ACTING ZONING ADMINISTRATOR: STAFF MEMBERS: MINUTES• Room B-6 - Civic Center 2000 Main Street Huntington Beach, California Mike Strange Mike Connor The Minutes of the June 12, 1991 Zoning Administrator Meetings were continued. REGULAR AGENDA ITEMS: ITEM 1: USE PERMIT NO. 91-26 Applicant: Lien T. Vu 7738 Edinger Huntington Beach, CA 92647 Request: To permit an annual tent sale - Temporary Outdoor Event - July 5, 1991 to July 25, 1991. Location: 7738 Edinger Mike Connor, Staff Planner, reported that the tent sale had been held annually for the past few years and that no problems resulted. Staff advised that no response had been received to the notification sent out to the tenants in the center. Staff concluded by recommending approval with the same conditions of approval as in the past. THE PUBLIC HEARING WAS OPENED. Lien Vu, the applicant, was present and concurred with the conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 91-26 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The tent sale is an annual event which has had no complaints from area businesses. b. Property and improvements in the vicinity of such use or building. The tent sale is temporary. 2. The granting of Use Permit No. 91-26 will not adversely affect the General Plan of the City of Huntington Beach. The tent sale is an adjunct use to the Furniture Store which is a permitted use within the General Commercial land use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated May 30, 1991 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum with of (20) twenty feet. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table locations, tents, barriers, etc.). 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant shall obtain necessary permits for balloons pennants and temporary signs. 7. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 8. All parking shall be a minimum of forty (40) feet from the proposed tent. 9. The proposed tent shall be of fire retardant material. Proof of Certification shall be submitted to the Fire Department for approval prior to the tent's installation on the site. 10. The proposed tent shall be secured against collapsing. The Fire Department shall inspect the proposed tent at least 24 hours prior to opening for business. ZA Minutes - 6/26/91 -2- (0130d) I- I 11. "No Smoking" signs shall be posted in conspicuous locations. 12. The applicant shall obtain permits for all electricity to the proposed tent. All electrical extension cord shall be protected from foot and automobile traffic. 13. No open flame cooking devices for hot dogs or other refreshments shall be permitted. 14. Fire extinguishers shall be provided in number and locations specified by the Fire Department. 15. A minimum of two (2) exits shall be provided, posted and maintained. 16. Stand by personnel shall be on site to safeguard premises. 17. An overnight security guard shall be provided to protect merchandise left overnight. The Huntington Beach Police Department shall be notified 24 hours prior to the event. INFORMATION OF SPECIFIC CODE REOUIREMENTS_: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 91-26 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 2• USE PERMIT NO. 91-2 Applicant: Huntington Christian School 1207 Main Street Huntington Beach, CA 92648 Request• To permit four (4) temporary classroom buildings pursuant to Section 9730.30 of the Huntington Beach Ordinance Code. Location: 1207 Main Street ZA Minutes - 6/26/91 -3- (0130d) Mike Connor, Staff Planner, reported that the original permit for the school was conditionally approved in 1982 by the Planning Commission with a maximum enrollment of 350 students. The new request for temporary classrooms meets setback and code requirements and, if approved, would be permitted for a maximum of five years. Staff recommended a change to the proposed plan to move the proposed play area to the area adjacent to the soccer field because it would _ be a more compatible land use and safer for the children. Staff also recommended that the enrollment be limited to a maximum of 350 students which is the enrollment analyzed under the original Conditional Use Permit. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Ron Pearson, Principal, stated that as a result of State cutbacks in the public education there is a large demand for quality education. He stated that their desire is to be good neighbors and would be willing to mitigate noise by adding a partial block wall to block the sound. He stated that if the play area were to be moved to the area adjacent to the soccer field then the trailers must be located there as well. In addition, the request would need to be expanded to six (6) trailers to provide offices, restrooms and a changing room. He requested that the enrollment be increased to a maximum of 425 students. Nancy Bloomfield, 19728 Seashore Circle, spoke in opposition to the request. She stated opposition to the increase in enrollment due to noise and felt that temporary classrooms were not appropriate in a R1 zone. - Judy Peterson, 7328 Waterside Drive, spoke in opposition to the request. She said her residence is directly across the street from the school site and that the noise from the physical education activities was very loud. She requested that enrollment remain at the present level. There were no other persons present to speak for or against the request and the public hearing was closed. Mike Strange, Zoning Administrator, stated that he had concerns with the request due to possible increased noise, traffic and the intensification of the school. He advised that the original use permit had been approved by the Planning Commission and stated that an intensification of that approval should be heard by the Commission. - USE PERMIT NO. 91-23 WAS REFERRED TO THE PLANNING COMMISSION TO THE MEETING OF JULY 23, 1991 BY THE ZONING ADMINISTRATOR. ZA Minutes - 6/26/91 -4- (0130d) PURSUANT TO GOVERNMENT CODE SECTION NO. 54954.2, THE NEED TO TAKE ACTION AROSE SUBSEQUENT TO THE AGENDA BEING POSTED ON THE FOLLOWING: ITEM 3• USE PERMIT NO, 91-33 Applicant: The Trading Post 6952 'Warner Ave. Huntington Beach, CA 92647 Request: To permit a trailer in the parking lot - June 28 through 30, 1991, July 3 through 7, 1991, August 9 through 11, and 16 through 18, 1991 pursuant to Section 9730.64. Location: 6952 Warner Mike Connor, Staff Planner, reported that pursuant to Government Code Section No. 54954.2, the need to take action arose subsequent to the agenda being posted. Staff advised that the request is to permit a temporary outdoor sale of ceiling fans. Staff stated concern that code permits temporary events for three days and the request is for five days which requires public notification. Staff was concerned that the proposed location for the trailer could obstruct visibility of other tennants and recommended that the trailer be located in the parking spaces adjacent to the store to reduce the impacts that the trailer might have. Staff concluded by recommending approval with suggested findings and conditions of approval. The applicant, Gil Schauer, stated that the merchants in the center do not oppose the location of the trailer. Mike Strange, Zoning Administrator, said that due to the July 4th holiday the three day maximum could be waived. USE PERMIT NO. 91-33 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND ADDED CONDITIONS OF APPROVAL. HE STATED THAT THE ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The trailer will be located within parking stalls and will not obstruct access or circulation on site. b. Property and improvements in the vicinity of such use or building. 2.
