ZONING ADMINISTRATOR: Scott Hess STAFF MEMBER• MINUTES• REGULAR AGENDA ITEMS: Mike Connor Center California The Minutes of the April 3, April 10 and April 17, 1991 Zoning Administrator Meetings were approved and the minutes of April 24, 1991 were continued to the May 15, 1991 Zoning Administrator Meeting. ITEM 1• TENTATIVE PARCEL MAP NO 90-404 (Waiver of Final Map) Applicant: Michael B. Foster 735 13th Street Huntington Beach, CA 92648 Request: To consolidate two parcels into one parcel with parcel map waiver pursuant to Sections 9110.2 and 9930.1 of the Huntington Beach Ordinance Code. Mike Connor, Staff Planner, reported that the applicant had completed all the requirements of the tentative parcel map and now requested waiver of the final map. Staff said that a release slip had been received from the Department of Public Works. Staff concluded by recommending approval of the waiver with a suggested finding and condition of approval. TENTATIVE PARCEL MAP NO. 90-404 (WAIVER OF FINAL MAP) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDING AND CONDITION OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDING OF APPROVAL FOR WAIVER: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITION OF APPROVAL: 1. Plat Map No. 404 must be recorded within sixty (60) days. ITEM 2: USE PERMIT NO. 91-17 Applicant: Huntington Beach Wetlands Conservancy P. 0. Box 5903 Huntington Beach, CA 92645 Request: To install a temporary ten (10) foot by forty (40) foot trailer for a visitor's center and an eight (8) foot by ten (10) foot storage shed pursuant to Section 9730.30 of the Huntington Beach Ordinance Code. Location: 22500 Brookhurst Mike Connor, Staff Planner, reported that the property is located adjacent to the bike trail and flood channel. Staff said the Conservancy has -a small trailer on site and the request is to permit a larger trailer. Staff recommended approval in concept with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Gordon Smith, Chairman of the Conservancy, said that the Conservancy concurred with staff's recommended conditions of approval. He said the facility would be open during the week by appointment only and on weekends for four to six hours. The Zoning Administrator added conditions limiting occupancy to 25 visitors & 3 staff and that the Use Permit be brought back before the Zoning Administrator in three years for review. There were no other persons present to speak for or against the request and the public hearing was closed. ZA Minutes - 5/1/91 -2- (9645d) USE PERMIT NO. 91-17 WAS APPROVED IN CONCEPT BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE USE PERMIT REQUIRES CALIFORNIA COASTAL COMMISSION APPROVAL DUE TO THE PROPERTY LOCATION IN AN UNCERTIFIED AREA OF THE CITY (WHITE HOLE). HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR "APPROVAL IN CONCEPT": 1. The establishment, maintenance and operation of the temporary visitor's center trailer and storage shed for up to five years will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. All visits and tours are limited to Saturdays and by appointment only. b. Property and improvements in the vicinity of such use or building. The proposed structures are temporary. 2. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The proposed visitor's center provides public information regarding wetlands which is consistent with the open space conservation designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 3, 1991 shall be the conceptually approved layout with the following modifications: a. Provide setback dimension from trailer to northerly property line and north arrow on site plan. b. Provide vicinity map. C. Indicate bike rack number and location. 2 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Two (2) fire extinguishers shall be provided at locations to be determined by the Fire Department. 4. The bike trails shall not be obstructed by the trailer or entrance stairs. Visitors should be encouraged not to obstruct the bike path. ZA Minutes - 5/l/91 -3- (9645d) 5. visitation arrangements shall be by appointment only except on Saturdays and shall not exceed more than 25 persons at any one time. 6. No more than three (3) employees/volunteers operating the facility shall be permitted on -site at any time. 7. No visitor parking shall be permitted on -site. 8. The trailer shall be permitted for a maximum of five (5) years from the date of the California Coastal Commission approval and shall be reviewed in three years (May 1994) by the Zoning Administrator. 9. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. 10. Building permits shall not be issued until this request has been approved by the California Coastal Commission. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke this Use Permit No. 91-17 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 3• USE PERMIT NO. 91-16 Applicant: Larry Cubit Huntington Seacliff Corp. 2134 Main Street Huntington Beach, CA 92648 Request: To permit a seasonal parking lot pursuant to Section 9605 of the Huntington Beach Ordinance Code. Location: 21002 Pacific Coast Highway Mike Connor, Staff Planner, reported that the request is permitted by Code and conforms to City standards. Staff recommended approval with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Larry Cubit, the applicant, agreed to the conditions of approval. He stated that the parking lot would be operating under the same plan as the previous year. USE PERMIT NO. 91-16 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of a seasonal parking lot will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The seasonal parking lot has been in operation for a number of years without any problems. b. Property and improvements in the vicinity of such use or building. The seasonal parking lot has been in operation for a number of years without any problems. 