MINUTES: The Minutes of the September 19, 1990 were
approved as submitted and the minutes of
September 26, 1990 were continued to the
October 10, 1990 Zoning Administrator
meeting.
REGULAR AGENDA ITEMS:
ITEM 1: ADMINISTRATIVE REVIEW NO, 90-17
Applicant: Eric Donnelly
J.A. Hill Corporation
Request: To permit a sales office and model home complex
pursuant to Section 9730.32 of the Huntington Beach
Ordinance Code.
Location: 200 Pacific Coast Highway
Herb Fauland, Staff Planner, reported that the request is to permit
a sales office and model homes for the Pier Colony Condominiums
which are adjacent to Pierside Pavillion. Staff expressed concern
that the code required parking is not available for the handicapped
and that the parking may not be adequate. Staff further noted
concern regarding the availability of the elevator for handicapped
access to the model homes. Staff advised the applicant that a
$1,000 bond shall be required for each unit in the project. Staff
recommended approval with findings and suggested conditions of
approval.
Eric Donnelly, the applicant, concurred with the suggested
conditions of approval. He advised that visitors could park on
Second Street as well as the City parking structure and that he
anticipated the use of their parking structure and elevator within
the next week.
ADMINISTRATIVE REVIEW NO. 90-17 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED
THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED
TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
September 6, 1990 shall be the conceptually approved layout.
2. Prior to release of the model homes and sales office for
occupancy the following items shall be completed:
a. Handicapped access shall be provided and maintained to
the sales office and model homes during business hours.
b. The parking structure and elevator shall be released for
use and access to the model homes and sales office by the
Building Department.
c. The office use shall be discontinued within thirty (30)
days following sale of the last on -site unit. A cash
bond of one thousand dollars ($1,000) shall be posted
with the City for the sales office and for each model
home to guarantee compliance with all provisions of this
code and the Huntington Beach Building Code. Such model
homes shall only serve the Pier Colony project specified
in the administrative review application.
3. The sales office shall not be converted or expanded into a
general business office for the contractor or developer.
4. The administrative review permit may be subject to review by
the Board of Zoning Adjustments one (1) year after issuance
to insure compliance with all city codes.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions
of the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
ITEM 2' ADMINISTRATIVE REVIEW NO, 90-18
Applicant: Amy's Bakery and Cafe
Request: To permit an ice cream vending cart at Pierside
Pavillion.
Location: 300 Pacific Coast Highway
Herb Fauland, Staff Planner, reported that the request is to permit
an ice cream vending cart at Pierside Pavillion. The cart as

proposed would be placed in two locations; one facing Main Street
and the other facing Pacific Coast Highway. Staff recommended
approval with findings and suggested conditions of approval.
Jeff Jacobson, representing the applicant, was present and concurred
with staff's recommendation and with the suggested conditions of
approval.
ADMINISTRATIVE REVIEW NO. 90-18 WAS APPROVED BY THE ZONING .
ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED
THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED
TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, and cart photograph received and dated
September 14, 1990 shall be the conceptually approved layout.
2. Fire access lanes shall be maintained. If fire lane
violations occur and the services of the Fire Department are
required, the applicant will be liable for expenses incurred.
3. There shall be no outside storage of equipment or carts.
4. Only one cart shall be permitted. Any additional carts or
accessories shall require a separate Administrative Review.
5. A trash receptacle shall be provided within ten (10) feet of
the cart during sales times.
6. The Proposed cart shall not obstruct pedestrian traffic.
Upon notification by the Police Department the cart shall be
relocated to a more suitable location so that pedestrian
traffic is not obstructed.
7. The applicant shall obtain clearance from the Public
Liability Claims Coordinator, Administrative Services
Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed at least five (5)
days prior to commencement of business.
8. The applicant shall obtain permits from the Fire Department
for all cooking facilities, and heating units.
9. This application shall be subject to a six (6) month review
from the date of approval.
10. The cart shall not be located in the public right of way.
11. The Zoning Administrator reserves the right to revoke this
Administrative Review if any violation of these conditions or
the Huntington Beach Ordinance Code occurs.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The cart shall comply with all applicable provisions of the
Ordinance Code and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
ITEM 3• USE PERMIT NO, 90-53
Applicant: Robert Smith
Request: To permit a Temporary Outdoor Event - Advertising
Balloon - From November 19, 1990 to December 3, 1990
pursuant to Section 9730.64.
Location: 19316 Beach Boulevard
Herb Fauland, Staff Planner, reported that the request is to place a
cold air balloon on top of a building to help promote a business
within a newly constructed automobile center. Staff recommended
approval with findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Mel Berkley, representing the applicant, advised that the business
is located in the back of the lot and the event would be excellent
advertising. He concurred with the suggested conditions of approval.
There were no other persons to speak for or against the request and
the public hearing was closed.
USE PERMIT NO. 90-53 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS
TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity because the balloon is a temporary use and is to
be placed on top of the building so that adjacent parking
will not be impacted.
b. Property and improvements in the vicinity of such use or
building because the balloon is a temporary use and is to

