PUBLIC HEARING ITEMS B-1 CONDITIONAL USE PERMIT NO 91-16/COASTAL DEVELOPMENT PERMIT NO. 91-7• APPLICANT: Richard L. Anderson LOCATION: 16418 Ladona Circle (Humboldt Island -Huntington Harbour) Conditional Use Permit No. 91-16 in conjunction with Coastal Development Permit No. 91-7 is a request to permit the construction of a 342 square foot third story exercise room pursuant to Section 9110.4(a) of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 91-15 and Coastal Development No. 91-7 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Haydee Tillotson, 16426 Ladona Circle, spoke in favor of the request. Ms. Tillotson stated that she has no problems with third story additions being built if they are built within code. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The proposed addition to an existing two story single family residence with a third floor 342 square foot exercise room will not have a detrimental effect upon the general health, welfare, safety and privacy of persons working or residing in the vicinity or will not be detrimental to the value of the property and improvements in the vicinity. The proposal as designed, meets and or exceeds the code requirements for a third story and, therefore, will not be detrimental to the surrounding neighborhood. 2. The proposed addition to an existing two story single family residence with a third floor 342 square foot exercise room is compatible with existing or proposed uses in the vicinity. The proposed third story exercise room is within the maximum height limits for any two (2) story residence and, therefore, will be compatible with the existing and surrounding two (2) and three (3) story residences of the Huntington Harbour area. The location, site layout and design of the proposed addition to an existing two story single family residence with a third floor 342 square foot exercise room is properly related to the streets, drive and other structures and uses in the vicinity in a harmonious manner. The location of the third story windows and deck are properly related and, therefore, will be harmonious with existing structures and uses. 4. The proposed addition to an existing two story single family residence with a third floor 342 square foot exercise room is consistent with the goals and policies of the Huntington Beach General Plan. The General Plan allows for a wide variety of housing types and the proposal as submitted conforms to the provision of a third story addition as implemented through the zoning ordinance and the plans and policies of the Housing element of the General Plan. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT N0, 91-7: 1. The proposed addition to an existing two story single family residence with a third floor 342 square foot exercise room as proposed by Coastal Development Permit No. 91-7 conforms with the plans, policies, requirements and standards of the Coastal element. 2. The proposed addition to an existing two story single family residence with a third floor 342 square foot exercise room as proposed by Coastal Development Permit No. 91-7 is consistent with the CZ suffix, low density residential development standards, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. The proposed addition to an existing two story single family residence with a third floor 342 square foot exercise room as proposed by Coastal Development Permit No. 91-7, will have available, infrastructure in a manner that is consistent with the C-LUP. 4. The proposed addition to an existing two story single family residence with a third floor 342 square foot exercise room as proposed by Coastal Development Permit No. 91-7 conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March 19, 1991 shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: PC Minutes - 6/4/91 -3- (0869d) a. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. b. Elevations shall depict colors and building materials proposed. c. The site plan (or reference page) shall include all conditions of approval imposed on the project printed verbatim. 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. All applicable Public Works fees shall be paid. b. The property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 4. Provide an automatic fire sprinkler system to comply with Fire Department Standards. 5. Install a two (2) inch domestic/fire service from City main to house complying with Water Department Standards. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 9. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be completed: a. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. b. Compliance with all conditions of approval specified herein shall be accomplished. 10. The Planning Commission reserves the right to revoke Conditional Use Permit No. 91-15 and Coastal Development Permit No. 91-7 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. This conditional use permit shall not become effective until an "Acceptance of Conditions" form has been properly executed by the applicant and an authorized representative of the owner of the property, recorded with County Recorder's Office, and returned to the Planning Division. 