2. The granting of Use Permit No. 91-16 will not adversely affect the General Plan of the City of Huntington Beach. The seasonal parking lot is consistent with the General Plan because it provides beach parking. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 3, 1991 shall be the conceptually approved layout. 2. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 3. The seasonal commercial parking lot may be permitted for a maximum of five (5) years ending in September of 1995. 4 The seasonal parking lot may operate only from Memorial Day through the third weekend in September of each year. 5. Directional and informational signs shall be displayed on -site to identify the entrance(s), fees, and hours of operation. Such signs shall be located at the entrance entering the parking lot and shall not exceed twelve (12) square feet and shall be six (6) feet high. Signs for seasonal parking lots shall be removed from the site each season no later than the third weekend in September. ZA Minutes - 5/l/91 -5- (9645d) 6 An attendant shall be on duty at all times during business hours. 7. Barricades shall be placed around the existing fire hydrant within the drive aisle to prevent customers from driving beyond that point. 8. An approved fire extinguisher shall be provided on the premises during business hours. 9. The site shall be maintained in a clean condition, free from trash and debris. Trash containers shall be placed on the site to accommodate and store all trash that accumulates on the lot. 10. A certificate of insurance for combined single limit bodily injury and/or property damage including products liability in the amount of $1,000,000 per occurrence shall be filed with the Department of Administrative Services. A hold harmless agreement holding the City harmless shall also be filed with the Department of Administrative Services. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke this Use Permit No. 91-9 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 4: USE PERMIT NO, 91-15 Applicant: Brent A. Lindstrom 902 England Huntington Beach, CA 92648 Request: To permit an addition to an existing nonconforming structure pursuant to Section 9652(c) of the Huntington Beach Ordinance Code. The structure is nonconforming due to a two and one half (2 1/2) foot exterior side yard setback in lieu of five (5) feet and a five and one half (5 1/2) foot front yard setback in lieu of fifteen (15) feet. Location: 902 England Mike Connor, Staff Planner, reported that the property is located on the northeast corner of England and Indianapolis and was constructed in 1924. Staff advised that the existing residence is 705 square feet with a proposed 1,130 addition in the rear portion of the residence. ZA Minutes - 5/l/91 -6- (9645d) THE PUBLIC HEARING WAS OPENED. Louie Hernandez, the architect, supported the request and indicated he was available to respond to any questions. Brent Lindstrom, the applicant, said the addition was being requested to allow sufficient room for his expanding family. He said that the addition would be an enhancement for the area. There were no other persons present to speak for or against the request and the public hearing was closed. Scott Hess, the Zoning Administrator, said he would support the request with the added conditions that the front of the residence be moved back six feet within two years, the front entry door be moved to the new addition and the porch removed entirely. USE PERMIT NO. 91-15 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND ADDED CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the proposed addition to an existing nonconforming structure will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The proposed addition will meet all code provisions. In addition, a portion of the existing structure (front deck area and living room area) will be eliminated to create an approximately 12 foot front yard setback which will be generally consistent with other structures in the vicinity. b. Property and improvements in the vicinity of such use or building. The proposed addition will meet all standards of code. 2. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The proposal is consistent with the Low Density Residential Land Use Designation in the City's General Plan. 3. The structure is worth preserving because of its unique architecturally style and the addition will be architecturally compatible with the existing structure. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 22, 1991 shall be the conceptually approved layout with the following modifications: ZA Minutes - 5/1/91 -7- (9645d) a. The main entrance to the unit shall be relocated from the existing structure to the new addition. b. The front portion of the existing structure (along England Street) shall be modified and/or demolished so as to be setback approximately 12 feet from the front property line within two (2) years from the date of approval. 2 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Any oil wells (active, idle, abandoned, etc) on property to be dedicated to the City shall be abandoned pursuant to Fire Department standards by the property owner, at the cost of the property owner, prior to City Acceptance of such property. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Natural gas shall be stubbed in at the locations of new cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 9. A radius dedication as specified by the Department of Public Works at the intersection of Indianapolis Avenue and England Street shall be required. 10. Two and one half (2 1/2) feet shall be dedicated to the City of Huntington Beach along the alley for alley purposes. 11. A grading plan shall be submitted to the Department of Public Works. 