2. The granting of Use Permit No. 90-53 will not adversely affect
the General Plan of the City of Huntington Beach because the
balloon will not change the land use and will not affect
traffic circulation.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated August 8, 1990 shall be the
conceptually approved layout.
2. The applicant's request shall include necessary permits for
balloons and temporary signs.
3. The applicant shall obtain clearance from the Public Liability
Claims Coordinator, Administrative Services Department, and/or
shall provide a Certificate of Insurance and Hold Harmless
Agreement to be executed at least five (5) days prior to the
event.
4. The proposed balloon shall be of fire retardant material.
Proof of Certification shall be submitted to the Fire
Department and Community Development Department for approval
prior to the balloon's installation on the site.
5. The applicant shall post a $100.00 dollar cash bond (cash,
cashiers check, money order) to insure that the balloon shall
be removed at the end of the temporary outdoor event.
6. The Zoning Administrator reserves the right to revoke this Use
Permit if any violation of these conditions of the Huntington
Beach Ordinance Code occurs.
INFORMATION OF SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the
Ordinance Codes, Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and
Federal Fire Codes, Ordinances and standards.
3. The Zoning Administrator reserves the right to revoke Use
Permit No. 90-53 if any violations of these conditions or the
Huntington Beach Ordinance Code occurs.
ITEM 4• USE PERMIT NO 90-40/ENVIRONMENTAL ASSESSMENT NO. 90-18
Applicant: City Of Huntington Beach
Request: To permit 1,000 sq. ft. expansion to the existing 1,000
sq. ft. Newland Barn pursuant to Section 9730.62 of the
Huntington Beach Ordinance Code.
Location: 19822 Beach Blvd.
Herb Fauland, Staff Planner, reported that parking is adequate to
permit a 1,000 square foot addition to the Newland Barn; however, a
parking and striping plan would be required subject to the approval
of the Director of Community Development. Staff also noted that the

proposed addition was reviewed and approved by the City of
Huntington Beach Design Review Board. Staff recommended approval
with findings and suggested conditions of approval.
Bill Sampson, Fire Department, reported that the expansion would be
required to meet the Uniform Fire Code with regards to occupancy.
Mike Strange, Zoning Administrator, said a condition would be added
that the entire project shall comply with the Uniform Fire Code and
Uniform Building Code with regards to occupancy.
USE PERMIT NO. 90-40/ENVIRONMENTAL ASSESSMENT NO. 90-18 WAS
APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity because with restriping the parking lot, the
proposed expansion will meet all standards of the code and
the building is at least 500 feet from any property zoned
or general planned for residential use.
b. Property and improvements in the vicinity of such use or
building. The project is located within an integrated
commercial center and will provide 100% of the required
parking.
2. The granting of Use Permit will not adversely affect the
General Plan of the City of Huntington Beach because the
proposed project is a permitted use in this area and will
enhance the social lifestyle of the area.
3. The proposal is consistent with the goals and objectives of the
City's General Plan and Land Use Map because the proposed
project is a permitted use in this area and will enhance the
social lifestyle of the area.
4. The location, site layout, and design of the proposed use
properly adapts the proposed structures to streets, driveways,
and other adjacent structures and uses in a harmonious manner.
5. The combination and relationship of one proposed use to another
on site are properly integrated.
6. The access to and parking for the proposed use does not create
an undue traffic problem because the access is proposed to be
taken from the existing driveways and with restripping, all
parking will be provided on site.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July 11, 1990 shall be the conceptually approved layout with
the following modifications:
a. A revised parking lot plan shall be submitted for review
and approval by the Director of Community Development.
2. The Fire Department requirements are as follows:
a. On -site fire hydrants and extinguishers shall be provided
in number and at locations specified by the Fire Department.
b. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
c. A fire alarm system will be installed and comply with Fire
Department regulations.
d. Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
e. Fire extinguishers will be installed and located in areas
to comply with Huntington Beach Fire Code Standards.
f. One (1) fire hydrant will be installed prior to combustible
construction. Shop drawings will be submitted to the
Public Works Department and approved by the Fire Department
prior to installation.
g. Address numbers will be installed to comply with Huntington
Beach Fire Code Standards.
h. Dimensions for Fire Access. Includes 24' or 27' fire
lanes, turnarounds and 17' by 45' radius turns.
i. Submit to the Fire Department for approval a Fire
Protection Plan containing requirements of Fire Department
Specification #426.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
4. Proposed structures shall be architecturally compatible with
existing structures. The colors and materials as recommended
by the Design Review Board on October 26, 1989 shall be
incorporated.
5. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
6. Low -volume heads shall be used on all spigots and water faucets.

