ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Mike Connor MINUTES: The Minutes of the September 26, 1990 and October 3, 1990 were approved as submitted. REGULAR AGENDA ITEMS: ITEM 1• USE PERMIT NO. 89-49 ONE YEAR EXTENSION OF TIME Applicants: Stephen R. Kilstofte Cayer, Kilstofte & Crayton Request: To permit a one year extension of time for Use Permit No. 90-49 to permit the construction of a five (5) unit apartment complex. Location: 7791 Glencoe Ave. Mike Connor, Staff Planner, reported that the that the original application was approved on September 13, 1989; however, since the approval, the applicant had passed away. The project was placed in probate and now the executor for the estate is requesting a one year extension of time. Staff recommended approval with all previous conditions of approval. THE PUBLIC HEARING WAS OPENED. No one was present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 89-49 (ONE YEAR EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. CONDITIONS OF APPROVAL: 1. All Conditions of Approval from the Notice of Action Letter dated September 13, 1990 shall still apply. ITEM 2: USE PERMIT NO, 89-52/CONDITIONAL EXCEPTION NO, 89-41 SIX MONTH EXTENSION OF TIME Applicant: Charles Suri Request: To permit a six month extension of time for Use Permit No. 89-52. To permit an addition to an existing nonconforming structure - and Conditional Exception No. 89-41 Location: 16692 Algonquin Street Mike Connor, Staff Planner, reported that the request is to permit two additional units to a non conforming structure and to permit a nine foot wide drive aisle in lieu of the 10 feet required by Code. Staff recommended approval of the six month extension of time with all previous conditions of approval. THE PUBLIC HEARING WAS OPENED. Mr. Suri, the applicant, said that the request is to allow additional time to obtain financing. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 89-52/CONDITIONAL EXCEPTION NO. 89-41 (SIX MONTH EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. CONDITIONS OF APPROVAL: 1. ITEM 3• TENTATIVE PARCEL MAP NO 90-323/COASTAL DEVELOPMENT PERMIT NO, 90-43 Applicant: Odin Enterprises, Inc. Request: To permit the subdivision of one single family residential lot into two lots pursuant to Sections 9110.2, 9920, and 9895.2 of the Huntington Beach Ordinance Code. Location: 17200 Sims Street Coastal Status: Non Appealable ZA Minutes - 10/10/90 -2- (7470d) Mike Connor, Staff Planner, reported that the parcel is 79 feet wide by 305 feet deep. The request would divide the parcel into a 140 deep parcel and a 160 foot deep parcel with a five foot street dedication along Simms. The access will take place from Hillside Circle. Staff advised that Hillside Circle is privately owned and the applicant will be required to obtain a written agreement signed by the four property owners to access the property from Hillside Circle prior to the subdivision. THE PUBLIC HEARING WAS OPENED. Ronald Jurs, the applicant,,advised that two of the property owners had been out of the country and had recently returned. He said that they will not authorize the access off of Hillside. He said if the subdivision was not approved, he would construct one house on the front of the lot with a guest house in back. Staff stated that only one residence could be constructed on the site by Code unless an attached "granny unit" were approved by the Planning Commission subject approval of a conditional use permit. Dolly Smith, 17202 Sims, said that her property is directly adjacent to the request. She stated concern that if the proposed subdivision was elevated to the level of Hillside, the property would drain onto her property. There were no other persons present to speak for or against the request and the public hearing was closed. Mike Strange, the Zoning Administrator, advised that the Department of Public Works would not approve a grading plan unless water runs off onto a street. He,stated that he would approve the request; however, the applicant would be required to obtain all the property owners permission to access off of Hillside Circle prior to any submittal to process the final map. TENTATIVE PARCEL MAP NO. 90-323/COASTAL DEVELOPMENT PERMIT NO. 90-43 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH CONDITIONS OF APPROVAL. HE STATED THIS ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE CITY COUNCIL WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL FOR TENTATIVE PARCEL MAP NO, 90-323: 1. The proposed subdivision of two (2) parcels for purposes of residential use in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for land use as well as setting forth objectives implementation of this type of use. this type of for ZA Minutes - 10/10/90 -3- (7470d) 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing commercial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO, 90-43: 1. The request to subdivide one single family residential lot into two lots conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan because no ocean views or public coastal access will be obstructed. 2. Coastal Development Permit No. 90-43 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property because no ocean views or public coastal access will be obstructed. 3. At the time of occupancy, the two proposed single family residences will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed subdivision of one single family lot into two lots conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act because no ocean views or public coastal access will be obstructed. SUGGESTED CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. Tentative Parcel Map No. 90-323 received by the Department of Community Development on August 17, 1990 shall be the approved layout. 2. Prior to approval of the final map, a written agreement from all owners of the private street shall be signed and recorded approving the use of the private street (Hillside Circle) for access to parcel 2. 3. Parcel 2 shall provide two (2) additional parking spaces on site for guest parking. Fil 1 ZA Minutes - 10/10/90 -4- (7470d) 4. No on street parking is permitted for parcel 2 on Hillside Circle. 5. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 6. Five (5) feet along Simms Street shall be dedicated to City standards. 7. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 8. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 9. All utilities shall be installed underground at the time said parcel(s) is/are developed. 10 The Development shall Comply with all applicable City Ordinances. 11 A copy of the recorded parcel map shall be filed with the Department of Community Development. 12. All vehicular access rights along Simms Street shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator. 13. Street improvements shall be constructed to Public Works standards. 14. Should a Traffic Impact Fee be adopted by the City Council, the applicant/property owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval. 15. The applicant/property owner shall be responsible for paying the Park and Recreation Fees in effect at the time the final map is accepted by City Council or issuance by building permits, whichever occurs first.
