ZONING ADMINISTRATOR: STAFF MEMBERS: MINUTES• REGULAR AGENDA ITEMS: Room B-6 - Civic Center 2000 Main Street Huntington Beach, California Scott Hess Wayne Carvalho, Mike Connor The Minutes of the March 11, 1992 zoning Administrator Meeting were approved. ITEM 1• LOT LINE ADJUSTMENT NO, 91-1 Applicant: Farhad Rezai Coast Engineering 17931 Beach Street, #116 Huntington Beach, CA 92647 Request: To adjust the existing lot lines between three (3) existing parcels of Parcel Map 83-555. Parcel 3 will be enlarged to match the approved site plan for Conditional Use Permit No. 91-28 while parcels 1 and 2 will be reduced accordingly. Location: 8052 Adams (Seabridge Village Shopping Center) Mike Connor, Staff Planner, reported that the request had been continued three times in an attempt to obtain copies of the reciprocal access and parking agreements. He advised that staff has received and reviewed the documents, and has determined that the lot line adjustment would not impact the agreement. Staff concluded by recommending approval with findings and conditions. THE PUBLIC HEARING WAS OPENED. The applicant, Farhad Rezai, was present and concurred with the conditions of approval. There were no other persons present and the public hearing was closed. LOT LINE ADJUSTMENT NO. 91-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. Lot Line Adjustment No. 91-1 will not create a nonconforming parcel or non conforming yards. The parcels are all part of a planned development with reciprocal access and parking. 2. Lot Line Adjustment No. 91-1 will not sever existing structures on the two lots. There are no existing structures on parcels 1 and 3 that would be affected by the lot line adjustment. 3. Lot Line Adjustment No. 91-1 will not allow a larger development than allowed by the code prior to the adjustment. The lot line adjustment will not increase the number of lots; and any new building will be required to comply with the development standards of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF A GRADING PERMIT AND/OR BUILDING PERMIT: 1. The lot line adjustment/plan received by the Department of Community Development on December 18, 1991, shall be the approved layout. 2. Monuments for the newly -established property lines shall be readjusted in compliance with the Subdivision Map Act. A record of survey shall be completed to verify the location of the newly placed monuments. 3. Authentic data on the bearings of the adjusted line shall be shown on a plat map which shall be certified by the City Engineer prior to recordation. 4. Said plat map shall be recorded with the County Recorder prior to the issuance of a grading permit for the parking lot improvements on the site. A copy of the recorded document shall be submitted to the Department of Community Development for the file. I * ZA Minutes - 3/18/92 -2- (2774d) ITEM 2: USE PERMIT NO, 92-12 Applicant: James Righeimer 17400 Brookhurst St. #102 Fountain Valley, CA 92708 Request: To construct two (2) three-story, single family residences with attached garages that have a reduced -side yard setback (4" in lieu of 3') pursuant to Section 9110.7(b) of the Huntington Beach Ordinance Code. Location: 609 and 611 Frankfort Wayne Carvalho, Staff Planner, reported that a similar variance was granted west of the subject property. Staff advised that the reduced side yard was required to accommodate a, two car garage due to the irregular shape of the lot. Staff concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Louie Hernandez, representing the applicant, was present. He advised that due to the lot configuration, if the homes were constructed where they would normally be placed, 25% of the lot would be driveway. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-12 WAS APPROVED B THE FOLLOWING FINDINGS AND CONDITIONS ADMINISTRATOR STATED THAT THE ACTION ADMINISTRATOR CAN BE APPEALED TO THE CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: Y THE ZONING ADMINISTRATOR WITH OF APPROVAL. THE ZONING TAKEN BY THE ZONING PLANNING COMMISSION WITHIN TEN 1. The granting of Use Permit No. 92-12 for a four inch (4") sideyard garage setback in lieu of three feet (3') on two single family residential lots will not have a detrimental effect on the general health, safety, welfare or privacy of surrounding residences. The reduced setbacks are on either side of the common property line of the two lots, and this will not impact any other parcels. 