ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Herb Fauland MINUTES: The Minutes of the February 13, 1991 Zoning Administrator Meeting were approved as submitted. REGULAR AGENDA ITEMS: ITEM 1: USE PERMIT NO, 91-2 Applicant: Huntington Harbour Anglers C/O Steve Clifton 4022 Figoro Circle Huntington Beach, CA 92649 Request: Temporary outdoor event - Charity Bazaar May 4, 1991, pursuant to Section 9730.64 Location: 16899 Algonquin Mike Connor, Staff Planner, reported that the charity bazaar was an annual one day event which had run smoothly in the past. Staff recommended approval with findings and suggested conditions of approval. Kathy Clifton, representing Huntington Harbour Anglers, was present and agreed with the conditions of approval. USE PERMIT NO. 91-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. k 2. The granting of Use Permit No. 91-2 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated January 22, 1991 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum with of (20) twenty feet. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant's request shall include necessary permits for balloons and temporary signs. 7. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 8. All parking shall be a minimum of forty (40) feet from the proposed tent. 9. The proposed tent shall be of fire retardant material. Proof of Certification shall be submitted to the Fire Department for approval prior to the tent's installation on the site. 10. The proposed tent shall be secured against collapsing to the satisfaction of the Fire Department. 11. "No Smoking" signs shall be posted in conspicuous locations. 12. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 13. A minimum of two (2) exits shall be provided and maintained. 14. Stand by personnel shall be on site to safeguard premises. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 91-2 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO, 91-4 Applicant: Clifford S. Woodward 16458 Bolsa Chica #321 Huntington Beach, CA 92649 Request: To permit a seven (7) foot - six (6) inch block wall on the rear property line pursuant to Section 9771(g)(1) of the Huntington Beach Ordinance Code Location: 5162 Caliente Drive Mike Connor, Staff Planner, reported that the request was to add an additional course of blocks and cap to an existing block wall fence. Staff advised that many other properties in the area have fencing over six feet and recommended approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Mr. Woodward, the applicant, was present and agreed with the suggested conditions of approval. There were no other persons to speak for or against the request and the public hearing was closed. USE PERMIT NO 91-4 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; There are many seven to eight foot tall block walls along the alley. b. The granting of Use Permit No. 91-4 will not adversely affect the General Plan of the City of Huntington Beach. The proposed wall is an adjunct use to the dwelling which complies with the land use designation. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated January 28, 1991 shall be the conceptually approved layout. 2 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. Proposed walls shall be architecturally compatible with existing walls. 5. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. ITEM 3: USE PERMIT NO, 91-3 Applicant: George A Pearson DBA G & M Oil Co. 15402 Electronic Lane Huntington Beach, CA 92649 Request: To permit the expansion of an existing video arcade into an existing suite pursuant to Section 9220.11 of the Huntington Beach Ordinance Code. Location: 16922 Beach Blvd. ZA Minutes - 2/27/91 -4- (8890d) Mike Connor, Staff Planner, reported that the request was to permit expansion of an existing video arcade into an adjoining suite. Comments were received from the Police Department recommending denial of the request due to the number of calls received from other tenants in the center. Staff recommended a continuance for two weeks in an attempt to work out problems. THE PUBLIC HEARING WAS OPENED. George Pearson, the applicant, advised that he was not aware of concerns of his neighbors or the Police Department. He supported staff's recommendation for continuance. Barbara Fernandez, a tenant in the center, spoke in opposition to the request. She said that customers of the arcade are undesirable and that the security guards employed by the arcade are inadequate. She indicated that the use was not compatible with other uses in the center or the residential that backs up to the center. There were no other persons to speak for or against the request and the public hearing was closed. USE PERMIT NO. 91-3 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE ZONING ADMINISTRATOR MEETING OF MARCH 13, 1991. ITEM 4• CONDITIONAL EXCEPTION NO, 91-1 Applicant: Mr. & Mrs. Bernard Davis 607 Eleventh St. Huntington Beach, CA 92648 Request: To permit the construction of a three (3) story single family dwelling with 52.3 percent site coverage in lieu of the 50 percent maximum permitted by Section 4.6.05 of the Downtown Specific Plan (DTSP) and to permit a portion of the dwelling to be placed at a five (5) foot minimum front yard setback in lieu of fifteen (15) feet as required by Section 4.6.06 of the DTSP and to permit a seventeen and one half (17.5) foot turning radius in lieu of twenty five (25) feet as required by Section 9603.3 of the Huntington Beach Ordinance Code. Location: 202 Sixth Mike Connor, Staff Planner, reported that the applicant is required to dedicate property for public