Administrator Meeting were approved as

ITEM 1: ADMINISTRATIVE REVIEW NO, 90-19
Applicant: Russel Gendron
Stubby's Recycling
15591 Computer Lane
Huntington Beach, CA 92649
Request: To permit outdoor storage in conjunction with a
Recycling Center pursuant to Section 9510.01 S of
the Huntington Beach Ordinance Code.
Location: 15591 Computer Lane
Mike Connor, Staff Planner, reported that the item was continued
from the October 31, 1990 Zoning Administrator meeting. He said the
request is to permit two large recycling bins and two large
semi -tractor trailors on the site to permit outdoor storage. Staff
indicated that the outdoor storage would obstruct parking spaces.
The Zoning Administrator reported that a Land Use Technician had
observed the site and determined that parking problems were minimal.
ADMINISTRATIVE REVIEW NO. 90-19 WAS APPROVED FOR SIX MONTHS TO
ALLOW APPLICANT TIME TO FIND A NEW LOCATION BY THE ZONING
ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED
THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED
TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
September 21, 1990 shall be the conceptually approved layout.
2. Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
3. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
4. There shall be no outside storage of recycled materials other
than in the approved trailers. All business vehicles shall be
stored on site.
5. The site and street shall be swept at the end of each business
day.
6. Administrative Review No. 90-19 shall expire May 31, 1991
unless extended by the Zoning Administrator.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke this
Administrative Review if any violation of these conditions of
the Huntington Beach Ordinance Code occurs.
ITEM 2• COASTAL DEVELOPMENT PERMIT NO 90-38/USE PERMIT NO. 90-64:

Request: Coastal Development Permit No. 90-38 is a request to
permit a 1,209 square foot addition to an existing
5,116 square foot house with demolition and
reconstruction of approximately 2,060 square feet of
the existing house pursuant to Section 989.5.3(b)(1) of
the Huntington Beach Ordinance Code.

Use Permit No. 90-64 is a request to permit an addition
to an existing nonconforming structure. The structure
has an eight (8) foot front yard setback for a side
entry garage in lieu of ten (10) feet as required by
Section 9110.6 of the Huntington Beach Ordinance Code
as well as a second story deck which is set back zero
(0) feet from the rear yard property line in lieu of
five (5) feet as required by Sectio 9110.8 of the
Code. The structure also has a second story storage
room set back eight (8) feet in lieu of fifteen (15)
feet as required by Section 9110.6 of the Code.
Location: 3841 Seascape
Mike Connor reported that the item was continued from November 7,
1990 to provide proper legal notice. He said the project has been
reviewed by the Trinidad Island Homeowners Association and they
recommend approval. Staff recommended approval with findings and
conditions due to the irregular shape of the lot.
THE PUBLIC HEARING WAS OPENED.
Mr. Richard Krantz said the addition would be an improvement to the
neighborhood.
Mr. Forrest Newhall advised that he had spoken to all the neighbors
on the cul-de-sac (except one neighbor who was on vacation) and they
all support the addition.
There were no other persons present to speak for or against the
request and the public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 90-38 AND USE PERMIT NO. 90-64 WAS
APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL
COMMISSION.
FINDINGS OF APPROVAL/COASTAL DEVELOPMENT PERMIT NO 90-38:
1. The request to permit the remodel and addition to a
two-story single family residence conforms with the
policies, requirements and standards of The Coastal
the General Plan because the proposed project will

2. Coastal Development Permit No. 90-38 is consistent with the CZ
suffix zoning requirements, the R1 Zoning District, as well as
other provisions of the Huntington Beach Ordinance Code
applicable to the property because the proposed remodel and
expansion meets all applicable provisions of the Huntington
Beach Ordinance Code.
3. At the time of occupancy, the proposed remodel and addition to
an existing two-story single family residence will be provided
with infrastructure in a manner that is consistent with the
Coastal Element of the General Plan.
4. The proposed remodel and addition to an existing two story
single family residence conforms with the public access and
public recreation policies of Chapter 3 of the California
Coastal Act because the proposed project does not obstruct any
existing or proposed public coastal access routes.
FINDINGS OF APPROVAL - USE PERMIT NO, 90-64
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The proposed remodel and addition meets all applicable
provisions of the Huntington Beach Ordinance Code. The
existing nonconforming setbacks have not been detrimental to
adjacent properties due to the unique configuration of the site.
3 The granting of Coastal Development Permit No. 90-38 will not
adversely affect the General Plan of the City of Huntington
Beach. The General Plan Land Use designation for this location
is residential low density. The proposed project complies with
this designation.
4. The proposal is consistent with the goals and objectives of the
City's General Plan and Land Use Map. The General Plan Land

2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. All proposed dock and ramp improvements shall require separate
permits for the improvements located within the public
waterways.
4. All proposed cantilevered deck improvements require separate
permits for the improvements.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
6. Proposed structures shall be architecturally compatible with
existing structures.
7. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units if these
facilities are changed.
8. Low -volume heads shall be used on all spigots and water faucets.
9. The Public Works Department requirements are:
a. A grading plan shall be reviewed and approved prior to
issuance of building permits.
10. The Fire Department requirements are:
a. Automatic sprinkler systems will be installed throughout to
comply with Huntington Beach Fire Department and Uniform
Building Code standards.

