ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Mike Connor MINUTES: The Minutes of the September 12, 1990 were approved as submitted and the minutes of September 19, 1990 were continued to the October 3, 1990 Zoning Administrator meeting. REGULAR AGENDA ITEMS: ITEM 1: TENTATIVE PARCEL MAP NO. 90-317 Applicant: Robert Brown Request: To consolidate nine (9) industrial parcels into two (2) 18,500 square foot parcels pursuant to sections 9920 and 9510.02 Location: 17611 and 17631 Metzler Lane Mike Connor, Staff Planner, reported that the tentative parcel map was a requirement of Administrative Review No. 90-3 which was approved to construct two industrial buildings on Metzler Lane. Staff advised that the Department of Public Works will require a five foot public utilities easement along Metzler Lane and the Fire Department will require one fire hydrant as well as a fire department hook up on each building. Staff recommended approval with findings and conditions of approval. The applicant was not present. TENTATIVE PARCEL MAP NO. 90-317 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed consolidation of nine (9) parcels into two (2) parcels for purposes of industrial use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for a general industrial district allowing industrial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. Tentative Parcel Map No. 90-317 received by the Department of Community Development on August 21, 1990 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Twenty two and one-half feet along the length of Metzler Lane shall be dedicated and improved to City standards for street purposes. 4. A five (5) foot wide Public Utilities easement along Metzler Lane shall be recorded with the Orange County Recorder's Office. 5. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 6. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 7. All utilities shall be installed underground at the time said parcel(s) is/are developed. 8. The development shall comply with all applicable City Ordinances. ZA Minutes - 9/26/90 -2- (7367d) 9. A copy of the recorded parcel map shall be filed with the Department of Community Development. 10. All vehicular access rights along Metzler Lane shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator. 11. Street improvements shall be constructed to Public Works standards. 12. All Fire Department conditions for Administrative Review 90-3 shall be completed. ITEM 2' CONDITIONAL EXCEPTION NO, 90-42 Applicant: Brian and Patti Medina Request: To permit a 713.5 square foot addition to an existing 1275 square foot single family residence. The applicant is requesting a reduced open space dimension of 22 feet in lieu of 25 feet as required by Section 9110.9(a) Location: 20941 Charwood Lane Mike Connor, Staff Planner, reported that the proposed addition requires a variance to permit the reduction in open space dimensions. Staff recommended approval on the basis that the residence was constructed toward the rear of the lot and the request meets the minimum square footage required by the code. THE PUBLIC HEARING WAS OPENED. Brian Medina, the applicant, concurred with the conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. CONDITIONAL EXCEPTION NO. 90-42 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; ZA Minutes - 9/26/90 -3- (7367d) b. Property and improvements in the vicinity of such use.or building. 2. The granting of Conditional Exception No 90-42 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. Granting of reduction in open space minimum dimension and minimum open space area will not reduce the required total open space area (900 Square Feet). 5. Because of special circumstances applicable to the subject property, including location of buildings, or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 6. The granting of Conditional Exception No.90-42 is necessary in order to preserve the enjoyment of one or more substantial property rights. 7. The granting of Conditional Exception No. 90-42 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 8. The granting of Conditional Exception No. 90-42 will not adversely affect the General Plan of the City of Huntington Beach. 9. The applicant is willing and able to carry -out the purposes for which Conditional Exception No. 90-42 is sought and he will proceed to do so without unnecessary delay. 10. The location, site layout, and design of the proposed use properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated August 29, 1990 shall be the conceptually approved layout. 2. Revised plans shall be submitted to the Planning Division depicting the following: a. A nine (9) foot wide entryway. b. A 16 foot wide family room. 3. The existing storage shed shall be removed prior to issuance of Building Permits. ZA Minutes - 9/26/90 -4- (7367d) 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. ITEM 3• USE PERMIT NO, 90-58 Applicant: Nancy L. Glass Request: To permit a six (6) foot high block wall five (5) feet from the front property line pursuant to Sec. 9771(L) of the Huntington Beach Ordinance Code. Location: 6712 Gate Hill Mike Connor, Staff Planner, reported that there are many homes located in the same tract with variances allowing garages at 7 feet from the sidewalk. The request for the block wall is compatible with others in the neighborhood. Staff advised that the subject property is on the golf course and is prohibited from having a fenced back yard. Staff recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Marillyn Pestolesi, 6762 Gatehill Circle, spoke in support of the request. She said she lives next to the Glass residence and feels that the wall will improve the property and the neighborhood. There were no other persons to speak for or against the request and the public hearing was closed. USE PERMIT NO. 90-58 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ZA Minutes - 9/26/90 -5- - (7367d) FINDINGS FOR APPROVAL: 1. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 90-58 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. The location, site layout, and design of the proposed wall properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, received and dated August 28, 1990 shall be the conceptually approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Proposed structures shall be architecturally compatible with existing structures. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. ITEM 4: USE PERMIT NO. 90-54 Applicant: Robert Stellrecht, Jr. Request: To permit the construction of a four (4) unit apartment project and a three (3) unit apartment project pursuant to Conditions of Approval for Conditional Exception No. 89-64 and Tentative Parcel Pap No. 89-443 Location: 7841 Glencoe ZA Minutes - 9/26/90 -6- (7367d) 1 Mike Connor, Staff Planner,'reported that the request for the use permit was the result of a condition of approval of a tentative parcel map. The proposed project meets setback, open space and parking requirements. Staff recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Bob Stellrecht, the applicant, was present and concurred with the conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of USE PERMIT NO. 90-54 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. The location, site layout, and design of the proposed use properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 5. The combination and relationship of one proposed use to another on site are properly integrated. 6. The access to and parking for the proposed use does not create an undue traffic problem. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated September 14, 1990 and floor plans, and elevations received and dated August 14, 1990 shall be the conceptually approved layout. 2. A revised plans shall be submitted depicting the modifications described herein: a. All second story decks shall have no dimension less than six (6) feet. ZA Minutes - 9/26/90 -7- (7367d) b. The site plan shall be revised to show all second story decks with dimensions to the nearest property line. The property line dividing Building A from Building B shall be shown on the site plan. 3. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Four (4) sets of landscape and irrigation plans to the Department of Community Development and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. Four (4) Landscape Construction Sets submitted to the Departments of Community Development and Public Works. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9608 and 9120.11 (F) of the Huntington Beach Ordinance Code . The set must be complete and approved by both departments prior to issuance of building permits. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 5. Should a Traffic Impact Fee be adopted by the City Council, the applicant/owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval. 6. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 7. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 8. A fire alarm system shall be installed to comply with Huntington Beach Fire Code and uniform fire code standards. The system shall include water flow, valve tamper and trouble detection, 24 hour supervision and audible alarms. 9. Driveway approaches shall meet Huntington Beach Standard 211 A and B and shall be of radius type construction. 10. A soils report and eroding plan shall be submitted to the Department of Public Works. ZA Minutes - 9/26/90 -8- (7367d) 1 F 1 C 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 12. Full Public Works improvements are required to the centerline of Glencoe Ave. 13. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 14. Low -volume heads shall be used on all spigots and water faucets. 15. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 16. Prior to issuance of building permits, the property owner shall submit an irrevocable reciprocal driveway and parking easement between the subject properties. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. The copy shall be filed with the Department of Community Development prior to occupancy. 17. All finish floors shall be constructed three (3) feet above highest adjacent curb. 18. Street lights shall be provided in locations and in number provided by the Department of Public Works. 19. All applicable Public Works fees shall be paid prior to issuance of building permits. 20. All Conditions of Approval shall be printed verbatim on all working drawings submitted to the building division. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 4. Landscaping shall comply with Section 9608 of the Huntington Beach Ordinance Code. ZA Minutes - 9/26/90 -9- (7367d) 5. The'Zoning Administrator reserves the right to revoke this Use Permit if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