7. If lighting is included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage" onto
adjacent properties.
8. A detailed soils analysis shall be prepared by a registered
soils engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and
utilities.
9. Existing mature trees on site shall be retained and
incorporated into the site plan if feasible. Any existing
mature tree that must be removed shall be replaced at a 2:1
ratio with 36" box trees which shall be incorporated into the
project's landscape plan.
10. If foil -type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Department.
11. Prior to the issuance of a grading permit, a grading plan shall
be submitted to the City's Department of Public Works. An
erosion control plan for all water runoff from the property
during construction and during initial operation of the project
shall be required by the Director of Public Works.
12. Information on equipment or facilities which may generate air
pollutants shall be submitted to the South Coast Air Quality
Management District staff for their review prior to the
issuance of a Certificate Of Occupancy for any use within the
building.
13. During cleaning, grading, earth moving or excavation, the
applicant shall:
a. Control fugitive dust by regular watering, paving
construction roads, or other dust preventive measures.
b. Maintain equipment engines in proper tune.
14. During construction, the applicant shall:
a. Use water trucks or sprinkler systems to keep all areas
where vehicles move damp enough to prevent dust raised when
leaving the site,
b. Wet down areas in the late morning and after work is
completed for the day,
c. Use low sulfur fuel (.05% by weight) for construction
equipment,
d. Phase and schedule construction activities to avoid high
ozone days (first stage smog alerts),

e. Discontinue construction during -second stage smog alerts.
15. Parking areas shall be restripped to satisfy parking code
requirement of sixty 9 foot wide by 19 foot deep parking spaces
in order to provide the required number of parking spaces.
16.
Construction shall be limited to Monday - Saturday 7:00 AM to
8:00 PM. Construction shall be prohibited Sundays and Federal
holidays.
17.
Prior to initiation of construction, police and fire
departments shall be notified and the departments shall be kept
informed about duration and extent of construction throughout
the process.
18.
Public Works Department shall provide alternate routes for
traffic during the construction phase, if necessary. Adequate
signage shall be provided to warn motor vehicles, bicyclists
and pedestrians of construction.
19.
The following program shall be implemented during grading and
construction activities on the property immediately adjacent to
the south side of the Newland Barn to mitigate impacts to
archaeological resources on the southern portion of the site:
a. A series of hand -controlled excavations in the area of
impact. These units should measure two meters square to
increase the area of exposure. The excavations should be
dug stratigraphically so that surfaces can be cleared off
and artifacts found in place over large exposed areas.
20.
Should any cultural materials be encountered during the initial
site survey or during grading and excavation activities, all
activity shall cease and the archaeologist shall determine the
appropriate course of action.
21. Should any human bone be encountered during any construction
activities on the site, the archaeologist shall contact the
coroner pursuant to Section 5097.98 and 5097.99 of the Public
Resources Code relative to Native American Remains. Should the
coroner determine the human remains to be Native American, the
Native American Heritage Commission shall be contacted pursuant
to State Law SB 297.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. Landscaping shall comply with Section 9608 of the Huntington
Beach Ordinance Code.

4. Prior to issuance of building permits the applicant shall
restripe the parking lot so that it conforms to provisions of
Article 960 of the Huntington Beach Ordinance Code.
