
6. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
7. Low -volume heads shall be used on all spigots and water faucets.
8. All applicable Public Works fees shall be paid prior to
issuance of building permits.
9. The facility shall be equipped with a security system to be
approved by the Police Department.
10. Fencing shall be provided and maintained.
11. The existing system and materials stored must be fully reviewed
by the building division.
12. Supply quantities and concentrations of all materials shall be
regulated by Chapter 9 of the 1988 Uniform Building Code and
Article 80 of the 1988 Uniform Fire Code.
13. Prior to issuance of a Certificate of Occupancy for any portion
of the building, the applicant shall provide proof of all state
and federal permits to operate such facility to the Department
of Community Development.

Mike Connor, Staff Planner, reported that this item would be
continued to the next Zoning Administrator meeting of
September 12, 1990.
COASTAL DEVELOPMENT PERMIT NO. 90-27 WAS CONTINUED BY -THE ZONING
ADMINISTRATOR TO THE MEETING OF SEPTEMBER 12, 1990.
ITEM 4• HOME OCCUPATION PERMIT - JOHN WAITE REVOCATION HEARING:
Petition/: Home Occupation Permit for John Waite Revocation
Document Hearing
Complaint: The garage is being used in connection with the
business other than to park business vehicles.
Location: 17401 Lido Lane
Environmental This request is covered by Categorical Exemption,
Status: Section 15301, Class 1, California Environmental
Quality Act, 1986
The Zoning Administrator reported that the request is for a
revocation of the home occupation permit issued to John Waite. A
complaint was filed with the City that the garage is being used in
connection with the subject business other than to park business
vehicles.
Robert Waite, representing John Waite, was present.
Mike Gregory, Staff Planner, presented a staff report. Mr. Gregory
stated that an initial inspection was conducted last year. At that
time, the applicant stated that storage in the garage area was for
hobby only. Based upon staff's findings during the inspection and

conversation with the applicant, the case was closed for
non -violation of the home occupation permit.
Hildegard Briedenstein, complaintant, was present to speak in
support of revocation of the home occupation permit.
Charles Briedenstein was also present to support the revocation.
Mrs. Briedenstein stated that the defendant was violating his home
occupation permit, creating unnecessary traffic and noise in the
neighborhood, and hardship to her family and property.
David L. Beatty, neighbor, was present and spoke in opposition to
revocation of the home occupancy permit.
Lengthy discussion ensued between the defendant, complaintant, staff
and Zoning Administrator.
The Zoning Administrator stated that he would render a decision
concerning this matter within ten (10) days and all parties involved
would be notified of final action.
CONCERNING THE REQUEST FOR REVOCATION OF HOME OCCUPANCY PERMIT -
JOHN WAITE, A DECISION WILL BE RENDERED WITHIN TEN (10) DAYS BY THE
ZONING ADMINISTRATOR.
ITEM 5• HOME OCCUPATION PERMIT - WILLIAM BOREN REVOCATION HEARING:
Petition/: Home Occupation Permit for William H. Boren -
Document Revocation Hearing

Complaint: Persons residing off of the premises are employed
at the home.

Environmental This request is covered by Categorical Exemption,
Status: Section 15301, Class 1, California Environmental

The Zoning Administrator reported that the request is for a
revocation of the home occupation permit issued to William Boren. A
complaint was filed with the City that persons residing off of the
subject premises are employed at the home.
William Boren, defendant, was present.
Mike Gregory, Staff Planner, presented a staff report. Mr. Gregory
stated that an initial inspection was conducted on November 13, 1989
and that no violations were observed. A second inspection was
conducted on January 11, 1990. At that time, Mr. Gregory spoke with
Mr. Boren and determined that the business was in compliance with

home occupation permit provisions. Based upon staff's findings, the
case was closed for non -violation of the home occupation permit.
