Staff is requesting a continuance of Conditional Use Permit

request for four (4) parking spaces.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission continue Conditional
Use Permit No. 91-27 to the July 23, 1991 Planning Commission
meeting.

Conditional Use Permit No. 91-23 in conjunction with Coastal
Development Permit No. 91-12 is a request to permit the construction
of a new single family residence with a 410 square foot third story
billiard room pursuant to Section 9110.4(a) of the Huntington Beach
Ordinance Code. A special permit is requested to allow a deviation
from the required 16 foot long transition ramp with maximum five (5)
percent slope when entering a parking structure from a public street
pursuant to Section 9601.6(a) of the Huntington Beach Ordinance Code.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve Conditional
Use Permit No. 91-23 with Special Permit and Coastal Development
No. 91-12 with findings and suggested conditions of approval.

Dennis M. Danahy, Applicant, stated he had received approval for
this project from all necessary homeowner associations. He also
stated he was there to answer any questions the Commission may have.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 91-23:
1. The proposed construction of a single family residence with a
third floor 410 square foot billiard room will not have a
detrimental effect upon the general health, welfare, safety
and privacy of persons working or residing in the vicinity or
will not be detrimental to the value of the property and
improvements in the vicinity. The proposal as designed, meets
and or exceeds the code requirements for a third story and,
therefore, will not be detrimental to the surrounding
neighborhood.
2. The proposed construction of a single family residence with a
third floor 410 square foot billiard room is compatible with
existing or proposed uses in the vicinity. The proposed third
story billiard room is within the maximum height limits for
any two (2) story residence and, therefore, will be compatible
with the existing and surrounding two (2) and three (3) story
residences of the Huntington Harbour area.
3. The location, site layout and design of the proposed
construction of a single family residence with a third floor
410 square foot billiard room is properly related to the
streets, drive and other structures and uses in the vicinity
in a harmonious manner. The location of the third story
windows are properly related and, therefore, will be
harmonious with existing structures and uses.
4. The proposed construction of a single family residence with a
third floor 410 square foot billiard room is consistent with
the goals and policies of the Huntington Beach General Plan.
The General Plan allows for a wide variety of housing types
and the proposal as submitted conforms to the provision of a
third story addition as implemented through the zoning
ordinance and the plans and policies of the Housing element of

the General Plan. The proposed construction of a ramp to an
underground parking garage deviating from the required maximum
five (5) percent downward slope for the first 16 feet by
special permit is properly designed to afford safe access to
the underground garage.
FINDINGS FOR APPROVAL - SPECIAL PERMIT:
1. The proposed construction of a ramp to an underground parking
garage deviating from the required maximum five (5) percent
downward slope for the first sixteen (16) feet by special
permit is properly designed to provide safe access to the
underground garage.
2. A schematic model prepared by a licensed architect has been
submitted which documents the impacts of the request and
demonstrates the undercarriage of a low slung car clears the
high point between the street gutter and the ramp down.
3. The special permit will not adversely affect the circulation
and safety of the use, structure or site, or adjacent land
uses as the schematic model demonstrates that a lengthy car
with a very low undercarriage can enter the underground
parking garage safely.
4. The special permit will result in a more effective and
efficient circulation pattern and parking layout by providing
a safe transition ramp useable by cars with very low
undercarriages to an underground garage with five (5) enclosed
parking spaces.--
5. The special permit will not be detrimental to the general
public health, safety, welfare or convenience, nor injurious
to property values in the vicinity. A schematic model
prepared by a licensed architect demonstrates the safety and
workability of increasing the downward slope percentage of the
transition ramp for the worst case scenario of a lengthy
low -slung car entering the underground parking garage from a
public street.
FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO, 91-12:
1. The proposed construction of a single family residence with a
third floor 410 square foot billiard room as proposed by
Coastal Development Permit No. 91-12 conforms with the plans,
policies, requirements and standards of the Coastal element.
2. The proposed construction of a single family residence with a
third floor 410 square foot billiard room as proposed by
Coastal Development Permit No. 91-12 is consistent with the CZ
suffix, low density residential development standards, as well
as other provisions of the Huntington Beach Ordinance Code
applicable to the property.

3. The proposed construction of a single family residence with a
third floor 410 square foot billiard room as proposed by
Coastal Development Permit No. 91-12, will have available,
infrastructure in a manner that is consistent with the C-LUP.
4. The proposed construction of a single family residence with a
third floor 410 square foot billiard room as proposed by
Coastal Development Permit No. 91-12 conforms with the public
access and public recreation policies of Chapter 3 of the
California Coastal Act.
CONDITIONS OF APPROVAL:
1.
The site plan, floor plans, and elevations received and dated
June 26, 1991 shall be the conceptually approved layout.
2.
Any modification to roof pitch which may be required due to
requirements of the Uniform Building Code, shall comply with
the standards for height of Section 9110.4(a) and shall be
depicted on a modified site plan to be submitted to the
Department of Community Development for review and approval.
3.
This approval shall not constitute approval for cantilevered
or projecting decks or freestanding archways greater than 42
inches in height within the setback areas. Such items will be
subject to separate entitlement review.
4.
Prior to submittal for building permits, the applicant/owner
shall complete the following:
a. Floor plans shall depict natural gas and 220V electrical
shall be stubbed in at the location of clothes dryers;
natural gas shall be stubbed in at the locations of
cooking facilities, water heaters, and central heating
units; and low -volume heads shall be used on all spigots
and water faucets.
b. If foil -type insulation is to be used, a fire retardant
type shall be installed as approved by the Building
Department and indicated on the floor plans.
c. Elevations shall depict colors and building materials
proposed.
d. The site plan (or reference page) shall include all
conditions of approval imposed on the project printed
verbatim.
5. Prior to issuance of building permits, the applicant/owner
shall complete the following:

a. All applicable Public Works fees shall be paid.
b. An engineering report which will assess the impact of
excavation and construction of the project to surrounding
properties shall be provided to adjacent residents.
6. The Fire Department requirements area as follows:
a. Provide one (1) fire hydrant per Water Department and Fire
Department standards prior to construction.
b. Provide an automatic fire sprinkler system per Fire
Department Standard 413.
c. Provide a two (2) inch domestic/fire water service per
Water Department standards.
7. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
8. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
9. Construction shall be limited to Monday - Saturday 7:00 AM to
8:00 PM. Construction shall be prohibited Sundays and Federal
holidays.
10. Prior to final building permit approval or issuance of a
Certificate of Occupancy, the following shall be completed:
a. All improvements to the property shall be completed in
accordance with the approved plans and conditions of
approval specified herein.
b. Compliance with all conditions of approval specified
herein shall be accomplished.
11. The Planning Commission reserves the right to revoke
Conditional Use Permit No. 91-23 and Coastal Development
Permit No. 91-12 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
12. Conditional Use Permit No. 91-23 and Coastal Development
Permit No. 91-12 shall become null and void unless exercised
within one (1) year of the date of final approval, or such
extension of time as may be granted by the Planning Commission
pursuant to a written request submitted to the Planning
Department a minimum 30 days prior to the expiration date.

B-3 REVISON OF CONDITIONAL USE PERMIT NO. 90-50:
APPLICANT: MICHAEL NICCOLE
LOCATION: 520 Main Street - Niccole's Restaurant
The proposed revision to Conditional Use Permit No. 90-50 is a
request by the owner of Niccole's Restaurant to add unamplified
musical accompaniment to the existing acoustical piano
entertainment, add a 115 square foot dancing area on the second
floor and expand the hours of operation to 1:00 AM on Monday through
Thursday and Sunday nights and 2:00 AM on Friday and Saturday nights.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve the proposed
revision to Conditional Use Permit No. 90-50 with findings and
suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Terry Olson, 611 - 6th Street, spoke in opposition to the request.
Major concerns included no permit from ABC, place of business in
close proximity to residences and parking problems.
Susan Zisakis, 16951 Mt. Collien, Fountain Valley, spoke in
opposition to the request. Ms. Zisakis is the manager of the
adjacent apartment complex. She states she has had numerous
complaints from her tenants regarding noise, parking and the
restuarant staff being uncooperative.
Gus Zisakis, 16951 Mt. Collien, Fountain Valley, spoke in opposition
to the request. Mr. Zisakis is also the manager of the adjacent
property. He stated they will be unable to find suitable tenants if
further problems occur. He also stated he has numerous late hour
noise and parking complaints.
Jo Christian -Craig, 529 Lake Street, spoke in opposition to the
request. Ms. Christian -Craig, is in favor of mixed -use development
in the area, but feels the late hour of closing will create noise
and traffic problems.
Rocco Sarracino and Mike Niccole, 520 Main Street, applicants, spoke
in favor of the request. They stated they will do everything
possible to eliminate the above stated objections and concerns.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
The Commission discussed approval of the request with the following
conditions: 1) double efforts to control employee parking in front
of residences; 2) control of alley activities; and 3) come back for
a 6-month review.

Commissioner Newman stated the area is mixed use and noise should be
expected. She also stated that the downtown area was being designed
to draw people to the area, and the noise factor would.be a fact of
life.
Commissioner Richardson discussed with staff the type of music to be
played.

NO, 90-50•
1. The addition of musical accompaniment to the existing piano
entertainment adding a small, informal dance area and extending
the closing hours 1:00 AM on Tuesday through Thursday and Sunday
and to 2:00 AM on Friday and Saturday nights will not be
detrimental to the general welfare of the persons residing in
the area.
2. The proposed revisions will not be detrimental to property
values in the area.
3. The proposed revisions will not create traffic problems.
4. The granting of the revision to Conditional Use Permit No. 90-50
will not adversely affect the General Plan.

B-4 APPEAL OF THE ZONING ADMINISTRATOR'S APPROVAL OF COASTAL
DEVELOPMENT PERMIT NO. 91-10/USE PERMIT NO. 91-10:
APPLICANT: City of Huntington Beach
LOCATION: Northeast corner of Pacific Coast Highwayt and 5th
Street.
This item is an appeal of the Zoning Administrator's approval of
Coastal Development Permit No. 91-10 and Use Permit No. 91-10. The
approval permitted the placement of one (1) 24 foot x 60 foot
temporary sales trailer on the inland side of Pacific Coast Highway
and 5th Street for 12 months pursuant to Section 9730.30 of the
Huntington Beach Ordinance Code. The trailer will serve as a
temporary relocation facility for Jack's Surf Shop.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission continue the Appeal of
the Zoning Administrator's approval of Coastal Development Permit
No. 91-10 and Use Permit No. 91-10 in order for staff to further
assess parking requirements.

TRACT MAP NOS 14007, 14009 AND 14010/MITIGATED NEGATIVE
DECLARATIONS NOS 90-44, 90-45 AND 90-46:
APPLICANT: Pacific Coast Homes
LOCATION: Tentative Tract Map No. 14007 - Westside of
Goldenwest Street, approximately 600 feet south of
Ellis Avenue.
Tentative Tract Map No. 14009 - Northeast corner
of Edwards Avenue at Garfield Avenue.
Tentative Tract Map No. 14010 - Northwest corner
of Goldenwest Street at Garfield Avenue.
Conditional Use Permit No. 90-47 with Special Permits in conjunction
with Conditional Exception (Variance) No. 90-35, Tentative Tract Map
Nos. 14007, 14009 and 14010 and Negative Declarations Nos. 90-44,
90-45 and 90-46 is a request for a master plan of development to
subdivide three (3) non-contiguous parcels of land totalling 51
gross acres into a 141 lot subdivision for single family estate
residential development with equestrian amenities. The master plan
of development includes the designation of a ten (10) gross acre
site for a potential school. The special permit (maximum 10%
deviation) request is to encroach into the front and rear yard
setbacks by two (2) to three (3) feet. The conditional exception
(variance) request is to exceed the maximum two (2) foot cut and two
(2) foot depth of fill for grading, a reduction of the minimum lot
frontage (flag lots) requirements and a deviation greater than the
10% permitted for the minimum front yard setback.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve Mitigated
Negative Declarations Nos. 90-44, 90-45 and 90-46, Conditional Use
Permit No. 90-47 with Special Permits, Conditional Exception
(Variance) No. 90-35 and Tentative Tract Map Nos. 14007, 14009 and
14010 as amended by staff with findings and suggested conditions of
approval.
The Commissioners discussed with staff their concern with the Design
Guidelines and the resident's concerns about same. The Commission
felt the guidelines should be more specific. Staff explained that
they have worked with the residents associations during the specific
plan and had asked for revisions on the schematic outline but
received none. Staff also explained that homeowner's have been
noticed and have had ample opportunity for comments— The Commission
expressed concern regarding the availablity of the report to the
public in a timely manner because of its complexity. They also
expressed their wish that the homeowners be completly involved with
the process.

THE PUBLIC HEARING WAS OPENED.
Tom Zanic, Urban West, stated that he agreed with the majority of
the conditions staff wished to impose, but did submit a letter
listing the conditions which he was not in agreement. He discussed
each of these with the Commission and staff.
Dwayne Dishno, Superintendent School District, spoke in opposition
to the request. Mr. Dishno stated the issue of the school site was
not simple. He said the school district cannot afford schools in
this area and urged the Commission to deny the request.
Shirley Carey, Board of Trustees, spoke in opposition of the
request. Ms. Carey stated the district must maintain standards and
meet needs of growing population.
Marshall Krupp, Consultant to Huntington Beach School District,
spoke in opposition to the request. Mr. Krupp submitted for the
record a large document. Mr. Krupp stated for the record the
following:
- The Planning Commission was not allowing the school district
sufficient time to state the facts.
If the lengthy report submitted to the Commission this evening
was not read prior to a decision, the Commission was denying
the school districts right to be heard.
- Opposed request and opposed their rights not being heard.
Tamar C. Stein, Esq., representing applicant, stated the law in this
area was very clear. She stated the adequacy of the school site is
not under their jurisdiction and theyu cannot deny under these terms.
Gerald Chapman, 6742 Shire Circle, stated he was concerned with a
common theme, one cohesive unit. He said it was not his intent to
halt the project, just to make it cohesive.
Joel Kirschenstein, Applicant, stated his concerns over the shcool
site. He rebutted Mr. Krupp's statements and stated the district
cannot receive state aide with the amount of surplus schools in
existance.
Ron Brundle, 1885 Goldenwest Street, spoke in favor of the project.
Mr. Brundle expressed his appreciation to Huntington Beach Company
for donating the land for the school.

The Commission discussed the affordable housing issue. They
discussed the fact that the City has yet to form a policy, but the
developer was expected to comply. A straw vote was taken to decide
if the Commission should continue this item to review the school
district's document, to work on design guidelines and look at

The applicant is requesting a one (1) year extension of time for
Conditional Use Permit No. 90-15 and Conditional Exception No. 90-22
which were approved by the Planning Commission on June 5, 1990.
These approvals permitted the conversion of a used car sales lot to
a new car dealership with a variance to encroach into the rear
setback with a building exceeding 18 feet in height.

Staff recommends that the Planning Commission approve a one (1) year

Limited Sign Permit No. 91-6 is a request to permit a face change to
an existing non -conforming pole sign. The sign exceeds the maximum
height of 7 feet permitted by Section 9160.5(b) of the Huntington
Beach Ordinance Code.

STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve Limited Sign
Permit No. 91-6 with findings and suggested conditions of approval.

LIMITED SIGN PERMIT NO. 91-6 WITH FINDINGS AND SUGGESTED CONDITIONS OF

FINDINGS FOR APPROVAL - LIMITED SIGN PERMIT NO. 91-6:
1. Allowing the maintenance of the sign for an additional twenty-one
(21) months will not adversely affect other signs in the area.
2. The proposed extension of time will not be detrimental to property
located in the vicinity of such sign, and will be in keeping with
the character of the surrounding area.
3. The sign in its existing location at the corner of Beach Boulevard
and Terry Drive will not obstruct pedestrian or vehicular traffic
vision.
4. Due to the unique circumstances applicable to the sign, immediate
alteration, removal or replacement of the sign will result in a
substantial economic hardship.
CONDITIONS OF APPROVAL - LIMITED SIGN PERMIT NO, 91-6:
1. The site plan and sign elevation received and dated April 1, 1991,
shall be the approved layout.
2. Expiration date of Limited Sign Permit No. 91-6 shall be April 10,
1993.
3. Prior to issuance of building permits, the applicant shall file a
cash bond in the amount of $5,000 with the City for the purpose of
indemnifying the City for any and all costs incurred with the
applicable provisions of the sign ordinance after twwenty-one
months from the date of approval, or remodel of the property.

E. DISCUSSION ITEMS
Commissioner Dettloff - asked staff to compile information on
the acreage available in Industrial Zones and the number of
uses coming into these areas that could use the available
acreage (i.e. churches). She also asked staff to clarify the
action taken when a problem is mitigated.
Commissioner Bourguignon - inquired about the Harbour Code
status and if it included the Solar Rooms. Mike Adams,
Director of Community Development, explained their will be one
more meeting of the Harbour Code Committe before incorporation
into Division 9. He also explained that the Solar Rooms will
be brought to the Commission separately.
Commissioner Richardson - thanked Bruce Crosby, Public Works
for his answer to the inquiry regarding the traffic signal at
Warner and Pacific Coast Highway.
Commissioner Leipzig - feels that Warner and Pacific Coast
Highway needs a left turn indicator. He strongly urged staff
to review.
Commissioner Kirkland - thanked staff for their response to
his inquiry regarding the Marshall Center.
F. PLANNING COMMISSION INQUIRIES
Commissioner Richardson - questioned staff as to the status of
the Revocation Ordinance in which the body that enacts has the
power to revoke. Mike Adams indicated it is being written in
the Division 9 rewrite.
Commissioner Kirkland - questioned staff as to the status of
the Citizens Task Force Committee regarding affordable
housing. Howard Zelefsky, Planning Director, explained the
Committee will be formed after policies are reviewed by City
Council and after a joint study session with City Council and
Planning Commission.
Commissioner Leipzig - questioned staff about the Garfield and
Edwards project. Bruce Crosby explained they should be
finished with that phase by January, 1992.
Commissioner Kirkland - questioned staff as to the half day
workshop for the Commissioners. Mike Adams stated they would
bring back some dates for the workshop at the next Planning
Commission meeting.