12. Conditional Use Permit No. 91-15 and Coastal Development Permit No. 91-7 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. B-2 CONDITIONAL USE PERMIT NO. 91-15/CONDITIONAL EXCEPTION (VARIANCE) NO. 91-12: APPLICANT: Dane S. Morinaka LOCATION: 6131 Dundee Drive (South of Bolsa Avenue, east of Springdale Street) Conditional Use Permit No. 91-15 in conjunction with Conditional Exception (Variance) No. 91-12 is a request to permit a 646 square foot second unit (granny unit) to an existing single story single family residence pursuant to Section 9110.3 of the Huntington Beach Ordinance Code. Conditional Exception (Variance) No. 91-12 has been initiated because the proposal does not comply with the Huntington Beach Ordinance Code, Article 911, (Low Density Residential District) in the following areas: 1. Section 9110.6 specifies that the minimum front yard setback for a front entry garage is 22 feet. The applicant is requesting a reduction of the minimum setback requirement to 20 feet. STAFF RECOMMENDATION: Planning staff recommends that the Planning Commission approve Conditional Use Permit No. 91-15 and Conditional Exception (Variance) No. 91-12 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Ruth Newborow, (SP?), spoke in opposition to the request. She feels the addition will change the character of the house and cause additional traffic. Chester Nixon, spoke in opposition to the request. Mr. Nixon is concerned with house being occupied by two (2) families after the addition. PC Minutes - 6/4/91 -5- (0869d) Dane S. Mornaka, applicant, stated he is building the addition for his parents and does not plan to rent it out. Emeline Shaffe, spoke in opposition to the request. She asked if the area will be rezoned. She also stated that the majority of residents in the area were not in favor of this addition. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission question whether the application had considered redesigning the project so that they would not need a variance. It was stated the reason it was designed this way was to give the parents idenpendance and privacy. The Commission was supportive of the general proposal. It was suggested though, that it be redesigned so a variance was not needed. Another concern included abuse of this type of unit in the future, if they were approve the one before them tonight. A MOTION WAS MADE BY LEIPZIG, TO CONTINUE CONDITIONAL USE PERMIT NO. 91-15 AND CONDITIONAL EXCEPTION (VARIANCE) NO. 91-12 IN ORDER TO REDESIGN THE PROJECT. NO SECOND MOTION FAILS. A MOTION WAS MADE BY SHOMAKER, SECOND BY NEWMAN, TO APPROVE CONDITIONAL USE PERMIT NO. 91-15 AND CONDITIONAL EXCEPTION (VARIANCE) NO. 91-12 WITH FINDINGS AND MODIFIED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Richardson, Newman, Shomaker, Kirkland, Dettloff, Bourguignon NOES: Leipzig ABSENT: None ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 91-15: 1. The location, site layout, and design of the proposed 646 square foot second unit addition and front entry garage properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The proposed addition generally conforms to code and will be provided with adequate access and on -site parking. 2. The combination and relationship of the 646 square foot second unit addition and front entry garage to the existing single family residence are properly integrated. The proposed addition is properly designed to provide an architecturally unified whole structure. PC Minutes - 6/4/91 -6- (0869d) 3. The access to and parking for the proposed 646 square foot second unit addition and front entry garage does not create an undue traffic or parking problem. The site is provided with four (4) on -site parking spaces and the applicant is providing a roll -up garage door for adequate tandem parking on the garage drive apron. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO.91-12: 1. There are exceptional or extraordinary circumstances or conditions applicable to the land, buildings or premises involved that do not apply generally to other property or uses in the district. The lot is provided with greater lot area and depth and the placement of the existing structure prohibits the construction of the second unit to code with the necessary front setback for a front entry garage. 2. The granting of a conditional exception (variance) for a reduction in the minimum setback for a front entry garage is necessary in order to preserve the enjoyment of one or more substantial property rights. The adjacent (east) lot has the same lot area and lot depth, placement of building and the same general layout as proposed by the applicant. 3. The granting of Conditional Exception (Variance) No. 91-12 for a minimum setback for a front entry garage will not be materially detrimental to the public health, safety and welfare, or injurious to the conforming (land, property, or improvements) in the neighborhood. The adjacent (east) lot has the same lot area and lot depth, placement of building and the same general layout as proposed by the applicant and adequate on -site parking is provided. 4. The applicant is willing and able to carry out the purposes for which the conditional exception (variance) is sought and he will proceed to do so without unnecessary delay. 5. Conditional Exception (Variance) No. 91-12 for granting of a reduction in the minimum setback for a front entry garage will not reduce the required total on -site parking spaces. The applicant provides a roll -up garage door to adequately provide the necessary space on the drive apron for the two (2) tandem parking spaces. CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and dated April 29, 1991 shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. The following safety and conservation measures for the new unit shall be implemented: 1) Insulation of accessible attic areas to R-19. PC Minutes - 6/4/91 -7- (0869d) 2) Weatherstripping of doors and windows. 3) Installation of low flow shower heads and facets certified by the California energy commission. 4) Installation of approved smoke detectors. b. Elevations shall depict colors and building materials proposed. c. The Community Development Department shall review and approve the following: 1) Proposed structures shall be architecturally compatible with existing structures. d. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. All applicable Public Works fees shall be paid. b. The property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 4. Curb, gutter, sidewalk and driveway shall be removed and replaced as per Public Works Standards. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. During construction, the applicant shall: a. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); b. Discontinue construction during second stage smog alerts. 8. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 9. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be completed: a. All improvements to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. PC Minutes - 6/4/91 -8- (0869d) b. Compliance with all conditions of approval specified herein shall be accomplished. 10. Pursuant to Article 911 of the Huntington Beach Ordinance Code, the following conditions shall apply: a. The second unit shall not be sold separately from the main dwelling. b. The second unit shall comply with all applicable land use regulations of the Huntington Beach Ordinance Code except as specified. c. The park and recreation fee shall be assessed at twenty-five (25) percent of the fee for a single family residence as set by resolution of the City Council. d. No separate utility meters shall be permitted for the second unit. 11. The Planning Commission reserves the right to revoke this conditional use permit and conditional exception (variance) if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 12. This conditional use permit shall not become effective until an "Acceptance of Conditions" form has been properly executed by the applicant and an authorized representative of the owner of the property, recorded with County Recorder's Office, and returned to the Planning Division. 13. Conditional Use Permit No. 91-15 and Conditional Exception (Variance) No. 91-12 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. B-3 CONDITIONAL USE PERMIT NO, 91-20: APPLICANT: Huntington Beach/Fountain Valley Board of Realtors LOCATION: 8101 Slater Avenue Conditional Use Permit No. 91-20 is a request for an expansion to an existing office building with a building height of twenty-eight (28) feet six (6) inches within forty-five feet of property zoned or general planned residential pursuant to Section 9200.3 of the Huntington Beach Ordinance Code. PC Minutes - 6/4/91 -9- (0869d) STAFF RECOMMENDATION: _ Staff recommends that the Planning Commission approve Conditional Use Permit No. 91-20 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. James Righeimer, President Huntington Beach/Fountain Valley Board of Realtors, stated he was concerned with the on -site circulation which caused them to loose six (6) parking spaces. Will Woods, Executive Vice President Huntington Beach/Fountain Valley Board of Realtors, was also concerned with the parking circulation plan. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. A discussion ensued among the Commissioners and staff regarding the circulation plan. A MOTION WAS MADE BY KIRKLAND, SECOND BY BOURGUIGNON, TO APPROVE CONDITIONAL USE PERMIT NO. 91-20 WITH FINDINGS AND MODIFIED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Richardson, Bourguignon, NOES: None ABSENT: None ABSTAIN: None MOTION PASSED Newman, Shomaker, Kirkland, Dettloff, Leipzig FINDINGS OF APPROVAL - CONDITIONAL USE PERMIT NO, 91-20: 1. The location, site layout, and design of the proposed office building expansion properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. An excess of twenty-one (21) parking spaces are provided on -site to more than adequately meet the office building's parking demand. 2. The proposed office building addition will not be detrimental to the general health, welfare, safety and convenience, nor detrimental or injurious to the value of property or improvements of the neighborhood or of the City in general. The proposed addition is compatible with the surrounding land uses and incorporates architectural features and appurtenances in its design. The maximum height permitted in this zone is thirty-eight (38) feet and the proposed addition has a building height of twenty-eight (28) feet six (6) inches. 1 PC Minutes - 6/4/91 -10- (0869d) 1 3. The access to and parking for the proposed office building expansion does not create an undue traffic problem. On -site circulation to prevent vehicular traffic from re-entering Slater Avenue is provided as well as an excess of twenty-one (21) parking spaces. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 91-20: 1. The site plan, floor plans, and elevations received and dated May 24, 1991 shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. b. Elevations shall depict colors and building materials proposed. c. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. d. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. The ten (10) foot wide pedestrian walkway easement shall be landscaped per Public Works standards. b. A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plant materials (location, type, size, quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Section 9607 of the Huntington Beach Ordinance Code. The set must be approved by both departments prior to issuance of building permits. c. All applicable Public Works fees shall be paid. PC Minutes - 6/4/91 -11- (0869d) 4. 