ZONING ADMINISTRATOR: Scott Hess STAFF MEMBER: Mike Connor MINUTES: The Minutes of the April 3, 1991 Zoning Administrator Meetings were continued to the meeting of April 17, 1991. REGULAR AGENDA ITEMS: ITEM 1• USE PERMIT NO 89-16 (Extension of Time) Applicant: Ocean Pointe Partners 520 Broadway, Ste. 100 Santa Monica, CA 90401 Request: A one year extension for Use Permit No. 89-16 which is to permit a three (3) foot exterior side yard setback in lieu of five (5) feet as permitted by Section 9130.7 of the Huntington Beach Ordinance Code. Location: Southeast side of Goldenwest between Walnut and Palm Ave. Mike Connor, Staff Planner, reported that Use Permit No. 89-16 was approved in 1989 and an extension of time was approved in 1990. Staff advised that this would be the final extension of time permitted by City Code. Public Works requested that the new Traffic Impact fee be added to the conditions of approval. Staff recommended approval of the extension of time with the added condition that the applicant be required to pay the traffic impact fee. Kathie Leighton, representing the applicant, concurred with the staff recommendation. USE PERMIT NO. 89-16 (ONE YEAR EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING ADDED CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. Conditions of Approval 1. All Conditions of Approval listed on the letter from the Zoning Administrator dated April 18, 1990 shall still apply. 2. The developer shall be responsible for paying all traffic impact fees to the Department of Public Works. ITEM 2: USE PERMIT NO, 91-11 Applicant: Seacliff Village Shopping Center 2134 Main Street, Suite 185 Huntington Beach, CA 92648 Request: To permit a Temporary Outdoor Event - Fourth of July Festival - pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: Home Federal Bank Parking Lot - 2111 Main Street Mike Connor, Staff Planner, reported that the outdoor event was held annually and that no complaints were received for the previous events. Staff recommended approval with findings and conditions of approval. USE PERMIT NO. 91-11 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event (Fourth of July Festival) held on one day (July 4, 1991) will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The festival is a one day event which is located within a commercial district and and takes place on a national holiday when many business are closed. b. Property and improvements in the vicinity of such use or building. All improvements are temporary. 2. The granting of Use Permit No. 91-11 will not adversely affect the General Plan of the City of Huntington Beach. The proposed festival is temporary in nature, and as such it will have no adverse impact on the General Plan. ZA Minutes - 4/10/91 -2- (9389d) SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated March 13, 1991 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. Fire access lanes shall be a minimum with of Twenty -Four (24) feet. 3. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. a. All parking shall be a minimum of forty (40) feet from the proposed tent. b. The proposed tent shall be of fire retardant material. Proof of Certification shall be submitted to the Fire Department for approval prior to the tent's installation on the site. C. The proposed tent shall be secured against collapsing to the satisfaction of the Fire Department. d. "No Smoking" signs shall be posted in conspicuous locations. e. Fire extinguishers shall be provided in number and locations specified by the Fire Department. f. A minimum of two (2) exits shall be provided and maintained. g. Stand by personnel shall be on site to safeguard premises. 6. The applicant's request shall include necessary permits for balloons and temporary signs. 7. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. ZA Minutes - 4/10/91 -3- (9389d) 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 91-11 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: COASTAL DEVELOPMENT PERMIT NO, 91-2/CONDITIONAL EXCEPTION NO, 91-5 Applicant: Dan Koon 16411 Barnstable Circle Huntington Beach, CA 92649 Request: Coastal Development Permit No. 91-2 - To permit the remodel of an existing one story dwelling with a second story addition pursuant to Section 989.5 of the Huntington Beach Ordinance Code. Conditional Exception No. 91-5 - To permit an eighteen (18) foot garage setback in lieu of twenty (20) feet as established by Use Variance No. 989 and to permit a nine (9) foot rear yard setback in lieu of ten (10) feet as required by Section 9110.8 of the Huntington Beach Ordinance Code. Location: 16411 Barnstable Circle Mike Connor, Staff Planner, reported that the property is located on Humboldt Island at the corner of Barnstable and Humboldt Drive. The property has a 12 foot front yard setback for living area which was approved under Area Variance No. 66-78; therefore the second story addition may be at 12 feet. Staff concluded by recommending approval of the coastal development permit and denial of the conditional exception. THE PUBLIC HEARING WAS OPENED. Frank Gislketsis, representing