ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Mike Connor MINUTES: The Minutes of the October 17, 1990 Zoning Administrator Meeting were approved as submitted. REGULAR AGENDA ITEMS: ITEM 1: CONDITIONAL EXCEPTION NO. 90-44 Applicant: Catherine A. Garland Request: To permit a four and one half (4 1/2) foot corridor (stairway) in lieu of seven (7) feet as required by Section 9130.13(d) of the Huntington Beach Ordinance Code. Location: 208 Lincoln Mike Connor, Staff Planner, reported that the request is to permit a 4 1/2 foot stairway (crossover) from the living area on the first floor of the house up to the addition over the garage. He stated that a seven foot wide crossover could not be constructed because the existing structure has bedrooms on the second floor and because a seven foot wide opening on the first floor would not allow for a shear wall required by the Building Division. Staff recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Catherine Garland, the applicant, presented a model depicting the addition. She requested that the outside closet shown on the plans be deleted from the approval. There were no other persons present to speak for or against the request and the public hearing was closed. CONDITIONAL EXCEPTION MAP NO. 90-44 WAS APPROVED BY THE ZONING ADMINISTRATOR DELETING THE OUTSIDE CLOSET WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 2. The granting of Conditional Exception No.90-44 is necessary in order to preserve the enjoyment of one or more substantial property rights. The floor plan and structural design of the existing structure prohibit the addition from being constructed to code. 3. The granting of Conditional Exception No. 90-44 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The project meets all other standards of code and the project is quite similar to other projects in the area. 4. The granting of Conditional Exception No. 90-44 will not adversely affect the General Plan of the City of Huntington Beach. 5. The applicant is willing and able to carry out the purposes for which Conditional Exception No. 90-44 is sought and he will proceed'to do so without unnecessary delay. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated September 14, 1990 shall be the conceptually approved layout. 2 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. Low -volume heads shall be used on all spigots and water faucets. 5. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 6. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. ZA Minutes - 10/24/90 -2- (7637d) INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke this Conditional Exception 90-44 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 2: CONDITIONAL EXCEPTION NO, 90-47 Applicant: P.A.C. Consulting and Design Request: To permit a five (5) foot exterior side yard setback in lieu of ten (10) feet as required by Section 9110.8(b) of the Huntington Beach Ordinance Code. Location: 9601 Castine Drive Mike Connor, Staff Planner, reported that the property is located at the end of a cul-de-sac with one side abutting Brookhurst. The subject parcel is approximately 59 feet wide at the front end of the driveway where the proposed garage expansion is closest to Brookhurst Street (five feet). A typical exterior lot is approximately 65 feet wide in order to allow for the additional five feet of setback that is required for exterior side yard setbacks. In addiition, the lot is irregular in shape thereby creating an additional hardship. The intent of Section 9110.8 (b) is for parcels at the corner of two intersecting streets. Castine is a cul-de-sac and does not connect with Brookhurst Street. None of the surrounding residents will be impacted by the project. Staff recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Jesse Raymond, representing the applicant, concurred with staff's recommendation and the conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. The Zoning Administrator said he would approve the request with an added condition requiring all new windows to be dual glazed to mitigate the noise impact from Brookhurst Street. CONDITIONAL EXCEPTION NO. 90-47 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ZA Minutes - 10/24/90 -3- (7637d) FINDINGS FOR APPROVAL: 1. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The granting of Conditional Exception No. 90-47 will not adversely affect the General Plan of the City of Huntington Beach. The property has a low density residential land use designation which permits single family residential development. 7. The applicant is willing and able to carry out the purposes for which Conditional Exception No. 90-47 is sought and he will proceed to do so without unnecessary delay. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated September 24, 1990 shall be the conceptually approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. Low -volume heads shall be used on all spigots and water faucets. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 4. The Zoning Administrator reserves the right to revoke this Conditional Exception if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
