ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Mike Connor MINUTES: The Minutes of the November 21, 1990 Zoning Administrator Meeting were continued to the next meeting of December 19, 1990. REGULAR AGENDA ITEMS: ITEM 1• TENTATIVE PARCEL MAP NO, 90-366 Applicant: Phillip Talbert 305 Coral Reef #6 - Huntington Beach, CA 92648 Request: To consolidate two (2) lots into one (1) lot. Location: 326 Crest Mike Connor, Staff Planner, reported that a request for a variance to the front and rear setbacks was submitted by the applicant in July, 1990. This request was approved by the Zoning Administrator. The applicant is now requesting to erase the lot line and requests to consolidate two lots into one for residential purposes. Staff stated that a two and one-half (2 1/21) dedication will be required. Staff is recommending approval of the request subject dedication of the alley dedication as well as findings and conditions. The applicant was not present. The Zoning Administrator reported that he would approve the request subject to alley dedication. TENTATIVE PARCEL MAP NO. 90-366 WAS APPROVED SUBJECT TO ALLEY DEDICATION WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed consolidation of two (2) parcels into one (1) parcel for purposes of residential use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. The property has a low density residential land use designation in the general plan. 3. The property was previously studied for this intensity of land use at the time the land use designation for low density residential district allowing Single Family Dwellings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. The proposed map is a consolidation of two existing smaller parcels which have been functioning as one parcel. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on October 29, 1990 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Two and one half feet along the alley shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 6. All utilities shall be installed underground at the time said parcel(s) is/are developed. ZA Minutes - 12/12/90 -2- (8056d) I 7. The development shall comply with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Community Development. 9. Upon completion of the above conditions, the applicant shall submit a request for the waiver of the final parcel map in conjunction with an eight and one-half (8 1/2) inches by an eleven (11) inch plat map. Upon the granting of the final map waiver by the Zoning Administrator, the applicant shall record a "Covenant to hold properties as one parcel" and the approved plat map with the Orange County Recorder's Office. A copy of the recorded covenant shall be filed with the Department of Community Development prior to final inspection/issuance of building permits. ITEM 2: ADMINISTRATIVE REVIEW NO. 90-21: Applicant: Chevron U.S.A., Inc. 1300 South Beach Boulevard La Habra, CA 90632-2833 Request: To replace an existing canopy and bill of lading and add an enclosed electrical power distribution center pursuant to Section 9530.01P Huntington Beach Ordinance Code. The request includes above ground product pipelines on site. Location: 17881 Gothard Street Mike Connor reported that the request is to replace an existing canopy and bill of lading kiosk and add an enclosed electrical power distribution center pursuant to Section 9530.01P Huntington Beach Ordinance Code. The request includes an expansion of two bays to three to eliminate the back-up of vehicles. The request also includes replacing underground piping to above -ground product pipelines on site. Staff stated that the site is located in the industrial district. Staff provided a brief description of the request and presented photographs of the site for the Zoning Administrator's review. Staff presented a letter which was submitted by the Chevron. The letter stated that the request would not increase traffic, but would allow the same number of deliveries to be made by fewer trucks. The Zoning Administrator expressed concern about the possible adverse visual impact of placing the pipelines above ground. Staff responded that the view of the exposed pipe would be limited and visual impacts virtually nondescript. Staff displayed maps of the pipeline location. Discussion about the pipeline proposal ensued concerning height of the pipes from the ground. Staff stated that the pipeline would rise four (4') feet off the ground to the canopy where it would rise to fourteen (14') feet and then return to four (4') feet again. ZA Minutes - 12/12/90 -3- (8056d) Staff recommended approval of the request with the added condition that the pipeline be painted white to be compatible with the structure. Standard findings and conditions of approval apply. The applicant was present and spoke in support of the request. ADMINISTRATIVE REVIEW NO. 90-21 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated November 2, 1990, shall be the conceptually approved layout. 2 The Zoning Administrator shall be notified in writing if any changes in building height, setbacks, or building elevations are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 4. The fire department requirements shall be as follows: a. Install Automatic Foam Deluge System per requirements of Huntington Beach Fire Department. b. Provide "on -site" foam in the quantity required to supply the deluge system for the specified and required operating time. c. Provide secondary containment adequate to handle the runoff and product from the loading rack area. 5. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 6. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. All utility apparatuses such as but not limited to backflow devices and Edison transformers, shall be prohibited in the front yard and exterior sideyards unless properly screened by approved landscaping or any other method approved by the Director of Planning. In no case shall they be within the setback areas along Pacific Coast Highway. All such apparatuses shall be depicted on the site plan prior to issuance of building permits. 9. Conditions of approval shall be printed verbatim on all working drawings submitted for plan check. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke this Administrative Review No. 90-21 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 3: USE PERMIT NO, 90-67 Applicant: Lyle Vonesh 1007 Delaware Street Huntington Beach, CA 92648 Request: To permit an addition to an existing residence with a nonconforming garage. The existing garage is currently seven (7) feet from the rear property line abutting an alley in lieu of seven and one half (7.5) feet as required by Section 9130.8 of the Huntington Beach Ordinance Code. After the two and one half (2.5) foot alley dedication, the garage will be four and one half (4.5) feet from the rear property line. Location: 1007 Delaware Mike Connor, Staff Planner, reported that the request is to permit an addition to an existing residence with a nonconforming garage. The existing garage is currently seven (7) feet from the rear property line abutting an alley in lieu of seven and one half (7.5) feet as required by Section 9130.8 of the Huntington Beach Ordinance Code. After the two and one half (2.5) foot alley dedication, the garage will be four and one half (4.5) feet from the rear property line. Staff stated that the property is located in the Oldtown area. The existing residence is not connected to the garage. ZA Minutes - 12/12/90 -5- (8056d) Staff presented photographs of the site. Staff requested three modifications to the proposal: 1. Relocate the fireplace or comply with the thirty (30") inch side yard Uniform Building Code requirement. 2. Shave nine (9") inches off the second floor overhang to provide adequate open space if the garage were ever relocated. 3. Remove the on -site storage shed attached to the garage. The Zoning Administrator concurred with two of staff's modifications and waived the requirement to shave nine (911) inches off the second floor overhang. THE PUBLIC HEARING WAS OPENED The applicant was present and spoke in support of the request. The Zoning Administrator inquired from the applicant if he was willing to make the requested modifications to the proposal. The applicant stated that he would comply with staff's recommendations. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 90-67 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will be detrimental to: a. The general welfare of persons residing in the vicinity; b. Property and improvements in the vicinity of such use or building. c. The reduction in rear setback will reduce the backup distance from garages as well as the functional width of the alley. 2. The granting of Use Permit No. 90-67 will adversely affect the General Plan of the City of Huntington Beach. The reduced alley width will hamper the safe and efficient movement of people and goods. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. ZA Minutes - 12/12/90 -6- (8056d) 1 SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated November 7, 1990 shall be the approved layout, however, a revised site plan shall be submitted depicting the modifications described herein: a. The fireplace chimney shall be shown at the,rear of the house in lieu of the side as shown on the plans. 2. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. The storage shed attached to the garage shall be permanently removed. Photographs showing the shed has been removed shall be provided for inclusion in the Use Permit file. 3. "Any oil wells (active, idle, abandoned, etc) on property to be dedicated to the City shall be abandoned pursuant to Fire Department standards by the property owner, at the cost of the property owner, prior to City Acceptance of such property." 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 9. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1.
