ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Mike Connor MINUTES: The Minutes of the November 21, December 5 and December 12, 1990 Zoning Administrator Meeting were continued to the meeting of January 2, 1991. REGULAR AGENDA ITEMS: ITEM 1: USE PERMIT NO, 90-68 Applicant: Concorde Development 19752 MacArthur, Ste. 240 Irvine, CA 92715 Request: To permit a nine retaining wall - Section 9771(J) Code. foot four inch (9 ft. 4 in.) high Block Wall combination pursuant to of the Huntington Beach Ordinance Location: 8302 Atlanta Avenue Mike Connor, Staff Planner, reported that a condominium project was approved by the Planning Commission and at the public hearing the neighbors requested that the wall at the southern property line be extended 3'4" to provide greater privacy to the existing residents. He said the request before the Zoning Administrator is to permit the addition to the existing wall and recommended approval with findings and conditions including a letter from the adjoining property owners association approving the wall because it is on the property line. THE PUBLIC HEARING WAS OPENED. Dennis Nelson, representing the applicant, said that the homeowners association had requested the wall to be extended and they were honoring their request. Robert Lambert, President of the Homeonwers Board, said they concurred with staff's recommendation and stated they did not have a problem with the wall on the property line and they would provide the letter requested by staff. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 90-68 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; The additional wall height will help to assure privacy for adjoining residents. b. The granting of Use Permit No. 90-68 will not adversely affect the General Plan of the City of Huntington Beach. The site plan, floor plans, and elevations received and dated November 9, 1990 shall be the conceptually approved layout. 2 The Zoning Administrator shall be notified in writing if any changes in building height, are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Four (4) sets of landscape and irrigation plans to the Department of Community Development and Public Works for review and approval. ZA Minutes - 12/19/90 -2- (8174d) 1 b. Landscape and irrigation plan to the Departments of Community Development and Public Works for review and approval. Said landscape plan shall include one (1) fifteen gallon tree per landscape pocket area adjacent to north property line, two (2) twenty-four inch box trees in front yard area, and one (1) fifteen gallon tree in each private yard area. c. A Landscape Construction Set submitted to the Departments of Community Development and Public Works. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9608 of the Huntington Beach Ordinance Code . The set must be complete and approved by both departments prior to issuance of building permits. d. Prior to issuance of building permits the applicant shall provide a letter from the property owners association consenting to the increased height of the wall on the property line. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. 7. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. 8. The materials for the increased height shall match the existing in size, texture and color. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Landscaping shall comply with Section 9608 of the Huntington Beach Ordinance Code. 4. The Zoning Administrator reserves the right to revoke this Use Permit if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ZA Minutes - 12/19/90 -3- (8174d) ITEM 2: CONDITIONAL EXCEPTION NO, 90-51 Applicant: Josip Kovac 9272 Cloudhaven Drive Huntington Beach, CA 92646 Request: To permit a storage shed with a zero (0) foot rear yard setback in lieu of five (5) feet as required by Section 9110.8 of the Huntington Beach Ordinance Code. Location: 9272 Cloudhaven Drive Bobbette Biddulph, Staff Planner, reported that the request is to permit a storage shed at zero setback. She recommended approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Mr. J. Kovac, the applicant, was present and said the purpose of the request was to relieve street parking as he owned four vehicles, five bikes, a lot of toals and yard equipment that could be stored in a shed. Mr. Trent Harris, a neighbor, supported the request stating that the shed would not be visable from the street. There were no other persons present to speak for or against the request and the public hearing was closed. CONDITIONAL EXCEPTION NO 90-51 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 5. The granting of Conditional Exception No.90-51 is necessary in order to preserve the enjoyment of one or more substantial property rights. 6. The granting of Conditional Exception No. 90-51 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 7. The combination and relationship of one proposed use to another on site are properly integrated. SPECIAL CONDITIONS OF APPROVAL: 1. Box 674 Huntington Beach, CA 92648 Request: To relocate an existing house currently located at 9542 Garfield to 10252 Garfield Ave. pursuant to Section 9811.5 of the Huntington Beach Ordinance Code. Location: 10252 Garfield Mike Connor, Staff Planner, reported that Tentative Parcel Map No. 89-368 to subdivide one lot into two was approved Since that time the applicant decided to relocate onto the parcel a house with a similar foot print. He advised that the applicant had approved plans to restore the house adding new doors, french windows and stucco. He stated that relocating a building requires staff to analyze whether or not the proposed relocation would have an injurious effect upon the area. Based upon age of the structure, architectural design and size. The two adjoining tracts were constructed in 1963 an 1965 and the two homes directly to the east were constructed in 1968. The house to be relocated was constructed in 1953. The house is of similar architectural style and size as other homes in the area. THE PUBLIC HEARING WAS OPENED. Charles Parsons, the applicant, advised that the plans have been approved by the Plan Check Section of the Building Division. He said the home would be an improvement to the neighborhood and that the roof line would match the homes in the tract. Irmin Langton, 10256 Garfield, said that the original application was approved over her objections. She was concerned because the request was to move a house built in 1953 which she felt would devalue the homes in the tract and increase traffic in the area. There were no other persons present to speak for or against the request and the public hearing was closed. The site plan, floor plans, and elevations received and dated November 14, 1990 shall be the conceptually approved layout. 2 The Zoning Administrator shall be notified in writing if any changes in building height,'floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. "Should a Traffic Impact Fee be adopted by the City Council, the applicant/owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval." 4. The house shall be completely restuccoed and new french doors and windows on all exterior openings prior to final inspection or occupancy. 5. An accessway from Garfield Avenue shall be approved by the Fire Department and installed prior to final inspection or occupancy. 6. Maximum separation between building wall and property line shall not exceed two inches (2"). 7. Driveways on Garfield Avenue shall be removed and replaced with sidewalks, curbs and gutters to the satisfaction of Public Works. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 11. Low -volume heads shall be used on all spigots and water faucets. 12. Prior to issuance of building permits, the subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. 13. All applicable Public Works fees shall be paid prior to issuance of building permits. 14. Per Huntington Beach Ordinance Code, Section 9960.2(f)(6), a ,30-inch box tree shall be planted in the front yard of each lot and in the exterior side yard of each corner lot as provided in the Street Tree Standards adopted by the City of Huntington Beach. A 36-inch box tree may be substituted, if a 30-inch box tree is unobtainable. 15. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 5. The Zoning Administrator reserves the right to revoke this Use Permit No. 90-69 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ZA Minutes - 12/19/90 -8- (8174d) PA ITEM 4• USE PERMIT NO, 90-70 Applicant: Mehran Ahrestani 18442 Manitoba Lane Huntington Beach, CA 92648 Request: To permit an existing six foot iron fence with seven foot tall columns within the front setback pursuant to Section 9771(1) of the Huntington Beach Ordinance Code. Location: 18442 Manitoba Lane Mike Connor, Staff Planner, reported that the applicant had requested that the item be continued as he would be out of town on the day of the -hearing. Staff concurred with the applicant's request. USE PERMIT NO. 90-70 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE ZONING ADMINISTRATOR MEETING OF JANUARY 2, 1991.
