ACTING ZONING ADMINISTRATOR: STAFF MEMBER• MINUTES• Room B-6 - Civic Center 2000 Main Street Huntington Beach, California Hal Simmons Mike Connor The Minutes of the April 3, April 10 and April 17, 1991 Zoning Administrator Meetings were continued to the meeting of May 1, 1991. REGULAR AGENDA ITEMS: ITEM 1 USE PERMIT NO 91-13 (Continued from April 17, 1991) Applicant: Aquatic Concepts 32017 So. Coast Highway Laguna Beach, CA 92677 Request: To permit a five (5) foot block wall six (6) feet from the front property line pursuant to Section 9771(L) of the Huntington Beach Ordinance Code. Location: 16702 Coral Cay Lane Mike Connor, Staff Planner, reported that the applicant had requested withdrawal of the application. Staff recommended that the request be withdrawn by the Zoning Administrator USE PERMIT NO. 91-13 WAS WITHDRAWN AT THE APPLICANT'S REQUEST BY THE ACTING ZONING ADMINISTRATOR ITEM 2: COASTAL DEVELOPMENT PERMIT NO, 91-10/USE PERMIT NO. 91-10 Applicant: City of Huntington Beach 2000 Main Street Huntington Beach, CA 92648 Request: To permit a temporary trailer pursuant to Section 9730.30 of the Huntington Beach Ordinance Code. Location: 420 Pacific Coast Highway - Northeast corner of Pacific Coast Highway and Fifth Street. Mike Connor, Staff Planner reported that the request is to relocate a trailer which is currently located at Main and Orange to the new location at Pacific Coast Highway and Fifth Street. Staff advised that the setback requirements could be met with the trailer on site and that the required parking would be met on site and across the alley upon demolition of the Terry Buick buildings. If the buildings are not demolished prior to placing trailers on site, the parking can be provided on Fifth Street at a new parking lot which is located at the southwest corner of Fifth Street and Walnut Avenue. Staff also advised that seven letters were received from property owners and tenants in opposition to the request. The letters were signed by: Elden Bagstad, Don Nelson, Brian Graham, Wayne Remest, Joy Lynn, Charlotte Gregory, Michael's Surf and Sport and a resident (signature illegible). Staff concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Keith Bohr, City Redevelopment Staff, was present to respond to Zoning Administrator questions. There were no persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 91-10 AND USE PERMIT NO. 91-10 WERE APPROVED BY THE ACTING ZONING ADMINISTRATOR WITH FINDINGS AND ADDED CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 91-10: 1. The request to permit the placement of a temporary retail sales trailer conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed trailer will not affect public views of the coast because of required setbacks from Fifth Street and Pacific Coast Highway. In addition, the proposed trailer will not impact coastal access. 2. Coastal Development Permit No. 91-10 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed trailer will help to promote visitor serving commercial businesses and will meet all applicable provisions of the Downtown Specific Plan. ZA Minutes - 4/24/91 -2- (9557d) 11 1 3. At the time of occupancy, the proposed trailer will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All necessary infrastructure is currently in place. 4. The proposed trailer conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The trailer will not impact public access or water oriented recreation. FINDINGS FOR APPROVAL USE PERMIT NO. 91-10: 1. The establishment, maintenance and operation of the temporary trailer for relocation of downtown merchants will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; Because other vacant lots in the immediate vicinity will be paved to replace parking lost as a result of placing a trailer at this location. b. Property and improvements in the vicinity of such use or building. The proposed trailer is temporary. 2. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The proposed trailer is in compliance with the General Plan Land Use Designation of mixed use because it will help to promote the visitor serving commercial businesses in the downtown area. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March 4, 1991 shall be the conceptually approved layout with the following modifications: a. The structure shall be placed a minimum of fifteen (15) feet from the front and exterior side yard property lines. b. Four (4) parking spaces for the trailer shall be provided on the north side of the alley which are in addition to the four (4) spaces provided on the subject property. c. Landscaping shall be provided in compliance with recommendations from the Design Review Board. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. Proposed structures shall be architecturally compatible with existing structures. 5. The trailer shall not be placed on site until the property on the north side of the alley is paved and striped to provide the required parking as well as to replace the six (6) public spaces which presently exist on the subject property. Alternatively, the former Surf Theater property on the west side of 5th Street may be paved and striped to provide the required and replacement parking. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 91-10 and Use Permit 91-10 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: USE PERMIT NO, 91-14 Applicant: David J. Pilecki 809 13th Street Huntington Beach, CA 92648 Request: To permit an addition to an existing nonconforming residence pursuant to Sections 9652(c) of the Huntington Beach Ordinance Code. The structure is nonconforming due to an existing four and one half (4 1/2) foot side yard setback in lieu of five (5) feet as required by section 9110.7(a) of the code. Location: 809 Thirteenth Street Mike Connor, Staff Planner, reported that the residence is nonconforming due to a four (4) foot six (6) inch side yard setback in lieu of five (5) feet as required by Code. The request is for an addition to the rear of the structure and a second story. Staff advised that no comments were received in response to the public notification. David Pilecki, the applicant, requested approval from the Zoning Administrator. He said that the neighbors did not have any concerns with the addition. There were no persons present to speak for or against the request and the public hearing was closed. Hal Simmons, Acting Zoning Administrator, responded that Code allows for approval of minor additions to nonconforming structures. USE PERMIT NO. 91-10 WAS APPROVED BY THE ACTING ZONING ADMINISTRATOR WITH FINDINGS AND ADDED CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed addition to an existing nonconforming structure will not be detrimental to: a. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The property is designated as Low Density Residential in the City's General Plan Land Use Element. The applicant's proposal is consistent with this designation. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March 28, 1991 shall be the conceptually approved layout. 2 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. Any oil wells (active, idle, abandoned, etc) on property to be dedicated to the City shall be abandoned pursuant to Fire Department standards by the property owner, at the cost of the property owner, prior to City Acceptance of such property. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 9. All applicable Public Works fees shall be paid prior to issuance of building permits. 10. Two and onehalf (2 1/2) feet shall be dedicated to the City of Huntington Beach and improved to the Department of Public Works standards. 11. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District for demolition of structures that could potentially contain asbestos. 4. The Zoning Administrator reserves the right to revoke this Use Permit No. 91-14 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