5. d. An interim parking and/or building materials storage plan shall be submitted to the Department of Community Development to assure adequate parking is available for employees, customers, contractors, etc., during the project's construction phase. The Public Works Department requirements are as follows: a. The Developer shall be responsible for payment of any additional fees adopted in the upcoming Water Division Financial Master Plan, if adopted by the City Council prior to issuance of building permits. b. The developer shall be responsible for payment of the traffic impact fee at the time of final inspecition. c. The developer shall use "drought tolerant" plants and turf for all common area landscaping. Landscape plans shall be approved by the Department of Public Works. Fire Department Requirements are as follows: a. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards. b. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. c. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: 1) Water flow, valve tamper and trouble detection. 2) 24 hour supervision. d. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. e. Fire lanes will be designated and posted to comply with City Specification No. 415. f. Address numbers will be installed to comply with City Specification No. 428. The size of the numbers will be the following: 1) The number for the building will be sized a minimum of ten (10) inches with a brush stroke of one and one-half (1-1/2) inches. PC Minutes - 6/4/91 -12- (0869d) g. Fire access roads will be provided in compliance with the Huntington Beach Fire Code and City Specification No. 401. Include the circulation plan and dimensions of all access roads (24' or27' fire lanes, turnarounds and 17' by 45' radius turns). h. Provide 13' 6" minimum clearance and 17' and 45' radius on driveways. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 9. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 10. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site; b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05% by weight) for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 11. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 12. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be completed: a. All signs shall be brought into compliance with the Huntington Beach Ordinance Code. (Article 961) b. The applicant shall restripe the parking lot so that it conforms to provisions of Article 960 of the Huntington Beach Ordinance Code. PC Minutes - 6/4/91 -13- (0869d) c. All improvements (including landscaping) to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. d. Compliance with all conditions of approval specified herein shall be accomplished. 13. The Planning Commission reserves the right to modify the terms of this Conditional Use Permit No. 91-20 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 14. This conditional use permit shall not become effective until an "Acceptance of Conditions" form has been properly executed by the applicant and an authorized representative of the owner of the property, recorded with County Recorder's Office, and returned to the Planning Division. 15. CONSENT CALENDAR C-1 GENERAL PLAN CONFORMANCE NO, 91-5: APPLICANT: City of Huntington Beach, Department of Administrative Services LOCATION: City -Wide The Department of Administrative Services has submitted a coordinated list of all capital projects recommended by City Departments for the coming fiscal year. They are requesting that the Planning Commission make a finding of conformity of the projects contained in the Capital Improvement Program with the General Plan prior to submittal to the City Council. NON-PUBLIC HEARING ITEMS D-1 ONE (1) YEAR EXTENSION OF TIME - SPECIAL SIGN PERMIT NO 90-1: APPLICANT: Watt Commercial Development Corporation LOCATION: Southwest corner of Edinger Avenue and Sher Lane. The request is for a one (1) year extension of time for Special Sign Permit No. 90-1 approved by the City Council on June 18, 1990. The City Council approved the request for the construction of a non -conforming freestanding sign when the applicant appealed the recorded Planning Commission and City Council actions are attached to this report. According to the applicant, there is litigation pending in court between two major tenants which has delayed the installation of the approved sign. PC Minutes - 6/4/91 154-1! DISCUSSION ITEMS None F. PLANNING COMMISSION INQUIRIES Commissioner Richardson - questioned staff on the status of the Affordable Housing Task Force. Staff explained that the Economic Development's Housing Department has submitted a suggested list of possible candidates for the Task Force to City Council. Council will now act on the Task Force and staff will keep the Commission informed. Commissioner Richardson also asked staff if BIA will be involved with the Affordable Housing planning. Staff said yes. Commissioner Richardson asked Counsel to check into a new Santa Ana Code which allows 5 people to a bedroom, to see if it will have any affect on Huntington Beach. G. PLANNING COMMISSION ITEMS Commissioner Richardson - Expressed his appreciation to staff for clarification of SRO to Council and the Commission. H. COMMUNITY DEVELOPMENT ITEMS Mike Adams, Director of Community Development, reiterated action taken at the June 3, 1991 City Council meeting.
