ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Mike Connor MINUTES: The Minutes of the October 24, 1990 Zoning Administrator Meeting were approved as submitted. REGULAR AGENDA ITEMS: ITEM 1• USE PERMIT NO, 90-65 Applicant: Barker Bros/Pat Faust Request: To permit a temporary outdoor event - tent sale - November 9-11, 1990 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 7777 Edinger Mike Connor, Staff Planner, reported that the tent sale would be held in the Huntington Center parking lot on November 9 through 11. He advised that the standard conditions of approval would be imposed along with a condition requiring an overnight security guard. Staff recommended approval with findings and conditions of approval. The applicant was present and concurred with the suggested conditions of approval. USE PERMIT NO. 90-44 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: `1 a. The general welfare of persons residing or working in the vicinity. The proposed tent is located in a remote portion of the parking lot therefore the temporary reduction in parking should have no impact on other businesses. b. Property and improvements in the vicinity of such use or building. The proposed tent is temporary. 2. The granting of Use Permit No. 90-65 will not adversely affect the General Plan of the City of Huntington Beach. The proposed tent use is temporary. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated October 11, 1990 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum with of (20) twenty feet. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant's request shall include necessary permits for balloons and temporary signs. 7. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 8. All parking shall be a minimum of forty (40) feet from the proposed tent. 9. The proposed tent shall be of fire retardant material. Proof of Certification shall be submitted to the Fire Department for approval prior to the tent's installation on the site. 10. The proposed tent shall be secured against collapsing to the satisfaction of the Fire Department. 11. "No Smoking" signs shall be posted in conspicuous locations. 1 ZA Minutes - 10/31/90 -2- (7705d) 12. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 13. A minimum of two (2) exits shall be provided and maintained. 14. Stand by personnel shall be on site to safeguard premises. 15. An overnight security guard shall be provided to protect merchandise left overnight. The Huntington Beach Police Department shall be notified 24 hours prior to the event. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 90-65 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 2• ADMINISTRATIVE REVIEW NO. 90-19 Applicant: Russel Gendron Stubby's Recycling Property Owner: Lusk Co. Request: To permit outdoor storage bins in conjunction with a Recycling Center pursuant to Section 9510.01 S of the Huntington Beach Ordinance Code. Location: 15591 Computer Lane Mike Connor, Staff Planner, reported that the request was the result of a citizen complaint. He advised that Code Enforcement staff has worked with the applicant and a considerable amount of work had been accomplished to clean up the site. The Zoning Administrator commended the applicant for his work. Staff indicated that the application is for the placement of storage bins in the area required for parking. Staff had visited the site to examine the operation of the business and evaluate the impact that the reduction in parking has upon the operation. One of the site visits on a Saturday, revealed 5 to 8 cars backed up into the street waiting to get into the facility to unload. In addition, other customers were parking on the street and carrying ZA Minutes - 10/31/90 -3- (7705d) their recyclable materials into the facility. Because of these conditions, the storage bins within the parking area impact adjacent businesses as well as the public streets. Staff recommended denial with findings. Russel and Bonnie Gendron were present and said that the problem is due to an automotive repair shop parking large trucks in front of their building. Mr. Gendron said that they have been at that location for three years and there had been no accidents. He said they were searching for a new location. ADMINISTRATIVE REVIEW NO. 90-19 WAS CONTINUED TO THE MEETING OF NOVEMBER 21, 1990 BY THE ZONING ADMINISTRATOR. ITEM 3: USE PERMIT NO. 90-56 Applicant: Carl Karcher Enterprises, Inc. Lorenzo Reyes Request: To permit the demolition of an existing restaurant and to permit the construction of a new 2,877 sq. ft. restaurant with drive through facilities pursuant to Section 9220.1(c)R of the Huntington Beach Ordinance Code. Location: 6882 Warner Mike Connor, Staff Planner, reported that there are circulation and design flaws with the proposed request. He said the proposed drive-thru is placed too close to the reciprocal access easement which would result in stacking of vehicles onto the easement and out into Warner Avenue. Staff visited the site during lunch hour and reported between 5 to 7 vehicles consistently stacked behind the menu board. In addition, the parking spaces on the east side of the proposed building would back up into the reciprocal access easement and could obstruct access to retail shops to the rear of that property. This indicates that the proposed design would impact adjacent businesses as well as the street system. He concluded by recommending denial based on findings. THE PUBLIC HEARING WAS OPENED. Lorenzo Reyes, representing Carl Karcher Enterprises, Inc., advised that the restaurant is number 67 of over 500 restaurants. He said that an updated restaurant would run more efficiently. He said that they do not want vehicles stacking as it would result in customers going to another fast food restaurant. The Company advertises 60 second service or the customer receives a coupon for free food. He stated that they do not wish to revise the plans. There were no other persons present to speak for or against the request and the public hearing was closed. ZA Minutes - 10/31/90 -4- (7705d) 1 F1 USE PERMIT NO. 90-56 WAS DENIED BY THE ZONING ADMINISTRATOR WITH FINDINGS. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR DENIAL: 1. The establishment, maintenance and operation of the use will be detrimental to: a. The general welfare of persons working in the vicinity. Stacking for the proposed drive thru will obstruct reciprocal access easements and will impact the flow of traffic on Warner Avenue.; b. Property and improvements in the vicinity of such use or building. Back up from the parking spaces on the east side of the building will obstruct access to the retail stores to the rear of the adjacent property. 2. The granting of Use Permit No. 90-56 will adversely affect the General Plan of the City of Huntington Beach. The proposed circulation is not compatible with other land uses. 3. The proposal is not consistent with the goals and objectives of the City's General Plan Circulation Element. The stacking for the drive through will result in restricting one or more lanes of Warner Avenue which will prohibit the safe and efficient movement of people and goods. 4. The location, site layout, and design of the proposed use does not properly adapt the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The stacking for the drive through as well as the backup for cars parked along the east side of the building will restrict access to adjacent uses and flow of traffic on Warner Ave. THE MEETING WAS ADJOURNED AT 2:30 PM BY THE ZONING ADMINISTRATOR TO A STUDY SESSION ON MONDAY, NOVEMBER 5, 1990 AT 4:30 PM AND THEN TO THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON WEDNESDAY, NOVEMBER 7, 1990, AT 1:30 PM.
