ORAL COMMUNICATIONS (4 MINUTES PER PERSON, NO DONATING OF TIME TO OTHERS) Anyone wishing to speak must fill out and submit a form to speak prior to Oral Communication or Public Hearing items. No action can be taken by the Planning Commission on this date, unless agendized. Larry Geisse, 6811 Corral Circle, stated that he had taken offense to one of the Commissioner's comment at a previous meeting. He said the Commissioner said he was bored and angered with the four (4) hours of public testimony. Mr. Geisse stated that if the residents of this City come to speak they should be listened to. He said the citizens are seeing and living the effects of Redevelopment and they have the right to speak. Commissioner Bourguignon stated that he was the one who had made the comment. He stated that he was referring to incorrect quotes, mistruths and halftruths being stated, not the speakers themselves. A MOTION WAS MADE BY LEIPZIG, SECOND BY WILLIAMS TO BRING ITEM D-1 TO THE FRONT OF THE AGENDA, AS A DISCUSSION ITEM WITH NO ACTION TO BE TAKEN, BY THE FOLLOWING VOTE: AYES: Shomaker, Mountford, Williams, Ortega, Kirkland, Bourguignon,,Leipzig NOES: None ABSENT: None ABSTAIN: None MOTION PASSED D-1 ANGUS PETROLEUM UPDATE: Staff presented the adopted conditions of approval for Angus Petroleum and discussed with the Commission the status of compliance for each. Commissioner Leipzig had questions regarding the terminology used, such as pending and complied. He suggested that staff develop some language for future reports with more description of what is actually happening at the present time and what is expected in the future. The Commission discussed how many wells have currently been abandoned, and requested a map to show where they are located. The Fire Department stated that as to Fire Standards, at this stage they are satisfactory. The Commission requested that this item come up for another review in one year. B. PUBLIC HEARING ITEMS B-1 CONDITIONAL USE PERMIT NO 90-49/NEGATIVE DECLARATION N0. 90-52 (CONTINUED FROM THE OCTOBER 16, 1990 PLANNING COMMISSION MEETING)• APPLICANT: CITY OF HUNTINGTON BEACH LOCATION: 7111 Talbert Avenue Conditional Use Permit No. 90-49 and Negative Declaration No. 90-52 is a request to expand the Talbert Library (Main Branch) by 26,476 square feet to include a childrens wing and conference and meeting rooms. On the recommendation of the Design Review Board, the Library department agreed to prepare a scale model of the proposed expansion, for presentation to the Planning Commission. In order to allow time for completion of the model, the item was continued by the Planning Commission to November 20, 1990. A study session on the item was held on November 6, 1990. PC Minutes - 11/20/90 -2- (8027d) STAFF RECOMMENDATION: Staff recommends that the Planning Commission take the following action: A. Approve Negative Declaration No. 90-52; and B. Approve Conditional Use Permit No. 90-49 with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Neil Noble, architect, explained to the Commission the proposed phases. He showed them a detailed site plan of the existing building with changes that would be made. Dorthy Silverman, 3471 Venture Drive, President -Friends of the Library, said she was delighted that the architectural plans follow the design originally created by Neutra. Ms. Silverman stated she was very pleased with the project and urged the Commission for approval. Barbara Milkovich, 6032 Dundee Drive, Historic Resource Board, spoke in opposition to the design. Ms. Milkovich feels it violates the integrity of the previous architecture. She said an alternative design should be considered and the original design should be looked at before a decision is made. Clare Hansen, 5971 Edmonds Circle, feels the addition does not mar the integrity of the design but instead aesthetically enhances it. She urged approval. Bruce Powers, 20722 Egret Lane, President Library Patrons Fund, stated that this is the sixth year of raising funds for the children's wing. He feels the approval of this project will serve to motivate further fund raising and expedite the construction as costs go up with time. Hal MacDonald, 6901 Rio Vista, stated that the request is a well coordinated program, enthusiastically supported by the majority of the community. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE PROJECT AND THE PUBLIC HEARING WAS CLOSED. The Commissioners discussed with staff the pedestrian crossing, possible parking problems, and the different phases. They also questioned why the original design for an addition created by Neutra was not used. Neil Noble explained that for various reasons the plans needed to be updated. Some of the reasons included earthquake safety and energy conservation. A modification to the drive entrance was also discussed. The location, site layout and design of the proposed library expansion properly adapts the proposed structure to Talbert Avenue, the library parking lot, the existing library and Huntington Central Park. 2. The architectural design and materials of the proposed library expansion are properly adapted to the architectural design and materials of the existing library. 3. The combination and relationship of one proposed use to another on the site are properly integrated. 4. The access to and parking for the proposed library expansion does not create an undue traffic problem. SUGGESTED CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 90-49: 1. The site plan, floor plans and elevations received and dated November 9, 1990 shall be the conceptually approved layout with the following modifications: a. Any new pedestrian crossing of Talbert Avenue shall be at a separate grade. The existing crossing shall be retained at the drive entrance. b. To include the additional parking spaces required for both Phase I and II. PC Minutes - 11/20/90 -4- (8027d) 1 [1 c. To clearly identify the extent of work for each Phase (I and II). d. The drive entrance of Talbert shall be modified to provide for a more adequate and convenient access to the site, subject to approval by the Department of Public Works. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Depict all utility apparatus, such as but not limited to backflow devices and Edison transformers, on the site plan. They shall be prohibited in the front and exterior yard setbacks unless properly screened by landscaping or other method as approved by the Community Development Director. b. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units; and low -volume heads shall be used on all spigots and water faucets. C. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. d. Elevations shall depict colors and building materials proposed. e. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. f. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations. g. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. h. The Design Review Board shall review and approve a three dimensional model of the proposed expansion. PC Minutes - 11/20/90 -5- (8027d) 3. i. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the subject property. All structures within this development shall be constructed in compliance with the g-factors as indicated by the geologist's report. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review prior to the issuance of building permits. j. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. Prior to issuance of building permits, the applicant/owner shall complete the following: a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file. b. A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plant materials (location, type, size, quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Section 9608 of the Huntington Beach Ordinance Code. The set must be approved by both departments prior to issuance of building permits. Any existing mature trees that must be removed shall be replaced at a 2 to 1 ratio with minimum 36-inch box trees, which shall be incorporated into the project's landscape plan. c. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. d. Hydrology and hydraulic studies shall be submitted for Public Works approval. e. An interim parking and/or building materials storage plan shall be submitted to the Department of Community Development to assure adequate parking is available for employees, customers, contractors, etc., during the project's construction phase. Landscape irrigation system shall be designed and constructed to include a separate water line for the use of reclaimed water subject to Water Department approval. 5. Fire Department Requirements are as follows: a. Automatic sprinkler systems shall be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings shall be submitted to and approved by the Fire Department prior to installation. b. A Class III wet standpipe system (combination) shall be installed to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings shall be submitted to and approved by the Fire Department prior to installation. C. A fire alarm system shall be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings shall be submitted to and approved by the Fire Department prior to installation. The system shall provided the following: 1. Manual Pulls 2. Water flow, valve tamper and trouble detection 3. 24 hour supervision 4. Annunciation d. Fire extinguishers shall be installed and located in areas to comply with Huntington Beach Fire Code Standards. e. Elevators shall be sized to accommodate an ambulance gurney. Minimum 6 foot 8 inches wide by 4 foot 3 inches deep with minimum of 42 inch opening. f. Fire lanes shall be designated and posted to comply with Huntington Beach Fire Department Standard No. 415. g. Address numbers shall be installed to comply with Huntington Beach Fire Code Standards. The size of the numbers will be the following: 1. The number for the building will be sized a minimum of ten (10) inches with a brush stroke of one and one-half (1-1/2) inches. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. PC Minutes - 11/20/90 -7- (8027d) 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 9. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 10. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site; b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05% by weight) for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 11. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 12. Prior to issuance of a Certificate of Occupancy for each Phase, the following shall be completed: a. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District and submit a copy to Community Development Department. b. All improvements (including landscaping) to the property shall be completed in accordance with the approved plans and conditions of approval specified for each Phase. 13. This conditional use permit shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 14. Phase II construction shall be staged at the lower level. 15. Any modification to the conceptual designs and layouts shall require Planning Commission review and approval. Prior to the issuance of any building permits for Phase II a Parking and Circulation Plan shall be submitted to the Planning Commission for review and approval. 17. The areas set aside for staff parking shall be relocated to the south side of Talbert only. B-2 USE PERMIT N0, 89-25: APPLICANT: SOUTH COUNTY MOTORS LOCATION: 18685 Beach Boulevard (west side, approximately 710 feet south of Main Street) Use Permit No. 89-25 is a request to expand the service department for South County Volkswagon by 3,913 square feet, and to construct a 3,610 square foot showroom building for a Hyundai dealership pursuant to Section 9220.1(c)A of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Use Permit No. 89-25 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Don Stephens, 7401 Seabluff Drive, employee of applicant, stated that the improvements requested will create a more efficient operation and one that is more aesthetically pleasing. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission discussed the addition of a planned sign program and asked that it be incorporated in the conditions of approval. The location, site layout, and design of the proposed expansion to South County Volkswagon and new Hyundai dealership properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 2. The combination and relationship of one proposed to another on a site are properly integrated, because adequate customer parking, service parking, display and storage area as, and accessways are maintained. 3. The access to and parking for the proposed expansion and new dealership does not create an undue traffic problem, because 135 on -site parking spaces are provided. 4. The proposal brings the site into conformance with current code requirements for parking and landscaping by providing 135 on -site parking spaces, 8.6% landscaped area, and a 13.5 foot wide landscape buffer along Beach Boulevard. SUGGESTED CONDITIONS OF APPROVAL - USE PERMIT NO. 89-25: 1. The site plan, floor plans, and elevations received and dated November 14, 1990 shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. A tentative parcel map and conditional exception shall be submitted for review and approval which shall include an access easement for Continental Auto Rebuilders. e. A Planned Sign Program shall be reviewed by the Design Review Board and approved by the Planning Commission. The Planned Sign Program shall include a phasing schedule to bring all signs into conformance with the Huntington Beach Ordinance Code. PC Minutes - 11/20/90 -11- (8027d) 4. The Public Works Department requirements are as follows: a. Remove and replace deteriorated improvements. 5. Fire Department Requirements are as follows: a. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. b. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. c. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. d. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards. e. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire code Standards. The system will provided audible alarms, 24-hour supervision, and Water Flow Valve tamper and trouble detection. f. Fire extinguishers will be installed and located in areas to comply with the Huntington Beach Fire code Standards. g. Installation or removal of underground flammable or combustible liquid storage tanks will comply with Orange County Environmental Health and Huntington Beach Fire Department standards. h. Submit to the Fire Department for approval a fire protection plan containing requirements of specification 426. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Pay traffic impact fees, established by Ordinance 3048, at the time of issuance of the Certificate of Occupancy, or the final inspection, whichever is first. 14. This use permit shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. B-3 CONDITIONAL USE PERMIT NO. 90-54: APPLICANT: PACTEL CELLULAR LOCATION: 20422 Beach Boulevard (Northeast Corner of Beach Boulevard and Indianapolis Avenue) Conditional Use Permit No. 90-54 is a request to establish a cellular telephone facility consisting of electronic equipment housed within a commercial office suite and grid -panel antennas. The commercial office suite is located within the existing Seaview Plaza building. The grid -panel antennas will be mounted on the sides of the stairwell enclosure atop the roof of the office building. The request is pursuant to Section 9630.0 of the Huntington Beach Ordinance Code. PC Minutes - 11/20/90 -13- (8027d) STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 90-54 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Richard Wagner, representing Pactel Cellular, stated he was there to answer any questions the Commissioners may have regarding the request. The establishment, maintenance and operation of the cellular phone facility will not be detrimental to the general welfare of persons residing or working in the vicinity, nor to property and improvements in the vicinity. 2. The granting of the conditional use permit for a cellular phone facility will not adversely affect the General Plan of the City of Huntington Beach. 3. The cellular phone facility is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. The cellular phone facility will reduce parking demand at the site because the facility is unmanned. 5. The antennas will be screened by the rooftop screening and will therefore not be unsightly. SUGGESTED CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 90-54: 1. The site plan, floor plans and elevations received and dated September 20, 1990, shall be the approved layout with the following conditions: PC Minutes - 11/20/90 -14- (8027d) 1 1 a. Antennas shall be painted to match the rooftop stairwell. b. Microwave dishes shall not project above the rooftop parapet. c. The rooftop screening shall be compatible with the existing commercial/office building. 2. Placement of additional antennas on the site shall require approval by the Planning Commission. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 5. The Planning Commission reserves the right to revoke this conditional use permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs. B-4 CONDITIONAL USE PERMIT NO. 90-62: APPLICANT: SUZANNE BEUKEMA LOCATION: 522 Main Street (eastside of Main Street approximately 50 feet north of Sixth Street) Conditional Use Permit No. 90-62 is a request to permit the on -site sale of beer and wine in conjunction with an existing bona fide eating establishment (Suzanne's Main Street Cafe) pursuant to Section 9636.1B of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 90-62 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Suzanne Beukema, 522 Main Street, applicant, stated she was there to answer any questions the Commission may have. The site uses on -street parking and a public parking lot, therefore, the use will not impact the residential and public uses in the vicinity. 