ITEM 3• TENTATIVE PARCEL MAP NO. 88-191
Applicant: Paul Weatherly

Request: To subdivide one existing lot into two (2) lots
pursuant to Sections 9530.02 and 9930.1 of the
Huntington Beach Ordinance Code.
Location: 7622 Talbert
Mike Connor, Staff Planner, reported that a conditional use permit
was approved for an automobile repair facility of approximately
42,000 square feet and as a condition of approval a parcel map was
required. The original parcel map was approved in 1988 however the
applicant was unable to get final approval on the map due to a
number of problems and the map has expired. On November 14, 1990
this item was continued by the Zoning Administrator to determine if
the new Traffic Impact Fee and upcoming Water Department Fee would
be applicable.
The Zoning Administrator said he would waive the Traffic Impact Fee
as the project was 80% complete; however the Water Fee is a charge
to connect into the City system is a necessity and could not be
waived.
Craig Eschrich, representing the applicant, said that the reason for
the delays is the result of the City not being able to identify the
location of the property line. He said they are are two million
dollars into the project and it is unfair to add these new fees.
TENTATIVE PARCEL MAP NO. 88-191 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL (WAIVING THE
TRAFFIC IMPACT FEE BUT INCLUDING THE WATER DEPARTMENT FEE). HE
STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The proposed subdivision of two (2) parcels for purposes of
industrial use in compliance with the size and shape of
property necessary for that type of development.
2. The General Plan has set forth provisions for this type of
land use as well as setting forth objectives for
implementation of this type of use.
3. The property was previously studied for this intensity of
land use at the time the land use designation for community
business district allowing commercial buildings was placed
on the subject property.

4. The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are
proposed to be constructed in compliance with standards
plans and specifications on file with the City as well as in
compliance with the State Map Act and supplemental City
Subdivision Ordinance.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
1. Tentative Parcel Map received by the Department of
Community Development on October 11, 1990 shall be the
approved layout (with the amendments as noted thereon).
2. A parcel map shall be filed with and approved by the
Department of Public Works and recorded with the Orange
County Recorder.
3. Water supply shall be through the City of Huntington
Beach's water system at the time said parcel(s) is/are
developed.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time said parcel(s) is/are
developed.
5. All utilities shall be installed underground at the time
said parcel(s) is/are developed.
6. The development shall comply with all applicable City
Ordinances.
7. A copy of the recorded parcel map shall be filed with the
Department of Community Development.
8. All vehicular access rights along Talbert Ave, Kovacs
Circle and Redondo Lane shall be dedicated to the City of
Huntington Beach except at locations approved by the
Planning Commission.
9. Street improvements shall be constructed to Public Works
standards.
10. The applicant/property owner shall be responsible for
paying the Water Department Fees in effect at the time the
final map is accepted by City Council.
11. No parking shall be permitted on Kovacs" Circle.

ITEM 4• USE PERMIT NO 90-66/CONDITIONAL EXCEPTION NO, 90-50

Request: Use Permit No. 90-66 - To permit a 108 square foot
addition to an existing restaurant pursuant to Section
9220(c)R of the Huntington Beach Ordinance Code.
Conditional Exception No. 90-50 - To permit a reduction
in required parking as required by Section 9606 of the
Huntington Beach Ordinance Code.
Location: 19770 Beach Blvd.

Mike Connor reported that this project was to permit an addition for
greenhouse purposes only and that a condition prohibiting the -
addition to be used for restaurant seating or retail display would
be imposed through a covenant.

The applicant, Mr. John J. Shoreder spoke in favor of the request.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 90-66/CONDITIONAL EXCEPTION NO. 90-50 WERE APPROVED
BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of Use Permit No. 90-66 will not adversely affect
the General Plan of the City of Huntington Beach. The project
will not increase the intensity of use.
3. The proposal is consistent with the goals and objectives of the
City's General Plan and Land Use Map. Restaurants are
permitted within the General Commercial areas.

4. Because of special circumstances' -applicable to the subject
property, including size, shape,'topography, location or
surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone
classifications. The applicant is unable to provide any
additional parking however, it will not result in an increase
of intensity.
5. The granting of Conditional Exception No.90-50 is necessary in
order to preserve the enjoyment of one or more substantial
property rights. The applicant is unable to provide any
additional parking however, it will not result in an increase
of intensity.
6. The granting of Conditional Exception No. 90-50 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications. The applicant is
unable to provide any additional parking however, it will not
result in an increase of intensity.
7. The granting of Conditional Exception No. 90-50 will not
adversely affect the General Plan of the City of Huntington
Beach. The applicant is unable to provide any additional
parking however, it will not result in an increase of intensity.
8. The applicant is willing and able to carry out the purposes for
which Conditional Exception No. 90-50 is sought and he will
proceed to do so without unnecessary delay.
9. The location, site layout, and design of the proposed use
properly adapts the proposed structures to streets, driveways,
and other adjacent structures and uses in a harmonious manner.
10. The combination and relationship of one proposed use to another
on site are properly integrated.
11. The access to and parking for the proposed use does not create
an undue traffic problem. The applicant is unable to provide
any additional parking however, it will not result in an
increase of intensity.

increased intensity of any kind.

All applicable Public Works fees shall be paid prior to
issuance of building permits.
9.
Conditions of approval shall be printed verbatim on all working
drawings submitted for plancheck.
