ZONING ADMINISTRATOR: Scott Hess STAFF MEMBER: MINUTES• REGULAR AGENDA ITEMS: Mike Connor The Minutes of the April 24 and May 1, 1991 Zoning Administrator Meetings were approved. ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 91-2 (RECONSIDERATION): Applicant: Dan Koon 16411 Barnstable Circle Huntington Beach, CA 92649 Request: To permit the remodel of an existing one story dwelling with a second story addition pursuant to Section 989.5 of the Huntington Beach Ordinance Code. Location: 16411 Barnstable Circle Mike Connor, Staff Planner, reported that the applicant had revised the plans to show a twenty (20) foot, front yard garage setback, a ten (10) foot rear yard setback and a maximum of four (4) bedrooms to meet the code requirements. Staff recommended approval with suggested findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Robert Earl, Architect, representing the applicant spoke in support of the request. John Misterly, resident, was present and questioned staff regarding the previous denial. Staff responded and Mr. Misterly concurred with staff's recommendation for approval. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 91-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 91-2 : 1. The request to permit the remodel and second story addition to an existing•one-story residence conforms -with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed addition will have no effect upon public views or coastal access. 2. Coastal Development Permit No. 91-2 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed addition meets all applicable provisions of code. 3. At the time of occupancy, the proposed remodel and second story addition to an existing one-story residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All necessary infrastructure is currently in place. 4. The proposed remodel and second story addition to an existing one story residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. The proposed addition will have no impact upon public views or coastal access. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March 23, 1991 shall be the conceptually approved layout with the following modification: a. The enlarged master bedroom on the first floor plan shall be revised to read "Family Room". 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. The applicant shall seek homeowners association approval prior to submittal for plan check. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. Proposed structures shall be architecturally compatible with existing structures. ZA Minutes - 5/15/91 -2- (9784d) L 5. Natural gas shall be stubbed in at the locations of new cooking facilities, water heaters, and central heating units. 6. Low -volume heads shall be used on all spigots and water faucets. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 91-2 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO. 91-8 Applicant: Eric Siverson Welding 8611 Joyzelle Garden Grove, CA 92641 Request: To permit a security gate for vehicular access to an existing apartment project with a special permit to allow for compact parking spaces pursuant to Section 9606.3 of the code. Location: 18832 Florida Mike Connor, Staff Planner, reported that the the parking will be restriped to allow for compact parking spaces and that a trash enclosure would be required. Staff concluded by recommending approval with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Eric Siverson, the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 91-8 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the proposed security access gate will not be detrimental to: ZA Minutes - 5/15/91 -3- (9784d) a. The general welfare of persons residing or working in the vicinity; The security access gate will provide added security to tenants of the building and their property. b. Property and improvements in the vicinity of such use or building. The security access gate will encourage tenants currently parking on Florida Street to park within the secured parking area. 2. The granting of Use Permit No. 91-8 will not adversely affect the General Plan of -the City of Huntington Beach. The security gate will provide for added protection for the building's tenants and their property which is consistent with the safety element. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, received and dated April 30, 1991 and elevations received and dated February 27, 1991 shall be the conceptually approved layout. 2. A revised site plan shall be submitted depicting the modifications described herein: a. Compact spaces shall be shown in locations as the lot has been restriped. b. A trash enclosure shall be constructed in the location shown on the approved site plan. 3 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. Trash bins shall not be placed in required parking spaces. 5. The parking lot shall be restriped to assure that there is no net loss in parking. All parking stalls shall be double striped in conformance with the parking layout as specified by Article 960 of the Huntington Beach Ordinance Code. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 1 ZA Minutes - 5/15/91 -4- (9784d) 1 7. Pedestrian egress shall be reviewed and approved by the Building Division. 8. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. Fire Department requirements shall be as follows: 1. A "Knox" switch must be placed on both sides of the gate. 2. The security access gate shall conform to City Specification No. 403. Plans must be approved by the Fire Department prior to issuance of building permits. 3. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 4. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke this Use Permit No. 91-8 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 3• COASTAL DEVELOPMENT PERMIT NO 90-9 (Twelve (12) Month Extension of Time) Applicant: Frank Jao 3322 Devon Circle Huntington Beach, CA 92649 Request: Extension of time for a Coastal Development Permit which was approved to permit the remodel and 3,208 square foot first and second story addition to an existing 2,228 square foot, single story residence. Location: 3322 Devon Circle (Admiralty Island, Huntington Harbour) Mike Connor, Staff Planner, recommended approval of the twelve month extension of time with suggested conditions of approval. ZA Minutes - 5/15/91 -5- (9784d) COASTAL DEVELOPMENT PERMIT -NO. 90-9 (TWELVE (12) MONTH EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10). CONDITIONS OF APPROVAL: 1. All previous conditions of approval from the March 21, 1990 letter from the Zoning Administrator shall still apply. 2. Coastal Development Permit No. 90-9 shall expire April 25, 1992 unless an extension of time is granted by the Zoning Administrator. ITEM 4: COASTAL DEVELOPMENT PERMIT NO. 89-32 (Three (3) Month Extension of Time) Applicant: Bill Rodgeway Design 5828 E. Second Street Long Beach, CA 90803 Request: To permit the remodel and 1,274 square foot addition with a 500 square foot roof deck to an existing two story residence. Location: 16391 Ardsley Mike Connor, Staff Planner, recommended approval of the three month extension of time with suggested conditions of approval. COASTAL DEVELOPMENT PERMIT NO. 89-32 (THREE (3) MONTH EXTENSION OF TIME) WAS APPROVED 'BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10). CONDITIONS OF APPROVAL: 1. All previous conditions of approval as reflected in the City Council minutes dated May 21, 1990 shall still apply. 2. Coastal Development Permit 1991, unless an extension Administrator. No. 89-32 shall expire August 21, of time is granted by the Zoning ZA Minutes - 5/15/91 -6- (9784d) is DUE TO THE FACT THAT INFORMATION CRITICAL TO THE VIABILITY OF THE PROJECT WAS RECEIVED BY CITY STAFF ON THE DATE OF THIS HEARING, AND THE NEED TO TARE ACTION AROSE, THE FOLLOWING ITEM WAS ADDED TO THE AGENDA.: ITEM 5: TENTATIVE PARCEL MAP NO. 90-393 (Request for Waiver of a Final Map) Applicant: Sheryl Caverly 553 Temple Hills Drive Laguna Beach, CA 92651 Request: To conoslidate two parcels into one parcel pursuant to Section 9930.1 of the Huntington Beach Ordinance Code and Section 4.7.02 of the Downtown Specific Plan Location: 201 and 203 Main Street Mike Connor, Staff Planner, reported that the Department of Public Works had advised that the dedications and improvements for the parcel map had been completed. Staff recommended approval of the waiver of the final map with suggested findings and conditions of approval. TENTATIVE PARCEL MAP NO. 90-393 (WAIVER OF FINAL MAP) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS OF APPROVAL FOR WAIVER: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: 1. Plat Map No. 393 must be recorded within sixty (60) days.
