ZONING ADMINISTRATOR: Scott Hess STAFF MEMBERS: MINUTES• REGULAR AGENDA ITEMS: Mike Connor The Minutes of the June 12, 1991 Zoning Administrator meeting were approved. The minutes of the July 10, 1991 Zoning Administrator meeting were approved. ITEM 1: TENTATIVE PARCEL MAP NO. 91-212 Applicant: Glenna McKeown 706 14th Street Huntington Beach, CA 92648 Request: To permit the consolidation of two (2) lots into one (1) with a request to waive the final parcel map. Location: 706 Fourteenth Street Mike Connor, Staff Planner, reported that the request is to consolidate two lots into one and also to waive the final parcel map. Staff stated that a conditional use permit had been approved by the Planning Commission two months ago to construct a master suite and granny unit on the existing dwelling. At the time of approval, a condition was imposed by the Planning Commission that a tentative parcel map application be submitted to consolidate the two lots. Staff recommended approval of the the consolidation request but recommended denial of the final map waiver because the existing lot line located down the middle of the parcel would not be eliminated. Dennis McKeown, applicant, was present and expressed opposition to staff's recommendation that the final map waiver be denied. He inquired about the necessity of a final map for the site. Discussion ensued between the applicant, staff and the Zoning Administrator about State and City requirements concerning the requirements for processing final maps. The Zoning Administrator reported that he would approve the consolidation request and the final map waiver if the applicant would agree to obtain a Restrictive Covenant Agreement to hold the two (2) parcels as one parcel. The Zoning Administrator reported that such an agreement is acceptable by the Uniform Building Code and would replace the necessity of obtaining a final map. The applicant stated that he would comply with the condition of approval. TENTATIVE PARCEL MAP NO. 91-212,WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND ADDED CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed consolidation of two (2) lots into one (1) lot for purposes of residential use is in compliance with the size and shape of property necessary for that type of development. The two lots combined total 5,750 square feet and have been held in common since 1940. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. The proposed lot is in compliance with the Low Density Residential Land Use Designation in the General Plan. 3. The property was previously studied for this intensity of land use at the times the land use designation for Low Density Residential district allowing Single Family Dwellings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. ZA Minutes - 7/17/91 -2- (0300d) 1 FINDINGS OF APPROVAL FOR WAIVER: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. Tentative Parcel Map No. 91-212 received by the Department of Community Development on June 24, 1991 shall be the approved layout. 2. Two and one half (2 1/2) feet along the alley shall be dedicated to City standards. 3. Water supply shall be through the City of Huntington Beach's water system at the time the parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed. 5. All on site utilities shall be installed underground at the time the parcel is developed. 6. The development shall comply with all applicable City Ordinances. 7. A covenant to hold the parcels as one shall be signed and notarized by the property owner, reviewed and approved by the Department of Community Development, and recorded with the County Assessor's Office prior to issuance of building permits. 8. The applicant/property owner shall be responsible for paying the Park and Recreation Fees in effect at the time the building permits are issued. ZA Minutes - 7/17/91 -3- (0300d) ITEM 2: USE PERMIT NO. 90-21 (EXTENSION OF TIME)_ Applicant: John Leece & Associates 1055-C E1 Camino Drive Costa Mesa, CA 92626 Request: To permit the exterior facade remodel of an existing shopping center and the construction of a new 5,000 square foot commercial building. Location: 9021-9055 Atlanta Avenue (Huntington South Center) Mike Connor, Staff Planner, reported that the request to permit the exterior facade remodel of an existing shopping center and the construction of a new 5,000 square foot commercial building was originally submitted and approved by the Zoning Administrator in June, 1990. Staff reported that since the date of approval, financing and a supermarket merger have prohibited the applicant from initiating construction. The applicant is now requesting an extension of time. Staff recommended approval of the extension as the applicant has been working diligently to begin construction. The applicant requested a 45-60 day extension of time. Staff recommended that the extension be for to six months. Andy Young and Larry Smith, representing John Leece and Associates, were present and spoke in support of the request. USE PERMIT NO. 90-21 (EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. HE STATED THAT THE ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. CONDITIONS OF APPROVAL: 1. All previous conditions of approval from the Zoning Administrator's letter dated June 27, 1990 shall still apply. 2. This extension of time shall expire January 9, 1991 unless an additional extension is granted.