12. All off site improvements as required by the Department of Public Works shall be constructed to the City of Huntington Beach standards. ZA Minutes - 5/1/91 -8- (9645d) 13. All applicable Public Works fees shall be paid prior to issuance of building permits. 14. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke this Use Permit No. 91-15 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 5• COASTAL DEVELOPMENT PERMIT NO, 91-8 Applicant: Sam and Marlene Hammontree 16891 Coral Cay Lane Huntington Beach, CA 92649 Request: To permit the demolition of an existing residence and to permit the construction of a 6,558 sq. ft. single family dwelling pursuant to section 989.5.2 of the Huntington Beach Ordinance Code. Location: 16891 Coral Cay Lane Mike Connor, Staff Planner, reported that the request meets City Code requirements and that there were no negative impacts to any coastal policies. The plans had been reviewed and approved by the homeowners association. Staff concluded by recommending approval with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Anthony Chisafi, representing the architect, was present to answer questions. The Zoning Administrator asked if other homes in the area had double driveways. Mr. Chisafi said other homes in the area had circular drives with double cuts. Mike Connor, Staff Planner, advised that Public Works had no concerns regarding the two (2) driveways because the street is privately owned. There were no other persons present to speak for or against the request and the public hearing was closed. ZA Minutes - 5/l/91 -9- (9645d) COASTAL DEVELOPMENT PERMIT NO. 91-8 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 91-8 : 1. The request to permit the demolition and reconstruction of a 6,558 sq. ft. two story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed two story residence is located within a private -gated community and will have no impact upon public coastal views or access. 2. Coastal Development Permit No. 91-8 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed single family dwelling meets all applicable provisions of the zoning code. 3. At the time of occupancy, the proposed demolition and reconstruction to a 6,558 sq. ft. two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All necessary infrastructure is currently in place. 4. The proposed demolition and reconstruction of a two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The proposed 6,558 square foot two story -single family residence will have no impact upon public coastal views or access. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March-20, 1991 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Any dock, ramp, and cantilevered deck improvements shall require a separate review and permits from the Community Development Department and Public Works Department. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 6. Low -volume heads shall be used on all spigots and water faucets. 7. An automatic sprinkler system shall be installed throughout the building to comply with Huntington Beach Fire Department and Uniform Building Code standards. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 91-8 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 6: ADMINI_STRATIVE REVIEW NO, 91-3 Applicant: Nicolina Cuzzacrea Marketing Director Coultrup Development 13001 Seal Beach Blvd., Ste 300 Seal Beach, CA 90740 Request: To permit a model home and sales office complex pursuant to Section 9730.32 of the Huntington Beach Ordinance Code. Location: 4165 Warner - Huntington Harbour Bay Club Mike Connor, Staff Planner, reported the request had been reviewed by the various City departments. He said one comment had been received from the Building Division requesting that handicapped access be provided to the sales office. Staff recommended approval with suggested findings and conditions of approval. Nicolina Cuzzacrea, the applicant, supported the request and advised that the elevators would be operational therefore handicapped access would be provided. ADMINISTRATIVE REVIEW NO. 91-3 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ZA Minutes - 5/l/91 -11- (9645d) SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 8, 1991 shall be the conceptually approved layout. 2. The sales office use shall be discontinued within thirty (30) days following sale of the last on -site unit. A cash bond of one thousand dollars ($1,000) shall be posted with the city for the sales office and for each model home to guarantee compliance with all provisions of this code and the Huntington Beach Building Code. Such model homes shall only serve the tract specified in the administrative review application. 3. Handicapped access shall be provided to the satisfaction of the Building Division. 4 The Administrative Review No. 91-3 may be subject to review by the Zoning Administrator one (1) year after issuance to insure compliance with all city codes. 5. The sales office shall not be converted or expanded into a general business office for the contractor or developer. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all -applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Administrative Review No. 91-3 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 7: COASTAL DEVELOPMENT PERMIT 91-2 (RECONSIDERATION Applicant: Dan Koon Request: To reconsider a request to permit the remodel of an existing one story dwelling with a second story addition and schedule for public hearing at the next Zoning Administrator Meeting. Location: 16411 Barnstable Circle Mike Connor, Staff Planner, reported that the applicant had made significant changes to the design subsequent to the Zoning Administrator's denial of the request. Staff recommended reconsideration of the request.