the applicant, said the reduced garage setback is to extend the garage for added area to store a RV and other equipment which is now in the driveway. He indicated that the proposal includes a roll -up garage door which will allow more room for parking. He said that property located at 16362 Ardsley (one block to the north) has a 15 foot garage setback. -He agreed with staff's recommendation for the rear deck at 10 feet; however, requested approval of the request for the reduced garage setback. Mike Connor, Staff Planner, advised that the property on Ardsley was denied by the Board of Zoning Adjustments; however, the application was approved by the Planning Commission on appeal. ZA Minutes - 4/10/91 -4- (9389d) 1 Scott Hess, Zoning Administrator, said he could not establish findings for approval of the variance for the reduced garage setback and suggested building redesign to alleviate encroachment into the setback. Mike Connor, Staff Planner, advised that the plans would have to be modified to have a three car garage and three open parking spaces as a result of the proposed six bedrooms or redesign the plans to have four bedrooms. There were no other person present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 91-21 AND CONDITIONAL EXCEPTION NO. 91-1 WERE CONTINUED, WITH THE APPLICANTS CONSENT, TO THE MEETING OF APRIL 17, 1991 BY THE ZONING ADMINISTRATOR. ITEM 4• COASTAL DEVELOPMENT PERMIT NO, 91-3 Applicant: Richard Anderson 128 S. Glassell Ave. Orange, CA 92666 Request: To permit a 450 square foot addition to an existing two story dwelling pursuant to Section 989.5.2 of the Huntington Beach Ordinance Code. Location: 17002 Marina Bay Drive Coastal Status: APPEALABLE Mike Connor, Staff Planner, reported that the request is for an addition to the rear of the residence for bay windows, family room and breakfast room. The addition would not obstruct any view of the harbor. Staff concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Richard Anderson, the applicant, concurred with staff's findings and conditions. There were no other persons to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 91-3 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. ZA Minutes - 4/10/91 -5- (9389d) FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO 91-3: 1. The request to permit the remodel and 450 square foot addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed addition will have no impact on public views or coastal access. 2. Coastal Development Permit No. 91-3 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed addition meets all standards of code. 3. At the time of occupancy, the proposed remodel and addition to an existing two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All necessary infrastructure is currently in place. 4. The proposed remodel and addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The proposed addition will have no impact on public views or coastal access. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March 1, 1991 shall be the approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 4. All proposed cantilevered deck improvements require separate permits. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. ZA Minutes - 4/10/91 -6- (9389d) 1 7. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units if these facilities are replaced. 8. Low -volume heads shall be used on all new spigots and water faucets. 9. Upon submittal for plancheck the applicant shall provide a copy of a letter showing that the proposed addition has been reviewed by the property owners association. ITEM 5• COASTAL DEVELOPMENT PERMIT NO, 91-4 Applicant: Richard Burnside 3979 Mistral Dr. Huntington Beach, CA 92649 Request: To permit a first story remodel and second story addition to an existing single family residence pursuant to Section 989.5.2 of the Huntington Beach Ordinance Code. Location: 3979 Mistral Mike Connor, Staff Planner, reported that the proposed project meets the maximum building height and site coverage requirments. Staff advised that there is no public access through the lot and recommended approval with findings and conditions of approval. Scott Hess, Zoning Administrator, asked if the Homeowners Association had approved the plans. Staff indicated that a representative of the Homeowners Association had reviewed the plans but no comments were received. THE PUBLIC HEARING WAS OPENED. Louie Hernandez, representing the applicant, advised that the Homeowners Association had a copy of the plans and they were waiting for comments. ZA Minutes - 4/10/91 -7- (9389d) COASTAL DEVELOPMENT PERMIT NO. 91-3 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 91-4 : 1. The request to permit the first story remodel and second story addition to an existing one-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed remodel and addition will have no impact upon public access to water oriented recreation nor will it impact public views. 2. Coastal Development Permit No. 91-4 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed remodel and addition meets all standards of code. 3.