2. The granting of Use Permit No. 92-12 for a four inch (4") sideyard garage setback will result in improved design and utility of the project by allowing for two (2) car garages on irregular shaped lots. In addition, the garages will have an eighteen foot (18') setback from the alley which exceeds the minimum setback requirement of seven foot six inch (7' 6"); this allows for two additional on -site parking spaces. The design of the two single family residences is compatible with the surrounding neighborhood with variations in building setbacks through the use of off -sets and/or architectural features. 4. The granting of Use Permit No. 92-12 for a four inch (4") sideyard garage setback will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated February 25, 1992 shall be the conceptually approved layout with the following modification: a. Both garages shall have a minimum eighteen foot (18') setback from the alley; and shall include roll -up garage doors with electric openers. 2. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. All applicable Public Works fees shall be paid prior to issuance of building permits. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. Per Huntington Beach Ordinance Code, Section 9130.12, a 24-inch box tree shall be planted in the front -yard of each lot. Three (3) fifteen gallon trees may be substituted for one larger tree. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. The Zoning Administrator reserves the right to revoke this Use Permit No. 92-12 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: USE PERMIT NO. 92-8 Applicant: Rick Russell 18971 Beach Blvd. Huntington Beach, CA 92648 Request: To permit an oil change operation in conjunction with a car wash by the converting two (2) bays within an existing four (4) bay detail building to oil change bays pursuant to Sections 9730.58 and 9220.1(c)(A) of the Huntington Beach Ordinance Code. Location: 18971 Beach Boulevard Wayne Carvalho, Staff Planner, reported that the request is to convert two of the four existing "detail" bays for oil change purposes. He advised that the change would not impact the parking requirements and that there would be no exterior modifications except for a six foot high masonry waste oil tank enclosure. Staff recommended that the oil service be ancillary to the car wash and no additional signage be permitted. Staff concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. The applicant, Rick Russell, was present and concurred with the conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. Scott Hess, Zoning Administrator, said he would approve the request with added conditions for a three to four foot wide landscape planter in the front of the proposed waste oil enclosure facing Beach Boulevard and that the applicant work with staff to arrive at a feasible way to block vehicular access at the westerly driveway along Garfield Avenue except for emergency vehicles. USE PERMIT NO. 92-8 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ZA Minutes - 3/18/92 -5- (2774d) FINDINGS FOR APPROVAL: 1. The granting of Use Permit No. 92-8 for an oil change operation in the detail center building in conjunction with a car wash will not adversely affect the General Plan of the City of Huntington Beach as the oil change operation will be ancillary to the car wash. 2. The establishment, maintenance and operation for an oil change operation in conjunction with a car wash will not be detrimental to the general welfare of persons residing or working in the vicinity as the entire oil change operation will be conducted wholly within the building. 3. The establishment, maintenance and operation for an oil change operation in conjunction with a car wash will not be detrimental to property and improvements in the vicinity of such use as no exterior modification will occur except for a six foot (6') high waste oil enclosure. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated February 14, 1992 shall be the conceptually approved layout with the following modifications: a. A minimum four foot (4') wide landscape planter shall be provided along the waste oil tank enclosure. 2. The applicant shall meet with staff to determine a feasible method to block ingress and egress on the westerly driveway along Garfield. Fire access shall be maintained by either a Knox box or removal bollards; no portable structures/signs are permitted. 3 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 5. All repair work shall be conducted wholly within the building. 6. Proposed structures shall be architecturally compatible with existing structures. ZA Minutes - 3/18/92 -6- (2774d) 7. Conditions of approval shall be printed verbatim on all working ; drawings submitted for plancheck. 8. All conditions of approval on Conditional Use Permit No. 88-44 still apply. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke this Use Permit No. 92-8 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