street and alley dedication and a 30 foot radius dedication for circulation. The dedication has created a hardship for development of the property. Staff advised that the residence will be in line with existing homes on the street. Staff recommended that the request be referred to the Planning Commission due to the complexity of the request and because the property was located in the Downtown Redevelopment Project Area. THE PUBLIC HEARING WAS OPENED. ZA Minutes - 2/27/91 -5- (8890d) Bernie Davis, the applicant, was present and spoke in support of the request. A. John Amling, 203 Sixth Street, spoke in opposition to the request. He said that he along with most of the neighbors had a great deal of concern with the request for a three story high residence since most other residences were two story. The Zoning Administrator advised that three stories were permitted use. There were no other persons to speak for or against the request and the public hearing was closed. CONDITIONAL EXCEPTION NO. 91-1 WAS REFERRED TO THE PLANNING COMMISSION BY THE ZONING ADMINISTRATOR. ITEM 5• USE PERMIT NO 90-79 IN CONJUNCTION WITH ENVIRONMENTAL ASSESSMENT NO, 90-58 Applicant: McDonnell Douglas Corporation c/o Marty Olson M/S A67-711 5301 Bolsa Ave. Huntington Beach, CA 92647 Request: To permit the construction of a 60,000 square foot industrial storage building pursuant to Section 9510.01 of the Huntington Beach Ordinance Code. Mike Connor, Staff Planner, reported that there is an existing structure on the site which would be expanded by 60,000 square feet. Staff advised that the new storage building would be located a considerable distance from existing residential. Staff recommended approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Marty Olson, representing the applicant, was present; however did not have anything to add to the staff report. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO 90-79 AND NEGATIVE DECLARATION NO. 90-58 WERE APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 90-79 will not adversely affect the General Plan of the City of Huntington Beach. The proposed storage facility is a permitted use within the General Industrial district of the General Plan. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The proposed storage facility is a permitted use within the General Industrial district of the General Plan. 4. The location, site layout, and design of the proposed use properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 5. The combination and relationship of one proposed use to another on site are properly integrated. 6. The access to and parking for the proposed use does not create an undue traffic problem. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 14, 1991, shall be the conceptually approved layout. 2 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. "The applicant/owner shall be responsible for paying the Traffic Impact Fee prior to issuance of a Certificate of Occupancy and/or final building permit approval." 4. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 5. Service roads and fire lanes, as -determined by the Fire Department, shall be posted and marked. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Proposed structures shall be architecturally compatible with existing structures. 9. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 10. All applicable Public Works fees shall be paid prior to issuance of building permits. 11. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke this Use Permit No. 90-79 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 6: COASTAL DEVELOPMENT PERMIT NO, 90-52: Applicant: W. H. Wilson 16961 Bolero Lane Huntington Beach, CA 92649 Request: To permit a 1,187 sq. ft. second story addition to an existing three story house pursuant to Section 989.5.2 of the Huntington Beach Ordinance Code Location: 16961 Bolero Lane Coastal Status: APPEALABLE Mike Connor, Staff Planner, reported that the request for the addition meets code standards. Staff indicated that the Planning Division had received a letter supporting the request with the removal of the third story loft. Mr. Wilson, the applicant was present and agreed to the the suggested conditions of approval. There were no other persons present and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 90-52 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO, 90-52: 1. The request to permit the remodel and addition to an existing three-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. 2. Coastal Development Permit No. 90-52 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed remodel and addition to an existing three-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed remodel and addition to an existing three story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 24, 1990, with revisions dated January 29, 1991, shall be the approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. The applicant shall record a covenant on the property agreeing to maintain the dwelling as a single family residence. ZA Minutes - 2/27/91 -9- (8890d) 4. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 5. All proposed cantilevered deck improvements require separate permits for the improvements. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. Proposed structures shall be architecturally compatible with existing structures. 8. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 9. Low -volume heads shall be used on all spigots and water faucets. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 90-52 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