2. The combination and relationship of the existing restaurant with the proposed on -site sale of beer and wine are properly integrated. The existing restaurant is provided with adequate seating and floor area to accommodate the addition of on -site sale of beer and wine. 3. The access to and parking for the existing restaurant does not create an undue traffic problem. Access to the site is provided on Main Street and the existing twenty-five (25) off -site parking spaces and on -street parking is adequate for the existing commercial use. SUGGESTED CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 90-62: 1. The site plan and floor plans received and dated September 30, 1990 shall be the conceptually approved layout. 2. The restaurant shall comply with all applicable provisions of the Ordinance Code, Uniform Building Code, and Uniform Fire Code. 3. All Alcoholic Beverage Control (ABC) requirements shall be met prior to alcohol sales. 4. Hours of operation shall be Tuesday - Sunday 8:00 AM to 2:00 PM, closed 2:00 PM to 5:00 PM and open from 5:00 PM to 10:00 PM. 6. All signs shall be in conformance with Article 961 Signs of the Huntington Beach Ordinance Code. 7. The Planning Commission reserves the right to revoke Conditional Use Permit No. 90-62 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. B-5 CONDITIONAL USE PERMIT NO. 90-52/COASTAL DEVELOPMENT PERMIT NO. 90-35• APPLICANT: PACIFIC COAST HOMES LOCATION: 6501 Palm (approximately 430 feet north of the intersection of Morning Tide Drive and Opelia Lane) Conditional Use Permit No. 90-52 and Coastal Development Permit No. 90-35 is a request to relocate the existing golf course maintenance facility from Oil Island "N" to Oil Island "Q" pursuant to Section 9630.P of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 90-52 and Coastal Development Permit No. 90-35 with findings and conditions of approval. A discussion ensued among the Commissioners and staff regarding access to the Island and the trips generated by the trucks per week. THE PUBLIC HEARING WAS OPENED. Russ Lines, representing the applicant, stated that he was in agreement with the majority of the conditions except two. He discussed these with the Commission and staff and also explained the access to the Island and the trip generation created by delivery trucks. Louis J. Mannone, 19821 Ocean Bluff, spoke in opposition to the request. He explained that there is currently to much noise coming from the country club with parties and garbage trucks. Nancy Howard, 6551 Morning Tide Drive, spoke in opposition to the request. She said she agreed with the previous speaker, and questioned whether the Huntington Beach noise code was being followed. Ms. Howard also says she cannot sleep at night now because of the noise, this will only add to it. The Commissioners questioned whether any alternative sites had been given consideration. The applicant stated that they had considered other locations but this one best suited the needs. He also stated that no matter where it is located the noise factor would still be prevalent. The Commissioners discussed conditioning delivery hours to limit the impact of the noise. The access to and parking for the proposed maintenance facility does not create an undue traffic problem. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO, 90-35: 1. The proposed maintenance facility development conforms with the plans, policies, requirements and standards of the Huntington Beach Coastal Element of the General Plan. The facility will not affect coastal access or views. 2. Coastal Development Permit No. 90-35 is consistent with the CZ (Coastal Zone) suffix, the R4 zone as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. At the time of occupancy, the proposed maintenance facility development can be provided with infrastructure in a manner that is consistent with the Huntington Beach Coastal Element and Coastal Land Use Plan of the General Plan. The facility will not affect coastal access or views. 4. The proposed maintenance facility development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The facility will not affect coastal access or views. SUGGESTED CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 90-52/COASTAL DEVELOPMENT PERMIT NO, 90-35: 1. The site plan, floor plans and elevations received and dated August 7, 1990 shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations. b. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. c. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. A grading plan for the required access road shall be submitted to the Departments of Public Works and Community Development for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. b. All applicable Public Works fees shall be paid. c. Submit a Parking Management Plan for review and approval by the Community Development Department which contains parking space designations for employees. PC Minutes - 11/20/90 -19- (8027d) d. A screening plan including landscaping, shall be submitted if the proposed building is visable from the adjacent residences. 4. Fire Department Requirements are as follows: a. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. b. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. c. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. d. On -site fire hydrants and extinguishers shall be provided in number and at locations specified by the Fire Department. e. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards. f. Development shall meet all local and State regulations regarding installation and operation of all underground storage tanks. g. Security gates will be designed to comply with Huntington Beach Fire Department Standard No. 3. h. Address numbers will be installed to comply with Huntington Beach Fire Code Standards. The size of the numbers will be the following: 1. The number for the building will be sized a minimum of ten (10) inches with a brush stroke of one and one-half (1-1/2) inches. i. All oil wells shall be abandoned to comply with the Huntington Beach Fire Department. j. The development shall comply with the Uniform Fire Code Article 80. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. There shall be no storage of vehicles, vehicle parts, equipment or trailers outside of the perimeter wall. PC Minutes - 11/20/90 -20- (8027d) 8. All repair work shall be conducted wholly within the building. 9. The site shall be restricted to minor servicing of maintenance equipment as defined by the Huntington Beach Ordinance Code. 10. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site; b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05% by weight) for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. f. Access the site through the existing oil fields to the north. 11. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 12. Prior to issuance of a Certificate of Occupancy, the following shall be completed: a. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District and submit a copy to Community Development Department. b. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. c. Compliance with all conditions of approval specified herein shall be accomplished. 13. The Planning Commission reserves the right to revoke this conditional use permit and coastal development permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 14. This conditional use permit and coastal development permit shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. Should a Traffic Impact Fee be adopted by the City Council, the applicant/property owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval. 16. The applicant shall be responsible for payment of Water Master Plan Fees if adopted by the City Council prior to issuance of building permits. 17. Truck deliveries to the maintenance facility shall be between 8:00 AM and 12:00 PM only. 18. The tract at Oil Island "N" (Tract No. 14277) is not considered as part of this application nor would approval of this application construe approval or support of Tract No. 14277. B-6 CONDITIONAL USE PERMIT NO. 90-55: APPLICANT: EDWARD W. SMITH LOCATION: 18682 Beach Boulevard, Suite B-120 (Beach Stone Plaza) Conditional Use Permit No. 90-55 is a request to permit church activities in a 1,580 square foot commercial suite within Beach Stone Plaza. The activities will include Tuesday evening bible study, Thursday evening prayer meeting, Friday evening fellowship meetings and a Sunday worship service for a maximum of 100 participating church members. The request is pursuant to Article 963, Unclassified Uses, Section 9630(c) of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 90-55 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Nancy Howell, 18682 Beach Boulevard, stated that the business hours stated in the staff report were not accurate. Ms. Howell stated that although Section 9602 allows the Planning Commission to change the parking code she feels nothing warrants this change. She was also concerned that future businesses would have varying hours that would conflict with those in the request. Brad Hills, 18632 Beach Boulevard, spoke in opposition to the request. He stated that the tax businesses in the center generate a lot of off hour parking. Mr. Hills said he specifically chose this site for his business because of the parking accessibility, which is now being threatened. Mr. Robertson discussed with the Commission the letter he had written to them, dated November 19, 1990. Mike Clayton, representing applicant, stated that they had chosen this site because they felt it would not impact parking and traffic. He stated that there is quite a bit of access and parking in the back of the center. Mr. Clayton also stated that his church will draw families for quiet study. The sign program will bring the existing, non -conforming, free-standing sign into conformance with Article 961 (Signs) and will assure that proposed business identification wall signs also comply with code. Submittal of the sign program was a condition of approval for Conditional Use Permit No. 90-40 (Centerfield Restaurant -Live Entertainment). STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Planned Sign Program No. 90-14 with findings and suggested conditions of approval. DISCUSSION ITEMS None F. PLANNING COMMISSION INQUIRIES Commissioner Kirkland, was concerned about the Hebrew Day School being in a dilapidated condition. He thought that a tentative parcel map was approved a year ago and questioned staff on the status of the tentative parcel map or what could be done to correct the situation. Commissioner Williams, questioned staff about the approval of the expansion of the horse stables. He stated he was aware that they had been completed, but the conditions had not yet been complied with. Staff informed Commissioner Williams that there would be a report at the next Planning Commission meeting. Commissioner Bourguignon, requested a report from Public Works on the dangerous curb ramps on the corner of Warner and Gothard. Commissioner Ortega, stated she had received numerous calls from residents of Pierce Street regarding the parking situation caused by the Moody Development. Mr. Adams stated that the street was public parking and they would have to contact Police for this type of complaint.
