Mayor Green called the adjourned regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to order at 6 p.m. CITY COUNCIL/REDEVELOPMENT AGENCY ROLL CALL PRESENT: MacAllister, Winchell, Silva, Green, Kelly, Robitaille, ABSENT: Moulton -Patterson Mayor Green stated Councilmember Moulton -Patterson was in Sacramento on city business. He requested staff to record a video copy of the meeting for her. PUBLIC COMMENTS Bruce Spencer, Huntington Beach Firemen's Association Treasurer, spoke regard- ing the contract proposal and stated that the Fire Department uses 15.3% of the general budget. He stated that the firemen's wage ranked below tenth in comparison to other cities. He stated he believed General Fund monies had been diverted into redevelopment and that there was. no schedule to pay back the funds. Guy Burnell, Huntington Beach Firemen's Association Vice President, spoke regarding the requested wage in the proposed contract. Don Shusta, Huntington Beach Fireman, listed the services of the Fire Depart- ment, the hours worked as compared to other cities, and stated he did not believe the Fire Department was the cause of the budget deficit. Don Weddle, Paragon Cable TV, stated the cable television service was not a utility and spoke in opposition of the proposed tax. Patrick Gunning, Contract Sales Representative of Paragon Cable TV, spoke in opposition of the proposed tax. He stated he believed the tax would create a search for alternatives to cable. Dirk Voss, spoke in opposition to the proposed cable television tax. He stated he believed it would be a hardship for the senior citizens on low budgets. Page 2 - Council/Agency Minutes - 6/10/91 John Jenkins, Paragon employee, stated he believed the proposed cable televi- sion tax was an unfair tax and taxed only a portion of the population. Clinton Holland spoke in opposition of the proposed cable television tax. He stated it was a main source of news and community service for poor people. Alvin Oelbaun stated he believed the proposed cable television tax had united the people of Huntington Beach who are in opposition to the tax. George Krupenkin, representing the Huntington Beach Surf Museum, announced the 3rd Annual Huntington Beach Pro Am to be held on June 15 and 16 and their annual fundraiser, a Polynesian luau, to be held on June 15. C. W. Scheid stated he believed the proposed cable television tax was unnecessary, unwarranted, and discriminatory. George Arnold stated he believed the city redevelopment was wrong and that he believed the City Council should represent the people, not persons employed by the city. Ben Bailey, an unemployed aerospace engineer, stated he had to budget his funds, and he requested the City Council to budget city funds. Alfred Cusolito stated he believed that city expenses should be cut instead of requesting additional taxes. Gayle McKenzie, 20-year resident of Huntington Beach, stated her opposition to the proposed cable television tax and stated that it was unfair taxation. (City Council) PURCHASE & TRAINING OF A POLICE K-9 - APPROVED (530.10) The City Clerk presented a communication from the Police Chief regarding the need to purchase a Police K-9 to replace Police K-9 Kim killed recently in the line of duty. Police Chief Lowenberg presented a staff report. A motion was made by Robitaille, seconded by Silva, to approve the transfer of $9,500 from Narcotics Asset Seizure Fund to Account #332-221 for purchase and training of a K-9. The motion carried by the following roll call vote: AYES: MacAllister, Winchell, Silva, Green, Kelly, Robitaille, NOES: None ABSENT: Moulton -Patterson (City Council) AGREEMENT APPROVED - LEGAL SERVICES - MOORE & RUTTER LAW OFFICE - PACIFIC ENVIRO DESIGN, et al v. CITY OF HUNTINGTON BEACH (600.10) The City Clerk presented a communication from City Attorney transmitting an Agreement for Legal Services between the City and the law firm of Moore and Rutter relating to the law suit of Pacific Enviro Design, et al v. City of Huntington Beach. (Wetland zoning along Pacific Coast Highway n/o Brookhurst Street and s/o Beach Boulevard). 1 7 The City Attorney presented a staff report. Page 3 - Council/Agency Minutes - 6/10/91 A motion was made by MacAllister, seconded by Robitaille, to approve and authorize execution of the Professional Services Agreement between the City and the law firm of Moore and Rutter, and appropriate $20,000 to City Attorney General Fund, Account No. #-AA-AT-130-4-05-00, Fiscal Year 1991-92. The motion carried by the following roll call vote: AYES: MacAllister, Winchell, Silva, Green, Kelly, Robitaille, NOES: None ABSENT: Moulton -Patterson (City Council/Redevelopment Agency) BUDGET STUDY SESSION (320.20) Bob Franz, Deputy City Administrator/Administrative Services, presented a staff report pertaining to the May 13, 1991 Budget Follow-up Report and the Proposed Amendments to 91/92 Preliminary Budget. The City Administrator reported and stated there would be a public hearing on the budget June 17, 1991. In answer to Councilmember Silva's inquiry, Police Chief Lowenberg stated he would prepare a follow-up report on the identification of ongoing cost for substation facilities. Bob Franz, Deputy City Administrator/Administrative Services, distributed a communication dated June 10, 1991 entitled, "Utility Tax on Cable TV Follow -Up Information". He presented a slide report comparing cost to customers in other Orange County cities. Discussion was held between Council and staff regarding the franchise fee on cable television. HUNTINGTON HARBOUR WATERWAY EVALUATION/DREDGING PROGRAM - $20 000 APPROVED FOR PUBLIC WORKS ACCOUNT Lou Sandoval, Public Works Director, presented a staff report. Discussion was held between Council and staff pertaining to the maintenance problem at the Huntington Harbour Waterway. A motion was made by Silva, seconded by MacAllister, to add $20,000 to the appropriate Public Works account to be used to begin cleanup work in the catch basis areas of the Harbour Channel and to evaluate nature and extent of the silting problem. The motion carried by the following roll call vote: AYES: MacAllister, Winchell, Silva, Green, Kelly, Robitaille, NOES: None ABSENT: Moulton -Patterson FOURTH OF JULY CONTRACT WITH PAGEANTRY PRODUCTIONS APPROVED - INSURANCE REQUIREMENTS WAIVED - CONTRACT PAYMENT DATE 7/4/91 - APPROVED A motion was made by Green, seconded by MacAllister, to make a determination that the need to take action on the issue of 4th of July contract arose 091 Page 4 - Council/Agency Minutes - 6/10/91 subsequent to the agenda being posted as specified in Government Code Section 54954.2(b)(2). The motion carried by the following roll call vote: AYES: MacAllister, Winchell, Silva, Green, Kelly, Robitaille, NOES: None ABSENT: Moulton -Patterson A motion was made by MacAllister, seconded by Green, to approve and authorize execution of the contract with Pageantry Productions and to waive insurance requirements and approve July 4, 1991 as date of parade payment for services. The motion carried by the following roll call vote: AYES: MacAllister, Winchell, Silva, Green, Kelly, Robitaille, NOES: None ABSENT: Moulton -Patterson HUNTINGTON BEACH FLOAT TROPHIES RECOGNIZED Councilman MacAllister presented two trophies the Huntington Beach float had won in the Strawberry Festival and Fish Fry Festival. He stated the Huntington Beach Queen and her court had ridden on the float and that it had been coordinated by the Public Information Office and 4th of July subcommittee. ADJOURNMENT - COUNCIL/REDEVELOPMENT AGENCY Mayor Green adjourned the adjourned regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to Monday, June 17, 1991 at 5:30 P.M. in Room B-8, Civic Center.
