The Minutes of the February 6, 1991 Zoning
Administrator Meeting were approved as
submitted.
ITEM 1: CONDITIONAL EXCEPTION NO. 90-18:
Applicant: Anthony Salem
Huntington Brake and Tire
19501 Beach Blvd.
Huntington Beach, CA 92648
Request: To permit the installation of a pump island canopy with
variance to canopy setback, min. 6'-0" landscape
planter along Beach Blvd. and min. 3'-0" landscape
planter along interior property lines.
Location: 19501 Beach Blvd. (Southwest corner of Beach Blvd. at
Yorktown Ave.)
Herb Fauland, Staff Planner, reported that the existing full service
gas station is non -conforming with regard to lot size, landscaping
and parking. Staff noted that the applicant will provide the code
required 6% of landscaping, on site parking and that the existing
signs will be brought into conformance with the sign code. Staff
indicated however that a reciprocal driveway located on the south
side of the property would preclude the placement of interior code
required landscaping and the existing pump island location prohibits
the minimum landscaping along Beach Blvd. Staff recommended that a
trash enclosure be constructed to the rear of the building. Staff
concluded by recommending approval with findings and suggested
conditions of approval.
THE PUBLIC HEARING WAS OPENED
Mr. Salem, the applicant, was present and agreed to the conditions
of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
CONDITIONAL EXCEPTION NO 90-18 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED
THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED
TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. Because of special circumstances applicable to the subject
property, including size, shape, topography, location or
surroundings, the strict application of the Zoning Ordinance
is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity and under
identical zone classifications. The existing property is a
legal non- conforming site with regards to frontage and area
and the existing buildings and pump islands prohibits the
placement of the pump island canopy to the code required
setback.
2. The granting of Conditional Exception No.90-18 is necessary
in order to preserve the enjoyment of one or more
substantial property rights.
3. The granting of Conditional Exception No. 90-18 will not be
materially detrimental to the public welfare, or injurious
to property in the same zone classifications.
4. The granting of Conditional Exception No. 90-18 will not
adversely affect the General Plan of the City of Huntington
Beach. The Highway Commercial land use designation permits
service stations and the proposed reduction of canopy
setback and landscape planter will enhance and upgrade the
existing service station site.
5. The applicant is willing and able to carry out the purposes
for which Conditional Exception No. 90-18 is sought and he
will proceed to do so without unnecessary delay.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and
dated January 25, 1991 shall be the conceptually approved
layout with the following modification:
a. The applicant shall construct an on -site trash
enclosure connected to the rear of the building.
2 The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the
plan check process. Building permits shall not be issued
until the Zoning Administrator has reviewed and approved the
proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original
entitlement be processed if the proposed changes are of a
substantial nature.

3. Prior to issuance of building permits, the following plans
and items shall be submitted and/or completed by the
applicant:
a. Four (4) sets of Landscape and irrigation plans shall
be submitted to the Departments of Community
Development and Public Works. The landscape
construction set shall include a landscape plan
prepared and signed by a State Licensed Landscape
Architect which includes all proposed/existing plant
materials (location, type, size, quantity), irrigation
plan, grading plan and approved site plan, and copy of
conditions of approval. The landscape plan shall be in
conformance with Section 9608 of the Huntington Beach
Ordinance Code . The set must be complete and approved
by both departments prior to issuance of building
permits.
4. Installation of required landscaping and irrigation systems
shall be completed prior to final inspection/within twelve
(12) months.
5. All signs shall be in conformance with Article 961 Signs,
section 9610.5(d) Service Stations prior to final building
permit inspection.
6. Fire access lanes shall be maintained. If fire lane
violations occur and the services of the Fire Department are
required, the applicant will be liable for expenses incurred.
7. There shall be no outside storage of vehicles, vehicle
parts, equipment or trailers.
8. All repair work shall be conducted wholly within the
building.
9. The site shall be restricted to servicing of automobiles and
sale of automobile -related products. A convenience market
or "mini -market" shall not be permitted without the approval
of a Conditional Use Permit by the Planning Commission.
10. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
11. Proposed structures (canopy/trash enclosures) shall be
architecturally compatible with existing structures.
12. Conditions of approval shall be printed verbatim on all working
drawings submitted for plan check.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions
of the Ordinance Code, Building Division, and Fire
Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. All signs shall be brought into compliance with the
Huntington Beach Ordinance Code prior to final building
permit inspection.
4. Landscaping shall comply with Section 9608 of the Huntington
Beach Ordinance Code.
5. Prior to issuance of building permits the applicant shall
restripe the parking lot so that it conforms to provisions of
Article 960 of the Huntington Beach Ordinance Code and the
approved site plan.
6. The Zoning Administrator reserves the right to revoke this
Conditional Exception No. 90-18 if any violation of these
conditions of the Huntington Beach Ordinance Code occurs.
THE MEETING WAS ADJOURNED AT 1:40 PM BY THE ZONING ADMINISTRATOR TO
A STUDY SESSION ON MONDAY, FEBRUARY 25, 1991 AT 4:30 PM AND THEN TO
THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON
